DESCRIPTION OF CLASS The Licence to Conduct High Risk Work – Forklift – permits use of a forklift truck other than an order-

picking forklift truck.

TASMANIAN LAW AND LICENCE TO CONDUCT HIGH RISK WORK The Tasmanian Workplace Health and Safety Regulations 2012 specify the classes of high risk work

and the conditions under which a person may conduct high risk work.

The Regulations specify the mandatory training that must be undertaken, through a Registered

Training Organisation and against a Unit of Competency, before a person may attempt the Licence to

Conduct High Risk Work assessment. Alternatively, an applicant may provide evidence that this

training has occurred and request recognition of their prior learning.

Assessment Instruments are now established and are the same across Australia. Workplace

Standards Tasmania is responsible for Accrediting and Registering Assessors who may conduct the

assessments, under arrangements with Registered Training Organisations.

In establishing our current Licence to Conduct High Risk Work training and assessment practices

TransTrain has worked closely with Workplace Standards Tasmania.

A copy of the Regulations is available at www.thelaw.tas.gov.au and an extract, specific to Licence to

Conduct High Risk Work, is available from TransTrain.

REQUIREMENT TO BE LICENCED Under the law in Tasmania effective from 1/1/2013, if you do not hold a current licence to conduct

high risk work (or a valid Assessment Summary Interim Licence), then you cannot conduct high risk

work, unless you are enrolled and have completed introductory training and are working under the

supervision of a licenced operator.

It is no longer legal for an unlicensed person to be supervised by a licensed person in

conducting a class of high risk work, UNLESS the unlicensed person is ALSO formally

enrolled with a Registered Training Organisation AND completing training for the specified

national unit of competency.

The penalty for individuals is up to $3600, and up to $18,000 for a body corporate.

DUTY TO ENSURE DIRECT SUPERVISION Regulation 84 specifies the duty of a Person Conducting Business or Undertaking (PCBU) to provide

direct supervision. A PCBU must ensure that a person supervising the work of a person carrying out

high risk work whilst undergoing a formal program of training through a RTO provides direct

supervision unless:

a) The nature or circumstances of a particular task make direct supervision impracticable or

unnecessary; and

b) The reduced level of supervision will not place the health or safety of the supervised person

or any other person at risk.

PCBU TO OBTAIN (AND KEEP) WRITTEN EVIDENCE OF LICENCE Regulation 85 specifies that a PCBU must not direct or allow a worker to carry out high risk work for

which a high risk work licence is required unless the person sees written evidence provided by the

worker that the worker has the relevant high risk work licence. The regulation also specifies that the

PCBU must see written evidence that any person supervising a person conducting high risk work

under a training program holds the relevant high risk work licence for that class of work.

This written evidence must be kept by the PCBU for at least one year after the high risk work is

carried out, and for at least one year after the last occasion on which the worker performs the

supervision work.

The penalty for individuals is up to $1200, and up to $6000 for a body corporate.

TRANSTRAIN PATHWAYS TO THE LICENCE You must be aged at least 18 years before you can apply for a Licence to Conduct High Risk Work. If

you are less than 18 years of age, please contact TransTrain to discuss options.

TransTrain offers four pathway options for applicants wanting to achieve a Licence to Conduct High

Risk Work.

Your pathway will depend on:

Your previous qualifications / licences held

Your access to a workplace with resources available to support the training

Your access to a workplace with resources available to support the assessment

The pathways are:

1. Recognition of Prior Learning Pathway – you must have an expired certificate of competency or forklift licence, OR a Statement of Attainment issued by a Registered Training Organisation (RTO), for the unit of competency TLILIC2001A or equivalent, to be eligible for RPL through TransTrain

2. Workplace Based Pathway – where you have access to suitable resources, including a licenced operator to provide you with direct supervision

3. Off Job Pathway – where TransTrain provides suitable resources and a qualified trainer and registered assessor

4. Combined Pathway – which provides options to meet specific situations – for example, where there is a forklift and licenced operator to provide supervision in the workplace, but all of the resources specified in the licence assessment are not available in the workplace. In this case, initial training can be conducted by TransTrain in the workplace, you can gain skills and knowledge by operating the forklift under supervision of a licenced operator in the workplace, and attend a TransTrain facility for the assessment phase.

WORKPLACE RESOURCE CHECKLIST Use this checklist to determine if your workplace is a suitable environment and has the required

resources for the forklift training and assessment.

The working zone for the forklift assessment must not be less than 400 square meters.

Shelving and or racking(where applicable, for the purposes of forklift assessment, shelving and racking can be taken to mean a flat stable area for the placement of loads suitable for the industry being worked in) which will allow the applicant to demonstrate the following lifts:

o Lift one: low level (floor level)

o Lift two: medium level (should not be performed at less than 25% of machine’s height capacity.

o Lift three: high level (should not be performed at less than 75% of machine’s height capacity.

Suitable obstacles to allow the forklift to maneuver through a chicane.

