INTRODUCTIONWe would like to invite Cattlemen and Women to attend the 5 Star Senepol Sale at Gracemere Monday September 19th at 11:00 am. On offer will be 81 bulls: 51 Senepol bulls, 8 African Hybrid bulls [T.A.T’s, tropically adapted Taurus], 8 Senegus bulls, and 14 Senelais bulls.

Senepol BullsThis year we are offering 51 select Senepol sires. What sets these bulls apart from other Senepol bull on offer in the country, is that they are selected from over 500 male progeny. Selection is done whilst running on ticky forest country, at Mt Eugene and Belmont Research Station. They have to perform on grass, adapting to heat, ticks, flies and Lantana, with minimal chemical treatments. Animals are culled on, growth, temperament, yearling scrotal development, structure and rebreeding rates. We now have a large number of bulls, which have been bred up for three to four generations under north Australian conditions, allowing us to put more selection pressure on longer lines of cattle. We sell the senepol bulls as registerable, they are not registered now, but if any clients would like them registered, we can have it done. Some breed society charges may apply.

Senepol Hybrid BullsWe again offer a run of 8 Senepol hybrid bred bulls, or tropically adapted Bos Taurus bulls [T.A.Ts], a mix of Senepol, Bonsmara, and Belmont. These T.A.Ts sires have been used successfully in many tropical and sub-tropical areas. Including the NT, the Gulf, Western Qld, and the North Coast of NSW. Being tropically adapted and also 100% Bos Taurus, they are able to increase fertility in Bos Indicus herds, meat quality, as well as MSA grading and dramatically inject the poll gene into horn herds across many sub-tropical environments. More Calves, More hybrid vigour, more growth, more pregnancies, less temperament, means more compliance and ultimately more profit.

Senegus bullsFor the fourth year we have incorporated a run of Senegus bulls into our draft. We again have 4 select sires from Clayton and Sarah Maynard’s operation in Canowindra, NSW. Southern Star offers 4 Senegus [60, 61, 62, and 63] and 3 Senepol sires [23, 24, and 25] in the draft. All of the Southern Star bulls have been running on Mt Eugene for the past 12 months, acclimatising to the heat, ticks, flies, rocks, spear grass, and Lantana, in Central Queensland. They are ready to work straight away. Lots 64, 65, 66 and 67, are small birth weight, Yearling, Senegus bulls, possibly suited to heifer matings. There are many more variables that affect ease of calving, namely gestation length, muscle pattern, nutrition especially in the third tri-mester etc. We believe these bulls will contribute to the lower birth weight variable.

Senelais bullsThis year we line up 14 select Senelais bulls, made from the best genetics available in the Charolais breed, Palgrove, Ayr, Fernvale, Mercer and French and USA A.I. Sires. [Lots 68 to Lot 81]. Selection on these Charolais genetics concentrate on re breeding rates, small birth weight, ability to cover, and pollness.

VaccinationsAll bulls have been done with 3 germ Blood, two shots of Vibrio, Two shots of 3 day vaccine, and two shots of 5 in 1, at Branding and weaning. David Reid scanned the bulls on September 12th and Ced and Adam Wise, semen tested the bulls on the 31st July and 31st of August 2016.

Callide Dawson Carcase CompetitionFor the past 8 years in a row, 5 STAR has won the growth rate section in either the heifers or the steers or both. This year a purebred senepol steer lead at the half way point with a 3.52 kg a day gain at 60 days, and completed a 2.82 kg a day gain for over 100 days, from 121 head in the class. Bonnie Maynard also gained a second placing in the heifers, with a whopping 3.00 kgs a day for over 70 days. Another 5 star entry came third in the bullock section. A grass fed heifer gained third in the single grass-fed, and a pen of three heifers came second in the pen of carcases

Indonesian feedlot studies – F1 Senepol vs Brahman steer comparison

Background: Research on improved pasture at the Douglas Daly Research Farm ( DDRF), in a Queensland commercial feedlot and meat quality studies have shown that F1 Senepols were heavier at weaning than Brahmans, grew as well or better than Brahmans on native and improved pasture in the NT, performed as well as Brahmans in a feedlot in Queensland, were on average graded into lower boning groups than Brahmans by MSA carcase assessment, and had more tender meat than Brahmans (assessed by shear force testing). In addition to this F1 Senepol steers appear to be leaner at the same weight as Brahmans, which means that they are likely to have more value adding potential for Indonesian feedlotters (as they can be fed to heavier weights before becoming over-fat).

