BACKGROUND: United Way of Olmsted County (UWOC) is an important organization in the community, providing assistance to the community and residents through grants and direct service since 1972. A substantial and important part of funding the UWOC is through its employer annual campaign. Olmsted County has participated in the Olmsted County United Way annual campaign since 2011, raising sustainable funds from County employees. United Way Campaign Co-Chairs, Brittney Marschall and John Helmers, respectfully request that the Olmsted County Board officially kick off the 2017 United Way Campaign for County personnel. Resolution No. 17-39 WHEREAS, The Minnesota Department of Transportation, MnDOT, wishes to

cooperate closely with local units of government to coordinate the delivery of transportation services and maximize the efficient delivery of such services at all levels of government; and

WHEREAS, MnDOT and Olmsted County are authorized by Minnesota Statutes

sections 471.59, 174.02, and 161.20 to undertake collaborative efforts for the design, construction, maintenance, and operation of state and local roads; and

WHEREAS, the parties wish to be able to respond quickly and efficiently to such

opportunities for collaboration, and have determined that by having the ability to write “work orders” against a master contract would provide the greatest speed and flexibility in responding to identified needs.

NOW THEREFORE BE IT RESOLVED, the County of Olmsted enter into Master

Partnership Contract No. 1028517 with MnDOT. That the County Board Chairperson and Administrator are authorized to execute such contract and any amendments thereto. That the County Engineer/Assistant County Engineer are authorized to negotiate and execute work order contracts on behalf of the County of Olmsted, pursuant to the Master Contract without further approval by this board. The work order contracts may provide for payment to or from MnDOT.

Resolution No. 17-40 Amendment to the Olmsted County Land Use Plan Map O2017-001LUPA

WHEREAS, a public hearing was duly held on May 16, 2017 in the Commissioners

Board Room, Olmsted County Government Center, 151 Fourth Street Southeast, Rochester, Minnesota, and the Olmsted County Board of Commissioners having heard and duly recorded and received all evidence, and being duly advised in the premises, and

WHEREAS, the original request to approve this Land Use Plan Amendment sought

to reclassify the subject property in the County’s Land Use Plan from Resource Protection to Resource Protection - Potential Suburban to make it consistent with Rochester Township’s Land Use Plan; and,

WHEREAS, the Olmsted County Future Land Use Plan recommends an amount of

land equivalent to three times the projected land area needed for suburban-style development to be mapped as Resource Protection - Potential Suburban to insure a sufficient, but not excessive, amount of land remains available at any given time for large lot suburban style developments outside the Rochester city limits, and the Resource Protection - Potential Suburban area was mapped through the 2011 Land Use Plan Update ; and,

WHEREAS, when this Land Use Plan Amendment application was received, the

Planning Department staff suggested in order to avoid increasing the amount of potential land suitable for suburban development beyond the amount of land mapped as Resource Protection - Potential Suburban, that areas designated as Resource Protection - Potential Suburban in Rochester Township to the north and west of the subject property in the North Half and SW ¼ of Section 19 and in the NW ¼ of Section 30, Township 106 North, Range 14 West could be reclassified from Resource Protection - Potential Suburban to Resource Protection, and these areas are also depicted in the diagram included on Page 45 of the County Board meeting packet for the May 16, 2017 meeting; and,

WHEREAS, the intent of the Planning Department staff in proposing this change was

to keep the amount of potential suburban development land in the County at roughly the same amount of acreage as the amount which existed prior to the submission of this proposed Land Use Plan Amendment, and

WHEREAS, the County Planning Advisory Commission and the County Board supported the original request to reclassify the subject property, but did not support the staff’s recommendation to initiate an application to reclassify the areas designated as Resource Protection - Potential Suburban in Rochester Township to the north and west of the subject property in the North Half and SW ¼ of Section 19 and in the NW ¼ of Section 30, Township 106 North, Range 14 West from Resource Protection - Potential Suburban to Resource Protection if the land use plan amendment for the subject property was approved, and

