Dear Mr. Schell:

It has come to my attention that the permit issued in 1980 to operate the above-mentioned rock quarry, as referenced in my letter to you of February 19, 1988, was modified in 1983. Enclosed you will find a copy of the 1983 approval.

You will note that an expansion to ten acres was approved, and the requirements for annual reporting and maximum yield were deleted. However, there are several conditions related to hours of operation and screening the pit and related activities from view of the road or neighboring properties.

If you intend to comply with all conditions of approval, please send me a letter declaring your intent. However, if it is your intent to vary from £nY one of the conditions of approval, you must apply to the Planning Commission for a conditional use permit.

Enclosed you will find a copy of the 1980 Planning Commission approval of the above-mentioned quarry. Carefully note the conditions of approval. If you intend to comply with all conditions of approval, please send me a letter declaring your intent. Please note that condition #8 requires an annual report of the production of the quarry.

However, if it is your intent to vary from any one of the conditions of approval, you must apply to the Planning Commission for a conditional use permit. For instance, if you propose to enlarge the site beyond one acre, or increase the annual yield beyond 2,500 cubic yards, or stockpile rock away from the pit, or operate during hours other than 8 to 5 on weekdays, then you must apply for a conditional use permit. A copy of the necessary application is enclosed for your reference. Please note that the Planning Commission conducts public hearings once a month, and an application must be submitted at least six weeks prior to a hearing in order to be placed on the agenda for that hearing. •

Renewal notices were sent to you on May 15 and July 7, 1987. Since your phone has been disconnected we have been unable to reach you by phone. i The permit expired on June 30, 1987. Since then we have heard nothing from you.

If this site is not brought into full compliance with the provisions of ORS 517.750 et seq. within 30 days of this notice you must provide evidence that the required reclamation has been completed or is underway and will be completed in accordance with the approved reclamation plan.

The Schell property is located on Soap Creek Road north of Corvallis and is a total of 53.60 acres. The parcel contains one residence which is occupied by the owner. In October of 1980 a Conditional Use Permit was granted authorizing a one acre quarry site on this property which involved excavation of rock material and an area for crushing equipment, loading and storage. The conditions of approval stated that not more than 2500 cubic yards of material could be extracted from the site annually.

The applicant wishes to expand to ten acres the area from which rock can be extracted, and to allow more than 2500 cubic yards of material to be extracted from the site per year. The proposed ten acre site must be a minimum of 100 feet from adjacent property lines and must be 500 feet from Soap Creek Road, as specified in the permit from the Department of Geology and Mineral Industries ( DOGAMI ) #020039.

The Department of Geology & Mineral Industries has stated that the reclamation plan submitted by the applicant is acceptable. According to this plan, the rock berms shall be maintained to diffuse noise from the site and the existing trees shall be maintained along the northern perimeter of the pit to provide visual screening.

Reclamation will begin 180 days after operations cease. Topsoil will be stockpiled and will be seeded with grass seed to prevent erosion. In order to insure proper drainage, ditches will be constructed as needed to provide for si 1t contra l •

0 0 The operation will involve the use of a drill, bulldozer, front end loader and crusher; blasting will also occur. The hours of operation shall remain the same, Monday thru Friday from 8 a.m. to 5 p.m., as specified in the Conditional Use Permit approved by Benton County in 1980.

I Article III.04 of the Zoning Ordinance states that ag gregate operations may be permitted as a conditional use in the Forest Conservation Zone provided that such operations can be shown not to have an adverse effect on the forest uses. Compliance with the requirements set forth in Article XVII.l1 will insure the proposal will not have an adverse affect on the forest uses.

The surrounding land uses and zones are Rural Residential to the northwest across Soap Creek Road and Forest Conservation to the north, east and south. This parcel and two adJacent parcels have been recommended by the Planning Commission at their September 27 meeting for rezoning to Rural Residential. Aggregate extraction is not a permitted use in the Rural Residential zone and �

therefore the expanded quarry waul d become a non-conforming use.

The "beneficial use" will be forest land or water impoundment and this plan has been approved by the Department of Geology and Mineral Industries. Since the site will be reclaimed according to tfii s plan, it wi 1 1 not adversely ef fect forest uses.

2. The site is screened by the existing trees, and rock berms wil+ be used to diffuse noise from the ag gregate extraction operations. Compliance with Article XVII of the zoning ordinance will minimize the impact on the surrounding properties.

3. The applicant has. obtai ned a reel amation plan from the Department of Geology and Mineral Industries.

Decision

Based on the above findings, the Development Department approves the request for an expansion of a on� acre quarry site to ten acres, and to allow greater than 2500 cubic yards of material per year to be extracted from the site.

Conditions of Approval

1. The applicant shall retain a 100 foot buffer between the excavation site and the east, south and west property lines and a 500 foot buffer strip between the site and Soap Creek Road.