These findings appear to show that F1 Senepol steers would provide production advantages to both north Australian cattle producers and Indonesian feedlotters. However despite this there is a perception that many of the cattle buyers that purchase cattle for Indonesian feedlots discriminate against cattle that are not high grade Brahman due to the perception that they won’t perform as well as Brahmans in Indonesian feedlots. Therefore this research was conducted to determine whether this perception was correct or not by comparing the performance of F1 Senepol and Brahman steers in an Indonesian feedlot. It was hoped that if there was scientific evidence showing that these types of cattle perform at least as well as high grade Brahmans in Indonesian feedlots that this would remove the threat of price penalties to north Australian producers considering adopting crossbreeding Brahmans with a tropically adapted Bos taurus breed. Also it is important to determine whether the cattle suit the Indonesian market and perform well there as it is anticipated that the Indonesian market will continue to be the main market for northern NT cattle for many years to come and it is important that they are happy with the cattle.

Description of the research and results:

A collaborative partnership was formed with Elders Indonesia who agreed to purchase Brahman and F1 Senepol steers from NT DPIF and allow the department to study their performance in the Elders feedlot in Lampung Province (Sumatra, Indonesia). These steers had been transported to DDRF shortly after weaning and grazed improved Buffel pasture in one mob as part of a cell grazing trial from June 2103 until they were sold to Elders on 26/2/14. The whole mob was weighed on 26/2/14 and steers were selected for sale if they were approaching the 350 kg Indonesian live export limit (steers were selected if they weighed more than 300 kg (unfasted weight)). At this time 24% of Brahman steers and 57% of F1 Senepol steers weighed more than 300 kg. As a result 32 Brahman steers and 54 F1 Senepols were sold for this work. This highlights how the heavier weaning weights and higher growth leads to a higher proportion of crossbred steers being turned off earlier.

The steers were transported from DDRF to the Berrimah export yards by a commercial trucking company on 27/2/14 and their average weight on arrival there was 313.0 kg. There was a delay while the shipment of cattle was being put together and the steers remained at the Berrimah export yards until 6/3/14 when they left Darwin on the “Gelbrey” (live export boat). After going through the quarantine process in Indonesia and being transported to the Elders feedlot at Lampung, feeding of the steers began in the Lampung feedlot on 12/3/14. The steers were gradually introduced to the new feedstuffs with a starter ration. The induction weight was recorded on 15/3/14 at which time the average weight of the steers was 310.1 kg. The wellbeing of each animal was assessed at induction and 5 steers were placed in a “sick pen” for observation and to receive extra care if necessary. Most of these steers only remained there for a short time but one animal remained in the sick pen for most of the feeding period (110 days).The steers were fed the normal commercial ration for a period of 121 days from induction until a final weight was recorded on 14/7/14. While in the feedlot the steers were managed as per the normal feedlot management. They were fed various levels of starter rations for 3 weeks before receiving the finishing ration. The major ingredients of the ration were Tapioca waste, Tapioca chip, DDGS (distillers dried grains plus solubles), Copra meal, Palm kernel cake, Napier grass and molasses. Feed intake over the entire feeding period averaged 13 kg/head/day as fed (or 10.4 kg dry matter). All the steers (both genotypes) were kept in the same pen while in the feedlot to allow a proper comparison between genotypes.

