(3) A l l fishing S e a r used in connection w i t h t h e a c t i v i t i e s of a fishing vessel and not physically attached to a fishing vessel shall be marked perr~anently with the i c l e n t i f ication markings of that vessel.

( 4 ) Y h e r e the fishing gear referred to in sub-regulation ( 3 ) is placed in the fishery waters, the position of such fishing,gear shall be immediately reported by the master to the Directos-.

7.(1) The mastei- of each f i s h i n g v e s s e l shall keep a listening watch at all times on V H F radio (Channel 16), and in ~ a r t i c u l a r , on being approached by 2 v e s s e l o r aircraft authorised to enforce the Decree, shall be on the alert for signals conveying enforcement instructions in accordarlce with the provisions of this regulation.

( 2 ) A fishing v e s s e l to be inspected by a v e s s e l a u t h o r i s e d to enforce the Decree will be i n f os~ned by VHF r a d i o ( C h a n n e l 16 ) , I n t e r n a t i o n a l Code signals " S i e r r a Quebec 3" (you must stop your vessel, I wish to board you), by flag or in Horse Code b y signal lamp.

( 3 ) If contact is not made through these means, the enforcement vessel shall direct a series of flashing white light towards the fishing vessel. The master of the fishing vessel shall then immediately cause the fishing vessel to follow the enforcement vessel.

( 4 ) "PLA", e t c , means ' c a l i for an unknown station, to which the signaled fishing vessel shall respond by illuminating the v e s s e l identification required in regulation 6.

( 7 ) When a vessel is signaled to s t o p or heave-.to f o r b o a r d i n g , t h e master s h a l l -

(a) s t o p immediately and la 'y-to or manoeuvre in such a way a s to p e r m i t the authorised o f f i c e r and his par.Ly to come aboard;

( h ) provide a s a f e ladder f o r the a u t h o r i s e d o f f i c e r and h i s p a r t y ;

( c ) when n e c e s s a ~ - y f o r s a f e boarding or, :lpon request, provide a manrope, s a f e t y l i n e and illunination f o r t h e ladder; and

(d) take such o t h e r a c t i o n a s may be n e c e s s a r y t o ensure the safety of the authorised officer and his party and to facilitate board ing .

PART V - IMDUSTRIAL FISWIKG LICENCES

8. (1) An a p p l i c a t i o n f o r l o c a l and f o r e i g n f i s h i n g v e s s e l licences s h a l l be mace i n w r i t i n g and i n accordance with the c o n d i t i o n s specified i n t h e S i x t h Schedule , addressed to to the Director and shall contain the information specified in t h e Seventh Schedule.

(2) Each application shall be received by t h e Director, for issuance at such t i m e o r times during t h e year as he may specify in writing, not l e s s than t h i r t y days be fo re the licence is due to be issued.

( 3 ) Applications shall be -

9 . (1) All fees for registration or licences and royalties related to the catches of fishing v e s s e l s shall be payable at the rates specified in the Second Schedule."

( 2 ) Fishing v e s s e l s carrying helicopters on board will be charged additional fees as may be specified by the DirecCor.

10. (1) Each fishing 1.icence s h a l l be issued in writing in the forrr~ specified in the Eight Schedule.

(2) Each licence shall be transmitted to tlie vessel prompt ly after issuance and carried on board at all times and .

s h a l l be produced for inspection upon request Sy an authorised officer or inspector.

( 3 ) Where a fishing licence has been issued but has not been received by the vessel, a confirmation of the licence and information contained in it by telex, telefax or cable and ca r r i ed on board shall constitute sufficient authority.

General 11. (1) A fishing licence s h a l l be valid condi t- only for the activities, species of fish, ions fishing methods, f i s h i n g gear, areas of fishing for fishing and such other conditions as may be specified and fishing in or endorsed on the licence or specified in licences . the Decree.

(2) Fishing shall n0.t be undertaken except as authorised in t h e licence.

