    Budget Hearings - Call to Action

    Send your Delegates and Senators an email, or give them a call, to urge their support for restoringfull funding for public education in the pending Fiscal 2012 State Budget. But even if full funding isnot restored, the Budget should only make one-year adjustments - not the proposal to reduce thefoundation amount for next four fiscal years.

    The first subcommittee hearings on the educationfunding section of the Governors budget are scheduledfor Wednesday, February 16 in the House AppropriationsCommittee and Friday, February 18 in the Senate Budgetand Taxation Committee. Call and email the Governor &Lieutenant Governor, your Delegates & Senators, andAppropriations and Budget &Taxation Committeemembers now, and throughout session, to urge their

    support for full funding for public schools.

    What to say:

    I am calling to voice my support for full funding forpublic education, restoring the $94 million cut in theGovernors proposed State Budget, and limiting any cutthat is adopted to this year only.

    The $94 million cut is made by reducing the per pupilfunding amount for all students in the state.

    This cut will have devastating impacts on classroomsacross the state, and should be avoided if at allpossible. No cut should be adopted, but if it is, it shouldbe for this budget only, not through 2015 as proposed.

    I urge your support for amendments to the Budget andBudget Reconciliation and Financing Acts to restore fullfunding for public education.

    Marylands public schools are #1 in the nation, and ourstudents are counting on us to keep it that way.

    I look forward to receiving your response to this requestthat you will pledge to work to restore the $94 millioncut proposed in the FY 2012 State Budget, to limit anycut that is adopted to a one-time cut in this yearsbudget only, and to restore any cuts as soon aspossible.

    Thank you for the demonstrated support for Marylands outstanding public schools. Fully funding theThornton Bridge to Excellence Act has made it possible for each of Marylands twenty-four schoolsystems to hire highly qualified teachers; expand kindergarten and pre-kindergarten; preparestudents for success on the No Child Left Behind Acts mandated students assessments in reading,math, and science; prepare students to excel on Advanced Placement exams; and make Marylandspublic schools #1 in the nation for three years in a row.

    Now the Fiscal Year 2012 State Budget is proposing to flat fund public education by cappingstatewide spending at the FY 2011 amount. But the budget would do so by reducing the per pupildollar amount for all students, in each school system, and would do so for the next four years.

    Holding the line on education funding should mean justthat. Up to now, since the recession began in 2007,Maryland has held the line on per pupil spending. TheFiscal Year 2012 State Budget should continue toprovide the per pupil funding amount provided in the priorState budgets. The proposed budget would reduce theper pupil amount called the foundation amount in the

    law to avoid a $94 million increase based on increasedenrollment. This $94 million cut will have devastatingimpacts on school systems struggling to cope with localfunding cuts and ever-expanding mandates foreducational programs and services. This $94 millionshould be restored in FY 2012, and most certainly shouldnot be adopted as a permanent cut to 2015.

    We urge you to support restoring full funding for publiceducation, in order to preserve statewide funding

    adequacy and equity and the integrity of the ThorntonBridge to Excellence Act funding formulas. The Bridge toExcellence Act school funding reforms have providedhistoric increases in funding for all students, with targetedincreases for special education, English languagelearners, and economically disadvantaged students.These reforms were hard fought and hard won to providean outstanding public education for all Marylandstudents.

    The FY 2012 State Budget (House Bill 71/Senate Bill 85)and the companion bill that makes the changes in law

    called for in the Budget, the Budget Reconciliation and Financing Act (House Bill 73/Senate Bill87), should be amended to restore full funding on behalf of the 850,000 students who are countingon us to prepare them for success in their futures, in college classrooms and in the workplaces ofthe 21st Century.

    Thank you for your support for Marylands outstanding public schools. I look forward to receivingyour response to this request that you will pledge to work to restore the $94 million cut proposedin the FY 2012 State Budget, to limit any cut that is adopted to a one-time cut in this years budgetonly, and to restore any cuts as soon as possible.

