Agreement with Goodwill Industries

5) It is recommended the Board of Education approve for 2011-12 the District Master Contract General Agreement for Nonsectarian, Nonpublic Agency Services between this District and Goodwill Industries of Orange County, dba Assistive Technology Exchange Center (ATEC), 410 N. Fairview, Santa Ana, CA 92703 to provide nonpublic agency services. Assistive technology services provided include, but are not limited to, assessments, programming and training of assistive technology equipment, and equipment loans and rentals. 6) It is recommended the Board of Education approve an Individual Service Agreement between this District and Kids Institute for Development and Advancement, 16832 Red Hill Avenue, Irvine, CA 92606 to provide an Independent Educational Evaluation (IEE) in the area of Occupational Therapy to student #40059008, effective October 13, 2011, through January 31, 2012. Agreement with Cara Lockwood & Associates

7) It is recommended the Board of Education approve an Independent Contractor Agreement between this District and Cara Lockwood and Associates, 25406 Elderwood, Lake Forest, CA 92630 to provide training to Head Start instructional staff based on the Center for Social Emotional Foundations in Early Learning (CSEFEL) Pyramid approach during the 2011-12 school year. Services include trainings, peer support groups, and classroom observations. The fee for these services shall not exceed $5,000. (NoHo Software), 18757 Burbank Boulevard, Suite 210, Tarzana, CA 91356 to provide software installation and training to Early Childhood Education staff during the 2011-12 school year. This software system will support ECE staff with the enrollment, reporting, and centralization of the State Preschool Program. The fee for these services shall not exceed $9,624.86. The term of this agreement is for three years beginning January 1, 2012. The Medco Pharmacy Plan is a self-funded plan where Anaheim City School District pays pharmacy claims based on number of members and plan utilization; i.e., number of prescriptions filled. 5) It is recommended the Board of Education renew the agreement between this District and California State University, Fullerton CalState TEACH Program, 2600 East Nutwood Avenue, Suite 300, Fullerton, CA 92831 to provide student teaching experience to students enrolled in teacher training curricula. The term of this agreement shall be operative until November 30, 2016. This service is at no cost to the District. Funding: No Cost to the District

4) It is recommended the Board of Education approve an agreement between this District and Special District Financing & Administration, 437 West Grand Avenue, Escondido, CA 92025 for the preparation of a Residential and Non-residential Developer Fee Justification Study for a cost of $8,500, plus reimbursable expenses. Funding: 01-65006575-5823 Facilities Administration (General Fund – Unrestricted) [SB50 requires that the Developer Fee Justification Study be updated as a prerequisite to increase the assessment.]

License Agreement with Anaheim Family YMCA

5) It is recommended the Board of Education approve an agreement between this District and the Anaheim Family YMCA, 240 South Euclid Street, Anaheim, CA 92802 for the use of two classrooms at the former Francis Scott Key School campus, 2000 West Ball Road, as an adult fitness center. Funding: No Cost to the District

6) It is recommended the Board of Education approve an agreement between this District and Yoon’s Security Service, 8622 Stanton Avenue, Suite 417, Buena Park, CA to provide on-site security service for the Melbourne Gauer School Modernization Project effective January 6, 2012, continuing until the responsibility for security is transferred to the contractor, for an estimated cost of $13,104. Agreement with CF Environmental – Marshall

7) It is recommended the Board of Education approve an agreement between this District and CF Environmental, 4017 Alcove Avenue, Studio City, CA 91604 to provide inspection services for asbestos and lead containing materials at John Marshall School Reconstruction, for an estimated cost of $59,437.30. Extension of Bid Agreement – Ortco, Inc. – Various Sites

8) It is recommended the Board of Education extend the bid agreement between this District and Ortco, Inc., 2163 N. Glassell Street, Orange, CA 92865 under the terms and conditions of the 2007 Play Area Safety Surfacing and Equipment Unit Price Bid Project LBDG 27568 for various sites throughout the District on a yearly basis. It is in the best interest of the District to contract for play area safety surfacing and equipment from Ortco, Inc., from November 19, 2011, through November 18, 2012, with an annual Consumer Price Index increase for the Los Angeles, Riverside, and Orange County areas of 2.8 percent. 1) It is recommended the Board of Education accept nominations for the California School Boards Association (CSBA) Delegate Assembly for Region 15. CSBA Delegates serve two-year terms. Those elected in 2012 will serve beginning April 1, 2012, through March 31, 2014.

