2018 Cascades of Fire International Fireworks Competition Rules NO PURCHASE NECESSARY. By participating in the Cascades of Fire International Fireworks Competition (the “Competition”), each entrant agrees to abide by and be bound by these Official Rules and all decisions of Winter Festival of Lights (the “Sponsor”), which shall be final and binding, without right of appeal, in all matters relating to this Competition and the awarding of the prize(s), including without limitation eligibility and/or disqualification of entries. 1. Eligibility The Competition is open by invitation only to fireworks teams whose members are legal residents of their respective countries and who are at least nineteen (19) years of age and have reached the age of majority in their jurisdiction of residence. Team members must complete a Cascades of Fire International Fireworks Competition Team Form and provide photo ID, passport and copies of their valid firework license from their home jurisdiction. Excluded from eligibility are the officers, directors, employees, agents and representatives of Sponsor, any Competition judges, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies (collectively, the "Promotion Entities"), and members of the immediate families (defined as parents, siblings, children and spouses, regardless of where they live) or households (whether or not related) of such officers, directors, employees, agents and representatives. 2. Deadlines Registration for the Competition is open from 12:00:01 a.m. at entrant’s local time on April 20 th , 2018 and ends at 11:59:59 p.m. local time on July 30, 2018 (the “Competition Period”). Completed registration form and all required documents must be received during the Competition Period. Any registration forms received after the end of the Competition Period will be rejected. Final script must be forwarded to Sponsor’s Technical Director by August 24, 2018. Photographs of each team member must be provided by July 30, 2018. 3. NO PURCHASE NECESSARY. By participating in the Cascades of Fire International Fireworks Competition (the “Competition”), each entrant agrees to abide by and be bound by these Official Rules and all decisions of Winter Festival of Lights (the “Sponsor”), which shall be final and binding, without right of appeal, in all matters relating to this Competition and the awarding of the prize(s), including without limitation eligibility and/or disqualification of entries.

1. Eligibility

The Competition is open by invitation only to fireworks teams whose members are legal residents of their respective countries and who are at least nineteen (19) years of age and have reached the age of majority in their jurisdiction of residence. 3. Event

The Competition event will take place in Niagara Falls, Ontario on November 9-11 and 16-18, 2019 (the “Event”), and attendance at Event is required to be eligible. acceptance of the invitation. All efforts will be made to accommodate team preferences, but scheduling will be at Sponsor’s sole discretion.

4. Display Requirements

Team members must conduct themselves in a polite and professional manner at all times at the Event and otherwise in connection with the Competition, and be in compliance with the following Display Requirements:

• Duration. The duration of display should be in the 16-18 minute range. • Installation. Installation of each display will be done by local crews under the control of a

Supervisor-in-Charge with assistance from the team members. The Supervisor-in-Charge will report any problems directly to the Technical Director whose decision is final.

• Product. Teams must comply with Sponsor’s direction on permissible products. Teams must provide Sponsor with a list of the product to be used by August 15, 2019. This will enable us to secure product in good time.

• Show Script. Teams must provide the final script must be forwarded to Sponsor’s Technical Director by August 24, 2019. Failure to do so will result in the team being disqualified. A .csv file, or a file compatible with Finale Fireworks is required.

• Firing Equipment. The firing equipment will be Pyromate digital system. The number and type of modules in each position is indicated on the site plan.

• Budget. The budget for each team is $25,000 CAD. NOTE: However, teams will be allowed to expand their program by including additional product at their own cost or by sponsorship.

• Canadian Fireworks Operator Certificate. Team members must hold a valid Canadian Fireworks Operator Certificate. Sponsor will apply for a “VISITOR” certificate for eligible team members. Each team member must provide Sponsor with verification of certification/licensing to use display fireworks from team member’s home country as well as a photograph of each team member (comprising head and shoulders, digital is acceptable). The deadline for this is July 30, 2019.

• Mortors / Igniters / Pyrotechnics. The maximum number of mortars available to each team is as follows: 3” 430 4” 539 5” 199 6” 135. Maximum of one igniter per shell. Low level maximum is 963 cues. Sponsor may, at its sole discretion, add 7”, 8”, 10”, and 12” shells, with the effects and quantities staying the same for each team. Comet/candle racks will be built as required.

• Site Plan. Installation must be designed according to the Site Plan provided in Schedule A below.

• On-site Access During Show. Maximum of two (2) individuals are allowed at the firing site during the display, consisting of the local supervisor for the team, and one (1) of the visiting team members.

• Post-show. The mortars must not be approached until 30 minutes after the display, at which time the local supervisor and the visiting team representative will check the mortars for unfired items,

remove them, and when safe to do so, give the “all clear” to the Technical Director or his designate.

• Safety.