Final weight and P8 fat depth (measured ultrasonically) were recorded on 14/7/14. The steers were transported to the Elders abattoir at Bogor (about 55km south of south of Jakarta on the island of Java) for slaughter and boning with the meat destined for the restaurant and supermarket trade. This had to be done over several days as there were too many animals to slaughter all at once. Also since this work was being conducted during Ramadan there were some significant dates that slaughtering had to be scheduled around. As a result the 30 Brahmans were

slaughtered on the 16/7/14 and the F1 Senepols were slaughtered in 2 lots during the following week. Transport from the feedlot to the abattoir took about 12 hours in total as the traffic in Indonesia makes travel slow. The steers were transported on small trucks in loads of about 10 head per truck. They stayed on these trucks during the short (2 hour) ferry ride from Sumatra to Java. After arriving at the abattoir the steers were spelled for 24 hours before slaughter. After slaughtering, hide removal and evisceration the carcases were split into 2 sides which were weighed and hung in a chiller over night before boning the next day.

Two of the Brahman steers were euthanized during the feeding period as they were considered to be sick (respiratory sickness) to the point where they were not likely to recover. The one F1 Senepol steer that remained in the sick pen for 110 days had a much lower average daily gain (ADG) than the rest of the steers (0.78 kg/day vs 1.71 kg/day average for the F1 Senepols) and therefore it’s data has been excluded from the genotype comparison of feedlot performance, as has the data from the 2 Brahman steers that were euthanized. The data comparing the performance of the genotypes is summarised in Table 9. It shows that the steers of both genotypes performed well and that the overall average daily gain (ADG) of the F1 Senepol steers was 0.17 kg/day higher than the Brahmans (1.54 kg/day vs 1.71 kg/day).

The average P8 fat depth of the F1 Senepol steers was similar to the Brahmans even though they were heavier. This indicates that their mature size is larger and hence they can be fed to heavier weights before becoming over fat when the Indonesian wet market is targeted.

The aim of this work was to find out whether F1 Senepols perform as well as Brahmans in Indonesian feedlots to ensure that Indonesian feedlotters would be happy with the cattle, and since there were concerns that cattle buyers discriminate against crossbred steers as they believe they don’t do as well there. These results show that this is not the case when a tropically adapted Bos taurus breed such as the Senepol is used in the cross. Therefore cattle buyers should be able to buy these types of cattle for Indonesian feedlots with confidence that their clients will be happy with their performance as the F1 Senepols were found to offer production advantages to Indonesian feedlotters as well as Australian cattle producers. Their better meat tenderness also gives Indonesian feedlotters confidence in the option of targeting the restaurant market in addition to the wet market.

How does hybrid vigour gains work?

Hybrid vigour is evident, when two unrelated genotypes meet. The amount of hybrid vigour is

proportional to the un-relatedness of the genetics.

E.g.

1. A Bos Taurus [Senepol] Cross A Bos Indicus [Brahman] .

Maximum hybrid vigour, yielding 10 to 12 % gain in both fertility and growth, from the mean of the parents.

2. A Bos Taurus [Senepol] Cross Bos Taurus [ Angus , Charolais ]

Hybrid vigour effect of 5 to 6% gain in both fertility and Growth, from the mean of the parents.

3. A Bos Taurus [ Senepol] Cross A Bos Taurus / Bos Indicus mix [Charbray, Droughtmaster, Brangus]

Hybrid Vigour effect , is 7 to 9% gain in fertility and growth rate , compared to the mean of the parents .Assume a 50/50 split in Taurus /Indicus make up. Hybrid Vigour is greater with more Indicus content.

The Senepol F1 steers, averaged a boning group of 6.3, and the Brah steers averaged 8.3.

Half brother to the previous lot, very similar in type, symbolising the consistency of these lines. We have been breeding Senepol since 1997, and now have a least 4 to 5 generations of Senepol selected on Mt. Eugene in ticky country on native and improved pastures, in sub tropical conditions. We have more confidence in these cattle having seen them perform in sub tropical conditions in Northern Australia. Having longer lines of 400 to 500 males each year to place selection pressure and move a population in a direction based on productivity has been beneficial.

Senepol crossbreeding meat quality research summarySummary: Recent research has found that crossbreeding with Senepols may be a way for northern cattle producers with Brahman herds to produce animals with improved meat quality. Research conducted by the NT Department of Primary Industry and Fisheries (DPIF) on F1 Senepol x Brahman cross steers and Brahman steers (that had been managed together all their lives) found that meat from the F1 Senepols was more tender.