2) It is recommended the Board of Education approve an agreement between this District and the California School Boards Association (CSBA) to subscribe to CSBA’s manual maintenance program to enable the District to maintain an online manual of its policies, regulations, and bylaws. 1) It is recommended the Board of Education adopt the SELPA Annual Service Plan as presented at the November 14, 2011, Board meeting in accordance with Education Code §56205. These documents are required components of the SELPA Local Plan and were submitted to the California Department of Education on October 31, 2011. The annual service plan includes a description of services provided, the nature of the service, and the physical location of the service. The description demonstrates that all individuals with exceptional needs shall have access to services and instruction appropriate to meet their needs and currently specified in the individualized education programs. Copies of this plan are available for inspection in the Special Services office. Funding: No Cost to the District

D. ADMINISTRATIVE SERVICES First Interim Report (Received under Separate Cover)

1) It is recommended the Board of Education approve the 2011-12 First Interim Report as presented. [Education Code requires school districts to file Interim Reports three times per year if the district has filed a qualified or negative report. The purpose of the Interim Report is to certify the District’s financial condition at periodic intervals during the fiscal year. The First Interim Report reflects the reporting period as of October 31, 2011. This is the first of three updates adjusting the July adopted budget.]

2) The District Board of Education shall certify in writing whether the District is able to meet its financial obligations for the remainder of the fiscal year and, based on current forecasts, for two subsequent fiscal years. The certifications shall be classified as positive, qualified, or negative, pursuant to standards and criteria adopted by the State Board of Education (Education Code 33127).

CERTIFICATION OPTIONS a) Positive Certification – In certifying the 2011-12 First Interim Report as

positive, the Board understands that the District is able to meet its fiduciary responsibility to maintain fiscal solvency for the current and subsequent two fiscal years.

b) Qualified Certification – In certifying the 2011-12 First Interim Report as

qualified, the Board understands that the District may be unable to meet its fiduciary responsibility to maintain fiscal solvency for the current and/or subsequent two fiscal years. [In order to file a Qualified First Interim Report, the District must agree to implement the necessary budget solutions to achieve ongoing budget reductions of $11.1 million on or before July 1, 2012.]

c) Negative Certification – In certifying the 2011-12 First Interim Report as

negative, the Board understands that the District may be unable to meet its fiduciary responsibility to maintain fiscal solvency for the current and/or subsequent two fiscal years.

RESOLUTION IN SUPPORT OF CSBA's PROFESSIONAL GOVERNANCE STANDARDS

WHEREAS, Local boards of education are entrusted by their diverse communities to uphold the constitution, protect the public interest in schools and ensure that a high quality education is provided to each student; and

WHEREAS, Local boards must govern responsibly and effectively on behalf of the students and

communities they serve; and WHEREAS, The California School Boards Association has developed a set of Professional

Governance Standards which describe the commonly agreed upon principles of effective governance in three interrelated categories; and

WHEREAS, These Professional Governance Standards reflect consensus among hundreds of school

board members, superintendents and other educational leaders throughout the state, and are based on research and the CSBA Effective Governance System; and

WHEREAS, The intent of these Professional Governance Standards is to enhance the public's

understanding about the critical responsibilities of local boards and to support local boards in their efforts to govern effectively; and

WHEREAS, The Professional Governance Standards will be utilized to help enhance our district's

effectiveness and to help our local communities and parents to better understand the structure and function of a local school board;

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City School District hereby adopts the CSBA Professional Governance Standards.

Public oversight of local government is the foundation of American democracy. Nowhere is this more evident than in our public schools, where local boards of education are entrusted by their diverse communities to uphold the Constitution, protect the public interest in schools and ensure that a high quality education is provided to each student. To maximize the public’s confidence in local government, our local boards must govern responsibly and effectively.

The California School Boards Association (CSBA), representing nearly 1,000 local school districts and county boards of education, recognizes there are certain fundamental principles involved in governing responsibly and effectively. These principles — or Professional Governance Standards — reflect consensus among hundreds of board members, superintendents and other educational leaders throughout the state.

These Professional Governance Standards describe the three components vital to effective school governance:

1) the attributes of an effective individual trustee, 2) the attributes of an effective governing board, and 3) the specific jobs the board performs in its governance role.

The intent of these standards is to enhance the public’s understanding about the critical responsibilities of local boards and to support boards in their efforts to govern effectively.

The Individual Trustee

In California’s public education system, a trustee is a person elected or appointed to serve on a school district or county board of education. Individual trustees bring unique skills, values and beliefs to their board. In order to govern effectively, individual trustees must work with each other and the superintendent to ensure that a high quality education is provided to each student.

To be effective, an individual trustee:

• Keeps learning and achievement for all students as the primary focus.

• Values, supports and advocates for public education.

