Good morning/afternoon, your honor and ladies and gentlemen of the jury. I, Anna Karas, and my co counsel, Zoe Adams, are representing MN in today’s proceedings.We are here to explain to you why the defendant, Madison Casco, is guilty of grand theft by the means of credit card fraud. Madison had an easy way to obtain all information that he needed to use the credit cards of others and use the anonymous school computer accounts to purchase the thousands of dollars of electronics. As a volunteer for Librarian LaPoint, Madison had access to all the usernames and passwords created by New Prague High, even those that hadn’t yet been assigned to anybody. He thought his actions were untraceable because of his use of unassigned accounts on school computers. On the contrary, with Madison’s elaborate drop off system, the correlations in the times the purchases, the evidence found in his apartment, and the [large sums of cash from buying and selling the objects on his person] prove his culpability. When Officer Brosnan did a search of Madison’s apartment, he found very new technology with serial numbers matching those of the ones bought with a stolen credit card. When talking to his long time best friend Devon, Madison was very short and secretive (an unusual thing, as the boys have always been very open with each other). Devon became very suspicious because of how Madison was acting and how complicated the drop-off system was.While Madison may reverse the roles of her and Devon by pinning the crime on Devon, the time frame and location of the purchases are clearly paralleled to Madison’s daily routine at school. Devon was in calculus between 10:00 and 10:50, not in the library like Madison.Through the facts in the witness statements of Devon Wilshire, Officer Rory Brosnan, and Librarian Pat LaPoint, Madison Casco is plainly guilty on charge of grand theft by credit card fraud. We beg you, the jury, to see through the lies of the defense and find Madison guilty.

OPENING STATEMENT - Defense

Good morning/afternoon, your honor and ladies and gentlemen of the jury. I, Zoe Adams, and my co counsel, Anna Karas, are representing Madison Casco in today’s proceedings. We are here to explain to you why the defendant is innocent of the charges brought against him.Madison is known at school and in his workplace as a hard worker. He was chosen by New Prague High’s librarian as a volunteer, a rather difficult position to attain. At work, Madison is a model employee that other servers would do well to emulate. Never has his employer, K.C. Cline, received a complaint about his servers. Not only is credit card fraud completely out of character for such an exemplary student and employee, but there is no evidence to prove that he is guilty of such a crime.Although Madison volunteers in the library around the same time that the fraudulent purchases were made, there is no one to attest to Madison’s involvement. The purchases were made from an anonymous student account, making it impossible to trace the website IP addresses back to a specific student. Furthermore, the librarian never saw Madison access the list of student logins and passwords.The fact that the fraudulently purchased goods were shipped to Windsor Arms Apartments does not point towards Madison as the person who ordered them. Today, two other witnesses also live in that apartment complex. Besides, Madison has not been seen picking up any packages in the apartment’s lobby.And regarding the money found on Madison’s person at school, she was unaware of New Prague High’s rule against carrying large sums of money.Madison has been deemed a trustworthy and hardworking student by school faculty, his employer, and his friends. If his incredible character is not proof enough of his innocence, the lack of physical evidence secures it. Ladies and gentlemen of the jury, Madison Casco is not guilty of grand theft via credit card fraud.

Your honor and ladies and gentlemen of the jury, Madison Casco is guilty of grand theft by the means of credit card fraud.Through the questioning of the witnesses and the evidence brought forth today, Madison is culpable for this crime beyond a reasonable doubt. He had an easy way to obtain all information that he needed to use the credit cards of others and use the anonymous school computer accounts to purchase the thousands of dollars of electronics. He was in the library at the time of the purchases, and he was seen near the drop off location multiple times. The items were shipped to Madison’s apartment complex and found in his family’s individual apartment. He was carrying around a thousand dollars for no concrete reason.All in all, the timeline of Madison’s daily activities aligns perfectly with that of the crime. He was given the opportunities to steal the credit card information, to use anonymous computer accounts, to make the fraudulent purchases, and to pick up the items without being seen.Ladies and gentlemen of the jury, Madison Casco is guilty. Your job is to make a ruling based on the facts presented to you. Consider every connection Madison has with the cases of credit card fraud. Uphold justice and free those victimized by Madison’s heinous crime by convicting him of grand theft via credit card fraud.