The NT DPIF has been conducting a research program to determine whether crossbreeding with Senepol bulls is a viable way for north Australian cattle producers with Brahman herds to produce animals that will perform well under harsh northern conditions, and will be suited to both the South East Asian live export market and the Australian domestic market. This would increase the marketing options for northern producers as their cattle often suffer a price penalty in Australian domestic markets due to a perception that Brahman cattle from northern Australia have poor meat tenderness.

Live export has been the main market for many northern producers for a number of years and demand for their Brahman cattle has been strong as the cooking methods used in South East Asia mean that meat tenderness is less of an issue. However it would be advantageous for northern producers to be able to produce cattle that are in demand in both the live export and Australian domestic markets so that they are less vulnerable to live export fluctuations. It was thought that crossbreeding Brahman herds with a tropically adapted Bos taurus breed such as the Senepol (which is known to have the desirable traits of tropical adaption, good meat quality and polledness) may be an efficient way of producing animals that perform well under north Australian conditions and will be suited to both the live export and Australian domestic markets. The NT DPIF has been conducting research to test this strategy since 2008 and part of this research has been to determine whether the F1 Senepol x Brahman cross actually grades better in abattoirs and has more tender meat than Brahmans.

This research compared the meat quality of F1 Senepol x Brahman steers and Brahman steers that had been bred on DPIF research stations in the Katherine/VRD region and then grazed improved pasture together for a year after weaning at the Douglas Daly Research Farm (NT). In July 2013, 25 steers of each genotype were transported to the Smithfield feedlot (Proston, Qld) where they were fed for 73 days and then slaughtered at the Dinmore abattoir where MSA assessment was conducted on the carcases. Striploin samples were collected from each carcase and evaluated for tenderness and other meat quality parameters at the University of New England (UNE) meat science laboratory.

MSA carcase assessment found that the F1 Senepol steers on average were graded 2 boning groups better than the Brahmans (the price received for carcases is determined by the boning group that they are graded into). The average boning group was 6.3 for the F1 Senepols and 8.3 for the Brahmans. Shear force tests conducted by the UNE meat science lab were used to assess the tenderness of the meat and the striploin samples from the F1 Senepol steers were found to have significantly lower (P<0.05) average shear force values than the Brahmans (3.43 kg vs 3.86 kg).

It should be noted that while the meat of the F1 Senepols was found to be more tender than the Brahmans, that the meat from the Brahmans in this study was actually found to be quite tender (shear force values of below 4.0 kg are considered to be tender). The shear force values for the Brahman steers in this study were quite low in comparison to values that have been found from other Brahmans (evaluation of data from 1,298 Brahman striploin samples found that the average shear force was 5.5 kg with a range of 2.53 to 16.88 kg - Rod Polkinghorne pers. comm.). The good tenderness results found for both genotypes in this study is likely to be due to the fact that they had grown well and were relatively young for their weight at slaughter (the average estimated age at slaughter of the steers was 21.5 months and the average carcase weight was about 238 kg).

This meat quality study combined with previous research which has found that the F1 Senepols perform at least as well or better than Brahmans in every growth and fertility measure studied so far by the NT DPIF, suggests that crossbreeding with a tropically adapted Bos taurus breed such as the Senepol may be a good way for north Australian cattle producers to increase their marketing options.

Senepol African HybridsTropical adapted Taurus, [T.A.T.S.]

Our Senepol African Hybrid, is a mix of Senepol, Belmont and Bonsmara genetics. This is still a Adapted Bos Taurus mix, with slick coats, poll/scurred, but retaining extra hybrid vigour in subsequent generations. We are able to offer group breedplan EBV’s through the Tropical Composite register and have recorded scrotal circumferences at yearling and 18 months of age.

These Tropical Adapted Taurus, [T.A.T.S.] have proven to work successfully in many different tropical environments, including NT, The Gulf, Western Queensland, and northern coastal NSW. Being tropically adapted and also 100% Bos Taurus, they are able to increase fertility in Bos Indicus herds, as well as increase meat quality, and therefore MSA grading in most tropical and sub tropical herds. More calves, more hybrid vigour, more growth, more pregnancies, less temperament, means more compliance and more profit. A simple equation.

