Restoration Advisory BoardMeeting Minutes - 15 Nov 94

Mr. Bailey welcomed all of the attendees and congratulated those who had volunteered toserve on the Restoration Advisory Board (RAB). He stated that the RAB, was aDepartment of Defense (DOD) initiative designed allow the regulatory and public

community to become stakeholders in the clean-up of DOD. The Installation RestorationProgram (IRP) is the United States Air Force's program for accomplishing Kelly AFB'sclean-up activities, through the Environmental Management Office. He also stated thatthis was the first RAB to be established at any of the Air Logistics Centers (ALC). Afterhis welcoming comments, the following were briefly discussed among the board

members:

• Review responsibilities of RAB members andlor their alternates, when reviewing

contractor documents, and how RAB member comments and feedback will be

handled by the board.

• Section 3 of the proposed charter in the information package had been changed toread "211 SARA". Board members were instructed to inform Mr. Estrada whether ornot they wanted their and their alternate's home phone numbers or business phonenumbers on the members contact list that will be provided to the public.

• As a result of the diverse background of the broad members and the anticipated

learning curve required to allow them to become familiar with Kelly's clean-upprogram, the board decided to meet at least monthly. The board decided that the nextmeeting should be held before 19 December 94. An invitation to attend a tour ofKelly AFB prior to the next meeting was given to everyone by Mr Bailey.

• The RAB charter was discussed and approved. The RAB meeting facilitator, Mr

Teague, an employee of SAIC was introduced and assumed responsibility for

proceduly electing a Co-Chair of the RAB. Five (5) individuals had volunteered to

serve as Co-Chair for the RAB. They were: Mr. Ayala, Mr. Mixon, Mr. Haglethom,Mr. Moore, and Mr. Jimenez, who was not present. Each was invited to give a brief

biography of themselves. By secret ballot, Mr Haglethom was elected as Co-Chair to

serve along with Mr Bailey.

After the meeting break, Mr. Richard Trevino, Chief of the Environmental ManagementRestoration Operations Branch, gave a basic overview of IRP program at Kelly AFB.

During his presentation, he briefly addressed issues related to underground storage tanks,

questions on history of clean-up program, accomplishments of IRP program and rationale

for the establishing the RAB. The charter of the RAB was reinforced on severaloccasions to indicate that currently the RAB is established to focus on IRP clean-up

activities. As requested, specific points of contact with respect to the different zones

being investigated on Kelly AFB is provided by attachment.

The meeting was closed at 9:15 p.m. with the next meeting was decided to be at the FireAcademy at 6 p.m. on 12 Dec 94. In the meantime, Mr Bailey indicated if there isanything anyone on the board needed between now and then to let him know. Mr Baileythanked the board volunteers for their time.

(2) Request for ranking of IRP sites at Kelly AFB: This information is a major agendatopic for the 12 Dec 94 RAB meeting and will be presented during the meeting.

(3) Request for funding currently expensed on the IRP at Kelly AFB: Kelly AFB hasexpensed over $74 million from 1983 to 1994. Over $25 million has been expensed onthe cleaning sites; the remaining dollars were used to evaluate the extent and type ofcontamination.

(4) Request for information on the status of the TIER II Report: Kelly AFB iscurrently not required to submit a TIER II Report. On 01 Aug 94, Kelly AFB submittedto the Chairperson of the Local Emergency Protection Committee (LEPC) a list ofchemicals that exceed threshold values. On 11 Aug 94, a revised listing was submittedupdating this information. The TIER II Report is required to be submitted to the LEPCby March 1995. In addition to the LEPC, the Environmental Management Office willalso submit a copy of the TIER II Report to our Base Fire Department and the localDepartment of Health.

El Sr. Bailey diO Ia bienvenida a todos los asistentes y felicitó a las personas que

se ofrecieron como voluntarios para servir en Ia Junta de Consejo de

Restauración (RAB). El señor Bailey comentO que el RAB era una iniciativa de

el Departamento de Defensa (DOD) diseñada para permitir a Ia comunidad y a

las autoridades ha participar en Ia limpieza del DOD. El Programa de

RestauraciOn de Instalaciones (IRP) es un programa de Ia Fuerza Aérea

destinado a realizar las actividades de limpieza ambiental en Ia Base Kelly,

atravéz de Ia Oficina de Administraciôn Ambiental. El Sr. Bailey expresó que

éste es el primer RAB establecido en un Centro de LogIstica Aérea. Después

de sus comentarios y bienvenida, los siguientes puntos fueron rápidamente

PRINCIPAL LAWS AND REGULATIONSAFFECTING THE CLEANUP PROGRAM

Several Federal laws guidecleanup programs in theUnited States. Each has adifferent emphasis, buttogether, they target the mostpressing hazardous waste sitesin the nation.

RCRAResource Conservation andRecovery Act of 1986 setsthe standards fo managinghazardous waste facilitieslicensed by the U.S.Environmental ProtectionAgency (EPA). It alsoprovides mechanisms fordealing with releases atthese sites.

CERCLAComprehensiveEnvironmentalResponse, Compensation andLiability Act of 1980 — also

known asSuperfiind—providesfor the funding, study andimplementing of cleanup efforts.

NEPANational EnvironmentalPolicy Act of 1969 requiresFederal agencies to considerpossible environmental effectswhen making decisions onproposed federal actions.

All three of these laws require public involvement under a well-

defined set of activities and schedules. The cleanup process will

vary with each site. A phased approach of study is used to helpmaximize efforts. The phases include studies to understand the

problem, identify possible cleanup alternatives, test potential

cleanup methods, refine the alternatives,

Each of the principal federal laws isdescribed in this factsheet. While details may vary at Kelly AirForce Base, the end goal remains constant — to protect human

health and the environment.

RCRA

RCRA created a management system for hazardous wastes,requiring that safe and secure procedures be used in treating,transporting, storing, and disposing of hazardous wastes.

Facilities must have permits to handle these wastes and arerequired to operate within specific guidelines. The law,amended in 1984, allowed EPA to require corrective actions forcontinuing releases and releases outside the facility's boundary.

RCRA focuses on whether or not releases of hazardous waste

has occurred on licensed operating facilities, and requirescorrective action if releases are found. A series of measures istaken to determine if a site requires RCRA-regulated cleanup.

1.) The first step is a RCRA Facility Assessment (RFA) todetermine if further study is needed. This initial study will identifythe potential hazards at the site. However, the RFA studies only

the identified releases from each site. It does not study other

possible hazards that may exist.