enough evidence to link Madison to the credit card fraud. Madison holds a very positive reputation amongst those who know him; as stated by our witnesses, he is a very honest and hardworking young man. He set time aside every day to volunteer for Pat LaPoint, the school librarian. He was an exemplary employee for K.C. Cline and frequently waited on returning customers that requested him as a server. Furthermore, despite Madison’s access to the credit card information of the diners, not one complaint was received indicating that credit cards were stolen. Through his job at the restaurant, Madison had a substantial income, therefore minimizing the oddity of his purchasing new electronics.Before this, there has been no record of Madison experiencing a single run-in with the law. There is no reason to alter such a record. At the most, Madison was in the wrong place at the wrong time, just as the drug dogs indicated a false positive; they alerted to his bag, and yet no drugs were found. Because of his dedication to Ms. LaPoint as a volunteer in the library, Madison is the easiest person to frame for the crime. However, his outstanding work ethic and reputation sharply contrast such a heinous crime.If the merits of Madison Casco that have been stated have not yet persuaded you of his innocence, let the evidence remind you of the lack of proof beyond a reasonable doubt. None of the emails sent in regards to monetary and product exchanges can be proven to be sent by Madison. Only weak and biased assumptions can be made claiming that Madison was the author of such communications. Comparatively, the student using the anonymous student account to purchase the electronics cannot be identified due to the nature of these “extra” accounts. And finally, no one has attested to physically seeing Madison place either money or electronic devices in the library, nor has anyone seen him picking up such devices in the common area of his apartment complex.Credit card fraud is against the character of Madison, and there is no proof beyond a reasonable doubt that he is guilty of it. Madison Casco is innocent of any form of credit card fraud. Ladies and gentlemen of the jury, remember the requirements needed to convict the defendant, and do not find Madison Casco guilty of grand theft via credit card fraud.

Madison Casco is guilty of Credit Card Fraud — Grand Theft or the lesser crime of Theft and Receiving Stolen Property. Her knowledge of her teacher’s receipts and pay stubs with no explanation to why or how she go this information leads to much suspicion. Her story of always being suspicious and curious to what her friend Devon was doing is false. She never acted and/or questioned her friend and when she claimed to ask her friend about what was up, she claimed “I don’t remember what the response was”. Several of the products reported as being stolen were things she had herself. She had roughly $1000 in cash at school which is $900 more than what is allowed at school.

Madison Casco is not guilty of Credit Card Fraud — Grand Theft or the lesser crime of Theft and Receiving Stolen Property. Devon Wilshire has been purchasing products for her “friend” and several other people for several months. Devon and Madison have been friends their entire lives so Madison felt no reason to question her friends intentions. Devon was the one who stole the credit card and started to purchase the items.

Madison Casco:1) In your testimony on line 7-9, you said that your friend, Devon, was able to get you anything you wanted for 50% off, you said you were suspicious. How come you never asked her how she was able to do this?2) Is it possible that someone else was buying all these products for you? "I eventually said something offhanded to Madison, who told me that an uncle (Madison called him Uncle Johnny) worked at some big retailer, like Nordstrom’s or something, and that the uncle was getting all this stuff for Madison at half-off." This is a quote from Devon's testimony saying that your uncle was getting you this stuff half-off 3) In line 27-28, you said "We all knew about how Conley keeps every receipt and piece of paper and pay stub and everything." You never said Conley told you himself, so how'd you come up with this information? 4) "I asked Devon what was going on, but I don’t really remember what the response was." How could you not remember something so important like this?