( 3 ) Each person shall comply with all applicable l a w s of Sierra Leone, including laws relating to fisheries and safety standards f o r s h i p p i n g .

( 1 2 ) T h e master o r owner of t h e v e s s e l or his local agen t s h a l l cotify t h e D i r e c t o r or such o t h e r pe r son as t h e Di rec to r may designate, of t h e entry i n t o any port in Sierra Leone at least 24 hour s p r i o r to such e n t r y .

(13) The mas te r o f the v e s s e l ~ l l a l l cause to be m a i n t a i n e d on board the vessel, at all times while the v e s s e l is in the fishery waters, a ship's log separate from the fishing log referred to in sub-regulation ( 5 ) and shall e n t e r i n t h a t log a r eco rd of the d a t e , t i m e and nature o f every instruction, direction or requirement cornmunicatsd t o t h e master by t h e Director or an authorised officer.

(14) The master and each member o f the. crew shall provide all reasonable assistance to enable an au-khorised officer o r i n spec to r to perform his duties safely.

(15) 2 1 a local fishing vessel is fishing in waters other than the fishery waters, t h e operator and each member of the crew shall comply with such laws r e l a t i n g t o fishing, if any, as may be recognised by the l a w s of Siersa Leone as h a v i n g force i n those waters.

(16) The master shall, while i n t h e f i s h e r y waters, t a k e a l l reasonable measures and p recau t ions t o avo id caus ing damage t o any f i s h i n g o p e r a t i o n s i n c l u d i n g non-commercial opera t ions i n t h e fishing w a t e r s .

( 1 7 ) The master of a radio-equipped vessel shall keep a continuous listening watch on VHF Channel 16 or 10 and on 2182 KHz, and while i n the f i s h e r y waters on 4 0 6 6 . 1 KBz.

(18) The naster 01 each foreign fishing vessel s h a l l cause to be carried on the vessel the latest edition of the "international Code of Signals" published by the International Maritime Organisation Marine S a f e t y Committee, and the signals specified in the Code shall be used in every communication by radio, flag or light between a licensed vessel in the fisheries waters and a Sierra Leone authority.

(19) A fishing vessel shall not be used for fishing within one nautical mile of a fish aggregating device except in accordance with the Decree or with the written permission of the person who bias responsible for placing the device.

(20) Each foreign or chartered fishing vessel shall, u n l e s s the Director otherwise directs i n writing or unless the master of the vessel is able to communicate effectively in English, carry a person who is able to communicate effectively in English and in the language of the master o f the vessel,

12. (1) Every a p p l i c a t i o n for an . authorisation made under section 25 of the Decree shall be in writing and addressed to the Director and shall contain information which may be required under the Decree or as the Director may irorn timc to time request.

(2) Each authorisation shall be in writing, and on a form prescribed by the Director.

Geceral 13. (1) The operator of each vessel conditions authorised to undertake a specified activity in for a u t h o r i s a - the fishery waters shall be responsible for ti ons . compliance with all licence conditions

required or prescribed.under the Decree in respect of local or foreign fishing vessels, as the case may be, and additional requirements relating to the specified activity as may be prescribed or otherwise required or requested by the Director.

(2 ) Every authorisation to conduct marine scientific research shall be subject to such conditions as are in accordance with the

14. (1) Bvecy l i c e n c e i s s u e d under these Regu1at:ions shall be c a ~ r i e d at all times by the holder while in the fishery waters or carrysng out related a c t i v i t i e s and shall be produced for inspection at the r e q u e s t of zny authorised officer or inspector.

PART V1 - TIZANS-SHIPMENT

15. (1) The m a s t e r o f any vessel intending to enter the fishery waters for the purpose of taking on board any fish by trans-shipment or any other means, s h a l l notify t h e Director of h i s intention to enter the fishery waters not more than 72 hours and not less than 12 hours before entry.

( 2 ) The master of any vessel, i n t e n d i n g t o c a r r y out trans-shipment activities in the fishery waters, shall notify the Director of such intention not less than 72 hours prior to the intended trans-shipment.