CERCLA is a federal lawpassed in 1980 and amendedin 1986. The law created aspecial tax that goes into atrust fund, commonly known

as Superfund, to study andperform remediation, orcleanup, of abandoned oruncontrolled hazardous wastesites. While def ense sites—such as Kelly Air ForceBase—are not eligible forSuperfund monies, Congressalso set aside funding forcleanup activities in a specialDefense EnvironmentalRestoration Account.

CERCLA is important for

providing funds and direction to

clean up sites not covered under

RCRA provisions. RCRA's

scope is limited to permitted

waste management facilities

which are monitored by EPA.

CERCLA consists of three

phases: (1) a preliminary

assessment, (2) a study of the

site, a review of cleanup

alternatives, and a selection of a

remedial action plan, and (3)

design and execution of the plan.

1.) The preliminaryassessment (PreliminaryAssessment/Site InspectionPA/Sl) will determine if thesite should be placed on theNational Priorities List. Thislist contains the most seriousuncontrolled or abandonedhazardous waste sites. It has

sites that states have selectedas their top priority sites andsites that pose a significantthreat to public health,welfare, or the environment.

The assessment focuses onthe potential forcontamination. If theassessment shows thatfurther action is needed, asite inspection is performedto determine the threat to thepublic and the environment.The site is scored based

upon this inspection. If anysite exceeds a certain score,the site will be added to theNational Priorities List.

2.) The second phaseincludes a RemedialInvestigation/FeasibilityStudy (RI/FS). The first partincludes study and planning.All work performed during theRl/FS will collect data on thesite to develop a cleanupstrategy, identify likely

remedies, and prepare a workplan. A sampling analysisplan is developed so that anydecisions made are based onthe most accurate and best

documented data possible.

The investigation steprequires extensive samplingand analysis activities. Thisdata is used to develop therange of alternatives forcleanup. One alternative isselected, and entered into aRecord of Decision, statingthe preferred method andmanner of remediation.Public comments andcommunity concerns areconsidered in the selection,and also placed in the record.

3.) The last phase includes aRemedial Design/RemedialAction (RD/RA), conducted toimplement the decision, and to

monitor the performance of thecleanup.

2.) If a problem exists, EPA requires the owner/operator of the site

to conduct a RCRA Facility Investigation (RFI) and a CorrectiveMeasure Study (CMS). The RFI will measure the type, extent, andrate of contamination, If a corrective action is needed, the CMS will

identify possible solutions to problems at the site.

3.) The last step is to begin the cleanup through a processcalled Corrective Measure Implementation (CMI). After theEPA selects the solution to pursue, the owner/operator performsthe corrective action and monitors the results.

NEPA is the Federal law thatsets basic policy on protectionof the environment. Throughthis law, every Federal action

is reviewed to determine if ithas significant environmentaleffects. NEPA requiresFederal agencies to evaluateall environmental impactsbefore taking any action.

If an action clearly has no

significant impact, aCategorical Exclusion is given.If an action may result in

environmental effects, anEnvironmental Assessment(EA) or an EnvirortmentalImpact Statement (EIS) maybe necessary. In preparing anEA, data collected will bereviewed to determine ifimpacts are not significant, orare great enough to require

the more complete EIS study.

Under NEPA, when anEnvironmental ImpactStatement is required, publicparticipation is called for earlyin the process of identifying

conditions at the site andreviewing cleanup remedies.Public involvement, or

"scoping," ensures that realproblems are identified early,efforts are concentrated onthose areas, and the EIS is

balanced and thorough in itsreview. The NEPA scopingprocess is different from thatof CERCLA. NEPA scoping

focuses on public participation,while CERCLA scopingconcentrates on planning.

All cleanup activities arereviewed and regulated by theState of Texas. The TexasNatural ResourceConservation Commissionworks closely with Kelly AirForce Base in determining thesites requiring cleanup. Atany one hazardous site, oneor more laws may apply, ornone, depending on theextent of contamination andthe types of contaminants.The regulations andstandards that pertain to eachsite are determined early toensure all applicable and/orappropriate requirements aremet. The goal for all cleanupactivities is to protect humanhealth and the environment.

OTHER LAWSAND

STANDARDS

A variety of other laws orstandards may also apply tospecific hazardous waste sites.

• The Toxic SubstancesControl Act regulates certainclasses of chemicals,including polychiorinatedbiphenyls (FOBs).

• The Clean Air Act is aFederal law that controlsemissions of waste into theair. Special protectiveequipment and permits arerequired.

• The Clean Water Act isa similar Federal law thatcontrols the amount of wastethat can be released intosurface water bodies bypublicly owned treatmentsystems.

• The Safe DrinkingWaterAct is designed to protectdrinking water resources.This law is incorporated intoboth RCRA and CERCLAprovisions dealing withgroundwater protection.

• National EmissionStandards for HazardousAir Pollutants limit airemissions of pollutants.

What is the Information Repository?

The Information Repository is a collection ofdocuments compiled through the Kelly AFBInstallation Restoration Program. These docu-ments contain studies and other work related to theAir Force's cleanup of hazardous waste sites atKelly AFB.

What is the CERCLA!lnstallation RestorationProgram?

The Comprehensive Environmental Response,Compensation and Liability Act, also known asSuperfund, governs the cleanup of hazardouswaste sites across the country.

The Installation Restoration Program is an AirForce initiative to clean up hazardous waste sitesat Air Force installations. Kelly's IRP uses the pro-cedures and process of CERCLA to guide its ef-forts to accomplish cleanup goals.

What is contained in the InformationRepository?

Your input is vital to the cleanup process. Publicparticipation is encouraged in cleanup actions andall public comments are considered before a finalaction is selected. To help citizens stay informed,all final documents concerning site cleanup arepublic documents and are made available for re-view. All CERCLA/IRP documents are kept at theInformation Repository including all important in-

vestigations, reports, studies and risk assess-ments.

When draft versions of documents are submittedto the Texas Natural Resource ConservationCommission or the Environmental ProtectionAgency for review, a copy of the final draft is

placed in the Information Repository. When regu-latory revisions have been made, the final versionis placed in the Information Repostiory in place ofthe draft.

In addition, the Information Repository containsthe Public Involvement Plan and copies of newsreleases, meeting minutes, Fact Sheets, and Pro-gress Reports that have been distributed throughthe news media or direct mail, as well as othercleanup related documents.

How can I find a document?

Studies, reports, correspondence and othertechnical products are listed in the first binder ofthe Administrative Record. This binder contains anindex that is continuously updated. Separate bind-ers contain the actual documents. Each binder islabeled with beginning and ending numbers for theitems in it.

