the State of Andhra Pradesh in the Sixty-Fourth year of the Republic of India asfollows:-

1. (1) This Actmay be called theAndhra Pradesh Public Safety (Measures)Enforcement Act, 2013.

(2) It extends to the whole areas ofGreater Hyderabad Municipal Corporation,Vijayawada Municipal Corporation,Visakhapatnam Municipal Corporation, theCorporations constituted under the AndhraPradesh Municipal Corporations Act, 1994,and such other areas and places as maybe identified and notified by the StateGovernment from time to time.

(3) It shall come into force on suchdate as the State Government may, bynotification in the Andhra Pradesh Gazetteappoint.

2. In this Act unless the contextotherwise requires -

(a) “Establishment” means a placefrequented by large number of people witha likelihood of public gathering of 100people or more at a time, such ascommercial establishments, industrialestablishments, religious places,educational institutions, hospitals, sportscomplexes, railway stations, bus stations,

places of organized congregations andsuch other establishments as theGovernment, may by notification declareto be an establishment for the purposeof this Act;

(b) “Government” means the stateGovernment of Andhra Pradesh;

(c) “License” means a validpermission or license to build or run anestablishment obtained under theGreater Hyderabad MunicipalCorporation Act, 1955 or the AndhraPradesh Municipal Corporations Act,1994 or the Andhra Pradesh Cinemas(Regulation) Act, 1955 or AndhraPradesh Education Act, 1982 or anyother Act or the rules made under therelevant Acts for this purpose;

(d) The Licensing (sanctioning)Authority” means an authoritycompetent to issue license to build orrun an establishment under the GreaterHyderabad Municipal Corporation Act,1955 or the Andhra Pradesh MunicipalCorporations Act, 1994 or the AndhraPradesh Cinemas (Regulation) Act, 1955or the Andhra Pradesh Education Act,1982 or an authority competent to issuepermission or license for running aneducational institution;

(e) “Notification” means anotification published by the Governmentin the Andhra Pradesh Gazette and theword notified shall be construedaccordingly;

(f) Prescribed” means prescribed bythe Government by rules made under thisAct;

(g) Public Safety Measures” meansAccess Controls and Closed CircuitTelevision Surveillance at entry and exitpoints of the establishments and theirparking areas by installing;

(i) Access Controls through Physicaland Technical means;

(ii) Surveillance through Closed circuittelevision surveillance cameras with aprovision for storage of video footage for30 days;

(iii) The technical equipments;adhering to the specifications notified bythe Government.

3. (1) Every owner/manager/person orthe persons who are running anestablishment shall, provide and maintainpublic safety measures so as to ensuresafety and security of the public visitingtheir establishment.

(2) Every owner/manager/person orthe persons who are running anestablishment shall save/store videofootage properly for a period of 30 daysand provide the same as and whenrequired by an Inspector of Police havingjurisdiction over the area or any otherauthority as may be notified by theGovernment.

4. (1) Every owner/manager/person orthe persons who are running anestablishment shall file periodical returnsin such manner and in such proforma asmay be prescribed, certifying that thePublic Safety Measures are provided,properly maintained and the relevantequipments are in working condition, oncein every six months, to the concernedInspector of Police having jurisdiction overthe area.

(2) Every owner/manager/person orthe persons who are running anestablishment as on the date ofcommencement of this Act, shall,implement public safety measures withina period of six months from the date ofcommencement of this Act or before thenext date of renewal of license, whicheveris earlier.

5. The Inspector of Police havingjurisdiction over the area, may at anytime, without prior notice, enter into anyestablishment, inspect and check asregards the installation and functioningof the public safety measures and incase of any default or violation shall senda report to the Assistant Commissionerof Police (ACP) or as the case may bethe Sub Divisional Police Officer (SDPO)concerned having jurisdiction over thearea.

6. (1) The Assistant Commissionerof Police (ACP) or as the case may bethe Sub Divisional Police Officer (SDPO)of the area concerned shall, on receiptof report from the concerned Inspectorof Police having jurisdiction over the areaunder section 5, issue a show causenotice to the owner/manager/person orthe persons who are running any suchestablishment, giving 15 days time forcompliance.