• Recognizes and respects differences of perspective and style on the board and among staff, students, parents and the community.

• Acts with dignity, and understands the implications of demeanor and behavior.

• Keeps confidential matters confidential.

• Participates in professional development and commits the time and energy necessary to be an informed and effective leader.

• Understands the distinctions between board and staff roles, and refrains from performing management functions that are the responsibility of the superintendent and staff.

• Understands that authority rests with the board as a whole and not with individuals.

The Board

School districts and county offices of education are governed by boards, not by individual trustees. While understanding their separate roles, the board and superintendent work together as a “governance team.” This team assumes collective responsibility for building unity and creating a positive organizational culture in order to govern effectively.

To operate effectively, the board must have a unity of purpose and:

• Keep the district focused on learning and achievement for all students.

• Communicate a common vision.

• Operate openly, with trust and integrity.

• Govern in a dignified and professional manner, treating everyone with civility and respect.

• Govern within board-adopted policies and procedures.

• Take collective responsibility for the board’s performance.

• Periodically evaluate its own effectiveness.

• Ensure opportunities for the diverse range of views in the community to inform board deliberations.

The Board’s Jobs

The primary responsibilities of the board are to set a direction for the district, provide a structure by establishing policies, ensure accountability and provide community leadership on behalf of the district and public education. To fulfill these responsibilities, there are a number of specific jobs that effective boards must carry out.

Effective boards:

• Involve the community, parents, students and staff in developing a common vision for the district focused on learning and achievement and responsive to the needs of all students.

• Adopt, evaluate and update policies consistent with the law and the district’s vision and goals.

• Maintain accountability for student learning by adopting the district curriculum and monitoring student progress.

• Hire and support the superintendent so that the vision, goals and policies of the district can be implemented.

• Conduct regular and timely evaluations of the superintendent based on the vision, goals and performance of the district, and ensure that the superintendent holds district personnel accountable.

• Adopt a fiscally responsible budget based on the district’s vision and goals, and regularly monitor the fiscal health of the district.

• Ensure that a safe and appropriate educational environment is provided to all students.

• Establish a framework for the district’s collective bargaining process and adopt responsible agreements.

• Provide community leadership on educational issues and advocate on behalf of students and public education at the local, state and federal levels.

La vigilancia pública del gobierno local es la fundación de la democracia Americana. Esto se evidencia en nuestras escuelas públicas donde las Mesas Directivas escolares locales tienen la confianza de sus comunidades diversas para defender la constitución, proteger el interés público en las escuelas y asegurar que una educación de alta calidad sea disponible a cada estudiante. Para aumentar la confianza del público hacia el gobierno local, nuestras Mesas Directivas escolares deben de gobernar responsable y eficazmente.

La Asociación de Mesas Directivas escolares de California (CSBA), representando a casi 1,000 distritos escolares locales y a Mesas Directivas educativas de los condados, reconoce que existen ciertos principios fundamentales que son usados para gobernar responsable y eficazmente. campaign to benefit the ACSD Education Foundation, Anaheim Outdoor Science Education Foundation, JumpStart4Kids, and Orange County United Way. Twenty-five site coordinators gathered to hear information about organizations and ideas to increase awareness and participation. The District is also offering several incentives to increase participation. The goal is to keep the campaign pressure-free and fun, while raising much-needed funds for these worthwhile organizations.

Gift of History - Over 1,800 District third-grade students participated in the

countywide Gift of History event on November 8 at Angel Stadium. The Orange County Department of Education provided history content for the presentation, and Patrick Henry students, as well as other students from across the county, were also selected to be videotaped as readers for the JumboTron history quiz at the event. The Guinness Book of World Records certified the event as the largest history lesson.

Principal for a Day - The District will host 24 guest principals to act as Principal for a Day for each of our school campuses on November 15. The Principals for a Day, represented by leaders from our community, elected officials, service organizations, and business and government employees, will learn about the many challenges and successes of our schools.

House of Blues Thanksgiving - Through the generosity of the House of Blues and Second Harvest Food Bank of Orange County, 650 students and family members selected by our Success for All staff will enjoy a traditional Thanksgiving meal on November 24. The House of Blues will also be providing musical entertainment throughout the event.

Facilities/Const. Update

B. Facilities/Construction Update – Superintendent José Banda

Abraham Lincoln School - Inclement weather stopped activities for a few days; however, work has resumed with the continuation of the steel work and electrical gear setup in addition to underground infrastructure.

Clara Barton School - Low voltage distribution, rough plumbing, roofing, epoxy flooring and exterior plaster work have all been completed. The electrical and the plumbing finish work are near completion. In addition, tile walls and floors, doors, paint, landscape, asphalt paving, and casework installation are also near completion. The carpeting and light fixtures are in progress.