Your honor, ladies and gentlemen of the jury, My name is Brian Waddick and this is my co-counsel Isaac Wilkowske, today we are representing the State of Minnesota. We are here today to determine the fate of Madison Casco who is being charged of Grand Theft by means of credit card fraud. Throughout this trial we will bring to light undoubtable evidence proving Madison's committed crime. Now, imagine a friend, one you've known for over a decade, with all the memories you've shared with this companion, one you have unwavering trust in...Now imagine one day that friend accuses you of a crime you didn't commit, in truth your friend did. This is what happened to Devon Wilshire(on April 3). Starting from January to April Madison Casco intentionally obtained items of various prices by use of other people’s credit cards without their consent. Madison not only stole but made a profit by selling all of the stolen items for half-off to students in New Prague High School. One of these students was Devon, Madison’s best friend. During the four months, Madison bought on the Internet and sold 11 electronic items to students. The exchange of items and money occurred in the school’s library after a time and date was set through the exchange of emails by Madison’s anonymous email and the buyer. On April 3 , the date Madison’s operation was suspended. That day a drug search was conducted in school and Madison was found carrying $1000. Four witnesses will be called on behalf of the prosecution. First Devon himself will share the story of what actually happened. Supporting him will be librarian Pat LaPoint sharing with you important details on Madison’s selective access to computer info at the school. Officer Rory Brosnan will share the evidence of Madison’s crime. Lastly, accomplished chemistry teacher Chris Conely will give his thoughts and knowledge being one of Madison’s victims. May the justice system of this fair land deliver retribution.

Your honor, ladies and gentlemen of the jury, my name is Isaac Wilkowske and this is my co-counsel Brian Waddick. We are here today to represent the defendant, Madison Casco in the case State vs. Casco. Your job as the jury is to uphold the law by proving the defendant not guilty. The defendant, Madison Casco, has been charged with 2 counts: Grand theft and/or receiving stolen property. These counts are offensive demoralizing to my client's character. The defendant is known has a hardworking and trustworthy individual. As a responsible person preparing for her future Madison works diligently to make as much money has she can. With that said, it's apparent that Madison has no reason to resort to any criminal activities especially ones concerning money. Madison learned of a way to get any product half-off of its retail price through her friend, Devon Wilshire. The defendant used this system to buy a few things with her hard-earned money. What Madison wasn't aware of was that the items were illegally obtained; Devon stole them using credit card fraud. Devon had access to Chris Conley’s credit card information and was seen snooping around his desk. He was also seen by Jamie Sung, an apartment neighbor, mysteriously collecting packages in the apartment lobby. Devon’s mother, Lola, called the school when she saw Devon coming home with items they couldn’t afford. Rory Brosnan, the school resource officer handled the situation terribly. Rather than questioning Devon, Rory searched Madison’s bag and confiscated a folder with $1,000 in earnings from the Crius restaurant. Rory concluded that the money was stolen and arrested her. Furthermore, when Brosnan found a stolen camera in the library, rather than taking custody of the item, Brosnan left the room to attend to another matter, an example of irresponsible police work. Four witnesses will be called to help prove the defendant’s innocence.

Devon Wilshire unknowingly involved/ associated himself with a criminal and now is being wrongly blamed for it. Let me ask you this- does a best friend throw you under the bus/ Does a decent person? The answer is no and Madison Casco is not only an indecent friend, but also a criminal. All or any doubt that Madison didn’t commit the crime should be evaporated due to the underlining fact that the majority of the purchases were made online, during 3rd hour, on a school computer, located in the library, where Madison is volunteering and who has access to ‘extra’ accounts...And Devon is in Calculus. It is neither possible nor reasonable to believe that Devon had any part to this crime. The facts and evidence add up and point to only one possible culprit, Madison Casco. Thank you your honor, ladies and gentlemen of the jury.

CLOSING STATEMENT - Defense

In conclusion, the prosecution has presented no concrete evidence that Madison indeed committed these crimes. A simple misunderstanding happened when Madison trusted the wrong person, Devon Wilshire. Devon Wilshire tricked his peers into buying stolen property and selfishly profited off it. Rory Brosnan wrongly arrested Madison with no outstanding evidence that she had placed the stolen camera on the shelf in the Russian Lit section of the library. Devon put the camera on the shelf in attempt to again profit off a stolen item. The witnesses established Madison as a smart and hardworking individual who wouldn't commit a crime, and Devon as a lackluster teen with no ambition. Madison did not sell stolen items, or receive anything she thought was stolen. To uphold justice in this country, please find the defendant not guilty on all charges.