STUD STOCK — AUCTION TERMS ANDCONDITIONS OF SALE

IMPORTANT NOTE! All bids shall be treated as offers made upon the following Terms and Conditions of Sale and all persons present are admitted to attend the sale on the basis that they gave notice of these Terms and Conditions.1. The highest bidder shall, subject to Condition 2, be the Purchaser provided that the Vendor reserves the right to bid

either by himself or through his Agent or Auctioneer and should any dispute arise among the bidders for any lot, during or immediately after the sale of the lot, it shall be settled at the Auctioneers absolute discretion who may, should one of the disputants advance, put the lot or lots up again. The bidding from time to time shall be regulated by the Auctioneer and no bid shall be retracted.

2. The sale will be conducted on a “Sale” or “No Sale” basis whereby the lot for sale shall be knocked down to the highest bidder, but the sale will be subject to the acceptance of the highest bid by the Vendor who will immediately after the fall of the hammer declare “Sale” or “No Sale”. Should the Vendor reject the bid of the highest bidder such bidder will have the right of first refusal of the lot at the Vendor’s nominated price for one hour after the lot has been passed out of the ring on the Terms and Conditions herein set forth in so far as they shall apply.

3. The details of the Purchaser, the purchase price and the lot sold as recorded by the sale clerk for and on behalf of the Auctioneer shall be equally binding on both Purchaser and Vendor.

4. The Auctioneer expressly reserves the right, without giving any reasons therefor, to:— (a) Refuse to acknowledge any bid; (b) Withdraw any lot or lots before or during the sale; (c) Exclude any person from the auction venue should it think fit.5. Each lot in all cases shall be at the risk and expense of the Purchaser upon acceptance of his bid by the Vendor or upon

acceptance of the highest bidder’s offer by the Vendor whichever shall be the earlier.6. Except as expressly provided in these Terms and Conditions of Sale no guarantee or warranty shall be given in respect of

any lot sold under these Conditions as to pedigree, sex, age, breeding condition or otherwise howsoever and no guarantee, warranty or condition whatsoever shall be implied from any affirmation made before or at the time of the sale, or from any circumstances of the sale, but in all cases where a guarantee is intended the same shall attach and be enforceable only if reduced to writing before delivery of the lot and signed by the Vendor or by the Auctioneer acting as agent for the Vendor, and the absence of such writing shall be conclusive evidence in case of dispute that no guarantee, warranty or condition whatsoever was given or implied.

7. In the event of any dispute in respect of the sale of any lot:(i) The Purchaser shall nevertheless be obliged to pay to the Auctioneer the full purchase price and any other monies or

interest payable by the Purchaser in accordance with these terms and conditions;(ii) The Vendor and the Purchaser shall resolve the dispute between themselves;(iii) The Auctioneer shall have no liability or responsibility in regard to the dispute; and(iv) No lot shall be returned to the Auctioneer and the Purchaser shall indemnify the Auctioneer for all costs, expenses and

damages which the Auctioneer is put to or incurs by reason of the Purchaser so doing.8. The name of the Vendor for whom the Auctioneer acts is acknowledged to have been furnished to Purchasers prior to the

sale and further particulars will in all cases be furnished to a Purchaser if required. In the case of any dispute the remedy of the Purchaser shall be against the Vendor only and in no case or under any circumstances against the Auctioneer who is to be regarded for all intents and purposes as agent for a disclosed principal.