(2) An owner/manager/person or thepersons who are running any suchestablishment, on receipt of show causenotice issued under sub-section (1), failsto comply with the directions of notice,the concerned Assistant Commissionerof Police (ACP) or as the case may bethe Sub Divisional Police Officer (SDPO)may, levy a compounding fee on the

owner/manager/person or the personswho are running such establishment, -

(i) for the first month of default -Rs. 5,000/-

(ii) for the second month of default- Rs. 10,000/-

(3) In case of any failure on the partof the owner/manager/person or thepersons who are running any suchestablishment, to comply with thedirections, within a period of two months,the Inspector of Police having jurisdictionover the area shall, seal the premisestemporarily and send a report tolicensing authority concerned, throughthe Assistant Commissioner of Police(ACP) or as the case may be the SubDivisional Police Officer (SDPO) havingjurisdiction over the area:

Provided that the religiousinstitutions of Endowments Departmentor any other religious place shall not besealed.

(4) The licensing authorityconcerned shall, on receipt of suchreport under sub-section (3), issue showcause notice to the owner/manager/person or the persons who are running

any such establishment and initiateaction as per the provisions of lawgoverning the issuance of license.

(7) No suit, prosecution or legalproceedings shall lie against anyauthority or officer for anything done ingood faith or intended to be done inpursuance of this Act or any rule or ordermade thereunder.

8. The provisions of this Act shallbe in addition to and not in derogationof provisions of any other law for the timebeing in force and nothing contained inthis Act, shall exempt any person fromany proceeding (whether by way ofinvestigation or otherwise), which mightapart from this Act, be instituted or takenagainst him.

9. (1) The Government may, bynotification, make rules for carrying outall or any of the purposes of this Act.

(2) Every rule made under this Actshall, immediately after it is made, be laidbefore the Legislature of the State, if itis in session and if it is not in session, inthe session immediately following for atotal period of fourteen days which maybe comprised in one session or in twosuccessive sessions and if, before theexpiration of the session in which it is so

laid or the session immediately followingthe Legislature of the State agrees inmaking any modification in the rule or inthe annulment of the rule, the rule shall,from the date on which the modificationor annulment is notified, have effect onlyin such modified form or shall standannulled as the case may be, sohowever, that any such modification orannulment shall be without prejudice tothe validity of anything previously doneunder that rule.

O R D E R:

In pursuance of the enactment of the AndhraPradesh Public Safety (Measures) Enforcement Act,2013 (Act No.6 of 2013), the Government after carefulexamination of the matter, have decided to issue theAndhra Pradesh Public Safety (Measures) EnforcementRules, 2014.

2. Accordingly, the following notification will bepublished in the Andhra Pradesh Gazette:-

In exercise of the powers conferred by sub-section (1) of section 9 of the Andhra Pradesh Public

Safety (Measures) Enforcement Act, 2013 (Act No.6 of2013), the Government of Andhra Pradesh hereby makethe following Rules:

RULES

1. Short title and Extent:

(i) These Rules may be called the Andhra PradeshPublic Safety (Measures) Enforcement Rules,2014.

(ii) These rules shall extend to the whole areas ofGreater Hyderabad Municipal Corporation,Vijayawada Municipal Corporation,Visakhapatnam Municipal Corporation and theCorporations constituted under the AndhraPradesh Municipal Corporations Act, 1994 andsuch other areas and places as may be identifiedand notified by the State Government fromtime to time.

2. (1) In these rules, unless the context otherwiserequires:-

(a) “Act” means the Andhra Pradesh Public Safety(Measures) Enforcement Act, 2013 (Act No. 6of 2013);

(b) “Annexure” means, Annexure appended tothese Rules;

(c) “Association” means;

(i) Group of owners of various shops /commercial places in any commercialestablishment where such premises isgiven for lease or owned by them, and;

(ii) Group of individual shops andestablishments concentrated in aparticular area giving scope for morecongregations at any given point oftime (Area Shops and EstablishmentAssociation);

(d) “Assistant Commissioner of Police / SubDivisional Police Officer” means, as the casemay be having jurisdiction over the area;

(e) “Establishment” means a place frequented bylarge number of people with a likelihood ofgathering of 100 people or more at a time,such as commercial establishments, industrialestablishments, religious places, educationalinstitutions, hospitals, sports complexes,railway stations, bus stations, places oforganized congregation and such otherestablishments as the Government may, bynotification declare to be an establishmentfor the purpose of the Act.