OPENING STATEMENT - Prosecution

Your Honor and ladies and gentlemen of the jury my name is Bayley and this is my partner Cole, and we are the prosecutors in the case State of Minnesota vs. Casco. We are here today to bring justice to the many people of New Prague, Minnesota who were victims of fraudulent purchases on credit cards. Around the time February 2015, there were multiple reports of credit card fraud all in the same area. Officer Brosnan, The officer in charge of this case, discovered that items purchased were bought from the computers of New Prague High School. After another report of credit card fraud came from a teacher in the school, he was almost certain that the culprit was a student within this school. Officer Brosnan, Pat Lapoint, and Chris Conley, can all place madison Casco at suspected places within the school, including the computer lab where the fraudulent purchases were made and where the blank student I.D.’s are kept, at a section in the library where item exchanges were being made, and in the office of the teacher who was a victim of credit card fraud. Ms. Casco was also discovered, during a routine drug search, to be carrying $1000 in cash with her at school, right when a possible exchange of items in the library was discovered. There are those who testified that Ms. Casco was a ice girl who would never commit this kind of crime, but these testimonies are based all on emotion and are given by people who cannot accept that their dear friend is a criminal. These statements hold no water and the evidence here is strong. It is your duty as the jury to put criminals behind bars so that they cannot commit more crimes, so I ask that you do your jobs and make the right choice.

Your Honor and ladies and gentlemen of the jury, my name is Bayley and this is my partner Cole. We are representing the defendant Madison Casco in the case State of Minnesota vs. Casco. Starting around February 2015 the New Prague police department began to receive numerous cases of fraudulent purchases on credit cards in their area, Officer Rory Brosnan was in charge of the case and began to investigate these crimes. Through the assistance of the many companies that supplied the items purchased and the help of Pat LaPoint, he was able to narrow down the location of the purchases to the computers of New Prague High School. Multiple witnesses came forward testifying against Madison Casco, and through a series of coincidences the Police were able to discover evidence that they believed proved that Madison Casco was responsible for the cases of credit card fraud. But I would like to point out that this is not airtight proof of Ms. Casco’s guilt. River Leno, K.C. Cline, and Jamie Sung, testified that Madison was a hardworking student who earned money on her own and worked hard in everything she did. To recount the evidence given against her in testimonies, much of it is based on speculations and flimsy evidence that could mean different things. Officer Brosnan based his investigation on facts that could be just as easily used to prove Devon Wilshire guilty, And Pat LaPoint never saw Madison completing the purchases or exchanges that she is being accused of. Multiple people have placed at her in areas where she would have access to the materials needed to commit the crimes in the school; she had access to the school computers and the student logins that would keep her identity a mystery. She also had the opportunity to gather the information needed to purchase items in Chris Conley’s name. I, Zoe Adams, and my co counsel, Anna Karas, are here to explain to you why the defendant, Madison Casco, is guilty of grand theft by the means of credit card fraud. Madison had an easy way to obtain all information that he needed to use the credit cards of others and use the anonymous school computer accounts to purchase the thousands of dollars of electronics. As a volunteer for Librarian LaPoint, Madison had access to all the usernames and passwords created by New Prague High, even those that hadn’t yet been assigned to anybody. He thought his actions were untraceable because of his use of unassigned accounts on school computers. On the contrary, with Madison’s elaborate drop off system, the correlations in the times the purchases, the evidence found in his apartment, and the [large sums of cash from buying and selling the objects on his person] prove his culpability. When Officer Brosnan did a search of Madison’s apartment, he found very new technology with serial numbers matching those of the ones bought with a stolen credit card. When talking to his long time best friend Devon, Madison was very short and secretive (an unusual thing, as the boys have always been very open with each other). Devon became very suspicious because of how Madison was acting, and how complicated the drop-off system was. Through the facts in the witness statements, as well as how those close to him believed this was not like him, we believe that the jury must find Madison guilty on charge of grand theft by credit card fraud.

