ACCOUNTEX MOBILE APP I love this idea. This year Accountex has launched a mobile app which is available from both Android and Apple’s iStore. I suggest downloading this asap. It contains all the information you need about every theatre, speaker and feature of Accountex 2014. So you can use it to keep you informed as you move around during the day.

The app is even more useful than this as it also contains the facility to manage various day-to-day business tasks such as: tracking mileage for expenses, calculating tax, logging receipts, staying up to date with the latest financial news and insightful blog posts from the exhibitors. I’d highly recommend checking out this free app asap!

LECTURE THEATRES There’s an even better choice of seminar theatres and interactive workshops this year than ever before. If you have any favourite speakers or sessions, please make sure you arrive early, as space is limited. You will also want to identify some backups in case your first choice theatre is full when you arrive.

7. Remain open to the new ideas and solutions being shared by the speakers and by the exhibitors.

BUSINESS CARDSMany exhibitors will use the bar code on your badge to follow up with you later, but many exhibitors prefer to collect business cards from genuinely interested visitors. You’re unlikely to generate any new clients while you wander around Accountex (or Legalex), but you may encounter like-minded visitors, exhibitors and speakers who are willing to meet up, email or speak on the phone next week. My advice is never give your business card out to anyone unless and until they ask for it.

Finally, your business cards are also useful for entering prize draws on exhibitors’ stands (and for getting added to their mailing lists).

Commercial Property Advisors, are you aware of the recent legislation changes affecting all commercial property transactions?

Never before has the issue of capital allowances legislation been so pertinent when considering the sale or purchase of commercial properties. This is because, any commercial property transactions taking place post April 2014, will be impacted by recent legislation changes. The changes are a result of a consultation process which HMRC launched in May 2011.

April 2014 changes mean that a purchaser will onlybe able to claim capital allowances on a commercialproperty if both of the following conditions are met.Firstly, the ‘past owner’ must have pooled the fixtures and brought a disposal value into account on sale. Secondly, the ‘Fixed Value Requirement’ (FVR) must be met, usually by virtue of both vendor and purchaser agreeing the value and making a Section 198 CAA2001 election within two years of the disposal. In the event that the parties can’t agree on a value for the fixtures, the matter can be taken to a First Tier Tax Tribunal. However, this will be costly and therefore, we think, uncommon. We expect the valuation of fixtures and the associated Section 198 election to become a standard provision of all, or certainly most sale and purchase agreements for a commercial property interests. The ‘past owner’ is defined as the last owner (this would usually be the vendor in the transaction) who was entitled to claim capital allowances.

So, when a vendor comes to sell his commercial property(and let’s assume that the vendor is a taxpayer), they willneed to establish a value for the fixtures containedwithin the property. A Section 198 CAA2001 electionwill then need to be made, using this value. They willalso need to pool the fixtures and bring a disposal valueinto account. Failure to do both of these will mean that

the purchaser’s claim to capital allowances in the futurewill be blocked in fact, not only the current purchaser,but all subsequent purchasers will lose their right.

What options do current owners of commercialproperties have, with respect to capital allowances,assuming that at some point in the future they are goingto sell? Firstly, they can do nothing. By doing so theyare missing out on the current tax relief available froma capital allowances claim. Or, they can wait until justbefore they sell and make a retrospective claim. This way,it may be possible (by bringing into account a nominaldisposal value for the fixtures) to obtain tax relief onpretty much the entire cost of the fixtures in a singleyear, by means of a balancing allowance. Or, they maymake a claim and then agree a disposal value for thefixtures with the purchaser which allows both parties toshare in the benefit of the tax relief. For example, havingclaimed WDA’s prior to disposal, a joint decision totransfer the fixtures at Tax WDV may be made.

If you haven’t already done so, now is the time, withoutquestion, to bring the whole issue of capital allowancesto the attention of your clients. The changes provide allaccountants with the opportunity they have been waitingfor to inform commercial property owners of this valuableform of tax relief. The fact that the owner is going tohave to engage in the process of establishing a fairvalue for the fixtures when they come to sell (becausethe purchaser will insist that the exercise is done) meansthat they might as well do it now and start benefiting fromthe reduced tax liabilities that such a claim will trigger.In broaching the subject with them you have the idealopportunity to inform current owners of the benefits ofmaking a capital allowances claim. And, given that a£1m property could deliver up to £135,000 of tax reliefto a 45% taxpayer, what better way could there be ofmaking that connection with your client base?

FAQs1. What are the commercial implications to my clients if I do nothing?To safeguard the benefits for purchaser and vendor, in practical terms a “fair value” for the fixtures contained within the property must be agreed at the point of sale.Client is purchaser: If the Agreement/CPSE is silent on capital allowances your client is foregoing any rights they have to valuable tax relief.Client is vendor: Failure to establish a fair value for the fixtures within the property prior to sale will result in the forfeit of financial savings for your client and/or the opportunity to use the available allowances to help negotiate the sale price.

2. What are the implications to me as an advisor if I do not act on this impending legislation change?Accusations of negligence are a real possibility as the sums involved can run into hundreds of thousands of pounds and failure to provide the correct advice could potentially result in litigation.

