Ram promises to Jitu that he shall pay him Rs. 1 lakh if Jitu gets first rank in confluence 2009. Jitu gets the first rank. Can Jitu claim the

amount? • Yes, (it is a contingent contract;, although

there is no consideration involved, yet they have made a contract; section 35 for details).


Ram buys a Aeroplane. Jitu promises to pay him Rs. 10 Lakh if the Aeroplane suffers an accident within one year. The Aeroplane

gets an accident, is Jitu expected to make the payment?

• Yes, it is a contingent contract, sec. 35.


Jitu promises to pay Ram Rs. 10 Lakh if two straight lines enclose a

space. Is this contract valid contract?

• No – because it is an impossible event.


Ram gives loan to Jitu, when Goutam promises that if Jitu will not

make the payment, Goutam will make the payment, is it a valid

contract?

• Yes, it is a contingent contract (a guarantee).


Ram shipped some goods to Jitu (who is in Tokyo). Jitu also had a seat in the same ship. In between the journey, Ram declared himself

insolvent, listening this Jitu took possession of the goods. Official

receiver of Ram demands possession of the goods, who will

get the goods?

• Ram’s official receiver.


In the previous question, if Ram had sold the goods on CIF basis,

what would have happened?

• Same answer: because the terms of CIF (carriage, insurance Freight) state that goods will be delivered to Jitu only at the destination port.


In the previous question, what will happen if the sale is ex-factory?

• Here the goods belong to Jitu.


What can seller do, if the buyer doesn’t make the payment of the

price?

• Sue for price (sec. 55)

• Sue for damages (sec. 56)

• Repudiate contract (sec. 60)

• Sue for interest (sec 61)


A sells goods of Rs. 10000 to B. B gives Rs. 5000 in cash and gives a promissory note for the rest. B gets insolvent. Now what will happen to

goods?

• A can retain the possession of the goods and resell them (because his part payment is left out).


Ram sold goods to Jitu and gave the possession of the goods. Now Jitu again gives those goods back

to Ram for repairs. Jitu gets insolvent. Ram does not give the goods to official receiver, claiming that he has some money due. Who

has the right of goods.

• Official receiver has the right to goods. Ram can only submit his claim.

• Ram is bailor and I am bailee.


I found a golden ring on the ground. It belongs to Ram. Who is bailor

and bailee here?

• It is a quasi contract. I am bailee, and Ram is bailor, I have a duty to return back the ring.