2. The hours of normal operations (not including mechanical breakdowns or servicing) involving blasting, truck hauling and crushing shall be between 8 a.m. and 5 p.m. weekdays only, excluding holidays.

3. Screening of the mining site must be maintained to obscure the view and minimize dust and I other annoyance from adjo·ining occupied property and adjacent public thoroughfares. Unless otherwise approved, the screening shall be at the boundary of the property on which the site is

1. A landscaped berm or preservation of a natural slope. 2. Vegetation.

4. Sound shall not exceed the maximum permitted by the state Department of Environmental Quality; a berm or other similar method shall be used to reduce the sound off site to the level permitted by the Department of Environmental Quality.

5. Vehicular parking off public thoroughfares shall be available for employees, customers, and visitors at the mining site.

6. A fence to control access to the pit shall be maintained at least 10 feet outside a pit that is within 200 feet of a public thorouyhfare.

Steam shovels, bulldozers, rock crushers and other equipment noise -Within 8 a.m. and 5 p.m., noise from equipment shall not exceed 5 5 dBA mor,e than 50 percent of the time; 60 dBA 10 percent of the time and; 7 5 dBA one percent of the time at a certain distance as specified by the DEQ from the closest noise sensitive dwelling in existence at the date of this approval.

I A noise survey of all noise sources from the quarry site will be done by the Department of Environmental Quality at the time the quarry operation begins, with random surveys made thereafter.

6. The applicant obtain a driveway approach permit from the Road De-partment including the construction of a drainage ditch, and provision of a culvert. Also, the applicant provide a surface on the acc·ess road that would be dust free for at least 300 feet from Soap Creek Road.

7 . Erosion shall be controlled in accordance with an erosion control plan approved by the Benton County Soil and Water Conservation District.

' . 8. Approval is subject to an annual report on the current status of operation

at the ex cavation site filed with the P lanning Department by the appli­cant. If this operation expands in terms of volume or land area limits, a new conditional use consideration shall be made with provision for recla­mation plans.

REQUEST SUMMARY

Appeal of a staff approved Conditional Use permit for a one acre rock quarry �nd crus hing operation on a 53. 6 acre parcel , al ong Soap Creek.

BACKGROUND

The subj�ct parcel fronts Soap Creek Road in a Forest Conservation zone. A residence is on the l ower portion of the parcel near Soap Creek Road. The parcel once was wooded but has been cut over and is now being used to graze l ivestock

The proposed quarry site on the parcel woul d incl ude a one acre excavation site and a l anding area for crushing equipment , l oading and storage. The proposed quarry. site is on l a northwest facing hil l side at about 650 feet above mean sea l evel . The sl ope of the hil l side varies from 12 to 20 percent. The v egetation found on the parcel is thinl y scattered hardwoods with natural grasses and brush as ground cover.

The soil found on the site is Price sil ty cl ay l oam. This soil is usual l y found on hil l sides having medium runoff and moderate erosion. Root penetra­tion is l imited by bedrock usual l y at a depth of 40 to 60 inches. Price sil ty cl ay l oam has an agricul tural capabil ity unit of III �nd Woodl and site cl ass productivity rating of 2.

Accardi ng to the DOGMU Rock Resources Short Paper 27 , the subsurface material general l y found on the subject parcel is Sil etz River Vol canics. This vol canic geol ogic unit is the ol dest rock in Benton County and the most preva­l ent. Sil etz River Vol canics sometimes contains unnamed intrusive rock. Such fine grained intrusive rock is most desirabl e for a road base as op posed to l ava (Sil etz River Vol canics) , which is l east desirabl e , and it is presumed that the proposed quarry is an area containing some of this intrusive rock.

The s ubject parcel front s Soap Creek Road,·which has a 15 foot oil mat s urface. The existing road on the parcel, leading to the proposed extraction

, site, can currently only be negotiated with a four wheel drive. There is les s steep terrain on the subject parcel leading to the proposed excavation site that could be developed as a more viable truck route.

As seen on Attachment 1, the predominate land use and lot size patterns north­west of Soap Creek Road in Section 34 are much more intensive than on the southeast side where the s ubject parcel is located.

The southeast side of the road is in Forestry use with parcels over 40 acres in size. The majority of the parcels on the northwest side of the road have been divided into much smaller parcels ranging from l acre to 16 acres, many of �ich are occupied by dwelling s. This area is zoned Rural Residential.

There are about three dwe.ll i ngs in the Forest zone on the southeast side of the road in Section 34 and some 23 dwellings in the Rural Residential zone on the northwest side of the road. Attachment 1 depicts approximate locations of dwelling s in relationship to the proposed quarry site. The closest neighbor­ing dwelling that could be affected by the proposed quarry operations is about 2,000 feet from the proposed site. There is a thin wooded buffer between the proposed quarry site and the closest dwelling at the bottom of the valley, which is at about 400 feet above mean sea level or 250 feet below the proposed site. As seen on Attachment B, there are two existing quarries on the upper portions of the two valley hillsides. The northwest site is a Starker Forest� quarry and the southeast site is the Oregon State University McDonald Forest quarry. Neither quarry is open for public use.