Explanation:

(i) While identifying the establishment, aSupervisory Committee consisting of arepresentative each from Municipal,Revenue and Police will jointly inspect theestablishment duly taking into accountwhether there is a gathering of more than100 people at any point of time, the threatperception of that particular establishment,the vulnerability of that particularestablishment and total number of people

visiting that particular establishment in aday, etc. Where there are multiple ownersof commercial establishments, theSupervisory Committee will advise suchmultiple owners to form as an associationand implement sector wise safety measures.Similarly, the Committee will also identifysectors having a large congregation withhigh vulnerability at any given point of timeand advise them to form an association andimplement safety measures (Area Shops andEstablishment Association);

(ii) Commercial Establishments, such asShopping malls, Multiplexes, Group ofindividual shops concentrated at a particulararea giving scope for more congregation atany given point of time, Cinema theatres,Places of entertainment, Amusement parks,Auditoriums, Hotels / Restaurants /Dhabas,Lodges, Bars and Restaurants, Food courts,Resorts, Banks and financial institutions andplaces of organised congregation such asconvention centres, Exhibitions, FunctionHalls, Circuses and places of public meetingand gathering are included under thepurview of the Act;

(f) “Form” means, a form appended to theseRules;

(g) “Inspector” means, Inspector of Police havingjurisdiction over the area;

(h) “License”, a valid permission or license tobuild or run an establishment obtained under

the Greater Hyderabad Municipal CorporationAct,1955 or the Andhra Pradesh MunicipalitiesAct, 1965 or the Andhra Pradesh MunicipalCorporations Act, 1994 or the Andhra PradeshCinemas (Regulation) Act, 1955 or FactoriesAct, 1948 or the Andhra Pradesh Education Act,1982 or any other Act or the rules made underthe relevant Acts for this purpose;

(i)“Licensing Authority” means, an authoritycompetent to issue license to build or run anestablishment under the Greater HyderabadMunicipal Corporation Act, 1955 or the AndhraPradesh Municipalities Act, 1965, the AndhraPradesh Municipal Corporation Act, 1994 or theAndhra Pradesh Cinemas (Regulation) Act, 1955or Factories Act, 1948 or the Andhra PradeshEducation Act, 1982 or an authority competentto issue permission or licence for running anestablishment;

(j) “Notification” means, a notification publishedby the Government in the Andhra PradeshGazette and the word notified shall beconstrued accordingly;

(k) “Prescribed” means, prescribed by theGovernment by rules made under this Act;

(l) “Public Safety Measures” means AccessControls and Closed Circuit TelevisionSurveillance at entry and exit points of theestablishments and entry and exit points oftheir parking areas by installing;

(i) Access controls through Physical andTechnical means;

(ii) Surveillance through Closed CircuitTelevision surveillance cameras with aprovision for storage of video footage for30 days;

(iii) The technical equipments adhering tothe specifications notified by theGovernment;

(m)“Sectoral Committee” means, a committeeformed in accordance with the provisions ofrule 4;

(n) “Supervisory Committee” means, a committeeformed in accordance with the provisions ofrule 9;

(2) The words and expressions not defined in theserules, but defined in the Act, shall have the samemeaning respectively assigned to them in the Act;

3. Public Safety Measures: - Every owner/ Manager/ Person or the Persons / Association who arerunning an establishment should provide andmaintain Public Safety Measures.

(i) Every Owner / Manager / Person or thePersons /Association who are running anestablishment(s) shall save / store videofootage properly for a period of 30 days andprovide the same as and when required byInspector of Police or any InvestigatingOfficer or any investigation agency;

(ii) The Inspector of Police or any otherInvestigation Agency shall maintain theconfidentiality of the data base. Except for

law enforcement, security and investigationpurposes, the footage shall not be used forany other purpose. Any misuse of the dataentails the concerned liable for action;

(iii) Every owner / owners / builders / associationof commercial establishments / personsrunning the establishment shall severally andjointly be responsible for installation ofpublic safety measures at their own cost;

(iv) The Public Safety Measures can be for singleindividual establishment or a group ofestablishments together operating business;

4. Sectoral Committee:

(i) The Commercial Establishments/Group ofEstablishments of a locality may form aSectoral Committee consisting ofrepresentatives from the owners of suchcommercial establishments / group ofestablishments in their locality to aid andassist the supervisory committee in theimplementation of the “Public SafetyMeasures”.