NOW, THEREFORE, BE IT AND IT IS HEREBY ORDAINED that the Olmsted

County Board of Commissioners does hereby approve the request to redesignate the property in Olmsted County described as

NE ¼ NE ¼ and the North half of the SW ¼ of the NE ¼, Section 30, Township 106 North, Range 14 West, Olmsted County, Minnesota.

the adoption of findings as approved by the Olmsted County Board of Commissioners:

1. Was a mistake made in the data used or in the application of the data at the time

the Plan was adopted? No mistake was made in the data used or in the application of the data at the time the Plan was adopted. The site was designated as Resource Protection in the plan based on CLUES data. Designation of land through the CLUES model, in some instances, resulted in designation of land that followed natural features and not property lines. This change to the land use designation would be consistent with a similar land use plan amendment in 2016, where Rochester Township amended its land use plan map to designate this site as Potential Residential Development from Agricultural Development.

2. Have conditions of land use, land subdivision, ownership, or growth in the community changed the character of the site and surrounding area? Land use conditions in the immediate area or County at large have not changed the character of the site and surrounding area since the 2011 Plan was adopted. National and economic conditions slowed development rates in recent years, though that situation was in play in 2011. The upturn in the economy, however, as well as Mayo Clinic's "Destination Medical Center" plan will likely jump start future economic development in the County.

3. Have policies related to the proposal changed since the Plan was adopted? Rochester Township amended its Land Use Plan in 2016 to re-designate this site, which was re- designated from Agricultural to Potential Residential Development. Policies regarding Potential Suburban Development lands within the Olmsted County Land Use Plan have not changed since the 2011 Plan update.

4. Is there an unanticipated shortage of land available for the proposed use? There is not an unanticipated shortage of Resource Protection - Potential Suburban land. There is also not an unanticipated shortage of Suburban Development land. When the 2011 Olmsted County Future Land Use Plan Map was adopted, 8,500 acres were designated for "Potential Suburban" use. This is approximately three times as much land as

population and employment projections suggest are needed for this land use, even in light of additional population anticipated by Mayo Clinic's Destination Medical Center project. No suburban subdivisions have been developed on lands initially designated as Resource Protection - Potential Suburban.

5. Is the land under consideration as suited or better suited for the proposed use than other lands now designated for the proposed use, and are those lands now properly designated according to the land use policies? (This analysis will be based on the Comprehensive Land Use Evaluation System model.) There are approximately 8,500 acres of land currently designated for Potential Suburban Development. The CLUES scores in those areas range from 0-133. This site has scores generally ranging from 141 to 157. These scores identify the site as less-suited for Potential Suburban designation than those areas already designated for Potential Suburban.

The CLUES model score for this site may have been lowered by an existing pit near the southern boundary of the site that may be a former mining operation that is no longer in use. The presence of this pit resulted in this area being considered an “incompatible land use” that was captured by the Suburban Development Score analysis. This feature lowered the Suburban Development Score of the site and likewise affected the composite CLUES score. This feature will need additional study as additional steps are taken toward development of the site. If not for this site feature, the

site would likely have a relatively high Suburban Development Score, which measures the general desirability for land to be developed with suburban development.

6. Is the proposed amendment consistent with the policies of the Plan? Within

the Within the Olmsted County Land Use Plan, land is designated primarily using

the CLUES model score. If designated to Resource Protection - Potential Suburban

Development, this would be the only land south of 40th Street SW in Rochester

Township with the designation. However, the CLUES score of the site is consistent

with the range of CLUES scores of land within the Suburban Development designation

on the north side of 40th Street SW. The property owner cannot apply for a land use

policy amendment to Suburban Development until the designation of the site is

changed to Resource Protection - Potential Suburban.

7. Is there an alternative to the proposed change that better meets the intent of the Plan (a different use designation or a smaller land area, for example)? The designation of the site to Resource Protection - Potential Suburban Development is consistent with the policy for Potential Suburban designation within the plan. Although the land use plan generally intends to cap the amount of land in Resource Protection - Potential Suburban designation at about 8,500 acres, the overall amount of Potential Suburban area will remain approximately the same because the site is a relatively small portion of a larger property. Additionally, approval of the land use amendment request would align the Olmsted County Land Use designation for the site with that of Rochester Township. State statutes do not require consistency between land use plan maps between a county and a township, but consistency optimizes cooperation and efficiency in their implementation.