Administrative Record sets in the InformationRepository are partial sets. To review the com-plete Administrative Record, contact the Environ-mental Restoration Operations Branch at 925-1812.

Documents released to the public, such as newsreleases or transcripts of public meetings, are con-tained in gray "Information Repository" binders.These include an index at the beginning of volumeone and an index in front of each individual groupof documents.

Water Quality Standard (WOS) - Thecombination of a designated use andthe maximum concentration of apollutant which will protect that use forany given water body. For example,In a trout stream, the concentration ofiron should not exceed one milligramper liter (1 mg/I).

Water Table - The boundary betweenthe saturated and unsaturated zones.Generally, the level to which water willrise In a well (except for artesian wells).

Wetlands - Areas that are coveredor saturated by surface orgroundwater frequently enough orlong enough to support primarilyplants and aquatic life whichrequire saturated or seasonallysaturated soil conditions forgrowth and reproduction.Wetlands generally Includeswamps, marshes, bogs, andsimilar areas, and are federallyprotected. Toxicity Testing - Biological testing(usually with an invertebrate, fish orsmall mammal) to determine theadverse effects, if any, of achemical, compound or effluent.

Toxicity - The ability of a substanceto cause harmful effects.

Toxicology - The study of theadverse effects of chemicals onbiological systems.

Treatability Study - Usuallyperformed after the feasibility studyalternatives screening to better definethe physical parameters needed fortechnology process options beingevaluated for use at the site.

Trlchloroethylene - A colorless,nonflammable liquid usually referredto as TCE. A solvent commonlyused to wash or degrease Industrialequipment, and also used in inks,paints and adhesives. Breaks downfairly easily and quickly into vinylchloride, a known carcinogen.

TSCA - (see Toxic SubstancesControl Act.)

TSD - Treatment, storage and/ordisposal facility. Refers to anyfacility which treats, stores ordisposes of hazardous wastes.

U.S.C. - United States Code. Thefederal law.

Underground Storage Tank (UST)- A tank located at least partiallyunderground that is designed to holdgasoline, other petroleum productsor chemicals.

Unsaturated Zone - A layer,beneath the surface of the land(usually between the surface and

the saturated zone) where someopenings are filled with air andsome with water.

Vadose Zone - The region abovethe saturated zone; the area notincluded In the capillary zone.

Vapor Dispersion - The movementof vapor clouds or plumes in the airdue to wind, gravity, spreading andmixing.

Vapor Recovery System - Asystem by which the volatile gasesfrom gasoline are captured Insteadof being released into theatmosphere. May be required forgasoline stations in non-attainment areas.

Vapor - The gas given off bysubstances that are solids or liquidsat ordinary atmospheric pressureand temperatures.

Vent - The connection and pipingthrough which gases enter and exit apiece of equipment.

Volatile - Any substance whichevaporates quickly.

Volatile Organic Compounds(VOC) - Any organic compoundcontaining carbon which evaporatesreadily to the atmosphere at roomtemperatures. VOCs contributesignificantly to photochemicat smogproduction and certain healthproblems.

Waste Minimization - Techniquesthat reduce the amount of wastesgenerated during industrialprocesses. The term Is alsoapplied to recycling and otherefforts to reduce the amount ofwastes.

Acid - A corrosive solution with a pHless than seven. Vinegar is acommon weak acid, battery acid ismuch stronger.

Acid Rain - Precipitation with acidicqualities caused primarily byindustrial combustion of fossil fuelsand automobile emissions.Increases acidity in soils, surfacewaters and forests. Dry forms ofacidic particulates may also fail.

Activated Sludge Process - Asewage treatment process by whichbacteria that feed on organic wastesare continuously circulated and putin contact with organic waste In thepresence of oxygen to increase therate of decomposition of thosewastes.

Acute Effect - An adverse orunhealthy effect on any lMngorganism In which severe symptomsdevelop rapidly and often subside orquit after the exposure stops.

Acute ToxIcity - Adverse orunhealthy effects that result from asingle dose or single exposure to achemical; any poisonous effectproduced within a short period oftime, usually less than 96 hours.This term normally is used todescribe the effects in experimentalanimals.

Ambient Air - Any unconfinedportion of the atmosphere; open air;surrounding air.

Anaerobic - A biological process whichoccurs in the absence of oxygen.

Applicable or Relevant andAppropriate Requirements(ARARS) - Any federal standardrequirements, criteria or limitationsthat are legally applicable or relevantand appropriate requirements underthe Comprehensive EnvironmentalResponse, Compensation andLiability Act (CERCLA). StateARARS must be met if they aremore stringent than the federalrequirements.

Aquifer - An underground rockformation composed of materialssuch as sand, soil or gravel that canstore and supply groundwater towells and springs. Most aquifersused in the United States are within1,000 feet of the surface. Oncecontaminated, it is physicallyimpossible to remove 100 percent ofthe contaminants from the aquifer.At times, engineers will be forced tosimply prevent the floating anddissolved contaminants from movingvertically and horizontally.

Artesian - Subsurface water underpressure stronger than normalatmospheric pressure. If a well isdrilled into artesian groundwater thepressure release will cause water tosurge upward. The Edwards Aquiferis under artesian pressure.

Assimilative CapacIty - The abilityof a natural body of water to receivewaste waters or toxic materialswithout harmful effects and withoutdamage to aquatic life or humanswho consume the water.

BCT - Best Conventional PollutionControl Technology. BCT refers tothose control technologiesconsidered most applicable tospecific waste streams.

Benthic Organism - Any of adiverse group of aquatic plants andanimals which live on the bottom ofmarine and fresh bodies of water.The presence or absence of certainbenthic organisms can be used asan indicator of water quality.

Bentonite - A naturally occurringclay often used to create a slurrywall or seal a groundwatermonitoring well.

Bloaccuniuiation/Biomagnification- A process where chemicals areretained in body tissue and increasein concentration over time.Biomagnification is the increase oftissue accumulation in species higherIn the natural food chain ascontaminated food species are eaten.

Bioassay - A method of testing amaterial's effects on livingorganisms.

Biochemical Oxygen Oemand (BOO)- A measure of the oxygen requiredto break down organic materials inwater. Higher organic loads requirelarger amounts of oxygen and mayreduce the amount of oxygenavailable for fish and aquatic lifebelow acceptable levels.

Biodegradable - The ability of asubstance to be broken downphysically andlor chemically bymicroorganisms. For example,many chemicals, food scraps,cotton, wool and paper arebiodegradable; plastics andpolyester generally are not.

