Chairperson Ada called the Public llcaring lO order and yields to the sponsor of the hill.

Senator San Nicolas: He starkd by giving a hricfsummary of Bill No. 163-:13. Th.:re arc over eight thousaml applicants that are waiting for their properties. I k expiained that the biggest bottleneck holding back these properties is surveying. The Land Trust docs not have the monetary resources to be able to smvey these properties and get them out to the bendiciaries. This hill would help the Land Trust become less cash poor by accelerating the lease payments. Ue added thm we could usc the ninety-nine dollars. due over the course of one yc'ar. for the purpose of surveying properties. Another provision in the bill would remove property tax exemptions since the government is paying ti.1r the surveying. He added that the revenut.: fron1 the taxes could then bl' us1::d to survey n1ore properties. }-le concluded h} saying that this bill is just a piece of1bc puzzle to make this twcnty·ycaroiJ idea become realit: for many of our people.

The second part being the waiving of property tax exceptions would provide fairness to the system. l le explained that we have to fie filir to the peopk who have already paid for their own surveys and leases and not allow this seven-year exemption that they cunently get. He concluded by saying that the Chamorro Land Trust wil I become more responsible and transparent.

Chairperson Ada: lfr asked Mr. Borja if the proceeds >vould get dep(bited into the Gcu..:ral Fund.

Mr. Borja: He replied saying that the funds would be assigned to a eettain ledger account designated from !he Chamorro Land Trust. lt would then be for general use.

Chairperson Ada: He explained that the previous bill was more preseriptiw of how the money is to be used and where i(s to be deposited. He wanted to report Bill No. J 64-33 first so that it establishc:s the account ancl then report out Bill N11. 163·33 so that the accelerated lease payments will go into the Spcdal Survey Fund for its particular purpose.

Ted Nelson: He explained that the sale of the lots in the Land [(;r the Landkss subdivisions could be used by Land Management to hegin surveying:.

Findings and Recommendations The Cummiltee finds that all revenues from the accelerated lease payments to the Chamorro Land Trust Commission should be deposited into the ( 'hamorro Land ll·usr S11rwy Fund. t'pon enactment of the c:rcation of said fund by Bill No. 164-:'1) intn Public Law. a.il revenues from Bill No. l 63-33 shall be deposited into the new fund \The Chamorro Land Trust Survey Fund).

The Committee reconum'!nds that expenditures from the Chwnorro Land Trusr Survey Fund shall be used for suncying and mapping ofCLTC land tracts for agricultural and residential leases. Section 5. Effective Date. This Act shall he effecth'e upon enactment.

Section 6. Severability. If any provision of this Law or its application to any

person or circumstance is found to he invalid, or contrary to law, such invalidity

shall not affect other provisions or applications of this Law which can be given

effect without the invaiid provision or app Ii cation, and to this end the provisions of

this Act are severable.

The Chamorro Land Trust Commission (CL TC) supports the two elements of Bill No. 163-33 regarding the payment of the residential and agriculture leases, and the property tax exemption waiver.

The annual cost of a CL TC residential and agriculture lease is one dollar. The steps necessary to account for this nominal payment vastly outweighs the fee itself. These steps include invoicing, printing and mailing, receiving and posting the payment, depositing and reconciling bank accounts; and. if necessary, pursuing collection of the one dollar if payment is delinquent. Multiply this times the number of CL TC leases and the manpower alone would demand we have a large office of accounting clerks and accountants.

This bill would create an efficiency in the system by requiring all residential and agriculture lease be paid in full, ninety-nine dollars ($99). wrthin the first year of the lease

With CL TC's plan to survey its properties in order to expedite the issuance of residential and agriculture leases, the second part of this bill will eliminate the lessee's exemption to pay property taxes in the first seven years of the !ease. Since this lessee did not expend any resources for the survey of the property. the property tax payments would begin once the lease is effective. Since many applicants have financial difficulty completing their surveys, CL TC would complete the surveys. The money collected from the property tax would then assist with the payment of other land surveys

Bill No 163-33 takes the commission in the right direction by assuring it can be more efficient internaliy and with externally our clients. i ask this committee to favorably report this bill and for this Legislature to pass it without delay.