( 3 ) No~ification y i v c n under sub- regulations (I) and ( 2 ) shall i n c l u d s -

( a ) t h e vessel's name, radia call sign and fishing licence number where applicable;

( b ) f u l l d e t a i l s of any catch on board t h e v e s s e l ;

(c) the intended place, date and t i m e of trans-shipment;

(d) the intended species and . quantity of fish to be txans- shipped;

( e ) the intended date and arrival time in Preetown i n o rde r that supe rv i so ry arrangements can be made in accordance with Section 101 of the Decree.

1 6 . (1) N o i less , t h a t 7 2 hours p r i o r to trans-shipinent, the rnas2cr shall a p p l y to ' the Di rec to r f o r a trsns-shipment or loading licence as the case may be in a c c o r d a n c e with the c o n d i t i o n s and i n the form set out in the Ninth Schedule and prior to t h e issuance of such licence shall pay the required fee.

(2) The trans-shipment cr loading licence shall specify when and where trans- shipment or loading shall take place and shall be subject to such cor ld i t io r l s as the Director may endorse on it.

17. (1) Trans-shipment or loading operations shall only take place in accordance w i t h t h e requirements of ihe Decree and as authorised S y a valid licence.

(2) The operator of a fishing vessel s h a l l -

(a) not trans-ship at sea under any circumstances unless authorised by the Dixector;

(b) provide '72 hours notice of a request to trans-ship any or . all of the fish on board and provide Lhe name of the vessel, its international radio c a l l sign, position, the catch on board by species, the time anci port where such trans-shipment is requested t.o occur and payment of all fees as may be required under the laws of Sierra Leone;

(c) only trans-ship at the time and port. or other place authorised by the Director. for trans-shipment;

(d) cause the fish being loaded to be accurately weighed and recorded by species on board the v e s s e l , and furnish the Director with d a i l y copies of these records;

( e ) during t h e Lrans - sh ipment operation give eve ry assistance to the a u t h o r i s e d officer, inspector o r o t h e r s u p e r v i s o r i n check ing t h e weight.

( f ) subrriit t o t h e D i r e c t o r w i t h i n 72 hours of the trans-shipment or before departing the fishery waters, whichever is earlier, full trans-shipment reports on forlns which may be prescribed or are otherwise required by t h e D i r e c t o r , inciudi.ng t h e f ol l .owing -

j i j the total amounts by weight of each spec ies o f f i s h ;

(ii) t h e identity of the vessel o r other place from which fish or fish products have been t r a n s - shipped;

(ii.i ) t h e amount by rvreight o f each f i s h spec ies and f i s h product t a k e n on board s ince the licence was i s sued from each vessel or place.

( 3 ) For the purposes of reporting under these Regulations, a fishing trip is deemed to have ended at such time as any o r a l l the f i s h on board the vessel are removed from the vessel, either ashore or onto another vessel.

PART V E I - NAVIGATIONAL CHARTS AND A I D S

(2) The master of a radio-equipped fishing vessel shall keep a contin~rous listening watch on VHF Channel 15 or 10 and on 2182 KHz, and while in the fishery waters on 4 0 6 6 . 1 RX1.z.

( 3 ) The master of a fishing vessel shall maintain a listening watch for calls from any enforcement vessel or aircraft on a designated frequency.

19. (1) All records, reports or notifications required to be maintained or made under the Decree shall be maintained or made in the English language.

(2) In any communication by radio, flag or light between any vessel and an enforcement vessel or a i r c r a f t , the signals specified in the "International Code of Signals" published by the International Maritime Orgznization shall be used.

20. ( 3 ) The D i r e c t o r may, t a k i n g i n t o account all relevant circumstances, r e q u i r e that specified L o g s and other reports may be. sent by courier within 72 hours o f a r r i v a l at the first post after d e p a r t u r e from t h e f i s h e r y waters.