Superfund Amendments andReauthorization Act of 1986 (SARA)- The amendments clarified manypublic participation questions andmade federal facilities accountableunder the statute. Reauthorizationextends funding for five years.

Surface Water - Any visible streamor body of water that is open to theatmosphere.

Survey - The review of records andthe examination of physical,sociological, economic and otherfactors that influence restorationdecisions.

Suspended Solids - Solids thateither float on the surface or aresuspended in water, waste water orother liquids.

Synergism - The interaction of twoor more chemicals producing agreater total effect than the sum oftheir individual effects.

TCLP - (See Toxicity CharacteristicLeaching Procedure.)

TDS - Total dissolved solids. Thequantity of dissolved material in agiven volume of water.

Ten-to-the-minus-sixth (1O) -Used in risk assessments to refer tothe probability of risk. Uterallymeans a chance of one In a million.Similarly, ten-to-the-minus-fifth (1 0)means a probability of one in100,000, and so on.

Teratogen - A substance thatcauses abnormal growth and

deformities, commonly used inreferences to fetuses and tumors.

Saturated Zone (Zone ofSaturation) - The layer beneath thesurface of the land in which allopenings are filled with water.

Scrubbing - Removal of impuritiesfrom a gas stream by spraying aliquid which concentrates theimpurities in the liquid waste. Acommon method of reducing stackair emissions.

Secondary Treatment - The secondstep in most publicly owned sewagetreatment systems in which bacteriaconsume the organic parts of thewaste. This treatment usuallyremoves about 90% of all solids andoxygen-demanding substances.

Sediment - Soil, sand and mineralswashed from land into water, usuallyafter rain. Sediments collecting inrivers, reservoirs and harbors candestroy fish and wildlife habitat.

Septic Tank - An underground tankto collect wastes from homes that arenot connected to a sewer system.Waste goes from the home to thetank where it is decomposed bybacteria. Solids and dead bacteriasettle to the bottom as sludge whilethe liquid portion flows into theground through drains. Whileproperly placed and maintainedseptic systems can effectively treatdomestic waste water, others are amajor source of groundwater andsurface water pollution.

Sludge - The residue (solids andsome water) produced as a result ofraw or waste water treatment fromindustrial waste treatment plantoperations.

Slurry - A pumpable mixture ofsolids and fluid.

Solid Waste Management Facility -Any disposal or resource recoverysystem or component thereof. Anysystem, program, or facility forresource conservatIon, and anyfacility for the treatment of solidwastes.

Solid Waste ReductIon(Minimization) - Reducing the amountof materials entering the waste streamby reducing or eliminating thegeneration of waste. Synonymous withwaste reduction. Redesigning productsor the patterns of production andconsumption, such as using returnablebeverage containers, are forms ofsource reduction.

Solid Waste - As defined underRCRA, solid waste is not alwayssolid. it includes any solid, semi-solid, liquid or contained gaseous,materials discarded from industrial,commercial, mIning or agriculturaloperations, and from communityactivities. Solid waste Includesgarbage, construction debris,commercial refuse, sludge fromwaste treatment plant, water supplytreatment plant or air pollutioncontrol facility, and other discardedmaterials.

Solvents - A liquid capable ofdissolving another substance; wateris the most common solvent.Industrial solvents are cleaningagents and degreasing compounds,sometimes also used as refrigerantsand aerosols. Some are suspectedof being carcinogenic.

Superfund - Federal legislationrequiring EPA to identify, list andclean up abandoned waste sites

Blodiversity - Refers to the varietyamong living organisms and theecosystems in which they occur. Theterm Includes the variety at differentlevels of biological structure, e.g.,ecosystems, species, genes.

Bloremedlation - The use of livingorganisms (e.g., bacteria) to cleanup oil spIlls or remove otherpollutants from soil, water andwaste water.

B iota - All living organisms in agiven area.

BTEX - Benzene, toluene,ethylbenzene, and xylene. Organiccompounds that are commoncomponents of fuel, including jet fuel.

Burial Pits - Disposal sites.Obsolete disposal methods wereused to bury materials in unlinedponds, pits, trenches, etc. Many ofthe pits were larger than footballfields. Solvents, waste oIls andother chemicals (toxic and non-toxic)were burled in these pits.

Cap - A fairly impermeable seal,usually composed of clay-type soil or acombination of clay soil and syntheticliner, which is placed over a landfill atclosure. It serves to minimize leachatevolume during biodegradation of thewaste by keeping most water frompercolating through the landfill. The capalso keeps odors down and animalscavengers from gathering.

Clean Water Act - Extensiveamendments in 1972 and 1977replaced the original Federal WaterPollution Control Act of 1948. Goalsof this act were to achieve zerodischarge of pollutants by 1985 andto restore and maintain the chemical,physical and biological Integrity ofthe nation's waterways. The Actrequires establishment oftechnology-based effluent limitationsto regulate discharges from pointsources and authorized regulation ofnon-point sources. It established theNational Pollutant DischargeElimination System (NPDES) whichrequires a permit before anydischarges of a pollutant can bemade to U.S. waters. The Act doesnot regulate underground waterunless it affects surface water.

Comprehensive EnvironmentalResponse, Compensation andLiability Act (CERCLA) - Authorizesestablishment of the EnvironmentalProtection Agency's (EPA)Supertund money. Originally signedinto law by the President on Dec. II,1980, the Act was amended and

reauthorized in 1986. Providesbasic authority for the President totake response actions with respectto dangers resulting from hazardoussubstances at disposal or spill sites.Response actions must beperformed In accordance with theNational Contingency Plandeveloped by the EPA. Imposes far-reaching liability for costs of cleanupon waste generators, transporters,and current and past owners ofdisposal sites. Title II provides for$1.6 billion Response Trust Fundgenerated by petrochemical taxes;however, monies from this fundcannot be used by federal facilities.

Concentration - The relativeamount of a substance mixed withanother substance. Term is used toexpress the mass per unit volume ofcontaminants, usually expressed asparts per million or billion. Anexample is five ppm of carbonmonoxide in air or one milligram perliter (1 mg/I) of iron in water.

Cone of Depression - A lowering Inthe water table that develops arounda pumped well.

Consent Order - Essentially anegotiated document entered into toavoid either litigation or a unilateralenforcement order issued by a stateor federal environmentalenforcement agency. Both theregulator and the regulated agencyagree to the terms of the orderissued under authority of the directorof the regulatory agency or anadministrative law judge.