OPENING STATEMENT - Defense

Good morning/afternoon, your honor and ladies and gentlemen of the jury. We are here to explain to you why you should rule the defendant as innocent. There are many flaws in the Prosecution witness statements and in their stories. Mr. Chris Conley, the chemistry teacher, says that he was a victim of credit card fraud, because a receipt had been stolen off his desk. Receipts are made of such light paper that it could have just blown off his desk when someone walked by! If someone had stolen the receipt, what information could they really have gotten off of it? Rarely do receipts have your name on them, let alone any actual credit card information (when they do, it’s only the last four digits) as they’re encrypted. When Officer Brosnan talked to Librarian LaPoint, she said that all purchases had been made from student accounts that hadn’t been assigned yet and all were from library computers. Also, when Officer Brosnan searched Madison’s apartment, he found things that were on the list of things bought with a stolen credit card, but found no evidence that Madison was behind it. There was no credit card, or email information to be found. [Officer Brosnan and the Principal of the school became slightly alarmed and suspicious when they found over $1000 in Madison’s backpack, but a couple sources stated that it wasn’t unusual for Madison to carry around large sums of cash.] Officer Brosnan became very suspicious of Madison when he realized that Madison lived in the building where the items were being sent to, but overlooked the fact that Devon Wilshire lives in that building as well. Devon’s mother also became suspicious when he began getting frivolous electronics and wasn’t telling her how he was getting them. He was also very secretive towards anybody else who asked about him getting it at a discount. The owner of the apartments that Devon and Madison live in stated that she had never seen Madison picking up any boxes, but had caught Devon picking up a few and looking suspicious when he was. Many sources, including teachers and bosses, talk about what a trustworthy, kind, and hardworking person Madison is. Based on these statements, we believe that after hearing this case, there will be no doubt of Madison’s innocence.

Furthermore, despite Madison’s access to the credit card information of the diners, not one complaint was received indicating that credit cards were stolen. Through his job at the restaurant, Madison had a substantial income, therefore minimizing the oddity of his purchasing new electronics.Not once has any one of our witnesses ever had trouble with him, and before this, Madison hadn’t had a single run-in with the law. There is no reason to alter such a record. At the most, Madison was in the wrong place at the wrong time, just as the drug dogs indicated a false positive; they alerted to his bag, and yet no drugs were found. Because of his dedication to Librarian LaPoint as a volunteer in the library, Madison is the easiest person to frame for the crime. However, his outstanding work ethic and reputation contrast such a heinous crime.If the merits of Madison Casco that have been stated have not yet persuaded you of his innocence, let the evidence remind you of the lack of proof beyond a reasonable doubt. None of the emails sent in regards to monetary and product exchanges can be proven to be sent by Madison. Only weak and biased assumptions can be made claiming that Madison was the author of such communications. Comparatively, the student using the anonymous student account to purchase the electronics cannot be identified due to the nature of these “extra” accounts. And finally, no one has attested to physically seeing Madison place either money or electronic devices in the library, nor has anyone seen him picking up such devices in the common area of his apartment complex.Credit card fraud is against the character of Madison, and there is no proof beyond a reasonable doubt that he is guilty of it. Madison Casco is innocent of any form of credit card fraud. Based on this testimony, there can be no doubt that Madison is guilty of credit card fraud. Credit card fraud affects millions each year, and can be extremely hard to catch, BUT this is not the case here! It is apparent on many levels that Madison had access to each aspect involved in the case. From the computers in the library, the suspicious back shelves of the Russian Language Section no student ever sets foot in, the teacher’s classroom during lunch. From the looks of her personality Madison would be one of the last students you would expect to be involved, with her hard working persistent personality, and the many jobs she works. This makes for a perfect alibi and an easy blame on her good friend Devon. On the contrary, this would make it quite easy for Madison to commit this fraud with all the many resources she had access to. The facts will also show that Madison had access to the teacher Chris Conley’s room during lunch in which she could have easily had access to his credit card information through receipts. Additionally, Madison was carrying ten times the allowed amount of money in her backpack during school ($1000), a very suspicious amount considering it was hidden in a math folder. To sum, it will become evident that Madison is guilty of these charges.

