General Style – Scope of Work

109.02 – The Department will make payment for the elements of work described under the “Construction” or “Procedure” subsection under the corresponding Item in the “Measurement and Payment” Subsection.

The Department will not make additional or separate payment for work or portion of work unless specifically provided for in the “Method and Measurement” Subsection.

Section 101.03 Terms

If the term is capitalized, it is capitalized in the Specifications• Contract – includes permits, boring logs, pavement core records• day – definition unchanged, but use of business day or calendar

day has been deleted from the specifications, except where required by State statute.

• Utility vs. utility – Utility is a company, which provides services/ utility is a facility owned by the Utility.

• Work vs. work – Work is the entire project/ work is any portion of the Work.

• RE – term RE replaces Resident Engineer, with few exceptions other representatives with the Department are simply referred to as the Department rather than by unit or division.

Section 104.03.03 Changes

Quantity Increases/Decreases – bid prices hold only for increases and decreases that are within 25% of proposal quantity. Outside that, prices may be renegotiated.

“Proposal quantity” does not include quantities designated on the Plans as “if and where directed.”

IF AND WHERE DIRECTED quantities should almost never be used. It can be used with the SME’s concurrence, where we specifically want to insulate the Department from risk.

Section 105.05 Working Drawings

Table is provided for which drawings are certified and which are submitted for approval

Ensure that the revised working drawings are submitted to the RE within 30 days of receipt of the conditional certification… The Department will require 45 days for review and approval or rejection and return of working drawings

Special Provisions should revise the required # of days to review drawings if the project will have a # of drawings that the designer may not be able to handle.

Section 105.07 Utilities

Contractor required to send all Utilities within the project limits an initial notice when beginning construction operations.

Contractor required to provide protection of Utility facilities as required by Utility (Designer’s should identify support requirements identified by Utility in design)

Work by Utilities – the contractor is responsible for providing the Utility with advance notice as required in Special Provisions. (Must show durations for utility stages)

Section 105.08 Environmental Protection

Do not use treated timber products in shellfish areas and other environmentally sensitive areas.

Use non-polluting materials such as fiberglass composites in these areas. Before using treated timber products in areas other than those specified in the Contract, obtain the Department's approval

Section 106.09 Proprietary Items

If material or equipment is specified using a proprietary item or the name of a particular supplier, the Contractor may propose a substitute except when the Special Provisions state that no substitution is permitted

Designers must document the criteria for evaluating a proprietary item

Section 108.02 Commencement of Work

When a Request for Authorization Form for the New Jersey Pollutant Discharge Elimination System 5G3 – Construction Activity Stormwater General Permit (NJG0088323) is specified, the Contractor must not perform land disturbance activities until 35 days after the submission of the Request for Authorization Form to the Department (this should be identified on the designer’s construction schedule)

Section 108.09 Maintenance within Project Limits

Project Limits (area) defined in 101.03 Contractor’s maintenance responsibilities for Project Limits:

– Picking up and disposing of trash and debris– Keeping the roadway clear of dust, soil– Maintaining a safe and unobstructed passageway through the

construction area including escape ramps at the edges of pavement.

– Maintaining surface drainage – Removal of ice and snow from bridge sidewalks open to

pedestrian access. – discuss with operations other sidewalk areas for which the DOT has ice snow removal requirement.

Must be amended in the Special Provisions, when the project does not involve a fixed area (Operations Service Contracts).

Section 108.11 Modifications toContract Time

If excusable noncompensable delays exceed 180 days, the time in excess of 180 days will be excusable, compensable. – Consider amend this to 90 days or less for projects with durations of less than 1 year

Extreme Weather - Time extensions for weather only granted if controlling activity on critical path is delayed due to weather and the cumulative delay due to weather exceeds the number of days specified in Table 108.11.01-1 for any month (Designer’s Progress schedule should be based on normal # days workable for a given month. If an aggressive schedule is being provided – the table may need to be tailored for the project.)

specifications to reflect current practices. More consistent in being clear on acceptance

practices/procedures and on requirement to be from a QPL.

Class V – formerly known as VES or VHE. Attains 350 psi flexural strength in 6.5 hours.

Class E – early strength concrete that attains 3000 psi in 72 hours.

Intended for pavement repairs caution should be used in using these mixes for other applications.

NJDOT Test Methods

After Division 1000 are the NJDOT test methods that used to be in 990. They are referred to in the specification by their designation. e.g. “NJDOT A-1”

The last item in this section is “NJDOT ST” which are the statistical tables which used to be in 914 but have been moved to the back as they are used in many of the statistical calculations.
