    PURPOSE

    To present the Draft Cobb 2040 Plan Development document in preparation for the first required public hearing to start the ten-year update to the Cobb County Comprehensive Plan, Cobb 2040: Vision for a New Era.

    BACKGROUND

    Cobb County Community Development has started working on the ten (10) year update to the Countys Comprehensive Plan, per new state guidelines approved by the Department of Community Affairs, effective March 1, 2014. The Agency has developed a draft framework document titled Cobb 2040 Plan Development. The framework provides elected officials, appointed officials, and the public with a roadmap for how the plan will be updated, which includes items such as timelines, data needs, recommended committees, public participation techniques, and required and optional focus areas that may be considered.

    After this presentation, staff will release the draft document for a thirty (30) day public review period. During the public review period, staff will publicize the Cobb 2040 Plan Development document through the web, e-mails, and various county newsletters to bring awareness to this resource. Amendments to the draft framework document will be made based upon input received during the thirty (30) day public comment period. On April 28, 2015, Community Development will request that a public hearing be held on the draft document, which will then provide the Board of Commissioners an opportunity to make final determination on the deliverable. Once approved, staff will proceed with the ten (10) year update to the Comprehensive Plan per the approved framework document.

    PURPOSE

    To present information regarding the implementation of a Behavioral Health Court program.

    BACKGROUND

    The Cobb County State Court is in the investigative stage of developing a proposal to implement a Behavioral Health Court Program. In additional to being approved by Cobb State Court Judges, the Behavioral Health Court will need formal approval from the Georgia Judicial Council. If established, the Behavioral Health Court intends to enter into a partnership with a psychological services care provider which has experience working with populations similar to those that are serviced by the accountability courts (e.g. habitual offenders, domestic violence perpetrators and victims, substance abuse, veterans, etc.). Paramount to the psychological services is comprehensive and quality care that is tailored to each individuals specific needs, and is intended to reduce recidivism and boost each individuals chances of successfully functioning outside of the court system. The State Court is seeking grants and other outside funding to sustain the program.

    RECOMMENDATION

    The Board of Commissioners consider information regarding the implementation of a Behavioral Health Court program.

    PURPOSE

    The Board of Commissioners recognize March 2015 as Women's History Month and the Cobb County NAACP's 13th year celebrating Women's History Month.

    BACKGROUND

    Womens History Month honors and celebrates the struggles and achievements of American women throughout the history of the United States. American women have struggled throughout our history to gain rights not simply for themselves but for many other under represented and disenfranchised groups in America.

    Womens History Month had its origins in 1981 when Congress passed Pub. L. 97-28 which authorized and requested the President to proclaim the week beginning March 7, 1982 as "Womens History Week". As requested by Congress, President Reagan issued Presidential Proclamation 4903 proclaiming the week beginning on March 7, 1982 as the first "Womens History Week" and recognizing the vital role of women in American history. President Reagan then issued Presidential Proclamation 5619 proclaiming March 1987 as "Womens History Month" and calling upon all Americans to mark the month with observances to honor the achievements of American women. In honor of Women's History Month, the NAACP of Cobb County has held luncheons for 13 years.

    PURPOSE

    To present certificates of recognition to Kahleel Shaw for being named an All Cobb County Scholar Athlete and to Kylil Carter for being selected as the Cobb County Touchdown Player of the Year.

    BACKGROUND

    High School athletic programs are a very important to the development of our future leaders. They open the door to new opportunities, promote school pride, motivate athletes towards positive outcomes--academically and socially, as well as, promote essential life skills. Cobb County has one of the most competitive leagues in the state and has a lot to be proud of. This year, South Cobb High School has the distinguished honor of being home to the county's Player of the Year, Kylil Carter. Kylil was also named Region 3AAAAAA Player of the Year and selected for the first-team all-state in class AAAAAA. In the fall Kylil will play for North Carolina A&T. Also of note for South Cobb High School's football team, Kahleel Shaw led his teammates with a very impressive GPA and will go onto continue his career at Davidson College.

    PURPOSE

    BACKGROUND

    On February 24, 2015, the Board of Commissioners authorized advertisement for and conduct of a public hearing for engineering design services for program management services. The Board also authorized issuance of a Request for Proposals to secure the engineering design services.

    The scope of work for this program management services contract will include program management assistance, pre-construction services, right-of-way services, and construction management services. Management services will also include limited general engineering services, major infrastructure projects that may develop over the term of the 2016 management contract, as necessary, and airport programs.