ORD I NANCE/POL I CY REQU IREMENTS (fRITERIA)

Zoning Ordinance criteria and standards relevant to this request are:

1. Because the s ubject parcel is in the Forest Conservation zone, rock extraction proposals are a Conditional Use. Article I I I.04 (6) states:

110perations conducted for the exploration, mining and processing of geothermal resources as defined by ORS 522.010 (4), provided that such operations can be shown not to have an adverse impact on the forest uses and a complete reclamation has been provided showing how the affected areas will be returned to forest use if feasible after depletion of the mineral resource.11

2. The Conditional Use section, Article XX.05 (2), states:

" No conditional u se application shall be approved unless the approving agency finds the request is consistent with the objectives and purpose of this Ordinance and the Comprehensive Plan and it is designed to be compatible with surrounding land u ses • • • "

D ISCUSSI ON

Some of the most important subjects that need to be addressed concerning this request are:

·

1. Whether the kind of rock materials found-at the proposed site are needed.

2. vJhether the proposed quarry rock operations will be compatible with forest uses.

3. Whether the proposed quarry operation will be compatible with the adjacent uses across Soap Creek Road, which is Rural Residential.

The Neuman Quarry, approved by the Board of Commissioners, is currently under appeal to LUBA. This quarry was in a similar situation given rural residences. The Board of Commissioners found that the Neuman Quarry was acceptable within a Forestry zone given limitation on the hours of use based on the prox.imity of the existing rural residences.

F I ND I NGS I N FAVOR

1. Under Comprehensive Policy 1 of Geologic Resources, Benton County recog­nizes that it is necessary to maintain rock material resource land suffi­cient to supply materi1al s for the needs of the County. The County shall protect aggregate resources through the use of appropriate zoning tech­niques, with particular emphasis immediately directed at existing and potential production and processing sites near urbanization for Rural Residential zones of the County.

2. According to the DOGAM I Short Paper 27, Rock Material Resources of Benton County, Oregon, an annual production of of rock material will be needed as Benton County•s population and per capita use increase. The existing rock resources could be gone in 2 5 years. This does not mean that Benton County will be out of rock material by the year 2005, but that new sites will be needed in the immediate and distant future. (Comprehensive Plan Geologic Resource finding.)

3. A preliminary analysis of the igneous rock by the County Engineer indi­cates that this rock is hard, dense, quite clean, and can be best used for road contruction.

4. Because most of the better hard rock quarries are south or west of Corvallis, the location of this site can keep hauling costs down for use north of Corvallis.

5. Because of the size of the proposed quarry operation, one acre in area, the operation would not pose any problem regarding the conversion of forest lands or the compatibility with forestry uses on adjacent lands. Also, the proposed quarry would not substantially diminish the land area needed for existing grazing activities.

6. Because of the pro posed extraction volumes over a year in time, environ­mental impact s such as truck traffic and noise would not occur every week day of the year. No more than 500 truck loads of rock material would be extracted, processed and trans ported from the site.

7. The nat ural vegetation s urrounding the quarry site serves as a vis ual b uffer from the valley bottom.

8. There are two existing quarry sites on each side of the valley hillsides that are intermittently used by Starker Forest and Oregon State University.

9. Comprehensive Plan rock material policies relevant to this proposal state:

a. "Benton Co unty recognizes that it is necessary to maintain rock material resource land s ufficient to supply an adequate quantity of rock materials for the needs of the County. The County shall protect aggregate resources through the use·of appropriate zoning techniques, with particular emphasis immediately directed at existing and potential production and proces sing sites near urbanizing or rural residential zones of the County;" and,

b. " Benton County shall appropriately zone mineral resource areas or provide for mining o perations by designating them as a Conditional Use within a zoning district, which will allow for the efficient utiliza­tion of mineral resources with minimum conflicts with adjacent lands and/or permit natural resource use conversions."

FINDINGS OPPOSED

1. The u se of the land and zoning is Rural Residential, 2000 feet to the west and northwest of the propo sed quarry site. Rock quarry operations involving proces sing equipment, noise, dust, blasting and truck traffic . could generate negative environmental impact s on adjacent lands.

2. Soils within this area are site Class 2 for forestry use. Development of a quarry on this parcel will remove potentially productive forest soils from forestry use.

STAFF RECOMMENDATION

Staff recommends that the applicant•s request be approved s ubject to the conditions which follow, based on the findings in favor as presented in the staff report.

CONDITIONS FOR APPROVAL

1. The total site area for ex pansion not to exceed more than one ( 1) acre in area, located 1 00 feet from the southeast property line adjacent to McDonald Forest as shown on the attached sketch map s ubmitted by appli­cant. No more than 2500 cubic yards be extracted from the site annually.