1. All team members must receive security clearance from Ontario Power Generation – this is to comply with site and security regulations. 2. Due to site regulations, all personnel must wear protective clothing/footwear as required. 3. The fireworks for each team will be stored in their own sea container which must be kept locked when not in use. At the end of each day the key(s) must be returned to the Technical Director. 4. An undercover preparation area will be made available to each team at the firing zone to enable preparation of pyrotechnic devices. 5. It is strictly forbidden to assemble pyrotechnic pieces in the storage facility. 6. It is strictly forbidden to leave any pyrotechnics not directly being worked on outside of storage containers. 7. Any incident occurring on site that involves pyrotechnics must be reported immediately to the Technical Director. 8. Teams may only have 2 cartons of any 1.3G items in the preparation site at one time. The preparation area must be kept clean at all times. 9. The storage facility doors of the storage area must be closed at all times except for handling purposes, until required. 10. The preparation site should be cleared of any pyrotechnic pieces at the end of each day. 11. Modification of any pyrotechnic device is strictly forbidden. 12. The removal of protective plastic covers from electric igniters is strictly forbidden. 13. It is forbidden to use portable communication devices, such as radios and cellular telephones, if you are within 4 m of electric matches and electrically fired fireworks. Do not carry these devices if you are handling fireworks that have an electric igniter. 14. It is forbidden to consume ignited or intoxicating substances (such as tobacco, cannabis or alcoholic beverages) on the launching ramps, and in preparation sites. 15. It is forbidden to assemble pyrotechnic pieces outside preparation or loading areas. 16. All launching ramps and preparation sites must be kept clean at all times. At the end of each work day, all unused pieces must be stored in one of the storage containers. 17. All work must stop upon the approach of a thunderstorm and may not re-commence without permission from the Technical Director. 18. No pieces or boxes containing pyrotechnic pieces may be taken to the ramps unless it is for immediate loading. 19. The pyrotechnicians must ensure that all shells are properly fitted at the bottom of mortars without forcing them in. It is not permitted to place an aerial shell of inferior caliber in a mortar made to receive.

There are three (3) prizes available to be won, as follows (all CAD):

• First Place: $5,000 plus invitation to provide the opening display for the 2019 Cascades of Fire.

• Second Place: $3,000 • Third Place: $1,000 • Fourth Place: $1,000 • Fifth Place: $1,000

Prizes must be accepted as awarded and may not be substituted or transferred, except at Sponsor’s sole discretion. Sponsor reserves the right, at its sole discretion, to substitute a prize of greater or equivalent monetary value if a prize cannot be awarded as described for any reason. Prizes will be delivered to verified winners only. Sponsor will not replace any lost or stolen prizes. Any other costs or expenses associated with the prizes not specified herein will be the responsibility of selected winners, including without limitation taxes.

6. Judging/Evaluation

Teams will be judged on synchronization to music, musical selection, crowd reaction, use of product and other parameters.

During the Event, performances will be evaluated by a team of judges based on the following criteria (the “Criteria”):

a. Theme and choice of music (the theme of the Competition is “Once upon a time in competing country)”, for example, “Once upon a time in Canada”). 20 points

b. Creativity 20 points c. Selection of effects and use within the display 20 points d. Synchronization to the music selection 20 points e. Crowd reaction and appreciation 20 points

The scoring sheets will be passed to the non-voting Jury Chairperson who will retain the scoring IN CONFIDENCE until after the final performance.

On or about November 18, 2018 at the Event, the Jury Chairperson, together with the jury members, will then tally the total points scored and determine the First, Second, Third, Fourth and Fifth Place teams. The team that receives the highest score on the basis of the Criteria will be selected as the potential winner of the First Place prize. The team that receives the second highest score on the basis of the Criteria will be selected as the potential winner of the Second Place prize, and so on for each prize. Odds of being selected depend on the skill in meeting the Criteria.

In the event of a tie, the team who submits the entry that receives the highest score in category A of the Criteria will be selected as the potential winner. If a tie still remains after this process,

the tie will be broken by conducting a random draw from among all tied entries for the purpose of selecting the potential winner(s).

Please note that the awards will be presented by the Mayor of Niagara Falls at the closing ceremony scheduled for Sunday, November 18, 2019. Potential winners must attend the closing ceremony to be eligible for a prize. If, due to their own commitments, team members are unable to remain for the awards ceremony they must nominate a person to act on their behalf at the ceremony.

7. Selected Entrant Verification and Prize Claim Conditions Selected teams will be notified of selection as a potential winner at the Event. In order to be declared a winner, selected teams must sign and return to Sponsor within the required time period a written declaration and release form, releasing the Promotion Entities from any liability in connection with this Competition or the use, misuse, awarding or possession of any prize (the “Release”); and otherwise comply with these Official Rules. Failure to provide proof of eligibility (if requested), Release, or other required documentation in a timely manner, or other non-compliance with these Official Rules may result in disqualification, forfeiture of the prize and, at Sponsor’s sole discretion, selection of an alternate eligible team for the forfeited prize in accordance with these Official Rules, who will be subject to disqualification in the same manner.

