Respondents/Plaintiffs Lisa Liberi, Lisa Ostella, and GoExcel Globalrespectfully submit this Opposition to the Emergency Motion under Circuit Rule

27-3 y Appellant Orly Taitz, for Order Barring Gittler & Bradford fromRepresenting Appellees, Lisa Liberi, Lisa Ostella, and Go Excel Global, in theAlternative Clarifying Representation of Such Plaintiffs, and Staying BriefingSchedule filed by Appellant/Defendant Orly Taitz ( Taitz ).

1 Taitz has not complied with Circuit Rule 27-3(b)(4), which requires:(4) if the relief sought in the motion was available in the district

court, Bankruptcy Appellate Panel or agency, the motion shall statewhether all grounds advanced in support thereof in this Court weresubmitted to the district court, panel or agency, and if not, why themotion should not be remanded or denied.2 In fact, Taitz and co-defendant Defend Our Freedoms Foundation

(who is represented y Taitz) raised this very issue concerning the representationof Lisa Liberi, Lisa Ostella, and Go Excel Global in the District Court, and itsrequest for relief was denied. The Ron. Andrew Guilford's Minute Order of July12, 2013 [District Court Docket No. 641, Exhibit A hereto] establishes that the

representation of the said Plaintiffs/Respondents was established in the DistrictCourt. District Court Docket Nos. 633 and 644 (referred to in Judge Guilford'sMinute Order) are attached hereto as Exhibit B. [Messrs. Marcus and Berg havesince withdrawn as counsel for Philip Berg.]

5 Taitz has not shown any good cause for any delay in the briefingschedule of this matter, and is merely seeking to delay the ultimate trial of this

matter on the merits. Any emergency , if any, is one of her own making, anddoes not justify any delay in these proceedings.

Proceed ings [IN CH MBERS} ORDER  ENYING PEN ING REQUESTSThe Court previously ordered all patties to seek leave of C o m i b e fore filing any m otionsor other documents in this case. (June 14, 2011 Order, Dkt. No. 227.)  On July 6, 2013,Orly Taitz, s ' 'counsel for defendants, emailed the Court requesting that the Comi holdan urgent hea ring to obtain addre sses of all the plaintiffs in  order to serv e each ofthem with pleadings for the purp ose of filing a notice of appeal of  the denial ,ofantiSLAPP. This request sparked a flurry of emails to the Court includin g, among other things, an opposition, a reply, a joinder, and, as is typical in this matter, requests forsanctions. The opposition clearly establishes that t he initial request is improper.   Seelso Dkt. Nos. 633, 634.)  The subsequent requests  are also improper.  The requests  are

DENIED.Further, the requests fm iher evidence why it was necessary to monitor filings in order tosecure the just speedy, and inexpensive detem1ination of  [this] action. Fed. R Civ. P1Taitz also states that [a]ll Taitz defendants decided to  file an appeal of antiSLA PP andstay proceedings in the District C our tpend in g decision in A ntiSLAPP. Any remaining defendants may continueto be active in this case. Finally, the CoUli notes that the pmiies' actions continue to highlight the Ninth Circuit'sconcern, shared by this Comi, that the pmiies in this case have persisted in treating thecomis as a public spectacle in which they repeatedly manifest their personal dislike forone another without regard to the truth or appropriate decorum.