    MABE Positions and Background on Pending Education Bills

    HB 1 EDUCATION YOUTH ATHLETES CONCUSSIONSRequiring county boards of education and the Maryland Public Secondary Schools AthleticAssociation jointly to establish guidelines and develop forms to educate individuals regardingconcussions and head injury; requiring specified individuals to sign information sheets; requiringthe removal of youth athletes from play under specified circumstances; prohibiting the return toplay under specified circumstances; requiring youth sports programs to provide statements ofcompliance; etc.

    EFFECTIVE OCTOBER 1, 2011(Position: Support with amendments; MABE submitted amendments to the bill sponsor andlearned that another bill would be filed as the this years concussions policy bill; MABE thensubmitted amendments to that sponsor and is awaiting the introduction of that bill, understandingthat our position of supporting this legislation with amendments to require guidelines and trainingwill be reflected in the bill.)

    HB 2 ELECTIONS CANDIDATES FILING FEESIncreasing filing fees for candidates for specified public offices; and increasing the amount of thefiling fees distributed to local boards of elections from the filing fees received by the State Board of

    Elections from candidates for statewide office.EFFECTIVE OCTOBER 1, 2011(Position: Oppose; While this bill would raise filing fees for all state and local elections, the boardof education filing fee increase from $25 to $500 warrants testimony opposing such an increaserelative to the stipend/income, if any, associated with the position, and therefore as an impedimentto this esteemed, if not generously compensated, public service.)

    HB 12 PROCUREMENT EMPLOYEE UNIFORMS AND EQUIPMENT PLACE OFMANUFACTUREProhibiting a public employer, under specified circumstances, from knowingly buying, furnishing,

    or requiring an employee to buy or acquire for use while on duty specified uniforms and otherequipment unless the uniforms or equipment are manufactured in the United States; requiring theBoard of Public Works to adopt specified regulations; and applying the Act prospectively.EFFECTIVE OCTOBER 1, 2011(Position: Oppose; unfunded mandate based on increased cost to purchase uniforms.)

    HB 26 EDUCATION FUNDING FORMULA AVERAGE DAILY ATTENDANCERequiring specified enrollment calculations used for education aid to be based on the averagedaily attendance in specified school years; etc.EFFECTIVE JUNE 1, 2011

    (Position: Oppose. MABE has opposed this bill is the past. The fiscal note for last years billpaints a grim picture, finding that local school system revenues from direct State aid decreaseby $167.9 million in FY 2011 and by an estimated $160.0 million to $165.0 million annuallythereafter. Required county and Baltimore City maintenance of effort appropriations to localschool systems decrease by an estimated $274.3 million in FY 2011.)

    HB 37 STATE GOVERNMENT ACCESS TO PUBLIC RECORDS ELECTRONIC

    DOCUMENTSRequiring a custodian of a public record to provide specified applicants with a copy of the publicrecord in a specified electronic format under specified circumstances; authorizing a custodian toremove specified metadata from specified documents; clarifying that a specified act does notconstitute creating, compiling, or programming a new public record; authorizing a custodian tocharge an applicant a fee under specified circumstances; etc.EFFECTIVE OCTOBER 1, 2011(Position: Support with amendments; MABE raised an objection to a provision that appearedto create an exception to the provision of that states the bill it is not intended to require thecreation of a new record. The sponsor met with MACo, MML, and MABE representatives and anamendment was agreed to.)

    HB 44/SB 53 EDUCATION WAIVER FROM MAINTENANCE OF EFFORT REQUIREMENT PROCESS AND FACTORSAltering the date by which a county governing body must make a request to the State Board ofEducation for a waiver from the maintenance of effort requirement; requiring the State Board toconsider specified factors when making a decision whether to grant a waiver; requiring the StateSuperintendant of Schools to make a preliminary assessment of waiver applications by aspecified time; etc.EMERGENCY BILL(Position: Support; MABE testified on SB 53 on Feb 2, where MSEA offered amendments to

    add criteria including local tax capacity and the history of funding above MOE relative to the rateof inflation; MACo offered one amendment to defer any penalty until the following fiscal year; andMontgomery County Council offered four amendments, not described at the hearing, butunderstood to include tying MOE to inadequate student performance, allowing for less than MOEif savings are achieved, factoring in student performance impacts as a waiver criteria, andreplacing the penalty with a plan to address the loss of funding below MOE. MABE testified infavor of the bill being passed clean, but noted that if the penalty issue was to be addressed, itshould be shifted to the counties.)