PART IX - GEAR STOWAGE, FIXED GEAR, FISH AGGREGATING DEVICES

G e a r s towage. 2 7 . A t any time when a fishing v e s s e l i s i n any area o f t h e f i s h e r y w a t e r s and -

{ a ) is not permitted to fish in that a r e a ; o r

(b) is permitted by fishing licence to fish only f o r certain spec ies of f i s h OK *,-:ith c e r t a i n types of f i s h i n g gear,

then t h e f i s h i n g gear , o r s o much of t h e gear as is not required for permitted fishing, shall be stowed in such a manner t h a t it is not readily available for use for fishing.

28. (1) T%G mas'1:er of a fishing v e s s e l in the fisheries waters shall t a k e a l l r ea sonab le measures t o avoid causing damage to fixed fishing gear marked i n accordance w i t h t h e Decree, p o t marks , f l o a t i n g gear, fish aggregating devices, marks and other t r a d i ' t i o ~ a l f i s h i n g d e v i c e s .

(2) No fishing vessel shall fish within h a l f a nautical mile o f f i x e d f i s h i n g gear position.

( 3 ) If a v e s s e l becomes entangled with f i x e d f i s h i n g gear o r o t h e r ob jec t r e f e r r ed t o i n s u b - r e g u l a t i o n (I), the master shall-

( a ) undertake to rninirnise any damage caused to the gear;

( b ) where prac . t i cab le r e t u r n the gear to the sea and log t h e pos i - t i on ;

( c ) rnaire a f u l l r e p o r t o f the i n c i d e n t and s t e p s t a k e n by him to the D i r e c t o r at the earliest opportu~ity.

29. (1) No p e r s o n shall p lace a fish a g g r e g a t i n g device i n t h e fishery waters except with t h e permission of t he D i r e c t o r and in accordance with such conditions.as h e may specify o r as are o the rwi se s p e c i f i e d i n t h i s P a r t .

( 2 ) In granting permission u n d e r sub-regulation (l), the c o n d i t i o n s which t h e D i r e c t o r may s p e c i f y include the following -

( a ) the method of use of the f i s h aggregating device;

( b ) its location;

( c ) the times during which it may be used; and

(d) the markings or c o l o u r i n g to be adopted .

30.(1) The D i r e c t o r may, by n o t i c e pub l i shed i r ~ t h e G a z e t t e , d e c l a r e any f i s h agg rega t ing device t o be a d e s i g n a t e d f i s h agg rcqa t ing dev ice f o r t h e purposes of t hdqe Regu la t ions .

( 2 ) Subject to sub-regulation (3),no pe r son s h a l l f i s h w i t h i n a r a d i u s of one n a u t i c a l mi le from a d e s i g n a t e d f i s h aggregating dev ice except with t h e permiss ion of the D i r e c t o r and i n accordance w i t h such c o n d i t i o n s as he may s p e c i i y .

( 3 ) The Director may, by n o t i c e publ i shed i n t h e G a z e t t e , d e c l a r e that any c l a s s of pe r sons who are S i e r r a Leone c i t i z e n s may f i s h w i t h i n a r a d i u s of one n a u t i c a l mi l e of a designated f i s h aggregating device or a c l a s s of des igna ted f i s h agg rega t ing d e v i c e s .

31. (1) Any f i s h agg rega t ing dev ice p l aced i n t h e f i s h e r y waters s h a l l -

( a ) be c l e a r l y marked with t h e name of the owner and of t h e v e s s e l f r o m which such dev ice was p laced ;

( b ) be equipped w i t h a radar r e f l e c t o r and such lights as s h a l l be c l e a r l y v i s i b l e a t n i g h t from a d i s t a n c e of one n a u t i c a l mi le ; and

Disposal of unauthorised f i s h a g g r e g a t i n g devices.

( c ) have such other equipment o r mark ings as the Direc to r may from t ime to time r e q u i r e .

32 . Any f i s h aggrega t ing device p laced i n t h e f i s h e r y waters o the rwi se t h a n i n accordance with t h e s e Regu la t i ons may be used or disposed of in such manner as the Director may d e c i d e .