    Notice of Public Hearing was advertised in the Marietta Daily Journal on March 6, 13 and 20, 2015. This public hearing is being held in accordance with Georgia Laws 1991, Page 4492, as follows:

    "Before the Commission expends County funds of $100,000.00 or more to employ an independent consultant or consulting firm or to conduct an independent study or survey, it shall hold a public hearing thereon.     PURPOSE

    BACKGROUND

    On February 24, 2015, the Board of Commissioners authorized advertisement for and conduct of a public hearing for engineering design services for Windy Ridge Parkway Bridge Pedestrian Improvements. The Board also authorized issuance of a Request for Proposals to secure the engineering design services.

    The Windy Ridge Parkway Bridge Pedestrian Improvements project will consist of the addition of pedestrian accommodations on the bridge. These improvements will allow for a safe path to link pedestrians to parking scattered across the area in association with SunTrust Park.

    Notice of Public Hearing was advertised in the Marietta Daily Journal on March 6, 13, and 20, 2015. This public hearing is being held in accordance with Georgia Laws 1991, Page 4492, as follows:

    PURPOSE

    To conduct a public hearing for the transit-related Title VI Program and required transit policies for Cobb Community Transit.

    BACKGROUND

    Title VI of the 1964 Civil Rights Act and related statutes and regulations provide that no person in the United States shall, on the grounds of race, color, sex, national origin, disability, or age, be excluded from participation in, be denied the benefit of, or be subjected to discrimination under any program or activity receiving federal aid.

    Cobb Community Transit (CCT) is a recipient of Federal Transit Administration (FTA) funding assistance through an annual formula allocation, as well as through various discretionary and competitive funding programs. FTA requires that all direct and primary recipients document their compliance with the U.S. Department of Transportations transit-related Title VI regulations by submitting a Title VI Program once every three years, or as otherwise directed by FTA.

    As a condition of receiving federal aid, FTA requires local governments serving 200,000 or more persons to approve and implement a transit-related Title VI Program. Failure of a transit operator to comply may result in suspension or termination of federal aid, or refusal to grant or to continue federal aid.

    On December 6, 2011, the Board of Commissioners approved a Title VI Program that met the Federal Highway Administration (FHWA) requirements for Cobb County to receive FHWA funds. FTA has different Title VI Program requirements than FHWA; therefore, the County is required to adopt a separate transit-related Title VI Program in order to receive FTA funds.

  • On October 1, 2012, the FTA issued a new Federal Circular which contained revised guidance and instructions necessary to carry out Title VI regulations. In order to comply, the Board must adopt a resolution approving the transit-related Title VI Program, pursuant to its budgetary authority and responsibility, prior to submission to the FTA.

    On November 13, 2012, the Board adopted a resolution to approve the Title VI Program for CCT. The current Title VI Program on file with FTA is scheduled to expire on March 31, 2015; a new three-year draft update was submitted to FTA for preliminary review by the February 1, 2015 deadline.

    Recent changes made by the FTA require that the following policies be adopted by the Board of Commissioners and incorporated into the Countys transit-related Title VI Program: Public Participation Policy-Major Service or Fare Changes; Disproportionate Burden Policy; Transit Amenities Policy; Vehicle Assignment Policy; Disparate Impact Policy; and Systemwide Service Standard Policy.

    The FTA requirement to establish system-wide service standards and related policies is meant to ensure that service design and operational practices do not result in discrimination on the basis of race, color, sex, national origin, disability, or age. The Department is seeking public comment on the proposed Title VI Program and required policies prior to adoption by the Board and subsequent submission to the FTA.

    On January 27, 2015, the Board authorized advertisement for and conduct of a public hearing for the transit-related 2015 Title VI Program and required transit policies. Notice of Public Hearing was advertised in the Marietta Daily Journal on March 6, 13 and 20, 2015. The Department also sought public input on the proposed Title VI Program and required policies by posting the program on the CCT website on January 23, 2015 and presenting it to the Transit Advisory Board (TAB) on January 26, 2015.

    The Department will present an agenda item to the Board concurrent with this Public Hearing item requesting adoption of a resolution to approve the transit-related Title VI Program and required transit policies, providing no comments are received at this public hearing to be incorporated into the transit-related Title VI Program and/or required transit policies. Once approved, the transit-related Title VI Program and required transit policies will be submitted to the FTA.

    BACKGROUND

    On October 21, 2014, the Board of Commissioners approved Z-56 of 2014 for the purpose of townhouses located on the south side of Shallowford Road at Childers Road. A stipulation of the rezoning requires the developer, Brooks Chadwick, LLC, to contribute up to $150,000.00 for traffic improvements on Shallowford Road at Childers Road.