    HB 70/SB 85 BUDGET BILL FISCAL YEAR 2012

    Making the proposed appropriations contained in the State Budget for the fiscal year endingJune 30, 2012, in accordance with Article III, Section 52 of the Maryland Constitution; etc.(Position: Support with amendments. See HB 72, the BRFA below)

    HB 71/SB 86 CREATION OF STATE DEBT MARYLAND CONSOLIDATED CAPITALBOND LOAN OF 2011, AND THE MARYLAND CONSOLIDATED CAPITAL BOND LOANS OF1996, 2003, 2004, 2005, 2006, 2007, 2008, 2009, AND 2010Authorizing the creation of a State Debt in the amount of $935,618,000, the proceeds to be usedfor specified necessary building, construction, demolition, planning, renovation, Conversion,replacement, and capital equipment purchases of the State, for acquiring specified real estate,

    and for grants to specified subdivisions and other organizations for specified development andimprovement purposes, subject to specified matching fund requirements by specified dates; etc.

    VARIOUS EFFECTIVE DATES(Position: Support. This is the Governors Capital Budget, in which he keeps his pledge tosustain funding for the Public School Construction Program at $250 million in accordance with theKopp Commission recommendations and School Facilities Act of 2004.)

    HB72/SB 87 BUDGET RECONCILIATION AND FINANCING ACT OF 2011Altering or repealing specified required appropriations; altering the distribution of specifiedrevenues; altering or repealing specified funding requirements; altering the authorized use ofspecified funds; authorizing specified fees; establishing a reformed contributory pension benefit forthe new members of the Employees Pension System and the Teachers Pension System on orbefore July 1, 2011; etc.VARIOUS EFFECTIVE DATES (Note: the BRFA is the bill which amends the law to implementthe Governors Stat Budget (HB 70).Position: Support with amendments. MABE supports full funding of the Thornton Bridge toExcellence Act, recognizing that the $94 million, 1.8% cut based on freezing FY 2012 funding atthe FY 2011 amount is far better than the specter of a $240 million, 5% across the board cut.However, the budget reduces the per pupil foundation amount for the remainder of the Governorsterm, FY 2012, 13, 14 and 15, and similarly reduces the inflation factor to a capped at 1% for

    those years. The BRFA provides for no increase in the form of either the higher FY 2012foundation amount, or CPI inflation factor, in FY 2015 or beyond. For this reason, MABE supportsat the very least limiting any cuts to FY 2012, with amendments to reset the foundation amount atthe regularly scheduled rate in FY 2013 Of course, the Governors FY 2013 budget could onceagain propose to lower that amount, but this year-by-year approach is preferable to a permanentfreeze.)

    awareness of the importance of providing universal access to high quality early education, but fallsshort in at the secondary level. Maryland is already in the vanguard of states adopting a lower ageat which it is compulsory to be enrolled. This bill would make a similar adjustment at the upper endof the spectrum, consistent with the states pledge to remain an education-based economy with oneof the most highly educated workforces in the nation. Opponents of raising the compulsoryattendance age often point to the high costs of providing instruction and other educational servicesto students who would drop out but for the change in the law raising the age. MABE rejects the

    argument that the age cannot be raised until resources are provided, foremost because they alreadyare, through the per pupil funding formulas and as evidenced by the unprecedented statewide effortto provide the necessary educational interventions to ensure that as many students as possible passthe High School Assessments (HSAs). It is, in fact, pre-kindergarten that is woefully underfundedand not at all on a per pupil FTE basis.)