However, the Board’s approval of the request to reclassify the subject property does not include the Planning Department’s staff recommendation to initiate an application to reclassify areas designated as Resource Protection - Potential Suburban in Rochester Township to the north and west of the subject parcel in the North Half and SW ¼ of Section 19 and in the NW ¼ of Section 30, Township 106 North, Range 14 West from Resource Protection - Potential Suburban back to Resource Protection if the original land use plan amendment for the subject property was approved.

BACKGROUND: The Minnesota Legislature established Children’s Mental Health Collaboratives and Family Services Collaboratives in 1993 as innovative approaches to address the needs of children and youth who face complex problems involving them and their families with multiple service systems. The Olmsted County BRIDGE (Building Resilience in Development, Growth and Education) Collaborative is one of 90 Children’s Mental Health and Family Services Collaboratives currently in Minnesota. Collaboratives are beneficial in improving communication and coordination between providers county-wide, providing the ability to generate funding through the Local Collaborative Time Study (LCTS), and providing the ability to fund additional programming for children and families in Olmsted County. The Olmsted County BRIDGE Collaborative’s goal is to establish an integrated children’s service system working toward coordinating services to children, adolescents and families that are high quality, efficient, and that remove barriers, encourage parent participation and promote community awareness of needs. The Collaborative members are Olmsted County Community Services and Public Health, Dodge-Fillmore-Olmsted (DFO) Community Corrections, Families First Minnesota, Three Rivers Community Action Program, Fernbrook Family Center and the following school districts: Rochester, Byron, Pine Island, Stewartville and Dover-Eyota. Olmsted County is contracting, as the fiscal host, on behalf of the BRIDGE Collaborative with Rochester Public Schools, Independent School District (ISD) #535, for $25,000 for evaluation and staff development related to the Trauma-Informed School work at Gage Elementary. Studies have shown that exposure to trauma and secondary trauma affects academic success. By utilizing a trauma-informed approach, organizations and their staff are able to recognize the widespread impact of trauma and understand potential paths for recovery; recognize the signs and symptoms of trauma; respond by fully integrating knowledge about trauma into policies,

This is a one-time request and the funds used are BRIDGE Collaborative dollars, there is no fiscal impact to Olmsted County.

BACKGROUND: This is a request to amend the City/County Park and Ride agreement for use of Graham Park to accommodate bus parking for Civic Center events, subject to availability. The City currently leases 368 parking spaces at Graham Park from the County for weekday park and ride at a rate of $17 per subscriber per month. The park and ride is serviced by Rochester Public Transit (RPT). The lease provides for exceptions of use to accommodate the annual week long Olmsted County Fair and two annual Goldrush events that take place on Friday through Sunday. The park and ride lease runs through June 30, 2019. With the recent addition to the Convention and Visitors Bureau, the City is in need of weekday bus parking for Civic Center events and has requested an amendment to the Park and Ride lease to allow this use. The proposed parking area for buses is on Lot C (the midway area). This is an area of the park that is vacant most of the time and, therefore, could easily accommodate bus parking on a daily basis. Under the amendment, the County would be paid $10 per bus per day. The payment would be processed through the monthly invoicing for park and ride. The use of the lot for bus parking would be subject to approval by Olmsted County on an event by event basis.

COUNTY BOARD ACTION REQUESTED: Adopt the prepared 2017 Agreement for Park and Ride Lot at Graham Park between the City and Olmsted County dated April 3, 2017 to allow for the parking of buses in Lot C (midway area) at a rate of $10 per bus per day subject to availability as determined by Olmsted County. The City will deliver 2 signed copies of agreement to Olmsted County after the July 5, 2017 council meeting.

