ORDINANCE NO. 5879

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, ANNEXING CERTAIN

TERRITORY TO THE CITY OF RENTON ( ERIC RESSLER II ANNEXATION; FILE NO. A-17-001).

WHEREAS, under the provisions of RCW 35A. 14. 120, as amended, a written annexation

petition was presented and filed with the City Clerk on or about April 11, 2017; and

WHEREAS, prior to the filing and circulation of the petition for annexation to the City of

Renton, pursuant to RCW 35A. 14. 120, the petitioning parties, comprised of property owners of

not less than ten percent (10%) in value, according to the assessed valuation for general taxation

of the area to be annexed, notified the City Council of their intention to commence the direct

petition for annexation proceedings; and

WHEREAS, after a public hearing, it was determined that the petitioning owners agreed

to accept that portion of the City' s Comprehensive Plan as it pertains to the territory including

the applicable Zoning Code relating thereto; and

WHEREAS, the King County Department of Assessments examined and verified the

signatures on the petition for annexation on or about July 24, 2017, and determined that the

signatures represent at least sixty percent (60%) of the assessed value ( excluding streets) of the

area to be annexed, as required by RCW 35A. 14. 120; and

WHEREAS, the Department of Community and Economic Development of the City of

Renton considered and recommended that the City of Renton annex the property; and

WHEREAS, consistent with RCW 35A. 14. 130, the City Council set September 25, 2017 in

the City Council Chambers, City Hall, as the time and place for a public hearing on the petition

with notice as required by law; and

WHEREAS, pursuant to the notice, the public hearing was held at the time and place

specified, and the City Council considered all matters in connection with the petition and

determined that all legal requirements and procedures applicable to the RCW 35A.14. 120

petition method for annexation have been met; and

WHEREAS, a " Notice of Intention," including all required information for review of the

annexation, was transmitted to the King County Boundary Review Board and approved as of

January 4, 2018; and

WHEREAS, the City of Renton pre-zoned the annexation site R- 4, four units per net acre,

as part of the East Renton Plateau Prezone Ordinance No. 5254 and that zoning will become

effective upon annexation;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES

ORDAIN AS FOLLOWS:

SECTION I. The findings, recitals, and determinations are hereby found to be true and

correct in all respects. All requirements of the law in regard to the annexation by petition

method, including the provisions of RCW 35A. 14. 120, 130, 140, and 150 have been met. It is

further determined that the petition for annexation to the City of Renton of the property and

territory described below is hereby approved and granted; the following described property

being contiguous to the city limits of the City of Renton is hereby annexed to the City of Renton,

and such annexation to be effective on and after the approval, passage, and thirty( 30) days after

publication of this ordinance; and on and after said date the property shall constitute a part of

the City of Renton and shall be subject to all its laws and ordinances then and thereafter in force

and effect; the property being described as follows:

See Exhibit " A" attached hereto and made a part hereof as if fully set forth herein

The property, approximately 4.4 acres is bounded by parcel lines. The parcel lineto the south is located in proximity of SE 134th Street ( if extended), to the east

the parcel line is located in proximity of 164th Ave SE ( if extended), to the north

the parcel line is at the City limits which runs along a parcel line in proximity ofNortheast 1st Place, and the parcel line to the west is at the City limits in proximityof 160th Ave SE ( if extended).]

and the owners of the property within the annexation shall be subject to the City' s

Comprehensive Plan and Zoning Code.

SECTION II. This ordinance shall be effective upon its passage, approval, and thirty( 30)

days after publication of a summary of this ordinance in the City' s official newspaper. The

summary shall consist of this ordinance' s title.

A certified copy of this ordinance shall be filed with the King County Council, State of

Washington, and as otherwise provided by law.

RENTON STORMWATER MANAGEMENT PROGRAM

PUBLIC EDUCATION AND OUTREACH (2018)

The City of Renton maintains a public education and outreach program with a variety of approaches to inform the general public, businesses, residents, developers, contractors, and engineers about ways to prevent stormwater pollution. The program has been developed locally with input from regional organizations such as the STORM group, Environmental Coalition of South Seattle (ECOSS), King County, WRIA 8 Salmon Recovery Council, WRIA 9 Watershed Ecosystem Forum, the Department of Ecology, and the Environmental Protection Agency. The goal of the education program is to reduce or eliminate behaviors and practices that cause or contribute to adverse stormwater impacts.

Highlights of the City’s public education and outreach program include the volunteer storm drain marker program, the spill kit program, and a wide range of educational materials for a variety of audiences. Table 1 summarizes these and additional 2018 City activities associated with Public Education and Outreach.

The City of Renton maintains a public education and outreach program with a variety of approaches to inform the general public, businesses and developers about ways to prevent stormwater pollution. The program has been developed locally with input from regional organizations such as the STORM group, Environmental Coalition of South Seattle (ECOSS), and King County. The goal of the education program is to reduce or eliminate behaviors and practices that cause or contribute to adverse stormwater impacts.

Components of the City’s public education and outreach program that informed businesses, and the general public of hazards associated with illicit discharges and improper disposal of waste (that meet S5.C.3.c.iv) are listed in Table 2.

The City implements an ongoing illicit discharge detection and elimination (IDDE) training program with the focus of training municipal field staff on: (1) identification of an illicit discharge and connection; and (2) proper procedures for reporting and responding to illicit discharges and connections. The City’s IDDE training program also includes training for staff whose primary construction, operations or maintenance job functions may impact stormwater quality. In 2018, IDDE training was completed by 184 City staff.

excavation area where the contractor was working and determined it was the

source. Maintenance told the inspector and contractor that they needed to

stop digging until they could control sediment discharge. The contractor built a

berm and silt curtain to isolate the work area from the discharge pipes and

minimize the discharge. The next day a new berm was installed. Pumping of

turbid water from the work area was shut down by the inspector and the

contractor planned to pump to a Baker tank for dewatering.

Alternative catch basin cleaning approach. (S5.C.5.d).

For the majority of the MS4, the Public Works Stormwater Maintenance Division uses S5.C.5.d.iii as its

alternative to the standard approach of inspecting all catch basins once no later than August 1, 2017 and

every two years thereafter.

S5.C.5.d.iii “The Permittee may clean all pipes, ditches, catch basins, and inlets within a circuit once

during the permit term. Circuits selected for this alternative must drain to a single point.”

The Parks and Golf Course Divisions use S5.C.5.d.ii as its alternative to the standard approach of

inspecting all catch basins once no later than August 1, 2017 and every two years thereafter.

S5.C.5.d.ii “Inspections at least once by August 1, 2017 and every two years thereafter may be

conducted on a “circuit basis” whereby 25% of catch basins and inlets within each circuit are

inspected to identify maintenance needs. Include an inspection of the catch basin immediately

upstream of any system outfall or discharge point, if applicable. Clean all catch basins within a given

circuit for which the inspection indicates cleaning is needed to comply with maintenance standards

established under S5.C.5.a”

ANNUAL NPDES REPORT (2018) - RESPONSE TO QUESTION 56

The City of Renton, in compliance with State and Local regulations, requires applicants to submit for

review and approval Technical Information Reports that provide on and offsite storm water analysis of

the existing and proposed drainage systems. These analyses provide the basis for whether a project

meets the City storm drainage regulations and can be approved for construction. Once a project is

approved for construction and a permit is issued for the work, the City requests that the applicant

provide any stormwater monitoring data that is sent to Department of Ecology as part of the applicant's

Construction Stormwater General NPDES Permit, if one is required. The City requests the monitoring

data to verify that the applicant is in fact monitoring their project’s stormwater discharge.