(ii) The formation of such committee shall beinformed to the Assistant Commissioner ofPolice / Sub Divisional Police Officer throughthe Inspector of Police having jurisdictionover the area.

5. Every establishment / association shall provideequipment of minimum technical specificationsfor Access Control and Surveillance Devices (CCTVs) as under:

(iii) Every establishment / association shallkeep one of the employees or a personfrom outsourcing agency having trainedto operate Electronic Devices likeAccess control and CCTV Cameras.

(iv) Every establishment / association shallbear the cost of providing “Public SafetyMeasures”.

(v) Cameras shall run 24 x 7 even when theestablishment is closed.

(vi) The cameras should be in such a waythat it should cover the approach areasat the entry and exit points ofestablishments and also entry and exitpoints of parking lots of theestablishment up to a distance of 50yards.

(vii) It shall have 30 days storage facility.

(viii) Commissioners of Police in theCommissionerates and Superintendentsof Police in the District Police Units shalldevelop a special wing with personnelwho are having knowledge and expertisein the subject of functioning ofelectronic devices like Access Controland CCTV Devices.

6. Liability for filing periodical returns:

(i) Every owner / Manager / Person or thePersons / Association who are runningan establishment shall file periodicalreturns in such manner certifying thatthe Public Safety Measures are provided,properly maintained and the relevantequipments are in working condition asprescribed in Form No.15 eitherelectronic form or physically, appendedto the Rules to the Inspector of Policehaving jurisdiction once in six months.

(ii) Every Owner / Manager / Person or thePersons / Association who are runningan establishment shall enclose anAnnexure with renewal of licenseapplication form, appended to the ruleswhile applying before the CompetentLicensing Authority.

7. Functions of the Inspector of Police:

(i) The Inspector of Police shall maintain aregister of Establishments identified inhis jurisdiction under these rules asprescribed in Form No.2, as appendedto the rules.

(ii) The Inspector of police shall inspect theestablishments within the area ofjurisdiction 10% at random, in each quarterand submit Inspection report in Form No.3,appended to the rules to the AssistantCommissioner of Police or Sub DivisionalPolice Officer as the case may be, wherevernon compliance is noticed as prescribed inForm No. 4 appended to the rules.

(iii) The Inspector of Police shall take assistanceof the special wing as specified at Rule 5(viii) at the time of inspection.

(iv) In case of any failure on the part of theOwner / Manager / Person or the Persons /Association who are running any suchestablishment, to comply with thedirections, within a period of two monthsfrom the date of levying of the 2nd monthcompounding fee, the Inspector of Policehaving jurisdiction over the area shall senda report to the Supervisory Committeethrough Assistant Commissioner of Police /Sub Divisional Police Officer concerned asprescribed in Form No. 10 appended to therules.

(v) The Inspector of Police having jurisdictionover the area of establishment shall sealthe premises temporarily as prescribed inForm No.13 on receipt of the orders fromSupervisory Committee as prescribed inForm No.12, appended to the rules.

(vi) The Inspector of Police, at the time of sealingthe establishment shall give time of 24hours for necessary disposal of perishablegoods found at the establishment.

(vii) The Inspector of Police shall send a reportabout sealing of establishment to thelicensing authority concerned throughAssistant Commissioner of Police (ACP) orthe Sub Divisional Police Officer (SDPO) asthe case may be having jurisdiction overthe area as prescribed in Form No.14,appended to the rules.

8. Functions of the Assistant Commissioner of Police/ Sub Divisional Police Officer:

(i) The Assistant Commissioner of Police / SubDivisional Police Officer as the case maybe having jurisdiction over the area undersection 6, issue a show cause notice asprescribed in Form No. 5, appended to therules to the Owner / Manager / Person orthe Persons / Association who are runningany such establishment giving 15 days timefor compliance on receipt of a report fromthe Inspector of Police regarding noncompliance.

