AUSTRALIA DAY HONOURS FOR FORMER ASSOCIATION PRESIDENT

Former Aerosol Association of Australia President, Lindsay Showyin, has had his contribution to the aerosol industry recognised in the 2014 Australia Day Honours, receiving an Order of Australia Medal (OAM) for his services to the manufacturing industry and to professional associations.

Before stepping down late last year, Mr Showyin had served as the Association’s President for nearly 30 years, overseeing a number of important Association and industry initiatives, including the shift from CFC propellants, the acceptance of post-consumer aerosols in kerbside recycling, the Association’s award-winning series of television, print and radio commercials in the 1980s and 1990s, and in recent years its pro-active engagement with aerosol associations throughout the Asian region.

Speaking on the Award, Mr Showyin said he was honoured and humbled to receive such recognition.

“It is also encouraging recognition of the contribution which the local aerosol industry makes to the Australian economy and of the role of industry associations, especially in areas such as safety and standards”, said Mr Showyin.

Mr Showyin remains actively committed to the aerosol industry and as well as remaining on the Association’s Executive, heis President of the Asian Aerosol Federation.

ACCC SURVEY ON RECALLS

The ACCC administers the product safety recall provisions of the Australian Consumer Law and is currently seeking the views of suppliers who have recalled goods to identify potential improvements to ACCC Recalls publications and the online recall notification and reporting tools for suppliers. The online survey closes on 1 March and you can participate in it atwww.consultation.accc.gov.au/ product-safety/recalls-survey/ consultation/.

The Australian Packaging Covenant has resolved to make its Design Smart Material Guides available for everyone, not just Covenant signatories.

The Guides provide a ‘checklist’ of sustainability considerations to keep in mind when designing and/or specifying packaging based on particular materials, and cover fibre packaging, rigid plastic packaging, flexible plastic packaging, aluminium containers, steel containers, glass containers,

composite packaging formats, degradable plastics packaging and packaging components/closures/ labels.

Following the presentation by Association Executive Director Philip Fleming to the half-yearly meeting of the Competent Authorities Panel (CAP) in Perth in late 2013, the Association was formally approached by the Panel for its opinion on the optimal approaches to regulate plastic aerosols.

After considering the issue thoroughly, the Association’s Technical & Regulatory Working Group supported a solution based on BS5597 to fill the ‘policy vacuum’ iidentified by the Panel.

At the same time the Association noted its support for the principal of global harmonisation and opposition to the prospect of “Australia only” requirements.

Accordingly, it expressed its concern to ensure that the requirements for plastic aerosols are consistent with those of our major trading partners.

WEIGHT MARKINGSMembers of the European

Parliament and Member States’ representatives reached a deal on the F-gases Regulation at the 4th trilogue meeting in late 2013.

The deal must now be rubber- stamped by the European Parliament and the Council.

Under the proposed F-Gas Regulation, HFCs will be ‘capped' at their existing level in 2015 and gradually phased down. HFCs will then be progressively reduced by 79% in 2030. The phase-down will start on 1 January 2016 (-7%), then comes down again on 1 January 2018 (-37%).

Technical aerosols* that contain HFCs with GWP of 150 or more, except when required to meet national safety standards or when used for medical applications, will be prohibited to be placed on the EU market from 1 January 2018.

Labelling requirements will also apply to aerosol cans that contain fluorinated greenhouse gases, with the exception of metered dose inhalers for the delivery of pharmaceutical ingredients.

No transition period has been granted for aerosols.

The Regulation will enter into force on 1 January 2015.

* Note: under the proposed new controls ‘technical aerosol’ means “an aerosol dispenser used in maintenance, repair, cleaning, testing, disinsecting, manufacturing, installation and other applications where a non-flammable formulation is required”.

1. HFCS – UPDATE [REVISED F-GASES REGULATION]

2. CLARIFICATION RE COLOURS & DIMENSIONS OF HAZARD PICTOGRAMS In response to requests for more information from Members, the FEA points out that colours and dimensions of the hazard pictogram(s) required under the new EU CLP legislation can be found in the ECHA Guidance on CLP labelling (the complete title is ECHA Guidance on labelling and packaging in accordance with Regulation (EC) 1272/2008).

Information on dimensions can be found in § 4.3 ‘Hazard pictograms’ and more specifically in § 5.2 ‘Size of the label and of the label elements’. [See also § 6 ‘Example Labels’.]

Hazard pictograms shall be in the shape of a square set at a point and must have a black symbol on a white background with a red border. The exact type of red, i.e. the Pantone colour number, is not defined.

Each hazard pictogram shall cover at least one fifteenth of the minimum surface area of the label dedicated to the information required by CLP Article 17, but the minimum area shall not be less than 1 cm².

[Note: The size of the pictogram relates here to the dimensions of the pictogram itself, and not to the size of the virtual square which the pictogram is in.]

Please note that aerosol products which are excluded from the CLP Regulation (medicinal products, veterinary medicinal products, cosmetic products, medical devices and food or feeding stuffs) only need to follow the provisions of the Aerosol Dispensers Directive and hence are not obliged to follow all dimensions provisions of the CLP.

However, it is advised to respect the minimum dimension of the hazard pictogram laid down in the CLP, i.e. the minimum area, shall not be less than 1 cm² (as shown in CLP Annex I, Table 2.3.1).Also note that aerosol products which are excluded from the CLP Regulation need to respect the colour code and shape of the hazard statement (as shown in CLP Annex I, Table 2.3.1).

Please note that aerosol products which are excluded from the CLP Regulation do not need to respect these provisions.

Further to the story in our December 2013 newsletter, the Association recently made a formal submission to the National Merriment Institute to help inform Australia’s position on the latest revised draft of the OIML publication ‘R79 – Labelling requirements for pre-packaged products’.

In line with submissions from the FMCG and cosmetics sectors, the Association argued for increased flexibility in weight/volume markings, supporting the provision in the draft for aerosols to be marked by weight and/or volume. And from the US comes news that the National Institute of Standards and Technology (NIST) has resolved that products utilizing bag-on-valve (BOV) technology shall declare their volume in weight, the same as ‘traditional’ aerosols (although BOV containers labelled as volume will probably have a sell-through period of three years).