Three varied loads suitable for the forklift weighing at least 50% of the rated capacity of the forklift

Appropriate communication systems, for example fixed channel radio and/or whistles

A suitable space (with table and chairs) where the knowledge assessment can be conducted without interruption

ELIGIBILITY CHECKLIST - SUMMARY

CHECK YOUR ELIGIBILITY FOR RPL If you have an expired forklift licence / certificate of competency, or a Statement of Attainment from a Registered Training Organisation for the unit TLLILIC2001A Licence to operate a forklift truck, you may apply for advanced entry to the training. This is known as Recognition of Prior Learning, or RPL. You must still complete the assessment aspects of the course, but your training time may be reduced on the basis of prior training. TransTrain has developed a RPL Application Form that you must use to apply for RPL. Following review of your RPL application and interview with you, TransTrain may require that you complete some training to fill gaps before proceeding to the assessment stages.

PRIOR TRAINING / LICENCE You are eligible to apply for RPL / advanced entry to the training and assessment service. Complete the Licence to Conduct High Risk Work Enrolment and RPL Assessment Form.

NO PRIOR TRAINING / LICENCE You are not eligible for any RPL. You must complete a training program with TransTrain before entering the assessment.

CHECK YOUR ACCESS TO WORKPLACE TRAINING Do you have a workplace, with hazard controls and a suitable forklift, appropriate communication systems and a person who is a licenced operator who will provide you with direct supervision whilst you gain skills and knowledge operating the forklift?

WORKPLACE AND RESOURCES AVAILABLE You are eligible for a workplace based pathway for your training.

NO WORKPLACE WITH RESOURCES TransTrain offers “off the job” options.

CHECK YOUR ACCESS TO WORKPLACE ASSESSMENT Do you have a workplace with hazard controls, minimum of 400 square meters, a range of loads, an operational forklift to standards AS2359, racking / shelving, appropriate communication systems available in your workplace for the assessment?

OPTIONS Use TransTrain’s Checklist to see if you have the resources to do the assessment in your workplace. If not, TransTrain offers an off the job assessment option.

Recognition of Prior Learning Available where you hold an expired Forklift Licence or Certificate of Competency, or have a

Statement of Attainment from a Registered Training Organisation for the unit of competency

TLILIC2001A Licence to conduct high risk work

Where you have one of the above listed documents demonstrating your previous training,

you can apply to have Recognition of Prior Learning applied to your training program.

If you apply to have your current competency recognized, you must provide documentation that

demonstrates that you have completed the content of the course that you are seeking recognition

for.

TransTrain will provide you with a Self Assessment Checklist and follow this up with an Interview.

The RPL Pathway includes an assessment phase for both knowledge and practical demonstration of

your skills. This service can be conducted in your workplace where suitable resources are available,

or in a facility where resources are provided by TransTrain.

RPL is granted against the training aspect. As a minimum, Applicants must still complete the

TransTrain Formative Assessment and the High Risk Work Licence Assessment.

Workplace Based Pathway: Available where all resources specified for the training and the National High Risk Work Licence

Assessment are available in the workplace, including licenced operator(s) to provide supervision.

The process:

PRE-PROGRAM

Contact us and book your service. We will provide our Code of Practice, a Pre-program Information

Package and an Enrolment form. We will ask you to use a checklist to confirm that you have the

resources available in the workplace. This is your responsibility – we will check the resources against

this checklist as part of the first stage of service.

STAGE 1: INTRODUCTORY TRAINING & WORKPLACE CHECK

(UP TO 4 HOURS)

TransTrain attends your workplace to:

Confirm that the resources are available

Complete any outstanding details from the Enrolment with you

Conduct introductory and safety training in operating the forklift

Meet with the Licenced Operator who will Supervise you operating the forklift

Provide you with a Log Book to complete when you operate the forklift under supervision

STAGE 2: WORKPLACE LEARNING

(UP TO 3 MONTHS)

You operate the forklift, under the supervision of a licenced operator for the purpose of gaining

experience, skills and knowledge. You must keep a log of all times you operate the forklift, who

supervised you and what you did while operating the forklift. TransTrain will contact you at the 2

month point to check on your progress and to make a booking for your assessment.

STAGE 3: ASSESSMENT PHASE

(UP TO 5 HOURS)

TransTrain attends your workplace and meets with you and your Supervising Operator. TransTrain

conducts a formative assessment (practical and knowledge aspects) to decide if you are ready to

attempt the Licence to Conduct High Risk Work Assessment. If you are successful, you proceed to

the Licence to Conduct High Risk Work Assessment.

If you are successful, you will be issued with an Assessment Summary Interim Licence which is valid

for 60 days – you must make application for your licence during this 60 days.

If you are not successful in the formative assessment, you may not proceed to the Licence to

Conduct High Risk Work Assessment. If you are not successful in assessments, TransTrain will meet

with you and your Supervising Operator to discuss options which may include further time on the

job to gain skills and knowledge, off job training and reassessment.

Off Job Pathway

Suitable where you require TransTrain to provide the facility and resources.

