WITH THIS EROSION CONTROL PLAN,THE ENGINEER HAS MADE AN ATTEMPT TO DESIGN A PLAN THAT REDUCES THEDISCHARGES OF STORM WATER POLLUTANTS FROM THE SITE. THE OWNER HASOBTAINED COVERAGE UNDER "AUTHORIZATION TO DISCHARGE UNDER THE NORTHDAKOTA POLLUTANT DISCHARGE ELIMINATION SYSTEM" (HEREAFTER REFERREDTO AS THE STATE'S CONSTRUCTION GENERAL PERMIT). THE CONTRACTOR SHALLADHERE TO ALL PROVISIONS OF THE SWPPP. THE CONTRACTOR SHALL AMENDTHE SWPPP WHENEVER THERE IS A CHANGE IN DESIGN, CONSTRUCTION,OPERATION, OR MAINTENANCE WHICH HAS A SIGNIFICANT EFFECT ON THEPOTENTIAL FOR THE DISCHARGE OF POLLUTANTS TO WATERS OF THE STATE. THESWPPP SHALL ALSO BE AMENDED IF THE PLAN IS FOUND TO BE INEFFECTIVE INCONTROLLING POLLUTANTS PRESENT IN STORM WATER. ALL COSTS FORSUBMITTING OR AMENDING SWPPP WITH THE STATE ARE INCIDENTAL TO THECONTRACT.
2. CONTRACTOR SHALL COMPLY WITH ALL REQUIREMENTS OF ALL LOCAL, STATE,AND FEDERAL REGULATORIONS AND PERMITS. IF EROSION, SEDIMENTATION, ORDISTURBANCE OCCURS DUE TO NON-COMPLIANCE WITH ANY OF THESE PERMITSOR REGULATIONS, CONTRACTOR SHALL RESTORE IMPACTED AREAS AT NO COSTTO THE OWNER. IF NON-COMPLIANCE WITH REGULATIONS AND PERMITS OCCURS,CONTRACTOR SHALL AT NO ADDITIONAL COST TO THE OWNER:
A.CONTACT THE AUTHORITIES HAVING JURISDICTION;
B.REMOVE SEDIMENT AND RESTORE IMPACTED AREAS TO THE SATISFACTION OFTHE OWNER AND THE AUTHORITIES HAVING JURISDICTION;
C.INSTALL OR CORRECT PREVENTATIVE MEASURES TO TEH SATISFACTION OFTHE AUTHORITIES HAVING JURISDICTION;
D.PAY ANY FINES OR OTHER ADDITIONAL REQUIREMENTS OF THE AUTHORITIESHAVING JURISDICTION; AND
E.MEET THE CONTRACT SCHEDULE FOR PROJECT COMPLETION.
4. ALL TEMPORARY PERIMETER EROSION AND SEDIMENT CONTROL DEVICES, SUCHAS SILT FENCE AND CONSTRUCTION ENTRANCES, SHALL BE IN PLACE PRIOR TOBEGINNING ANY CONSTRUCTION ON THE PROJECT. TEMPORARY EROSIONCONTROL AND SEDIMENT DEVICES INTERIOR TO THE SITE, SUCH AS SEDIMENTTRAPS, SHALL BE INSTALLED AS CONSTRUCTION PROGRESSES. THE TEMPORARYEROSION AND SEDIMENT CONTROL DEVICES SHALL BE INSPECTED, MONITORED,AND MAINTAINED BY THE CONTRACTOR CONSISTENT WITH THE REQUIREMENTSOF THE STATE'S CONSTRUCTION GENERAL PERMIT UNTIL FINAL TURF COVER HASBEEN ESTABLISHED AND ACCEPTED BY THE CITY AND NOTICE OF TERMINATIONHAS BEEN FILED WITH THE STATE, OR THE SITE HAS BEEN TURNED OVER TO SITECIVIL IMPROVEMENTS CONTRACTOR(S), WHICHEVER COMES FIRST.
5. CONTRACTOR SHALL MAINTAIN EXISTING SITE DRAINAGE AND PROVIDE EROSIONCONTROL MEASURES AT ALL TIMES. STORM WATER AT THE SITE MUST BEMANAGED TO REDUCE THE POTENTIAL FOR SEDIMENT TRANSPORT OFF-SITE.
6. CONTRACTOR SHALL CLEAN AND MAINTAIN ROADWAYS AFFECTED BYCONSTRUCTION ACTIVITIES, INCLUDING HAUL ROUTES, TO THE CONDITION THEYWERE IN PRIOR TO THE START OF CONSTRUCTION ON A DAILY BASIS, OR ASNEEDED.
7. SILT FENCE (UNSUPPORTED AND SUPPORTED) SHALL BE INSTALLED IN AREASINDICTED ON DRAWINGS AND AROUND ALL TOPSOIL AND SUBSOIL STOCKPILESCREATED BY CONTRACTOR (NOT SHOWN ON DRAWINGS).
8. ALL OTHER TEMPORARY EROSION AND SEDIMENT CONTROL DETAILS SHALL BE ASSHOWN ON THE DRAWINGS.
9. TEMPORARY STABILIZE EXPOSED AREAS WHERE CONSTRUCTION ACTIVITY HASTEMPORARILY CEASED CONSISTENT WITH THE STATE'S CONSTRUCTION GENERALPERMIT.
10. CONTRACTOR SHALL REMOVE AND REINSTALL CONSTRUCTION FENCE AND SILTFENCE AS MANY TIMES AS NEEDED FOR CONSTRUCTION AND NO ADDITIONALCOMPENSATION WILL BE MADE FOR SUCH WORK.
11. CONTRACTOR SHALL PROVIDE CONCRETE TRUCK WASH-OUT AREA AS NEEDED ATA LOCATION APPROVED BY THE OWNER. CLEANUP AND REMOVAL OF WASH-OUTDEBRIS SHALL BE AT THE CONTRACTOR'S EXPENSE.
12. INLET PROTECTION SHALL BE PLACED AT ALL STORM WATER INLETS THAT MAYRECEIVE TRACKED SEDIMENT FROM CONSTRUCTION ACTIVITIES TO PREVENTSEDIMENT FROM ENTERING STORM DRAINAGE SYSTEMS PRIOR TO TEMPORARYOR PERMANENT STABILIZATION OF THE DISTURBED AREAS.
13. CONTRACTOR WILL BE REQUIRED TO INSTALL A TEMPORARY ROCKCONSTRUCTION ENTRANCE FROM 4TH AVENUE NW TO ACCESS THE SITE.
