Finding of Emergency(As required by Government Code (GC) section 113461 (b)(2))

GC section 1283$.5 provides that commencing July 1, 2005, the California Department o~Corrections and Rehabilitation (CDCR) succeeds to, and is vested with, all the powers, functions,duties, responsibilities, obligations, liabilities, and jurisdiction of abolished predecessor entities,such as: Department of Corrections, Department of the Youth Authority, and Board of Corrections.

PC Section 5000 provides that commencing July 1, 2005, any reference to the Department ofCorrections in this or any code, refers to .the CDCR, Division of Adult .Operations.

PC .Section 5050 provides .that commencing July 1, 2005, any reference to the Director ofCorrections, in this or any other code, refers to the Secretary of the CDCR. As of that date, theoffice of the Director of Corrections is abolished,

PC Section 5054 provides that .commencing July 1, 2005, the supervision, management, andcontrol of the state prisons, and the responsibility for the care, custody, treatment, training,discipline, and employment of persons confined therein are vested in the. Secretary of CDCR.

PC Section 5058 authorizes the Director to prescribe .and amend regulations for the administrationof prisons.

This action provides the following:.• Eliminates copayments for .health care services. for CDCR patients.• Clarifies that CDCR prescribed appliances shall be provided at no cost to patients.

Anticipated Benefits of the Proposed Regulation

The. Department anticipates the proposed regulations will benefit the Department and patients byencouraging patients to seek early treatment for health care issues. By eliminating copaymentsand the requirement for non-indigent patients to purchase prescribed appliances, patients will bemore likely to pursue early treatment forhealth care needs, which may result in increased treatmentefficacy, improved patient health care. outcomes, and decreased long-term .health care andadministrative. costs..Additionally, the. proposed .regulations will reduce .the number of submittedhealth care grievances and healthcaregrieuance appeals and ensure consistency in practice amongCDCR institutions.