This program is offered over three days (may be reduced to two days for 2 or less

participants).

The final day includes the TransTrain formative assessment and the National Assessment for Licence

(knowledge questions, calculations assessment and practical assessment).

Combined – Workplace Learning, Off Job Assessment Suitable where resources suitable for training are available in the workplace but not the resources

required for the Licence to Conduct High Risk Work Assessment.

The process:

STAGE 2: WORKPLACE LEARNING

(UP TO 3 MONTHS)

You operate the forklift, under the supervision of a licenced operator for the purpose of gaining skills

and knowledge. You complete the activities in the Activity Book provided by TransTrain and keep a

log of all times you operate the forklift, who supervised you and what you did while operating the

forklift.

STAGE 3: ASSESSMENT PHASE

(JOIN TRANSTRAIN OFF JOB PROGRAM FOR FINAL DAY)

Join a TransTrain scheduled program for the final day to complete your Assessment activities.

DETAIL OF THE TRAINING AND ASSESSMENT PROCESS

ENROLMENT

Provide evidence of identity and confirm eligibility for the licence

Complete TransTrain Enrolment Form to relevant unit of competency

If applicable, make application for recognition of prior learning based on previous

experience – must provide documentary evidence, complete a self assessment and interview

COMPLETE REQUIRED TRAINING

TransTrain provides introductory, safety training on enrolment for all classes of high risk work.

Depending on the circumstance, you may then complete specified activity in the workplace under

supervision of a licenced operator, or may complete further structured training in a facility provided

by TransTrain. All time in training is recorded in an Operator Log Book. .

COMPLETE SELF ASSESSMENT AND SUPERVISOR ASSESSMENT

Operator and Supervisor (if workplace pathway) or Trainer (if off job pathway) complete a statement

to confirm the operator’s readiness for final assessments.

COMPLETE FORMATIVE ASSESSMENTS

TransTrain conducts a formative assessment to confirm readiness for the final Licence to Conduct

High Risk Work Assessment.

COMPLETE NATIONAL HIGH RISK WORK LICENCE ASSESSMENT

The National Assessment Instruments (AIs) for Licence to Conduct High Risk Work are used for the

final assessment. These are confidential and may only be disclosed once you have been deemed

ready to participate in the assessment.

There are generally three parts to these assessments – a knowledge component, a calculations

assessment and a practical demonstration. Each part can be conducted separately, within a

specified timeframe.

When you have been successful in all parts of the assessment you will be issued with an Assessment

Summary Interim Licence which is valid for 60 days – you must make application for your licence

during this 60 days. This provides an interim licence and is also the evidence needed to apply for the

Licence to Conduct High Risk Work.

The satisfactory assessment also triggers the Registered Training Organisation to generate a

Statement of Attainment for the relevant national unit of competency.

IF YOU ARE NOT SUCCESSFUL If you are not successful in the TransTrain Formative assessment, you may not proceed to the

Licence to Conduct High Risk Work Assessment. TransTrain will negotiate a training plan and re-

assessment opportunity for you.

If you are not successful in the Licence to Conduct High Risk Work assessment, you may not

participate in a re-assessment within 21 days of you unsuccessful assessment, however if you were

successful with some sections of the assessment, these remain valid for 60 days and you do not

need to repeat these.

If you are not successful in assessments, TransTrain will meet with you and your Supervising

Operator to discuss options which may include further time on the job to gain skills and knowledge,

off job training and reassessment. Additional services including re-assessment will be at additional

cost.

APPLY FOR LICENCE TO BE ISSUED

You apply through Service Tasmania for the issue of a Licence to Conduct High Risk Work for the

specified class.

RENEWAL OF LICENCE TO CONDUCT HIGH RISK WORK

Licences issued under the new regulations have a 5 year expiry (Regulation 92). The process to

renew a licence is set out in Subdivision 4 of the Regulation.

APPLICATION WITHIN THE LICENCE PERIOD

The person must make application, before the expiry of the licence, including a declaration that he

or she has maintained competency to carry out the high risk work. The regulator may require that

the person complete any relevant training or reassessment for example if the regulator is concerned

about the original quality of training and or assessment, or if there is evidence that the person has

conducted high risk work incompetently (Regulation 95).

APPLICATION ONCE LICENCE HAS EXPIRED, BUT LESS THAN 12 MONTHS

If the High Risk Work Licence (NOT a previous Certificate of Competency) has expired, the applicant

has a 12 month window in which to make application for renewal of the licence, but may not

LICENCE EXPIRED MORE THAN 12 MONTHS

After a High Risk Work Licence (NOT a previous Certificate of Competency) has been expired more

than 12 months, the applicant is deemed a new applicant and must undergo the standard process of

licence application through enrolment and assessment with a Registered Training Organisation.

Your expired licence may provide evidence of RPL and shorten the training phase of your program.

TransTrain is also available to conduct Verification, or Validation, of Competency (VOC), to confirm

operator current skills and knowledge. Operators must have a current Licence to Conduct High Risk

Work for this class to be eligible for the VOC assessment.