8. Right to Void / Terminate / Suspend / Modify Sponsor reserves the right to terminate, suspend or modify this Competition, in whole or in part, at any time and without notice or obligation if, in Sponsor's sole discretion, any factor interferes with its proper conduct as contemplated by these Official Rules. Without limiting the generality of the foregoing, if the Competition, or any part thereof, is not capable of running as planned for any reason, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, programming errors, or technical failures, which, in the sole discretion of Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, Sponsor may, in its sole discretion, void any suspect entries and: (a) terminate the Competition, or any portion thereof; (b) modify or suspend the Competition, or any portion thereof, to address the impairment and then resume the Competition, or relevant portion, in a manner that best conforms to the spirit of these Official Rules; and/or (c) award the prizes from among the eligible, non-suspect entries received up to the time of the impairment in accordance with the winner selection criteria discussed above. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process, the operation of the Competition, violates the Official Rules, or acts with intent to annoy, abuse, threaten or harass any other person.

9. Limitation of Liability and Releases BY PARTICIPATING IN THIS COMPETITION, TEAMS AND TEAM MEMBERS AGREE THAT SPONSOR, COMPETITION JUDGES AND THE PROMOTION ENTITIES HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY TEAMS AND TEAM MEMBERS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL,

CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM THE COMPETITION, INCLUDING THE ACCEPTANCE, POSSESSION, MISUSE OR USE OF THE PRIZE, OR THE MERCHANDISE FOR WHICH IT IS REDEEMED (IF APPLICABLE). FURTHER, BY PARTICIPATING IN THIS COMPETITION, TEAMS AND TEAM MEMBERS AGREE THAT SPONSOR, COMPETITION JUDGES AND PROMOTION ENTITIES HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY TEAMS AND TEAM MEMBERS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM: A) ENTRY OR PARTICIPATION IN THIS COMPETITION, INCLUDING RELATED TRAVEL AND ATTENDANCE AT THE EVENT, OR B) ANY CLAIMS BASED ON PERSONALITY OR PRIVACY RIGHTS, DEFAMATION OR MERCHANDISE DELIVERY. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you. Without limiting the foregoing, Sponsor, Competition judges and the Promotion Entities, and any of Sponsor's other suppliers or contractors, shall not be responsible for: (a) any incomplete or inaccurate information that is caused by any of the equipment or programming associated with or utilized in the Competition, or by any technical or human error which may occur in the processing of submissions or displays in the Competition; (b) lost, interrupted, or unavailable network, server, service provider, on-line systems, telephone networks or telephone lines, or any other connections; (c) the theft, destruction, loss or unauthorized access to, or alteration of, entries; (d) any problems with, or malfunctions or failures of, telephone networks or lines, computers or computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (e) garbled transmissions or miscommunications; (f) failure of any e-mail to be received by or from the Competition judges or Sponsor for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (g) damage to a user's computer equipment (software or hardware) occasioned by participation or downloading of materials related to this Competition; (h) printing, distribution, programming or production errors, and any other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise; or (i) technical, pictorial, typographical or editorial errors or omissions contained herein.

10. Protection Of Personal Information and Publicity Release Sponsor and its authorized agents will collect, use, and disclose the personal information you provide when you enter the Competition for the purposes of administering the Competition and prize fulfillment. 11. General Conditions All entries become the property of Sponsor and will not be returned and no correspondence will be made with or entered into except with selected teams. By participating in the Competition, teams and team members agree that Sponsor, Competition judges and the Promotion Entities have not made, with respect to each of their own products/services provided as a prize or part thereof (if applicable), any warranty, representation or guarantee express or implied, in fact or in law, with respect to the prize and specifically disclaim all such warranties, including without

limitation, the implied warranties of merchantability and fitness for a particular purpose. Winning a prize is contingent on fulfilling all the requirements set forth herein. Mass entries, automated entries, entries submitted by third parties, and any entries or prize claims that are late, incomplete, fraudulent, illegible, unidentified or delayed will be void. All entries and prize claims are subject to verification. Proof of entry submission does not constitute proof of receipt. Team and team members agree to abide by these Official Rules. Decisions of Sponsor and/or any independent Competition judging organization will be final and binding on all matters pertaining to this Competition. Competition is subject to all applicable federal, provincial and municipal laws. Void where prohibited. Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, then the Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. The Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate or necessary to comply with applicable law. Should a winner make any false statement(s) in any document referenced above, the winner may be required to promptly return to Sponsor his/her prize, or the cash value thereof. WARNING: ANY ATTEMPT BY TEAM, TEAM MEMBER OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS COMPETITION OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of the person who submitted any entry, the authorized account holder of the e-mail address submitted at registration will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an access provider, service provider, or other person or organization responsible for assigning e-mail addresses for the account associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.