3. I have clients who have owned commercial property for some time; can I revisit historic clients to suggest this service?Whilst only post April 2014 transactions are affected by the Legislation changes it is appropriate for commercial property owners to secure the available allowances now so your clients can enjoy tax relief sooner rather than later. Therefore now is the perfect time to touch base with your clients and proactively highlight the availability of these allowances, by doing so you are enabling them to maximise the speed in which their benefit will be received.

4. How long will it take as I don’t want to delay the property sale process?Our average turnaround time is 8-12 weeks. Thus it is imperative to advise your clients wishing to dispose of or acquire commercial property to investigate the matter immediately to prevent any disappointment in loss of benefit and/or loss of potential buyer

5. How will my client benefit from this if they are selling the property?When the owning entity disposes of their commercial property there is an opportunity to realise the full relief, which can result in a large financial benefit. If the capital allowances are not identified this immediate and significant benefit will be lost forever. Therefore it is imperative solicitors are aware of capital allowances legislation and the impacts.

Julia Penny is Content Manager (Audit and Accounting) at Wolters Kluwer UK, but her keen technical interest and background in training has also led to extensive involvement with the ICAEW. PHONE: 0845 5190 882In February 2014, HMRC launched a private beta programme for the first in a line of new online services. This service, intended for UK employees, provides an online method for notifying HMRC that new benefits in kind are being received or existing ones surrendered. Run in parallel with existing postal and telephone services, employees will soon have a new method for ensuring that their tax codes are kept up to date.

Whilst this sounds like a fairly simple operation, it also introduces

a new method of verifying one’s online identity. Identity Assurance is an initiative spear-headed by the Government to enable online transactions to take place with an assurance that the person making the request is who they say they are. In other words, it aims to combat online fraud. Every citizen of the UK, business or agent (not just accountants, but lawyers, carers, those holding power of attorney etc.) will be required to validate their identity whenever they interact online with a Government service.

This may come as a surprise to you. You might also be surprised to learn that a similar beta is in progress with the DVLA that enables drivers and their insurers to view their driving licences. In fact, the Government has identified some 25 services that are being provided with

HOW DOES IT WORK?One of the key tenets of IDA is that an individual’s identity can be validated and authenticated as part of an online transaction. In doing so, the individual will be challenged using information about them only they will know.

However, the UK Government is reluctant to handle this personal data themselves. Private enterprises, such as the Post Office, PayPal and Experian, plus five others (at time of writing) have therefore been contracted to provide such a service. The intention is, that over time, this list will expand and offer people additional options for choosing their trusted identity provider (or IDP for short).

For agents, IDA will ultimately replace the Government Gateway, the portal that all accountants use to file their clients’ tax returns. The transition is currently expected to begin in April 2015, with at least one year’s grace for accountants to migrate to the new service.

What is the Cloud?

The cloud is now a very loose term and means different things to different people. While different groups compete to own the term, at it’s most fundamental level, using the cloud means using software and data that is remote from the user (as in not at the same physical location).

Is the cloud the best solution for everyone?

Not necessarily. Some solutions are inherently location based - such as building and access control systems, time and attendance soft-ware - and so for practical reasons, it’s best to run them onsite. Other systems, like epos systems for retail, would typically be run on the premises, although they may feed a business data repository, like an accounting system, that is hosted. You should look at what you need and decide what’s best for you. Typical drivers for

implementing a cloud solution include needing access to software and data from more than one location, the flexibility to use Macs and iPads or other tablets in the business, and improved disaster recovery and business continuity.

Do you need superfast broadband to move to the cloud?

The capabilities of your internet connection can affect cloud based services. Different types of solutions need different connection capabilities. For example, web based applications need to download all components of each webpage. Interactive services, like hosted telephony or a hosted desktop typically need much less bandwidth, but need a more responsive connection. Unfortunately, Internet Service Providers (ISPs) promote and sell services based on the amount of data that can be carried by the connection (how fat it is) rather

than how quickly data will cross the pipe (how short it is). Many services need short pipes, but users end up buying fatter and fatter pipes thinking that a fatter pipe is actually faster. Where internet connections are unreliable, some services are more prone to disruption and so a model that allows the user to work locally on cached data is a good choice. For offices in areas without super fast broadband, hosted software is likely to provide a more efficient work experience.

distinguish between what different cloud vendors say and understand the implications for themselves. For example, one vendor might explain that they use military grade bombproof data centres. This is good news for customers who are concerned that armed terrorists might forcibly remove the physical devices that store their data, but for customers that are concerned about losing access to their data due to flooding, using an underground bunker in Berkshire is probably not a good choice. Most customers don’t carry out their own risk assessments and so rely on the spin they get from vendors. Changes in the Finance Act 2012 have introduced a layer of complexity and risk in the claiming of Capital Allowances for all parties involved in the property transaction. From April 2014, all expenditure that qualifies for Capital Allowances must be identified by the seller, but not necessarily claimed, before the transfer to a new owner. The significance is that the new owner cannot claim any allowances if this is not done, or not done correctly.