    The Department has identified the need for safety and operational improvements at the intersection of Shallowford Road at Childers Road, to include the addition of a right turn lane and/or a through lane on westbound Shallowford Road. Traffic signal modifications are also included.

    On June 10, 2014, the Board approved the 2014 Master Task Order Contracts. Kimley-Horn and Associates, Inc., was approved for Highway Design: Roadway, Bridge & Surveying.

    On March 10, 2015, the Board approved a Memorandum of Agreement with Brooks Chadwick, LLC, and authorized the appropriation of the developer contribution for intersection improvements on Shallowford Road at Childers Road.

    BACKGROUND

    Cumberland Boulevard Traffic Signal Upgrades is a traffic signal project located within the Cumberland Community Improvement District (CCID).

    On May 27, 2014, the Board of Commissioners approved a Cobb Framework Agreement (CFA) with the CCID for this project. Under the terms of the CFA, the CCID will fund 100 percent of the project costs. The Department will provide engineering and design oversight, bidding administration and construction oversight of the project.

    This project consists of replacing seven existing traffic signals with decorative mast arm systems, installing seven Uninterruptable Power Supplies (UPS), and installing seven IP Dome Closed Circuit Television (CCTV) cameras at signalized intersections on Cumberland Boulevard and Akers Mill Road.

    The Invitation to Bid was advertised in the Marietta Daily Journal on November 21 and 28, 2014, and on December 5 and 12, 2014. Bids were received on December 18, 2015, from the following companies:

    Details for action requested are as follows:

    In addition to the approval of this contract, Change Order No. 1 to the contract with Brooks, Berry, Haynie & Associates, Inc., in the deductive amount of $375,545.11, is requested to remove two signal locations and associated costs from the project. Project bid amounts exceeded the original CCID project budget of $1,000,000.00; therefore, it is necessary to reduce the scope of this contract.     PURPOSE

    To adopt a resolution authorizing the submission of PLAN 2040 Transportation Improvement Program applications to the Atlanta Regional Commission requesting federal funding for South Barrett Parkway Reliever, Phase 3, ARC Project No. CO-450B, Windy Hill Boulevard, Transit Supportive Sidewalks, new Cobb Community Transit buses, and Cobb County Bicycle and Pedestrian Improvement Plan Update.

    BACKGROUND

    On January 21, 2015, the Atlanta Regional Commission (ARC) released a call for applications for federal funding of projects under the Surface Transportation Program Urban (STP-Urban) and Transportation Alternatives Program (TAP) for FY 2016 through FY 2019. Applications are due by April 6, 2015. Applicants are required to provide resolutions from the local government body in support of the applications, stating commitment to provide matching funds of at least 20 percent of the total cost for each awarded project.

    The focus areas for the solicitation relevant to the County are new infrastructure projects or initiatives that support PLAN 2040 and transportation planning or project feasibility studies.

    The Department recommends submitting applications for consideration to fund four new infrastructure projects and one transportation study. New infrastructure projects include: construction of South Barrett Parkway Reliever, Phase 3, ARC Project No. CO-450B; preliminary engineering of Windy Hill Boulevard (2016 SPLOST project); preliminary engineering and construction of Transit Supportive Sidewalks for segments of US 41/SR 3/Cobb Parkway and SR 139/Mableton Parkway; and procurement of new Cobb Community Transit (CCT) buses. The transportation study is for the Cobb County Bicycle and Pedestrian Improvement Plan Update. Projects located within the city limits of Marietta will require obtaining land disturbance permits from Marietta.

  • Upon notification from ARC of federal funds awarded to the County for any of the requested projects, the Department will present agenda items to the Board requesting approval of separate subgrant agreements for each specific project. A detailed project description and budget, outlining all applicable federal, state, and local funding sources to be used for the project, will accompany each subgrant agreement.