James Madison School - The value engineering phase is in progress. The delivery of the buildings for the temporary housing was completed on November 11.

Melbourne A. Gauer School - The design has been submitted to the Division of the State Architect (DSA) for final approval and the value engineering phase is in progress. Site audits occurred on November 10.

Thomas Edison School - The value engineering phase is in progress. The construction teams are creating the scope of work for the temporary housing phase.

John Marshall School - The value engineering phase is in progress.

Alexander J. Stoddard School - The architect is to contact DSA to discuss site specific difficulties regarding accessibility and mechanical installation work as it relates to possible structural modifications.

Budget Update C. Budget Update – Superintendent José Banda State Budget - On Monday, November 14, the Department of Finance confirmed that

state revenues for the month of October were well below projections. Overall revenue for the month was projected to be $5.774 billion; however, only $5.166 billion was collected, for a shortfall of $608 million. According to the California Association of School Business Officials, this brings the year-to-date shortfall to $1.275 billion. The June adopted State Budget assumed an additional $4 billion of state revenues above the economic-based forecast of the May Revision. Significant cuts to K-12 education funding are triggered if revised revenue forecasts released in November by the Legislative Analyst's Office and in December by the Department of Finance are $2 billion or more short of the Budget estimates. Should mid-year cuts be implemented, ACSD could be faced with a reduction in revenue from $500,000 to $5.1 million dollars. Because of prudent budgeting by the Board of Education and cooperation with AEEA, CSEA, and AESMA, the District has set aside reserves in the event mid-year cuts occur. Unfortunately, these cuts will make planning for the education of our students much more difficult for 2012-13.

Student Attendance and Saturday School - Through October, the student attendance rate for the District is .80% higher than last year's attendance rate. Schools are working hard to stress the academic and financial importance of student attendance with parents. On October 28, all multi-track schools and Thomas Jefferson School held Saturday School for students with one or more absences. Saturday School was a success and attendance for the month of October was higher at all six schools. Additional Saturday Schools will be held on December 10, January 28 and April 28.

A. Redevelopment Funding Report Dante Gumucio, Public Economics, Inc., updated the Board on recent legislation and legal decisions and provided estimates of potential revenue for facilities over the next several years. Redevelopment funding is pass-through money the District receives when a local jurisdiction sets up a redevelopment project area. This funding typically is used to make various improvements to school facilities.

CBEDS Enrollment

B. 2011-12 California Basic Educational Data System (CBEDS) Enrollment Dr. Rob Coghlan, assistant superintendent, administrative services, shared information from the 2011-12 CBEDS report. CBEDS, a count of students, instructors, credentials, ethnicity, etc., that is taken each year at the same time (in October) in all school districts in the state, provides year-to-year comparisons. The 2011-12 CBEDS shows an increase of 190 students from the 2010-11 CBEDS report.

10. BOARD DISCUSSION Public Hearing A. The Board of Education declared a public hearing for the purpose of review and

adoption of the SELPA (Special Education Local Plan Area) Annual Service Plan in accordance with Education Code §56205. These documents are required components of the SELPA Local Plan and were submitted to the California Department of Education on October 31, 2011. The annual service plan includes a description of services provided, the nature of the service, and the physical location of the service. The description demonstrates that all individuals with exceptional needs shall have access to services and instruction appropriate to meet their needs as currently specified in the individualized education programs. Copies of this plan are available for inspection in the Special Services office.

Hearing no comments from the public, the Board President gave notice that a vote on this item is scheduled for the December 12, 2011, Regular Board meeting.

6) It is recommended the Board of Education approve the appointment of Jordan Brandman and Mariellen Sereno to two-year terms on the Measure G Independent Citizens’ Oversight Committee. Mr. Brandman and Ms. Sereno will fill taxpayer organization positions.

The Board discussed the Citizens’ Oversight Committee (COC) bylaws and

nomination process and identified a need to appoint a taxpayer representative and a replacement parent member to the committee due to the vacancy of two members. The COC will also correct the length of terms of members to reflect the bylaws.

School Business B. Board Member activities related to school business:

Dr. José F. Moreno recognized the work of Pupil Services in supporting homeless students and families. Dr. Moreno commented on the recent Anaheim Mariachi Festival held to raise money to fund student participation in a Mariachi program. He cautioned fellow Board members and staff from accepting invitations from businesses due to potential conflicts of interest and public perceptions.

Jeff Cole commented on the District’s attendance at a recent meeting held by the

Mandarin in the Schools Committee. District staff attended the meeting to learn more about the program.