2017 AMENDED AGREEMENT FOR PARK AND RIDE LOTS AND BUS PARKING LOT AT GRAHAM PARK

CITY OF ROCHESTER/ OLMSTED COUNTY

THIS AMENDED AGREEMENT is made and entered into this ____ of July, 2017 by and between the CITY OF ROCHESTER, a Minnesota municipal corporation (hereinafter, the "City"), and Olmsted County, a political subdivision of the State of Minnesota (hereinafter, the "Owner").

WITNESSETH

WHEREAS, the City and the Owner have determined that it is in the public interest to provide additional parking for downtown Rochester employees in outlying parking lots in the community served by Rochester Public Transit; and

WHEREAS, the City and the Owner entered into an agreement in June, 2015 and later amended to provide 230 parking spaces at Graham Park (the Olmsted County Fairgrounds) to serve Rochester area employees which are then offered bus transportation to downtown and other locations by Rochester Public Transit (RPT); and

WHEREAS, such agreement ends on June 30, 2017 and the City and the Owner have determined to renew this agreement and increase the number of parking spaces provided effective July 1, 2017 through June 30, 2019.

NOW, THEREFORE, IT IS AGREED AS FOLLOWS:

1. The Owner shall provide to the City up to 368 parking spaces in Parking Lots A and Bat the Olmsted County Fairgrounds in Rochester, MN as shown on Exhibit A.

The Owner shall also provide to the City space for the parking of buses for various civic events in Lot C on the Midway Area at Graham Park where amusement park rides are placed during the Olmsted County Fair , as shown on Exhibit A. This may only occur when Owner has not previously committed to making that space available to other users for other events. The City must submit requests to use the space for this purpose in writing to the Owner not less than 7 days in advance of an event.

2. Park and Ride spaces shall be available for subscribers Monday through Friday, 5:00a.m. until 10:00 p.m. with the following exceptions;

Olmsted County Fair week Monday through Friday July 24- 30, 2017 and July 23-29, 2018.

The Friday before Gold Rush including August 18, 2017 and May 11 and August 17, 2018 and May 10, 2019.

3. The City shall provide public transit service by Rochester Public Transit to and fromthe park and ride location and downtown and St Marys Hospital.

4. The Owner shall maintain and repair park and ride spaces, including crack filling,sealing and striping. Such activities shall be carried on outside operating hours asdefined in Paragraph 2. The Owner shall provide for snow removal and clearing ofaccess roads through the Fairgrounds to allow access to the lot at the times as definedin Paragraph 2. The City shall arrange for snow removal and sanding of the lots. TheOwner shall provide for appropriate lighting during non-daylight hours.

5. The City shall provide the following improvements to the park and ride lots;

Installation of park and ride signage.

Installation of bus stop areas including concrete pad and passenger shelters. The locations must be approved by the Owner. The City shall retain ownership of the passenger shelters and remove such shelters within 90 days upon termination of this agreement.

The City shall also be responsible during the lease term for compliance with the Americans with Disabilities Act of 1990, 42 U.S.C. §§ 12101 through 12213, 47 U.S.C. §§ 225, 611, with regulations at 29 C.F.R. § 1630, as it pertains to use of the Park and Ride Lot by its subscribers.

6. The City agrees to pay the Owner the amount of $17.00 per subscriber parking spacein Lots A and B per calendar month beginning with the month of July, 2017. The Cityalso agrees to pay the Owner $10.00 per bus per day for each day a bus is parked inLot C. Payment shall be made within 30 days of the end of each month. The amountshall be prorated based on number of working days available to account for days thelot is not available as noted in paragraph 2. (For example in July, 2017 the lot isavailable 16 of 21 work days. Therefore the amount is calculated $17.00 x number ofspaces times 21 days x 76%. However, the proration shall not apply to the paymentsfor bus parking on Lot C.

7. This Agreement begins July 1, 2017, and terminates with 120 days written notice byeither party. Unless terminated this agreement shall run through June 30, 2019.