  • A RESOLUTION OF THE COBB COUNTY BOARD OF COMMISSIONERS SUPPORTING THE

    FILING OF SURFACE TRANSPORTATION PROGRAM-URBAN AND TRANSPORTATION

    ALTERNATIVES PROGRAM FEDERAL FUNDING GRANT APPLICATIONS TO THE

    ATLANTA REGIONAL COMMISSION

    WHEREAS, the Atlanta Regional Commission (ARC) is the federally designated Metropolitan

    Planning Organization for the Atlanta Region that includes Cobb County and is responsible for

    developing a multi-modal, financially constrained transportation plan that meets all federal

    transportation and Clean Air Act planning requirements;

    WHEREAS, the Atlanta Regional Commission (ARC) has issued a call for applications for funding to

    projects under the Surface Transportation Program Urban and Transportation Alternatives Program for FY 2016 through FY 2019; and

    WHEREAS, the focus areas for the solicitation relevant to the County are: new infrastructure projects

    or initiatives; and transportation planning or project feasibility studies; and

    WHEREAS, the County desires to submit applications for consideration to fund the following new

    infrastructure projects: South Barrett Parkway Reliever Phase 3 (ARC Project Number: CO-450B),

    Windy Hill Boulevard, Transit Supportive Sidewalks for Cobb Parkway and Mableton Parkway, and

    to purchase CCT buses; and the following transportation study: Cobb County Bicycle and Pedestrian

    Improvement Plan Update; and

    WHEREAS, Cobb County Department of Transportation has prepared the applications and will

    execute the projects, if awarded; and

    WHEREAS, the grant agreements for federal financial assistance, if awarded, will impose certain

    obligations upon the County, requires the County to provide a minimum 20 percent local share of the

    cost of the projects, and provide all necessary certifications and assurances to the ARC as required for

    the projects; and

    WHEREAS, the ARCs 2015 PLAN 2040 TIP solicitation application requires applicants to provide resolutions from the local government body in support of the applications and to commit matching

    funds.

    NOW THEREFORE, BE IT RESOLVED that the Cobb County Board of Commissioners will

    provide the required twenty (20) percent match for each of the aforementioned projects should the

    ARC award grant funds to the County; and

    NOW THEREFORE, BE IT FURTHER RESOLVED that the Cobb County Board of

    Commissioners authorizes the filing of grant applications to the ARC to fund the aforementioned list

    of projects; and:

    1) The Cobb County Board of Commissioners is aware that the ARC may choose to award an amount for any of the aforementioned projects that is less than the maximum award allowed,

    for which the County has applied.

    2) That the Chairman of the Cobb County Board of Commissioners or his designee is authorized to execute and file applications for the aforementioned projects for federal assistance on behalf

    of Cobb County with the Atlanta Regional Commission.

    3) That the Chairman of the Cobb County Board of Commissioners is authorized to execute and file the necessary certifications, assurances and other documents the ARC may require before

    PURPOSE

    To authorize procurement of 28 personal computers for Cobb Community Transit to replace outdated hardware and software.

    BACKGROUND

    Cobb Community Transit (CCT) currently provides computers and other office related equipment required for staff to access county printers, applications and assets. Up to date computer hardware and software are essential tools used by CCT staff and our contracted service provider staff, Transdev Inc., for daily transit operations, management and customer service. This procurement will replace outdated equipment, originally purchased in 2011 and no longer under warranty, and will also provide additional equipment to cover new personnel needs in the service delivery, tracking, safety and security of CCT operations.

    On June 12, 2012, the Board of Commissioners adopted a resolution authorizing the submission of an amended Fiscal Year 2012 Section 5307 Grant application (Grant No. GA-90-X312) to the Federal Transit Administration (FTA) for transit capital, planning and operating projects. The project list included funding for computer hardware and software needs.

    The Georgia Department of Administrative Services currently has in place an Open Agency Contract from Dell Marketing, L.P. (Dell). The Department has coordinated personal computer needs with the Information Services Department, and has obtained a quote from Dell of $976.29 per computer.

  • The total cost of this procurement is estimated at $27,336.12. Funding for 80 percent of the total cost, or $21,868.89, is available in existing FTA Grant No. GA-90-X312. The required 20 percent local match, or $5,467.22, is available in the approved Transit Capital Budget.

    The Department recommends procurement of 28 personal computers, utilizing the Georgia Department of Administrative Services Open Agency Contract with Dell, to enhance current/future security, video streaming, bus tracking operations, and management applications.

    PURPOSE

    To approve Project No. 4826-TO#01 to the 2014 Master Task Order Contract with Kimley-Horn and Associates, Inc., for engineering design services for renovation of the Cobb Community Transit Bus Fueling Station and Bus Wash Facility, MIS Contract No. 000812.

    BACKGROUND

    In 2002, the Cobb Community Transit (CCT) bus fueling station and bus wash facility were constructed at the CCT Maintenance Facility on Commerce Park Drive. Outdated technology has become an ongoing maintenance issue at these facilities, creating environmental, safety, and security hazards.

