FORWORDToday’s dispersal Sale comprises of 39 Cows and Calves and 5 in calf heifers that form the com-mercial herd of suckler cows on behalf of Oakdean Partnership at Oaksey. The Sale comes aboutfollowing the departure of the stockman and David Bush’s decision to concentrate on the PedigreeSimmental Chapman herd that has run alongside the commercial cows at Oaksey.

The original Commercial herd was made up from the use of top Pedigree Simmental bulls runningwith pure British Friesian Cows which continued with their progeny being put back to topSimmental Bulls to create what is now a herd of deep bodied commercial cows. Use of such Bullsas Sterling Krakajack bred at Boddington Estates and Heywood Statesman have helped produce aherd of excellent crossbred cows of tremendous size. The Chapman herd of Pedigree Simmentalsis one of the top herds in the country and any heifers that did not meet the highest standards forthe Pedigree herd made superb purebred additions to the commercial herd. The herd has been runin association with an HLS grassland farm and any cows that lost time in their calving pattern leftthe herd and you will note the regularity of calving pattern in the records shown.

The herd policy has been to breed a small number of female replacements alongside British Bluecross calves to sell onto commercial beef producers. The cows have run with the Pedigree BullHeywood Warlord to do this and two British Blue Bulls; firstly the tremendously bred Avon BluesUpshot who is the father of all Blue Cross calves in the sale today and he was replaced at the endof June (following damage to his leg) by the superb Blue Bull who is in today’s sale Highridge BluesIggle Piggle ET bred by the Dunn Family at Okehampton a bull by Drift Domino and with thefamous Grandsire Twyning Ash Troy.

Two cows in today’s sale, Lots 17 and 20 were shown at Beef Expo as an example of remarkablecows and calves in the commercial beef system and the sale also includes a very smart bunch of 5purebred Simmental heifers that are warranted in calf to the new British Blue Bull.

Herd Health: The herd has always been closed except for new bulls coming in and are of highHealth Status and tested clear and regularly vaccinated for BVD and IBR. The herd was last vaccinated in March 2015. All calves were wormed on 30 th July with Paramectin. There has neverbeen a case of Johnes disease on the farm. The herd has a good TB history and has been completelyclear since 2006 when one inconclusive was recorded and later found to be clear. The herd was premovement tested on 18th and 20th August.

COWS AND CALVES

Note: All cows stated as PD positive are warranted by the Vendor to be in calf.

All calves selling where the Dam is warranted back in calf or the calf is strong enough to be weanedwill be sold as “a” lots after their dam allowing purchasers to buy the cow separately, but to alsobuy the calf should they so require.

All cows have run with the bull but those that the vet could not be certain were back in calf are notwarranted back in calf however there is no reason why they may not be.

All cows have run with the bulls listed below on a 3 week rotation; from calving to date of sale. Thecows ran with Avon Blues Upshot until 15 th June and then with Heywood Warlord and from 28thJune until date of sale with Highridge Blues Iggle Piggle ET.

Where warranted, the Vendor warrants the cow to be in calf but does not warrant the breed of thecalf.

All male calves are warranted to be steers.

All calves in the sale whilst sired by the British Blue are described on their passports as Simmentalcross.

10. If, not withstanding Condition 8 above, the Auctioneer permits the Purchaser to remove his lot from the sale

premises prior to payment in full having been received then:

(a) ownership of the same shall remain with the Vendor and no property in the lot whether legal or equitable

shall pass from the Vendor to the Purchaser until payment of the full price has been received in cleared funds

by the Auctioneer or the Vendor (as the case may be). Payment shall, unless otherwise agreed, be made to

the Auctioneers;

(b) the Purchaser undertakes to house the lot on his premises separately from his own and those of any other

person and in such manner as makes it readily identifiable as the Vendors;

(c) the Purchaser’s right to possession of the lot shall automatically cease immediately prior to his doing any

thing or failing to do anything which would entitle a Receiver to take possession of the lot(s) or which would

entitle any person to present a petition for the winding up of the Purchaser;

(d) the Vendor or the Auctioneers may for the purpose of examination or recovery of any lot remaining unpaid

enter upon any premises, where it is housed or where it is reasonably thought to be housed;

(e) if the Purchaser shall sell on the lot, then such part of the proceeds of such resale as equates to the full price of

the lot remaining unpaid shall be held by the Purchaser in a separate bank account as trustee thereof on

the Vendor’s behalf.

11. Without prejudice to any other right or remedy of the Vendor or the Auctioneers, if the Purchaser shall be in

breach of any other Composite Conditions, the Vendor or the Auctioneers shall have power to resell the lot(s)

purchased by the Purchaser retaining any surplus and charging any deficiency or expense to the Purchaser.

12. Neither the Vendor nor the Auctioneers will be responsible for any accidents or injury, not arising out of their

negligence, which happens to person or any property while on the sale premises.

CONDITIONS OF SALEThe attention of all persons attending the Auction is drawn to these Conditions of SaleThe following Conditions of Sale ("the Conditions") together with the Notice to Buyer overleaf andthe usual Conditions of Sale on display at the Auctioneers' Office shall govern the sale of each lotat the Auction and any person making a bid which is accepted by the Auctioneers shall inconsideration of such acceptance be deemed to be bound thereby. These Conditions shall not bevaried except in writing signed by or on behalf of the Auctioneer, but if these Conditions areinconsistent with any other Conditions set out or referred to in the Auction Catalogue, the Catalogueconditions shall apply:-

1.1 All Livestock is sold subject to these conditions (“the Conditions”), the Association of Livestock Auctioneers

Conditions of Sale (1998) edition (“the LAA Conditions”) and, in case of any pedigree livestock, any special

conditions expressly applicable (“the Special Conditions”) (all together “the Composite Conditions”).