8. The City shall provide passes for those individuals authorized to park in park and ridespaces.

9. The City and Owner specifically disclaim any responsibility against any loss or damageto any vehicle using the park and ride spaces or the bus parking spaces. The Cityshall indemnify the Owner from all liability and responsibility for worker's compensationclaims concerning any city employee engaged in the performance of this Agreement.The Owner shall not be liable for any damages or injury to city employees, volunteers,or those persons participating in the park and ride program or bus parking program.The City shall name the Owner as an additional insured on the City's insurance policy

only with respect to the park and ride program and the bus parking program.

10. For purposes of this Contract all data created, collected, received, stored, used,maintained, or disseminated by either party in the performance of this Contract issubject to the requirements of the Minnesota Government Data Practices Act,Minn. Stat. Chapter 13 and the Minnesota Rules implementing the Act now in force orhereafter adopted.

11. Both parties shall keep such business records pursuant to this Agreement as wouldbe kept by a Minnesota local governmental entity. Both parties shall maintain suchrecords for at least 6 years from the date services or payment were last provided ormade or longer if any audit in progress requires a longer retention period. Allaccounting records shall be kept in accordance with generally accepted accountingpractices. Each party shall have the right to audit and review all such documentsand records at any time during the other party’s regular business hours or uponreasonable notice. These records are subject to examination, duplication, transcriptionand audit by either party and either the Legislative or State Auditor of the State ofMinnesota pursuant to Minnesota Statute § 16C.05, subd 5. Such evidences are alsosubject to review by the Comptroller General of the United States, or a duly authorizedrepresentative, if federal funds are used for any work under this Contract.

12. Neither party shall enter into any subcontract for performance of any of the servicescontemplated under this contract, nor assign or transfer its interest in this agreementwithout the prior written consent of the other party and subject to such conditions andprovisions as the other party may deem necessary. If the other party approves asubcontract or an assignment, the assigning party shall be responsible for theperformance of all subcontractors and assignees and the provisions of this agreementshall be binding upon and shall inure to the benefit of the parties hereto, and theirrespective successors and assigns.

13. Neither party shall be held responsible for delay or failure to perform caused by fire,flood, epidemic, strikes, riot, acts of God, unusually severe weather, terrorism, war,acts of public authorities other than the parties or delays or defaults caused by publiccarriers which was beyond a party’s reasonable control, provided the defaulting partygives notice as soon as possible to the other party of the inability to perform.

14. This agreement shall be subject to, governed by, and construed and interpreted solelyaccording to the laws of the State of Minnesota. The parties hereby consent and submitto the jurisdiction of the appropriate courts of Minnesota or of the United States havingjurisdiction in Minnesota for adjudication of any suit or cause of action arising under orin connection with the contract documents, or the performance of such contract, andagrees that any such suit or cause of action may be brought in any such court.

15. particular term or provision held to be invalid.

16. The failure of the City or Owner to enforce any provisions of this Agreement shall notconstitute a waiver by the City or Owner of that or any other provision.

17. The parties agree that if any term or provision of this Agreement is declared by a courtof competent jurisdiction to be illegal or in conflict with any law, the validity of theremaining terms and provisions shall not be affected, and the rights and obligations ofthe parties shall be construed and enforced as if the Agreement did not contain theparticular term or provision held to be invalid.

18. This Agreement constitutes the final expression of the parties' agreement, and thecomplete and exclusive statement of the terms agreed upon. This Agreementsupersedes all prior negotiations, understanding, agreements, and representations.There are no oral or written understandings, agreements or representations notspecified herein. Furthermore, no waiver, consent, modification, or change of terms ofthis Agreement shall bind either party unless in writing and signed by both parties.Such waiver, consent, modification, or change shall be effective only in the specificinstance and for the specific purpose given.

19. The City representative is the Transit and Parking Manager located at 4300 East RiverRoad NE, Rochester, MN 55906, Telephone (507) 328-2424. The Owner'srepresentative is the Olmsted County Graham Site Manager, 1407 3rd Ave. SE,Rochester, MN 55904, Telephone (507) 328-7059.

