The direction from the Bureau was that they understand that certain laws, such as the FDCPA or the Bankruptcy Code, may prevent attempts to collect a debt from a consumer in bankruptcy, but does not believe that these laws prevent a servicer from sending a consumer statement on the status of their loan. Servicers are allowed to make changes to the statement as they believe are necessary when a consumer is in bankruptcy; and may include a message about the bankruptcy and alternatively present the amount due to reflect the payment obligations determined by the individual bankruptcy proceeding.