Construction and DemolitionWaste - Waste building materials,dredging materials, tree stumps, andrubble resulting from construction,remodeling, repair and demolition

Waste Disposal Act of 1965, Callsfor comprehensive regulation ofdesignated hazardous waste fromthe time of generation to disposal(cradle to grave). TheEnvironmental Protection Agencyregulates generators andtransporters and Issues permits fortreatment, storage and disposalfacilities. The EPA has broadenforcement powers includingadministrative orders, injunctiverelief, civil fines and criminalpenalties. Restoration - The application ofcontainment or decontaminationtechnologies to eliminate existingpublic hazards or to render theproperty. acceptable for conditionalor unconditional reuse.

Risk - A measure of the chance thatdamage to life, health, property and!or the environment will occur as aresult of a hazard.

Risk Assessment - An estimate ofthe chance that a given risk situationwill occur, together with an estimate

of the severity of its impact. Riskassessments use specific chemicalinformation plus risk factors.

Risk Communication - The processof exchanging information aboutlevels of health or environmentalrisks and the significance ormeaning of those risks.

Risk Factor- A characteristic (e.g.,race, sex, age, obesity) or variable(e.g., smoking, exposure)association with increased chanceof toxic effects. Some standard riskfactors used in general riskassessment calculations includeaverage breathing rates (20 cubIcmeters/day), average weight (154lbs.), and average human life span(70 years).

Rodenticlde - A chemical or othermaterial used to destroy rats andother rodents or to prevent themfrom damaging food, crops, etc.

Safe Drinking Water Act -Established regulatory program in1974 to ensure safety of thenation's public drinking water andwater supplies. Program wasdesigned to establish standardsfor acceptable levels ofcontaminants in drinking water, toallow enforcement of thesestandards by the states, and toprotect water supplies fromunderground injections.

Sanitary Water - Also known asgray water. Water discharged fromrest rooms, showers, foodspreparation facilities or othernonindustrial operations.

Effluent - Wastewater dischargedfrom a point source, such as a pipe.

Emission Standards - Governmentstandards that establish limits on therelease of pollutants into the environ-ment (usually In reference to air).

Emission - The release or dischargeof a substance Into the environment.Generally refers to the release ofgases or particulates into the air.

Endangered Species - Animals,plants or other living organisms thatare threatened with extinction byman-made or natural changes intheir environment.

Environmental Assessment (EA) -A concise public document requiredby Federal law (NEPA) which

Polychlorlnated Biphenyls (PCBs)- A group of toxic, persistentchemicals used as a flame retardant,or in electrical transformers andcapacitors for insulating purposes,and in gas pipeline systems as alubricant. Further sale and new useof PCBS were banned by law in1979 when it became known thatPCB5 had problems of persistence(not easily degraded bymicroorganisms) and toxicity(suspected carcinogen). PCBs bindstrongly to soils and move little ornot at all in groundwater.

Potable Water - Raw or treatedwater that is safe for humanconsumption.

Potentially Responsible Party -lndMdual or company that is potentiallyresponsible for or has contributed to aspill or other contamination at aSuperfund site. Whenever possible,EPA requires these parties to clean upthe sites they have contaminated.

POTW - Publicly-owned treatmentworks. A Municipal or public-servicedistrict sewage treatment system.

PestIcide - Substance Intended torepel, kill or reduce the harmfuleffects of any pest.

pH - The measure of acidity oralkalinity of a chemical solution,from 0-14. Neutral water, forexample, has a pH of seven. Acidshave a pH of less than seven,bases (alkaline) greater thanseven.

Plume - A concentration ofcontaminants in air or water usuallyextending from a distinct source orhazardous waste site.

Point Source - Any distinctdischarge of pollutants from pipes,ditches, containers, wells, stacks,etc.

Pollutant - A natural or man-madesubstance that degrades waterquality to such an extent that thewater is not suitable for agricultural,industnal or domestic use.

Pollution Prevention - The activeprocess of Identifying areas,processes and activities whichcreate excessive waste and whichcan be substituted, altered oreliminated to prevent wastegeneration. Preventing the creationof waste prevents environmentalharm.

Flare - A control device that burnshazardous materials to prevent themfrom being released to theenvironment. Flares may operatecontinuously or intermittently and areusually found on top of a stack.

Flash Point - The lowesttemperature at which evaporation ofa substance produces enough vaporto form an ignitable mixture with air.

Floodplain - Mostly level land alongrivers and streams that may besubmerged by floodwater. A 100-year floodplain is an area which canbe expected to flood once in every100 years.

Freedom of Information Act(FOIA) - Federal and state lawswhich guarantee citizens access todocuments in the public record.

Fugitive Emissions - Air pollutantsreleased to the air other than thosefrom stacks or vents. Typically smallreleases from leaks in plantequipment such as valves, pumpseals, flanges, samplingconnections, etc.

FungIcide - A pesticide used tocontrol or destroy fungi.

Garbage - Food waste (animal andvegetable) resulting from thehandling, storage, packaging, sale,preparation, cooking and serving offoods.

Generator - A facility or mobilesource that emits pollutants into theair or releases hazardous wastesinto water or soil.

Grab Sample - A single sample ofsoil or of water taken without regardto time or flow.

Greenhouse Effect - The warmingof the Earth's atmosphere attributedto a build-up of carbon dioxide andother so-called "greenhouse gases."

Ground Cover - Plants grown tokeep soil from eroding.

Groundwater - Water found belowthe surface of the land, usually inporous rock formations.Groundwater is the source of waterfound In wells and springs. Geologicunits that yield appreciable amountsof water to wells are termed aquifers;intervening units with little or nowater are called aquitards orconfining units. Top of the zone ofcomplete saturation is called thewater table.

Hazardous Chemical - EPA'sdesignation for any hazardousmaterial that requires an MSDS (SeeMaterial Safety Data Sheet) underOSHA's Hazard CommunicationStandard. Such substances arecapable of producing adversephysical effects (fire, explosion, etc.)or adverse health effects (cancer,dermatitis, etc.)

Hazardous Waste Landfill - Anexcavated or engineered area atwhich hazardous waste is depositedand covered. Proper protection ofthe environment from the materialsto be deposited in such a landfillrequires careful site selection, thecataloging of types of wastes, good

Non-PoInt Source - Any source ofpollution not associated with adistinct discharge point. Includessources such as rainwater, runofffrom agricultural lands, industrialsites, parking lots and timberoperations, as well as escapinggases from pipes and fittings.

Open Dump - A land site wheresolid waste is disposed in a mannerthat does not protect theenvironment. Problems associated

with open dumps includemultiplication of disease-carryingorganisms, fires, air pollution, waterpollution, unsightliness, wasted land,pests and accidents to people, suchas cuts and falls.

Organism - Any living being,whether plant, animal or microbial.