BACKGROUND: Dodge-Fillmore-Olmsted Community Corrections (DFO) has contracted with Family and Children’s Center (FCC) since 2006 for “Youth Night Campus”. DFO utilizes “Youth Night Campus” to address the risks and needs of youth in our community, this program is often referred to as Day Treatment. The program uses strength-based approaches that hold youth accountable, while at the same time promoting change through counseling, support, education, and collaboration. Staff work closely with youth and their families to strengthen relationships, enhance public safety, and develop community ties. Programming is offered Monday through Friday from 4:00pm to 9:00pm year-round and includes Victim Empathy training with national Department of Justice curriculum, daily peer group therapy, weekly individual therapy, recreational therapy, life skills training, study/tutoring time, and evidenced based cognitive skills programming. In addition to serving males and females on Juvenile Probation this resource has been expanded to serve youth from Olmsted County Social Services-Youth Behavioral Health.

In 2016 we began contracting with FCC in 6 month increments to ensure for proper transition in the business model and to allow for any necessary changes in program development. The new business model allows FCC to maximize third party billing and decrease the overall cost to Olmsted County. The new business model moved from a lump sum payment for a bundled service to a model where we are breaking down the services and FCC is billing per service per client. In 2017 we are estimating the cost to the County to be under$150,000. FCC exhausts all third-party billing options and Olmsted County covers the cost of uninsured youth. Olmsted County Community Services/Dodge-Fillmore-Olmsted Community Corrections has an executed Agreement with Family and Children’s Center (FCC) for “Youth Night Campus” and related services that will expire June 30, 2017. Olmsted County wishes to extend the term of the Agreement by six (6) months to end December 31, 2017. The rates of the FCC Agreement

BACKGROUND: The Housing & Urban Development (HUD) Department's Continuum of Care Program Grant, previously known as "Shelter Plus Care" is a renewable rental subsidy grant that serves homeless individuals and families with mental health and chemical dependency disabilities. Olmsted County Community Services has been receiving this grant annually since 1993. Continuum of Care grants can only be granted to a government entity or a housing authority. The goal of this grant is to provide permanent supportive housing. Program participants can continue to receive the housing subsidy as long as they meet program requirements. Olmsted County partners with Zumbro Valley Health Center to provide housing support services to the individuals and families receiving rental subsidies through this grant. The grant has been successful in housing more than 17 individuals and families in scattered site apartments annually. Grant Period: April 1, 2017 to March 31, 2018 Grant Amount: $148,436 (Includes $143,388 for subsidies and $5,048 for Administrative Costs) Administrative Costs: Actual eligible administrative costs related to administering the housing assistance can be reimbursed up to $5,048. Match Requirements: There is no levy needed to cover the grant match. There is a supportive service match requirement to this grant, but any service a participant is linked to including social services and medical care can be used as match. The participants' normal service spending is sufficient to cover the required grant match.

COUNTY BOARD ACTION REQUESTED: Approve the renewal of HUD Continuum of Care Grant in the amount of $148,436 for the period of April 1, 2017 through March 31, 2018. Delegate signature authority of this grant to Community Services Director, Paul Fleissner.

BACKGROUND: The Regional Quality Council for Region 10 has awarded Olmsted County Community Services with a one-time grant for $5,000 to provide training in self-determined living to people with disabilities and their families. Goals of the training include: 1) Promoting person-centered thinking of those supporting the individual, 2) Provide ideas and training on how adaptive technology can assist in helping people live independent and safe lives in their own home, versus total reliance on high cost staffing to provide all assistance, 3) Educate the community on the benefits of connecting with those with disabilities and how possibly sharing living costs would benefit all involved in this time of high cost housing and renting. This grant enhances the Department of Human Services (DHS) and Olmsted County's direction of assisting people in living their lives as independently as possible, supporting self-direction, and reducing our reliance on high-cost group homes for those that would be overserved in this type of setting. These trainings will be funded solely through the grant funds and be held in the Fall of 2017 and the Winter of 2017/18. The Region 10 Regional Quality Council is comprised of Olmsted, Wabasha, and Houston Counties working collaboratively with regional stakeholders and partners, to monitor and improve the quality of services, person-centered outcomes, and overall quality of life for people with disabilities, at both an individual and system level.