1.2 If there is any conflict or inconsistency between the elements comprising the Composite Conditions the order of

precedence shall be first, the Special Conditions, secondly, the Conditions and thirdly, the LAA Conditions.

1.3 Every Vendor, Bidder and Purchaser shall be deemed to have full knowledge of the Composite Conditions and to

agree to be bound by them.

1.4 A copy of the LAA Conditions and any Special Conditions is available for inspection on request.

2. All lots are accepted for sale on the terms that the Vendor warrants his right to sell the same and undertakes to

indemnify the Auctioneers against all actions, proceedings, claims, demands, costs, charges and expenses to

which they may be exposed or which they may incur by reason of any defect in the Vendor’s title.

3. The Auctioneers act in all respects only as agents for the Vendor and it shall he deemed that no condition or

warranty expressed or implied has in any circumstance been given by the Auctioneers or any servant of the

Auctioneers, whether as to title, description, the quality of any lot sold or otherwise. The Auctioneers and their

servants shall not incur any liability to the Purchaser in respect of any defect of title, error of description or

imperfection or in respect of any announcement or statement relating to or affecting any lot offered for sale

whether made orally or in writing and whether given before, during or after the auction, nor shall they incur any

liability in relation to any dispute between any Purchaser and Vendor.

4. The Auctioneers reserve the right to refuse to accept bids from a Vendor and they reserve on behalf of themselves

and of the Vendor(s) the following rights:

(a) to fix a reserve price;

(b) to bid on behalf of a Vendor;

(c) to re-arrange, consolidate or withdraw any lots or vary the order of sale; and

(d) without giving any reason therefore, to refuse to accept the bids of any person.

5. The person making the highest accepted bid shall be the Purchaser.

6. No bid shall be retracted.

7. If a dispute arises as to any bidding, then at the discretion of the Auctioneers, either:

(a) the lot to which the disputed bid relates shall immediately be put up again; or

(b) the Auctioneers shall determine the dispute, and their decision shall be final and binding on all parties.

8. The Purchaser shall, when requested, give his name and address to the Auctioneers and unless otherwise agreed

by the Auctioneers the Purchaser shall pay for the lot(s) he has purchased ON THE DAY OF SALE. All lots are sold

on condition that the ownership of the same shall remain with the Vendor and no property in the lots whether

legal or equitable shall pass to the Purchaser and no lot(s) shall be removed from the sale premises unless or until:

(a) payment in full has been made in cash, or by bankers draft, or by a cheque not exceeding the amount stated

on an accompanying valid cheque guarantee card;

(b) the Purchaser has obtained a pass-out slip from the Auctioneer’s clerk.

9. Notwithstanding Conditions 8 and 10 each lot shall be at the absolute risk and expense of its respective Purchaser at

the fall of the hammer and subject to Conditions 8 and 10 shall be removed from the sale premises at the

Purchaser’s expense within the time stated by the Auctioneers at the commencement of the sale.

CONDITIONS OF SALE

1 The Auctioneers sell as agents for the Vendor (except where they are stated wholly or partly to own any lot as principal) and as such are not personally responsible for any default by the Vendor or Purchaser.

2 Subject to the reserve price (if any) being reached, the highest bidder for any lots shall be the Purchaser, and if any dispute arises, the Auctioneers may determine the same, or the lot may be put up again and resold at their discretion.

3 The bidding at all times to be at the discretion of the Auctioneers, who reserve the right to refuse any bidding or to withdraw any lot or lots from the sale, and to sell in such order and combine lots as they think fit. No bidding shall be retracted.

4 At the fall of the hammer, each Purchaser shall upon request give to the Auctioneers his or her name and address, and pay for any lots purchased at the close of the sale.

5 No lot or lots shall be removed from the premises until paid for, but each and every lot shall, at the fall of the hammer, be considered as delivered and at the risk of the Purchaser and shall be removed from the sale field at the Purchaser's expense and taken with all faults and errors, save as hereinafter provided.

6 The Auctioneers describe each lot with care from information supplied by the Vendor or from their inspection when cataloguing but no allowance will be made for errors of description or misstatement contained in advertisements, catalogues or given verbally at or before the sale. Buyers should satisfy themselves prior to the sale of the condition of each lot.

7 Purchasers paying by cheque must be prepared, if required, to produce a letter of credit from their bankers.

8 The Auctioneers will, at the Purchaser's request, transfer lots to another Purchaser, but the original Purchaser shall not cease to be responsible for the purchase money and, in the event of default may be sued for the same.

9 No lot of any description is sold with a 'warranty' or 'condition', unless specifically mentioned at the time of sale.

10 If a Purchaser shall fail to comply with any or all of these conditions any money deposited will be forfeited and any lot which remain uncleared after the times and date specified in the General Remarks will be sold by public auction or private sale, without notice to the Purchaser, and the deficiency (if any) arising upon the resale together with interest thereon (at a rate of 15% per annum) and all costs, charges and expenses incurred shall be due as a debt by the Purchaser in default upon the first sale and be recoverable as for liquidated damages.

11 Accidents - Every person attending the sale shall be deemed to be there at their own risk and neither the Vendor nor Auctioneers will be responsible for any damage to life or limb or property, prior to or during the progress of the sale, or at any time during the removal of lots. Cars are parked entirely at the Owner's risk.

12 These conditions and all transactions shall be governed by and construed in accordance with English law.