OSHA - Occupationai Safety andHealth Administration.

OSWER - Office of Solid Waste andEmergency Response of EPA.

Oxidant - A substance, oftencontaining oxygen, which reactschemically with other materials toproduce new substances. Oxidantsare the primary ingredients inphotochemical smog.

Ozone - Three molecule oxygencompound (03) found in two layers ofthe earth's atmosphere. A layer ofbeneficial ozone occurs at seven toten miles above the surface andshields the earth from ultravioletlight. Harmful ozone (in highconcentrations) occurs at the surfaceas a result of a reaction betweenbyproducts of fossil fuel combustionand sunlight. High levels of near-surface ozone may have harmfulhealth effects on humans and theenvironment.

Particulates - Fine liquid or soiidparticles such as dust, smoke, mistor smog found in air emissions.

Parts per Million (PPM) - Adilution ratio of one ounce in amillion ounces. Roughlyequivalent to milligrams per liter(mg/i). For comparison, one ppmis comparable to one second in11.6 days.

Minimization - A comprehensiveprogram to minimize, eliminate orreduce wastes. Usually applied towastes at their point of origin.

Mitigation - Measures taken toreduce adverse or unhealthy effectson the environment.

Monitoring Wells - Special wellsdrilled at specific locations on or offa hazardous waste site. Purpose ofthe wells is to sample groundwaterat selected depths to determine thedirection the water is flowing andthe types and amounts of anycontaminants present.

Morbidity - Rate of incidence ofdisease.

MortalIty - Death rate.

Mutagenicity - The property of achemical that causes the geneticcharacteristics of an organism tochange in such a way that futuregenerations are permanently affected.

National Priorities List (NPL) - Alist of sites ranked in order of priorityfor hazardous waste cleanup underSuperfund.

National Response Center (NRC)- A U.S. government commun-

icatlons center operated by the U.S.Coast Guard for the report of spillsand other unexpected releases tothe environment. The NRC relaysinformation to the appropriatefederal agency.

National Environmental Policy Actof 1969 (NEPA) - Public Law 91-90,which declares a national policy thatencourages productive andenjoyable harmony between manand his environment, establishes theCouncil on Environmental Qualityand states the requirements forenvironmental Impact statements.

National Oil and HazardousSubstances Pollution ContingencyPlan (NCP) - Codified in 40 CFR 300.The NCP establishes procedures andstandards for responding to releasesof hazardous substances, pollutants,and contaminants.

National Pollutant DischargeElimination System (NPDES) -The primary permitting programunder the Clean Water Act whichregulates all discharges to surfacewater in the United States.

National Priorities Ust -Environmental Protection Agency'slist of the most serious uncontrolledor abandoned hazardous waste sitesIdentified for possible long-termremedial response using moneyfrom the Trust Fund. The list isbased primarily on the score a sitereceives on the Hazard RankingSystem. EPA is required to updatethe list at least once a year. None ofKelly's sites are on the NationalPriorities Ust.

NESHAP - National EmissionsStandards for Hazardous AirPollutants. Emission standards set

design, proper operation, leachatecollection and treatment, andthorough final closure.

Hazardous Wastes - Solid wastesthat pose fire hazards, are highlyreactive, corrosive or explosive, orotherwise pose threats to humanhealth or the environment. A solidwaste is a hazardous waste If it isnot specifically excluded fromregulation and it meets any of thefollowing criteria:

— It is specifically listed as ahazardous waste by EPA;

— it exhibits one or more of thecharacteristics of hazardouswastes (ignitablilty,corrosiveness, reactivity and/or toxicity);

— it is created by the treatment ofhazardous waste; or

— It is contained In a hazardouswaste.

Hazardous Substance - Anymaterial that poses a threat to publichealth or the environment. Typicalhazardous substances are materialsthat are toxic, corrosive, Ignitable,explosive, chemically reactive orcarcinogenic.

Heavy Metal - Metallic elementswith high atomic weights. Most candamage organisms at lowconcentrations and tend toaccumulate in the food chain.Examples Include: chromium, lead,mercury, cadmium, copper, zinc andiron. Some are believed to causecancer or abnormal growth.

Herbicide - A chemical that controlsor kills plants such as weeds andgrasses. Some herbicides arespecifically designed to kill certaintypes of plants while others will killall plants.

Burningdetoxifies the incinerated organics,reduces the volume of waste andconverts wastes to solids byvaporizing water and other liquids Inthe wastes. The residue ashproduced contains little or nocombustible material. It may containsome hazardous material, such asnoncombustible heavy metals,concentrated from the original waste.

Incinerator - A device for the routineburning of waste materials usingcontrolled flame combustion.

IncompatIble Waste - A wasteunsuitable for mixing with anotherwaste or material. These may reactto form a hazard.

Indirect Discharge - TheIntroduction of a waste to a publiclyowned sewage system fortreatment before release into theenvironment. Facilities which useindirect discharge often must pre-treat the waste before sending it tothe sewage treatment plant.

Industrial Waste - Unwantedmaterials produced in oreliminated from an industrialoperation. They may becategorized under a variety ofheadings, such as liquid wastes,sludge wastes, solid wastes andmay include hazardous wastes.

Information Repository - Filescontaining current information,technical reports and referencedocuments. Kelly AFB'sInformation Repositories arelocated in the science andtechnology section of the Main SanAntonio Public Library and at theKelly AFB Library.

Installation Restoration Program -Department of Defense program thatIdentifies and cleans contaminationfrom past hazardous waste disposalsites on present or former military-owned property.

Interagency Agreement - Anagreement between the U. S.Environmental Protection Agencyand federal facilities as required bythe 1986 Superfund amendments forthe expeditious cleanup of NationalPriorities List sites. States areencouraged to be a party to theseagreements.

Irritant - A substance which cancause irritation of the skin, eyes orrespiratory system. Effects may beacute from a single high-levelexposure, or chronic from repeatedlow-level exposures. Someexamples of irritants are chlorine,nitrogen dioxide and nitric acid.

JP-4/JP-8 -A kerosene-like fuel forjet engines.

Karst - A geologic formation ofirregular limestone deposits thatcontain sinks, underground streamsand caverns.

Lagoon - A shallow pond wheresunlight, bacterial action and oxygenwork to purify waste water.

Land Ban - Mandated by the 1984amendments to ACRA, a phaseoutof land disposal of most untreatedhazardous wastes.

Landfill - A method for final disposalof solid waste on land. The refuse isspread and compacted and a coverof earth applied so that effects on theenvironment (Including public healthand safety) are minimized. Under

current regulations, landfills arerequired to have liners and leachatetreatment systems to preventcontamination of groundwater andsurface waters.