BACKGROUND: In September of 2015, the Olmsted County Sheriff's Office received a federal grant through the MN Department of Public Safety for a DWI Officer program, renewable for up to 4 years. The purpose of the grant is to provide an officer to focus solely on DWI offenders. During the first 3 years of the grant, funding for an additional Deputy (staffing costs and equipment) was received in the following amounts: 2015: $175,550 2016: $153,658 2017: $142,970 In 2018, the likely funding amount is about $146,000. Because of this grant program, the Olmsted County Sheriff's Office has been able to increase DWI enforcement in our communities. In fact, DWI arrests increased from 147 in 2014 to an estimated 216 in 2017 representing a 47% increase. Drunk driving related deaths and serious injuries in Olmsted County have declined over the same time period by over 50%. See attached report on outcomes of this grant.

Chart (A) below shows Olmsted County’s history of DWI and the types of occurrences that happen with drunk driving.

We started the DWI Officer program in Sept 2015 and believe it is making an impact.

However, the biggest program we are involved in that works to prevent serious injury and fatal crashes is

Towards Zero Deaths (TZD). This program brings multiple agencies together to work as a group to Engineer

roadways, educate the public, enforce traffic laws and emergency medical services.

Through our work with TZD and having a dedicated DWI Deputy, Olmsted County has seen and should

continue to see a positive result of fewer fatal and serious injury crashes. As you can see below, we are on a

trend to reach 216 DWI arrest this year vs 147 in 2014, just prior to the program starting. Although we would

like to believe that the DWI officer program is making a major impact for us, truly the public’s use of alcohol

and our inability to control what choices they make is realistically impossible but between the two programs,

TZD and DWI Officer, we know we are getting the message out there that is you drink and drive, you will be

pulled over.

BACKGROUND: The Olmsted-Wabasha Lake Zumbro Joint Powers Board is proceeding with implementation of the lake dredging project. This project will require the preparation of an Environmental Assessment Worksheet (EAW) to determine the potential environmental impact of the project and to determine whether a more in depth Environmental Impact Statement (EIS) needs to be prepared before the project can move forward. A local unit of government must serve as the Responsible Government Unit (RGU) to oversee the environmental review process and insure adequate public input. The professional and county staff working on the project and the Joint Powers Board believe that of all of the jurisdictions which have a role in oversight of all or part of this project, Olmsted County is best suited to serve as the RGU to oversee the EAW process. Additional details concerning this request can be found in the resolution included with this Request for County Board Action.

RESOLUTION No. 17-___ WHEREAS, the Olmsted County Board is aware that the Olmsted-Wabasha Lake Zumbro Joint Powers Board is coordinating the work needed for the planned project to dredge Lake Zumbro to improve its utility for recreational purposes; and, WHEREAS, Olmsted County is providing project management, finance and legal support to the Joint Powers Board for this project; and, WHEREAS, in connection with this project, the professional staff working on the project has determined that an Environmental Assessment Worksheet (EAW) should be prepared to measure the potential impact of the lake dredging project on the natural environment in and around Lake Zumbro; and, WHEREAS, when an EAW is completed, a local unit of government must be identified to serve as the Responsible Government Unit (RGU) to coordinate the necessary issuing of notices and to conduct public hearings to solicit public input on the lake dredging project to determine if an EAW is sufficient to measure the environmental impact of the dredging or whether a more in depth Environmental Impact Statement (EIS) should be required as well; and, WHEREAS, there are a number of local units of government which have a role in oversight and/or permitting related to facets of this project, and Lake Zumbro itself is located in both Olmsted and Wabasha Counties, and so one of those local units of government needs to serve as the RGU; and, WHEREAS, under Minn. Rule 4410.0500, Subp. 5(B) it provides that when “two or more governmental units propose to carry out or have jurisdiction to approve the project, the RGU shall be the governmental unit with the greatest responsibility for supervising or approving the project as a whole” or in some cases, the RGU should be the local government unit that “has expertise that is relevant for the environmental review”, and; WHEREAS, after consultation with the Joint Powers Board and the professional and county staff working on this project, it has been determined that where the County Environmental Resources Department is providing project oversight and state grant management services, the County Finance Department is providing accounting support for the project, the County Attorney’s Office is providing legal support for the project, the County Property Records and Licensing Department is providing parcel and assessment information support for the project, the County Planning Department is providing wetland impact analysis for the portion of the project located in Oronoco Township in Olmsted County and GIS mapping support, and the County Public Works Department will be issuing an access permit for truck traffic travelling to and from the lake dredging site in Oronoco Township to the dredged spoil disposal site in Farmington Township, Olmsted County will have the “greatest responsibility for supervising and approving the project as a whole” and “has expertise that is relevant for the environmental review”. NOW, THEREFORE, BE IT RESOLVED, by the Olmsted County Board of Commissioners as follows: 1. Olmsted County shall serve as the Responsible Government Unit (RGU) in connection with the EAW needed for the Lake Zumbro dredging project.