9 (a). PAYMENT — Unless prior credit arrangements have been made in writing with the Auctioneer the full purchase price for each lot shall be due and payable to the Auctioneer in cash upon acceptance of the highest bid or the highest bidder’s offer by the Vendor and prior to delivery. Notwithstanding that delivery is given to or possession obtained by the purchaser or his representative prior to the payment of the purchase money in full the property in any lot which is sold shall not pass to the Purchaser until the full purchase price and all cheques, promissory notes, bills of exchange, acceptance orders or drafts given in connection with such payment have been paid and liquidated and until property shall pass, the Purchaser shall hold such lot as bailee, provided that in all cases should such payment not have been made and liquidated within 14 days of the date of the sale the Auctioneer reserves the right to:—(i) Rescind the contract on behalf of the Vendor and repossess and resell any lot;(ii) Recover from the Purchaser interest upon the purchase price at a rate per annum which aggregates the AMBA Bill

rate and two percentum. For the purposes of this condition, the expression “the AMBA Bill Rate” is the rate published by the Australian Merchant Bankers Association in good faith as at the date of the sale as its bill rate for 180 day bills of exchange expressed as a percentage per annum. If at any time the AMBA Bill Rate becomes unavailable for any reason, the Auctioneer shall determine and advise the Purchaser of the interest rate to apply for the purposes of this condition.

(b) The Auctioneer is selling as the del credere agent of the Vendor and the full purchase price of any lot sold shall be payable by the Purchaser to the Auctioneer and be fully recoverable by the Auctioneer in its own name.

10. If the Purchaser shall neglect or fail to comply with any of the within conditions, any lot purchased by him may be immediately resold by public auction or private contract, with or without notice, at the risk of the former Purchaser, who will be held responsible for all loss and expenses arising out of such resale and shall not participate in any profit accruing therefrom.

11. Any Vendor or Purchaser removing the sale number from any lot after it has been sold will fully indemnify all affected parties for any loss, costs or damage should the lot be wrongly delivered.

12. The Purchasers, if any more than one, shall be jointly and severally bound by these Terms and Conditions and shall jointly and severally carry out and perform same.

13. Any person who advances a bid on a lot shall do so on the expressed condition and understanding that should that person’s bid be the highest bid and such bid is accepted by the Vendor then that person will be held personally liable for the price so agreed upon, regardless of the fact that that person may be acting on behalf of another party, either disclosed or undisclosed to the Vendor or Auctioneer, provided however, that this Condition shall not in any way negate the Vendor’s right to claim against any principal and in such case the bidder’s liability shall be construed to be by way of guarantee.

14. The Auctioneer may, should it think fit, make arrangements on a Purchaser’s behalf for the feeding, watering, trucking, shipping of and general attendance to any lot after sale but no responsibility will be accepted by the Auctioneer and all such service will be at the Purchaser’s risk and expense.

15. No lot will be delivered until the sales invoice has been checked and signed by the Purchaser or his duly authorised representative.

16 (a). Each lot in all cases shall be sold with all faults, if any and excepting those conditions and warranties implied by the Trade Practices Act or any applicable State legislation which cannot be contractually excluded and excepting conditions and warranties expressly contained in these Terms and Conditions of Sale, any express or implied condition, statement of warranty, statutory or otherwise, is hereby excluded. The Auctioneer is not liable in respect of any error, misdescription or omission shall entitle the Purchaser to annul the sale or reject the lot or claim any compensation, damage or abatement in price.

(b). Each lot will be sold subject to passing all veterinary tests required by the law of the state or country to which the Purchaser intends to transport that particular lot, such tests to be undertaken at the Purchaser’s expense and concluded immediately following the sale. In the event of a lot failing to pass these tests, the sale shall be null and void, any purchase moneys paid by the Purchaser shall be refunded and property in the lot shall revert to or remain with the Vendor.

17. Guarantees of Fertility:—(1) Bulls. Save and except for calves at foot, all bulls are guaranteed breeders and to so prove within six months of the

date of sale or by reaching the age of 24 months whichever date shall be the latter.(2) Females. Save and except for female calves at foot, all females are guaranteed to be in calf or go into calf within 6

months of the date of sale or by the age of 30 months whichever date shall be the latter. A positive pregnancy test certified by a qualified veterinary surgeon shall be sufficient evidence that the animal is in

calf.(3) Claims under Clauses 17 (1) and 17 (2) guarantees of fertility shall be made to the Vendor within six months from the

date of sale or prior to the animal entering a quarantine area other than on the Vendor’s property.(a) All claims must be accompanied by a veterinary certificate issued by a registered veterinarian in accordance with

the guidelines established by the Australian Association of Cattle Veterinarians which shall identify the basis of the claim.