MunIcipal - A landfill whichdisposes of domestic wasteincluding garbage, paper, etc.This waste may include toxinsthat are used in the home, suchas insect sprays and powders,engine oil, paints, paint thinnerand weed killers.

Industrial - A landfill which disposesof non-hazardous Industrial wastes.

LC 50- Lethal Concentration. Aconcentration of a pollutant oreffluent at which 50% of the testorganisms die. Common measureof acute toxicity.

LD 50 - Lethal Dose. The dose of atoxicant that will kill 50% of testorganisms within a designatedperiod of time. The lower the LD 50,the more toxic the compound.

Leachate - Liquid (mainly water) thatpercolates through a landfill and haspicked up dissolved, suspended and/or microbial contaminants from thewaste. Leachate can be comparedto coffee where water has percolatedthrough the ground coffee and filter.Leaching may result In hazardoussubstances entering soil, surfacewater or groundwater.

Liner - Structure of natural clay ormanufactured material (plastic) whichserves as a barrier to restrict leachatefrom reaching or mixing withgroundwater in landfills, lagoons, etc.

Long-Term Monitoring - A programof water, soil or sediment analysisintended to track migration ofcontaminants.

Manifest System - Tracking ofhazardous waste from "cradle tograve' (generation through disposal),with accompanying documentsknown as "manifests."

Material Safety Data Sheet (MSDS) -Printed material concerning ahazardous chemical, or ExtremelyHazardous Substance, including itsphysical properties, hazards topersonnel, fire and explosion potential.safe handling recommendation, healtheffects, fire fighting techniques,reactivity and proper disposal.Originally established for employeesafety by OSHA.

Maximum Contaminant Level(MCL) - The maximum level ofcertain contaminants permitted indrinking water supplied by a publicwater system as set by EPA underthe federal Safe Drinking Water Act.

Maximum Contaminant Level Goal(MCLG) - The maximum level of acontaminant that is associated withno adverse health effects fromdrinking water containing thatcontaminant over a lifetime. Forchemicals believed to cause cancer,the MCLGs are set at zero. MCLGsare not enforceable, but are ideal,health-based goals which are set inthe National Primary Drinking WaterStandards developed by EPA. MCLsare set as close to MCLGs aspossible, considering costs andtechnology.

Metal Plating - An electrically drivenprocess that coats metal objects witha new layer of plating metal.

Microorganisms - Generally, allliving things that are microscopic insize, including bacteria, yeasts,simple fungi, algae, protozoans and

CharterI. Name

A. This organization shall be known as theKelly Air Force Base Installation RestorationProgram Restoration Advisory Board. TheKelly Restoration Advisory Board will fulfillall requirements of 10 U.S.C. 2705(c) forTechnical Review committees at U.S.Department of Defense installations.

B. The Restoration Advisory Board charter,herein referred to as "the Charter," isentered into by Kelly Air Force Base andthe Restoration Advisory Board.

II. Purpose and Functionof the Restoration AdvisoryBoard

A. The purpose of the RestorationAdvisory Board is to ensure public inputinto the planning and implementation ofenvironmental restoration activities at KellyAir Force Base. Board Members promotecommunity awareness and obtainconstructive community review andcomment on environmental restorationactions to accelerate the overall cleanupand potential community reuse of portionsof Kelly Air Force Base. The RestorationAdvisory Board will facilitatecommunication and disseminateinformation a bout the InstallationRestoration Program; ensure opinions aboutenvironmental restoration reflect diverseinterests within the community by providingan opportunity for comment on actions andproposed activities taken by Kelly Air ForceBase under the Installation Restoration

Program; and facilitate regulatory andpublic participation consistent withapplicable laws. The Restoration AdvisoryBoard serves in an advisory capacity toKelly Air Force Base, the U.S.Environmental Protection Agency (Region6), and the Texas Natural ResourceConservation Commission.

B. Kelly Air Force Base shall consult withand seek the advice of the Board Memberson the following issues:

a. Identifying environmental restorationactivities and projects at Kelly Air ForceBase.

b. Monitoring progress on theseactivities and projects.

c. Collecting information regardingrestoration priorities at Kelly Air ForceBase.

d. Addressing land use, level ofrestoration, acceptable risk and wastemanagement and technology developmentissues related to environmental restorationat Kelly Air Force Base.

e. Developing environmental restorationstrategies for Kelly Air Force Base.

C. The Air Force has developed a PublicInvolvement Plan which outlines thecommunity involvement program. TheRestoration Advisory Board supplementsthe community involvement program. Acopy of the plan is available at theinformation repositories established at the

III. Basis and Authorityfor Charter

The basis and authority for this charter arecontained in the ComprehensiveEnvironmental Response, Compensation,and Liability Act (CERCLA) of 1980, asamended by the Superfund Amendmentsand Reauthorization Act (SARA) of 1 986,particularly Sections 1 20(a), 1 20(f), and121(f), and 10 U.S.C. 2705, enacted bySection 211 of SARA.

IV. Membership

A. Individual community Members mustreside or work in Bexar County or currentlywork or live on Kelly Air Force Base.

B. Members shall serve withoutcompensation. All expenses incident toroutine travel and review inputs shall beborne by the respective Members or theirorganizations. Subject to the availability offunds, Kelly Air Force Base will fund perdiem and travel expenses for BoardMembers attending training courses orseminars on environmentally-relatedmatters relevant to Members' duties on theBoard.

C. Members are expected to attend allRestoration Advisory Board meetings orsend an alternate. If a Member fails toattend or send an alternate to twoconsecutive meetings, the RestorationAdvisory Board on a majority vote mayrevoke the membership of the absentMember.

D. Members unable to continue to fullyparticipate shall submit their resignations inwriting or by orally notifying either of theRestoration Advisory Board co-chairs.Resigning Members may nominate newMembers to replace them for a full two-year term.

E. Members should be willing to promotepublic input into the planning andimplementation of environmentalrestoration activities at Kelly Air Force Baseand to communicate with the localcommunity members and interest groupsconcerned with specific base cleanupissues. Members will serve as a direct andreliable conduit for information flow to andfrom the community. To improvecommunication between the public andRestoration Advisory Board, Members'names, addresses and telephone numberswill be made available to the public andlisted in meeting minutes.

