CM21 – A Hitchhiker’s Guide to Privilege, Ethics and Lawin Cyberspace and the Real WorldAll LevelsWSCTC, Ballroom 6B

Designed to achieve a balance between the demands of jus-tice and the confidentiality of the attorney-client relationship, the doctrine of privilege in relation to trademarks is strainingunder the threat of fresh challenges. One recent strain is theexplosive growth of cyberspace as a trading medium, whereuse of the same brand may be subject to different rules andadvice on legal and ethical issues that transcend nationalborders. A second strain is the attempt to bridge the gapbetween countries with a rich tradition of client privilege andthose where it is little recognized, and attempts to identifycommon ground and norms for a future international treaty. But these challenges cannot be resolved in the abstract, asthey relate to real problems faced by real businesses. Thissession, presented by a panel of professors, offers aHitchhiker’s Guide through a wide spectrum of issues, flag-ging topics that should be of concern to every brand ownerand to every trademark attorney.

WT50 — Market Evolution and Similarity ofGoods/Services – Implications for Brand OwnersIntermediate LevelWSCTC, Room 606

Similarity of goods and services is a key concept in trade-mark law and affects trademark searching and the requiredjudgment calls when clearing new brands. It is often criticalto determining whether registration can be achieved over aprior mark and whether unauthorized use is infringing and insetting the outer limits of enforceable coexistence arrange-ments. As markets evolve, similarity is affected. Think ofApple and Cisco over the iPhone® personal digital assis-tant, as well as Apple Records and Apple over download-able music. In this workshop, you will brainstorm with expe-rienced trademark practitioners from old and new industriesand consider those markets where change is occurring andthe implications for brand owners.