All the evidence is pointing toward Madison. Please find her guilty on the counts of Credit Card Fraud and Receiving stolen propert. Thank you for your time.

LEGAL ISSUES (How the trial court answered the question and Analysis)

Cruman was convicted in the original trial. The evidence that Cruman argued was not admissible due to how it was acquired was allowed despite his objections, and that led to his conviction. The case was appealed to a lower court and that appeals court upheld the ruling of the first court. This ruling was wrong and that’s why this was brought to the Supreme court.

STATEMENT OF FACTS

On October 22nd, 2014, Principal Lyons of Scrava High School received an anonymous tip that Peter Cruman, a student of Scrava, posted in a Facebook group that he would be selling drugs on campus. Cruman was questioned and denied involvment right away. Lyons asked Cruman to relinquish the username and password to his Facebook account in order to see the post. Cruman refused, but two and a half hours later after intense questioning Cruman logged on to his account for the principal to see. Lyons found the incriminating posts and Cruman admitted to dealing drugs and hand wrote a confession to give to the school. The police later got involved. The school officer was not assisting during the questioning, nor was any other school official besides Lyons. Cruman’s parents were not called until after the questioning and confession.

ARGUMENTS RELATED TO ISSUE 1

The Fourth Amendment states “The right of the people to be secure in their persons, houses, papers and effects against unreasonable searches and seizures shall not be violated,”In Safford Unified School District #1 v. Redding, a teenage girl was unreasonable searched in a school without enough cause to search her. She was strip searched by her vice principal for drugs hiding in her underwear. The girl’s mother sued the school district, which led to the trial. The court ruled in favor of the School at first, as did the district appeals court. The Ninth Circuit Court ruled in favor of Redding, the appellant.The same values apply to the case in question. Cruman was searched unlawfully, as he was forced to give up the rights to his Facebook account to the Principal based only on an anonymous tip. It was not a search of his body, but the Fourth Amendment includes papers which this post can be qualified as. According to this precedent set by the court, Cruman was unlawfully searched and therefore the post cannot be used against Cruman.

ARGUEMNTS RELATED TO ISSUE 2

The Fifth Amendment states “nor shall [any person] be compelled in any criminal case to be a witness against himself,”

In Miranda v. Arizona, the court held that statements made in response to interrogation by a defendant in police custody will be admissible at trial only if the prosecution can show that the defendant was informed of the right to consult with an attorney and of the right against self-incrimination before police questioning. In this case, Ernesto Miranda was arrested based on circumstancial evidence for raping an 18 year old girl. The police never informed Miranda of his right to remain silent, right to representation, or his Fifth amendment right against self-incrimination. The Supreme court ruled that because Miranda was not informed of these rights, his written confession was not voluntary and therefore inadmissible.In today’s case, Cruman was never read his rights. He was taken into custody by the school resource officer, who is a sworn law enforcement officer. Cruman was in custody for the duration of the questioning by Lyons, and therefore in accordance with the precedent set by the Supreme court in Miranda v. Arizona Cruman’s confession during this questioning cannot be admissible because he was never informed of his rights, just as in Miranda’s case.

CONCLUSION

Cruman’s Fourth and Fifth amendment rights were violated. He was not read his rights by the SRO or the Principal, and in order for his confession to be admissible he must be read his rights, as set by Miranda v. Arizona and JDB v. North Carolina, and the fact that he was not violated his Fifth amendment rights. The information from the Facebook posts were searched in violation of Cruman’s Fourth Amendment rights according to the precedent set by Safford School Dist. #1 v. Redding. Therefore, the confession and the Facebook post cannot be admissible in court.