F. Government agencies, communitygroups, citizens, and special interest groupsmay apply for membership to theRestoration Advisory Board. Onceaccepted to the Restoration AdvisoryBoard, a term of two (2) years is required.After two years, Members may continue toserve additional two-year terms, ifnominated and appointed, until theRestoration Advisory Board is terminated(as long as they continue to meet thecriteria stated in Section IV of this Charter).Additional membership applications can beaccepted at any time; however, priority willbe given those applicants who clearlyenhance the diverse nature of themembership. Applications are approved bya majority vote of the Restoration AdvisoryBoard Members present. Applicants mustbe present at the meeting at which thevote is taken.

V. Restoration Advisory BoardStructure

A. The Restoration Advisory Board shall beco-chaired by the San Antonio Air LogisticsCenter Director of EnvironmentalManagement and a community member.The responsibility for presiding over eachmeeting will be alternated between Co-chairs. The Co-chairs or their alternatesshould attend all meetings and ensure thatall Restoration Advisory Board Membershave an opportunity to provide input into

B. The Community Co-chair will beselected by a majority vote of theRestoration Advisory Board communityMembers. The alternate for the CommunityCo-chair shall also be designated by thecommunity Members of the Board by amajority vote. The Restoration AdvisoryBoard Community Co-chair will serve a 1 2-month term. A Co-chair may serve morethan one term, if approved by theRestoration Advisory Board communityMembers.

C. The Restoration Advisory Boardmembership is responsible for terminatingthe Community Co-chair if that person isfound to be ineffective or detrimental to theprogress of the Restoration Advisory Board.Co-chair removal is determined by majorityvote of the Restoration Advisory Boardcommunity Members present at themeeting following the one at which removalis proposed.

D. The Restoration Advisory Board shallmeet quarterly at formally advertised timesand locations, preferably at an off-baselocation. More frequent formal meetingsmay be held, if deemed necessary by theRestoration Advisory Board. The minimumnumber of members required to be presentbefore the Board can transact business is50 percent of the membership.

E. Agenda items will be compiled by theCo-chairs. Suggested topics fromRestoration Advisory Board Members andKelly Air Force Base staff will be given tothe Co-chairs not later than two (2) weeksprior to the meeting. Base personnel shallbe responsible for providing writtennotification to all Restoration AdvisoryBoard Members of the upcoming agenda,date, time, and place of the scheduledRestoration Advisory Board meetings. AllRestoration Advisory Board meetings willbe open to the general public and to thenews media.

F. Base personnel shall be responsible forrecording and disseminating meetingminutes in both English and Spanish. Awritten list of attendees at each meetingwill be recorded and incorporated intomeeting minutes. Action items will beincluded in the minutes for the RestorationAdvisory Board meeting at which they areassigned. Progress on each action item willbe briefed at each Restoration AdvisoryBoard meeting. Until an action item isclosed, the written response/progress willbe included in meeting minutes.

G. A copy of the Restoration AdvisoryBoard meeting minutes will be sent to allRestoration Advisory Board Members andwill be available for public review in theinformation repositories established at theSan Antonio Central Library and the KellyAir Force Base Library.

H. In order to ensure public input into theplanning and implementation ofenvironmental restoration activities,Restoration Advisory Board Members willbe asked to review and comment onvarious environmental restorationdocuments. Restoration Advisory BoardMembers should submit any writtencomments to either the Community Co-chair or individually to the base communityinvolvement coordinator on the subjectdocuments within the time frame specified(30-60 days). The Community Co-chair willconsolidate comments from the Memberswho wish to have him submit them on theirbehalf. In addition, Restoration AdvisoryBoard Members are encouraged toparticipate in the mandatory publicmeetings during the 30-day publiccomment period on Proposed Plans.

I. Final documents, Member's commentsreviewed by the Restoration AdvisoryBoard, responses to action items, andRestoration Advisory Board meetingminutes will become part of theAdministrative Record.

information repositories for all publicdocuments relating to restoration activities.These repositories are located at the SanAntonio Central Library and the Kelly AirForce Base Library. Board Members areauthorized access to any documents,studies, or information which have beenplaced in the public repositories ordistributed at Restoration Advisory Boardmeetings. In addition, the Kelly Air ForceBase Community Involvement Coordinatorwill make available to the RestorationAdvisory Board Members three completecopies of draft preliminary assessment/siteinvestigation, remedial investigation,focused feasibility study, and feasibilitystudy documents for review and/ordissemination at the same time they areprovided to state and federal regulators.One copy of all other documents will beavailable through the CommunityInvolvement Coordinator at the same timethey are provided to the regulators.

K. In keeping with the intent of theEmergency Planning and Community Right-To-Know Act and other federalenvironmental acts, the RestorationAdvisory Board, at its discretion, mayappoint a committee to be notified viatelephone by Kelly Air Force Base personnelof any reportable releases or significantenvironmental incidents involving hazardoussubstances. Such notification will occur assoon as practical after regulatory agencieshave been notified. In addition, a listing ofany reportable releases or incidents asdescribed above and a summary ofremedial actions taken or planned will bemade available to Members at theRestoration Advisory Board meetingfollowing the release or incident. TheRestoration Advisory Board will be notifiedof all reportable spills prior to a review ofthe meeting minutes. To ensure that properfocus on Installation Restoration Programactivities is maintained, any discussion of arelease or incident will be tabled until allother agenda topics have been addressed.

VI. Effective Date andAmendments

A. The effective date of this Charter shallbe the date the Base and Community Co-Chairs sign this Charter.

B. This Charter may be amended by a two-thirds majority vote of the Memberspresent at the meeting following the one inwhich the amendment was proposed.Amendments must be consistent with KellyAir Force Base agreements with state andfederal regulatory agencies and statutesstated in Section II of the Charter (Basisand Authority of Charter).

VII. Termination

This Charter will be terminated uponcompletion of requirements as stated inapplicable state and federal agreements.However, after implementation of the finalremedial design, it may be terminatedearlier upon a two-thirds majority vote ofthe Restoration Advisory Boardmembership.

Some discussion points to remember for this evening:

1. The RAB charter was changed to correct an error. The reference to 211 of CERCLA 211 insection III was changed to 211 of SARA. All RAB members have copies of the corrected charterin their folders.

2. We need each RAB member to tell us how they want their names, addresses and phonenumbers to appear in the public listings. A special form has been provided in the folders that theyshould fill out and return to us this evening.

3. We need to schedule a tour of selected IRP sites and cleanup facilities in addition to the nextregular meeting. Might have to offer several tours to meet everyone's needs.

4. News media. We do not know if any media will show up tonight. In any case, we need to letthe RAB members know that they can call upon Kelly's public affairs officers for assistance intalking to the news media. This is strictly voluntary, but we would be happy to help anyone inpreparing for or conducting a media interview.