    The CCT Maintenance Facility renovation project will require design services to determine renovation requirements of the existing bus fueling station and bus wash facility to resolve current safety, security, and environmental concerns.

    On June 24, 2014, the Board of Commissioners approved the 2014 Master Task Order Contracts. Kimley-Horn and Associates, Inc., was approved for Transit services.

    On February 10, 2015, the Board authorized the advertisement for and conduct of a public hearing to secure engineering design services for renovation of the CCT Maintenance Facility, prior to expending more than $100,000.00 for these services. The public hearing was held on March 10, 2015.

  • The CCT Maintenance Facility renovations will be accomplished in two phases. Phase 1 will consist of completing engineering design services for programming and preliminary plans, and will also include services to achieve an approved environmental document. Phase 2 will consist of engineering design services for final construction plans, specifications, and documents. Phase 2 will also include services for assistance with development of bid documents for construction of the bus fueling station and bus wash facility. Upon satisfactory progress or completion of Phase 1, the Department will present an agenda item to the Board requesting authorization to proceed with Phase 2.

    Estimated costs for construction of the CCT Maintenance Facility renovation project is $5,000,000.00. Funding for 80 percent of the estimated total costs, or $4,000,000.00, is available in existing Federal Transit Administration (FTA) grants. The required 20 percent local match, or $1,000,000.00, is available in the approved Transit Capital Projects Fund Budget.

    Project No. 4826-TO#01 to the 2014 Master Task Order Contract with Kimley-Horn and Associates, Inc., in an amount not to exceed $232,035.70, is requested for design services for the renovation of the CCT Bus Fueling Station and Bus Wash Facility. Federal funding for 80 percent of the total cost, or $185,628.56, is available in existing FTA grants. The required 20 percent local match, or $46,407.14, is available in the approved Transit Capital Projects Fund Budget.

    PURPOSE

    To adopt a resolution to approve the transit-related Title VI Program and required transit policies for Cobb Community Transit.

    BACKGROUND

    Title VI of the 1964 Civil Rights Act and related statutes and regulations provide that no person in the United States shall, on the grounds of race, color, sex, national origin, disability, or age, be excluded from participation in, be denied the benefit of, or be subjected to discrimination under any program or activity receiving federal aid.

    Cobb Community Transit (CCT) is a recipient of Federal Transit Administration (FTA) federal aid through an annual formula allocation, as well as through various discretionary and competitive funding programs. FTA requires that all direct and primary recipients document their compliance with the U.S. Department of Transportations transit-related Title VI regulations by submitting a Title VI Program once every three years, or as otherwise directed by FTA.

    As a condition of receiving federal aid, FTA requires local governments serving 200,000 or more persons to approve and implement a transit-related Title VI Program. Failure of a transit operator to comply may result in suspension or termination of federal aid, or refusal to grant or to continue federal aid.

    On December 6, 2011, the Board of Commissioners approved a Title VI Program that met the Federal Highway Administration (FHWA) requirements for Cobb County to receive FHWA funds. FTA has different Title VI Program requirements than FHWA; therefore, the County is required to adopt a separate transit-related Title VI Program in order to receive FTA funds.

  • On October 1, 2012, FTA issued a new Federal Circular which contained revised guidance and instructions necessary to carry out Title VI regulations. In order to comply, the Board must adopt a resolution approving the transit-related Title VI Program, pursuant to its budgetary authority and responsibility, prior to submission to FTA.

    On November 13, 2012, the Board adopted a resolution to approve the Title VI Program for CCT. The current Title VI Program on file with FTA is scheduled to expire on March 31, 2015; a new three-year draft update was submitted to FTA for preliminary review by the February 1, 2015 deadline.

    Recent changes made by the FTA require specific policies be adopted by the Board and incorporated into the County's transit-related Title VI Program. As part of this Title VI Program update, the Department requests the Board also approve the following required transit policies: Public Participation Policy-Major Service or Fare Changes; Disproportionate Burden Policy; Transit Amenities Policy; Vehicle Assignment Policy; Disparate Impact Policy; and Systemwide Service Standard Policy.

    Notice of Public Hearing was advertised in the Marietta Daily Journal on March 6, 13 and 20, 2015. The public hearing was held on March 24, 2015, concurrent with this agenda item. The Department also sought public input on the proposed Title VI Program and required policies by posting the program on the CCT website on January 23, 2015, and presenting it to the Transit Advisory Board on January 26, 2015.

    The transit-related Title VI Program and required transit policies have been reviewed by the County Attorneys Office.