(ii) An Owner / Manager / Person or the Persons/ Association who are running any suchestablishment, on receipt of show causenotice issued under sub-rule (i), fails tocomply with the directions of notice, theconcerned Assistant Commissioner of Police(ACP) or the Sub Divisional Police Officer

(SDPO) as the case may be, levy acompounding fee on the owner / manager/ person or the persons / association whoare running such establishment:

(a). For the first month of default -Rs. 5,000/- (in Form No.7)

(b). For the second month of default -Rs.10,000/- (in Form No. 8)

(iii) The Assistant Commissioner of Police / SubDivisional Police officer having jurisdictionover the area shall maintain register ofshow cause notice / compounding fee asprescribed in Form No.6, appended to therules.

(iv) The Assistant Commissioner of Police / SubDivisional Police officer having jurisdictionover the area shall issue receipt forcompounding fee as prescribed in FormNo.9, appended to the rules.

(v) The Assistant Commissioner of Police / SubDivisional Police Officer having jurisdictionover the area on receipt of report of theInspector of Police as specified in rule 7(iv) shall place that report before theSupervisory Committee.

(vi) The Assistant Commissioner of Police / SubDivisional Police Officer having jurisdictionover the area shall forward the report ofthe Inspector of Police having sealed theestablishment to the licensing authority.

(vii) The compounding fee collected shall bedeposited in the relevant Head of Accountas may be notified by the Government.

9. Supervisory Committee:

The Supervisory Committee consisting of arepresentative each from Municipal Corporation /Municipality, Revenue Department and PoliceDepartment. The representatives shall be of thefollowing cadre:

(i) Zonal Commissioner or MunicipalCommissioner, as the case may be, havingjurisdiction shall nominate an officer notbelow the rank of Assistant City Planner(GHMC) / City Planning Officer(Corporations like Warangal, Vijayawada.,etc / Town Planning Officer / Town PlanningSupervisor (Other Municipalities);

(ii) Revenue Divisional Officer havingjurisdiction shall nominate an officer notbelow the rank of Revenue Inspector;

(iii) Assistant Commissioner of Police or SubDivisional Police Officer, as the case maybe, having jurisdiction;

(iv) Assistant Commissioner of Police or SubDivisional Police Officer, as the case maybe, having jurisdiction shall be theConvener of the Supervisory Committee.

10. The functions of Supervisory Committee:

(i) The Committee shall identify anestablishment under the Act and maintain

the same as prescribed in Form No.1,appended to the rules;

(ii) The Assistant Commissioner of Police or SubDivisional Police Officer, as the case maybe, having jurisdiction shall be theConvenor of the Committee for conveningthe meeting of Supervisory Committee;

(iii) The Supervisory Committee shall on receiptof the report of the Inspector of Police,forwarded through Assistant Commissionerof Police / Sub Divisional Police Officerhaving jurisdiction of the area as prescribedin Form No.10 that the establishment hasfailed to comply with the rules even afterlevying 2nd month compounding fee, shallissue show cause notice as prescribed inForm No.11, appended to the rules forsealing the establishment for noncompliance;

(iv) The Supervisory Committee may visit theestablishment, if necessary;

(v) The Supervisory Committee shall pass thesealing order as prescribed in Form No.12,appended to the rules, within one weekfrom the date of receipt of explanation forthe show cause notice;

(vi) Supervisory Committee shall take theassistance of the Sectoral Committee in theeffective implementation of Public SafetyMeasures.

11. The functions of the Licensing Authority:

(i) The Licensing Authority while issuing alicense shall make it binding on theestablishment for compulsoryimplementation of public safety measures.

(ii) The Licensing Authority shall, at the timeof renewal of license, ensure that theestablishment is implementing the publicsafety measures without any violation.

(iii) On receipt of report from AssistantCommissioner of Police / Sub DivisionalPolice Officer having jurisdiction regardingtemporary sealing of the premises, thelicensing authority shall issue show causenotice to the owner / manager / person orthe persons / association who are runningany such establishment and initiate actionas per the provisions governing the issuanceof license.