(b) Infertility resulting from injury or disease occurring after the sale of the animal shall not be covered by this guarantee. .

(c) The Vendor retains the right to have the animal placed on a property nominated by him or returned to his own property for further assessment of fertility for a period not exceeding six months. In the event of the animal being proven fertile within the period such status shall be confirmed by a certificate issued by a registered veterinarian in accordance with the guidelines established by the Australian Association of Cattle Veterinarians and costs incurred shall be borne by the purchaser. In the event of the animal not being proven fertile within the period the costs incurred shall be borne by the vendor.

(4) Liability of a Vendor. Except for costs defined elsewhere in the conditions of sale, the liability of a Vendor in respect of claims relating to fertility shall not exceed the purchase price of the animal(s) or provide mutually agreed upon replacement animal(s). .

(5) Refunds. In the event of a claim being substantiated and the purchase price being refunded, the animal/s shall automatically become the property of the Vendor and be returned to him or disposed of according to his instructions at his expense.

(6) This guarantee shall be voided by the Purchaser if:— (a) The animal is returned to the Vendor.

(i) In poor physical condition or with any injury; (ii) tests carried out on behalf of the Vendor within fourteen days of such return proved positive to any diseases

which may affect the animals fertility or ability to breed naturally.

OR

(b) The Purchaser has collected and stored semen from a bull or embryos from a female.(7) In the event of a dispute as to whether a lot is a breeder, such dispute shall be resolved by the Vendor and the

Purchaser and the Auctioneer, while he will use his best endeavours to assist, shall have no liability or responsibility in that regard. In the event that a lot is alleged or proved not to be a breeder, the Purchaser shall nevertheless be obliged to pay the Auctioneer the full purchase price and any other monies or interest payable by the Purchaser in accordance with these Terms and Conditions.

18 (a). Each lot shall be at the risk of the Vendor in respect of any damage or injury, whether by disease, accident or otherwise, or whether caused by the negligence of the Auctioneer for the period that the lot be in the custody of the Auctioneer, unless such lots shall have been sold in which latter case such lot shall be at the risk of the Purchaser in all such respects.

(b) If any Vendor brings to the sale premises any lot which is dangerous, or infected with any disease, that Vendor shall be liable for all injury, damages, costs, losses or expenses which the Auctioneer may sustain, incur or be put to either directly or indirectly as a result of the Vendor so doing. The Auctioneer reserves the right, at its absolute discretion, to exclude from the sale, or put out of the sale venue or dispose of, any lot which in its opinion shows signs of any disease, whether infectious, contagious or not, or of any serious fault or of being dangerous.

19. DELIVERY — Except at the discretion of the Auctioneer no lot shall be delivered to the Purchaser unless payment of the purchase money together with any additional charges incurred including those expenses incurred by the Auctioneer pursuant to Condition 14 hereof, is first made by the Purchaser to the Auctioneer. Release of lots may be withheld by the Auctioneer until personal cheques are cleared.

20. In these Conditions:—(a) References to “Auctioneer” shall be taken to mean as the context so admits, the Selling Agent or any member,

subsidiary or related corporation or body, officer, agent or employee thereof, authorised by the Vendor to conduct the sale of the lot;

(b) “Purchaser” shall have the meaning ascribed to it in Condition 1;(c) “Vendor” shall mean the person or corporation upon whose account lots are offered for sale and where a stud or farm

is named shall mean the proprietor of that stud or farm;(d) “Lot” shall be taken to mean the animal offered for sale and/or sold by the Auctioneer on behalf of a Vendor.

IMPORTANT NOTICEThe Selling Agent, its members, subsidiary or related corporations, officers, agents and employees

for themselves and for those for whom they act while exercising due care provide all information without responsibility and give no guarantee whatsoever as to its accuracy.

All persons who attend the Sale do so entirely at their risk and the Selling Agent, its members, subsidiary or related corporations, officers, agents, employees and its principals, for themselves and for those for whom they act, do not assume or accept any responsibility or liability of whatever nature for any injury or damage whatsoever which may occur.