2. The professional engineering staff retained as consultants on the project, WHKS and Co. and Barr Engineering Co, will have the responsibility to prepare the draft scoping EAW and distribute the EAW to the jurisdictions impacted by the project which includes Olmsted County, Wabasha County, Rochester Public Utilities, the Olmsted-Wabasha Lake Zumbro Joint Powers Board, the Lake Zumbro Improvement District, Oronoco Township, and Farmington Township in Olmsted County, and Mazeppa and Zumbro Township in Wabasha County. The Olmsted County Planning Advisory Commission shall be responsible for review of the EAW and shall hold at least one public hearing on the items to be considered in the EAW and make a recommendation concerning approval or denial of the EAW to the County Board. 3. The Olmsted County Board shall approve the final scoping EAW and shall submit it to the Environmental Quality Board. The Board shall determine the adequacy of the EAW and shall determine whether an EIS is needed for the project unless notified by the EQB that the EQB will make the final determination. 4. The County Environmental Resources Director shall determine the cost for reimbursement of County expenses regarding development, administration and review of the EAW. The cost shall be paid by the Olmsted-Wabasha Lake Zumbro Joint Powers Board. 5. BACKGROUND: On March 7, 2017, the Board approved a contract to repair a portion of the Olmsted Waste to Energy Facility (OWEF) known as the 'Quench Reactor' with Moorhead Machinery and Boiler Co. in the amount $129,712. The Quench Reactor is a vital component of the OWEF Air Pollution Control (APC) system. Within this 10.5’ diameter x 65’ tall vessel, lime slurry is introduced to aid in control of acids gases. Additionally, the cooling of the exhaust gases increases capture of condensable pollutants. The lower portion of the vessel is comprised of a cone (hopper) in which particulate and ash are contained and transferred to the ash system. Due to constituents of the particulate and ash, the cone is highly susceptible to erosion and corrosion. The original specification indicated complete reuse of a part of the machinery known as the 'manway access' to the cone. However, during demolition, contractors discovered that this metal had deteriorated beyond a point of reuse. Moorhead fabricated replacement metal to bring the manway access back to original specifications. A contract change is needed for this work.

The project manager was granted change order authority at the time of contract award and instructed the contractor to make the repairs in order not to delay the project. Formal acceptance of the repairs is requested, including a request for Change Order # 1 in the amount of $1,465.70.

The Department has participated in a project involving employees from several different County Departments to help plan for the implementation of the new County Administrative Enforcement and Appeals Ordinance. This Ordinance will create a new process for appeals of violations and exceptions to be handled by a contracted county hearing officer, or by a subordinate county board or commission where an ordinance currently provides for review by a subordinate county board or commission, prior to any subsequent appeal to the County Board. It is necessary as part of that process to amend the Department’s ordinance(s) to redirect the handling of appeals of violations and exceptions from the process under the current ordinances to this new ordinance. These changes will take effect January 1, 2018.
