Types of Patent Searches

•Patentability / Novelty - A review of prior art to determine NOVELTY, UTILITY (industrial applicability), NON-OBVIOUSNESS which are mandatory to obtain a patent, thus assisting in making patent application decisions

•Freedom to operate (FTO/FTP)/Right to Use Search - This service decides whether a particular product, process, or composition of matter can be made and marketed nationally or internationally.

Validity/Invalidity - To study the possibilities and ways to oppose or invalidate a competitor’s patent that is in force, in whole or in part, or to review and reaffirm the validity of the client’s patent with respect to the patent prior art thus assisting in enforcing or defending subject patent in litigation/licensing

•Infringement/Non-infringement/Clearance - Non/infringement search is conducted to show that the product, process or composition of matter that is contemplated to be manufactured/patented/pending patent does not fall within the scope of the claims of a patent prior art.

• State of the art / collection search - State-of-the-art searches helps the client to know the latest technological advancements in his/her area of expertise thereby assisting in patent portfolio development, competition scoping, or research decisions

• Accelerated Examination Search - An extended novelty search with preparation of an accelerated examination report which makes possible a faster (usually within 12 months) prosecution of the patent at the US Patent and Trademark Office.

•Design Search (US only) - A search of patents granted on the ornamental design of a functional item. Design patents are a type of industrial design right. Ornamental designs of jewellery, furniture, beverage containers and computer icons are examples of the subjects of design patents.

As far as technology is concerned we have a secured VLAN connecting our network to that of our Clients.

In most cases the Client would initially prefer to have us connect to a standalone system rather than access his or her entire network. A win-proxy server can facilitate this. The Client for us to access usually provides case Management Software. Firewalls, encryption and intrusion alert detection systems are essential and standard norms.

Clients can choose from a variety of options in terms of connectivity for uploading or downloading work – thru secure F.T.P. transfer to our server that is resident in the U.S.

FAQs….How is confidentiality guaranteed?We have a secure work environment with no electronic media being permitted inside the office premises. All employees prior to their employment are made to sign Non Disclosure Agreements with our company. Finally in certain cases as requested by our clients we are willing to enter into Service Level Agreements with penalty clauses for any breach of confidentiality.

Is the Quality of work assured?Firstly we follow ISO 9000 standards of quality control as well as follow the quality protocol of ISO 27001 which is an International Standard for Data Security.

How do I know the Status of Work and whom should I contact?We will communicate the project status to clients as per requirement. We update the records on client’s servers. A Project coordinator will be assigned to respond to enquiries.

How does the Service Provider secure the case information in its repository?We work on client’s servers. Our staff is fully trained to prevent malicious computer-hacking techniques. We’ve deployed firewalls, secure socket layers, 128-bit encryption, and physical card-key access. In short, the client’s information is protected by the highest degrees of security.