PART X - ON-SHORE FISH P R O C E S S I N G AND HARKETXNG

AppZica t i o n 33. (1) Each application f o r a for fish licence to operate a fish processing processing establlishmentma6e under section 99 of t h e licences. Decree shall be i n writing addressed.to

t h e Director and i n the form s e t out i n t h e Tenth S c h e d u l e .

(2) Each application to process f i s h on a vessel in the f i s h e r y w a t e r s sha l l be made in w r i t i n g , addressed to the Direc to r and in such form as he may r e q u i r e .

( 3 ) Each l i c e n c e t o engage i n fish processing o p e r a t i o n s shall be i n the forrn desc r ibed i n t h e ELevenflr S c h e d u l e . I t s h a l l be posted in a c o n s p i c u o u s l o c a t i o n and produced f o r inspection at the r e q u e s t of an au thor i sed o f f i c e r or i n s p e c t o r .

jd) t h e Director i s s a t i s f i e d that the fish processing establishment or other operation complies with all s u c h s a f e t y and sanitary standards a s the Decree and the Director by notice in t h e Gazette shall r e q u i r e ;

( e ) if the applicant has been convicted of any offence under the Decree or any other law relevant to the operation of a fish processing operation, the requirements of the judgment have been f u l l y met.

3 5 . The f e e s for licences to engage in fish processing operations shall be specified in the Second Schedule.

36. Every licence to operate a fish process ing establishment shall be subject to the follovring conditions in addition to any other . conditions required under section 99 of t h e Decree -

( a ) the fish processed shall not exceed the total quota provided f o r that operation, including those r e l a t i n g to species and q u a n t i t y ;

(b) any change in t h e information submitted in the application C o r m shall be notified to the Director as soon as praczicable and in any case not later than seven days froin the d a t e of the change.

3 7 . Every licence issued under this P a r t s h a l l be subject to cancellaCion in accordance w i t h the Decree, and be valid for a period of not less than two years or not more than five years, as shall be s p e c i f i e d in the l i c e n c e .

3 8 . The Direc tox may cancel or suspend a licence issued under t h i s Part i f he is satisfied that any of the conditions to which it is subject is not complied w i t h .

3 9 . Any person a g g r i e v e d by a d e c i s i o n n o t t o i s s u e , to cancel or suspend a l i c e n c e may appeal to t he Sec re ta ry of State within 30 days of t h e d e c i s i o n . T h e Secre ta ry o f State's d e c i s i o n , which shall n o t be d e l e g a t e d , s h a l l be f i n a l .

4 0 . (1) A n i n s p e c t o r appointed under the Decree may request such in fo rma t ion and s h a l l keep such r e c o r d s a s are authorised u.nder the Decree or by the Director.

( 2 ) Information requested and records kept by an inspector in relation to fish mzrket ing s h a l l i nc lude t h e following p a r t i c u l a r s -

( a ) t h e name of t h e s e l l e r ;

( 5 ) 'chc name of tlie D i s t r i c t or P r o v i n c e :

( c ) the name of the v i l l a g e the s e l l e r i s from:

( c l ) t h e number of f i s h b e i n g sold;

( e ) t h e d e s t i n a t i o n of t h e sh ipment ;

( f ) the name of the buye r ;

( g ) the d a t e of s a l e ;

{h) the d a t e of s h i p m e n t ;

( i ) the total weight of s p e c i e s being s o l d ;

( j ) the p r i c e per kilogram;

(k) t h e p r i c e of s h i p m e n t ;

(1) the name of ship or plane;

( 3 ) Any person to whom a request for information is made by an inspector shall promptly furnish such information.

41. (1) F o r purposes of fishery conservation and management, the Director may require data returns from the sellers or purchasers of such species as he may designate dur ing such period as he may s p e c i f y .

( 2 ) Such returns may i n c l u d e information relating to the following -

(a) quantity of fish bought or sold;

(b) name of the buyer or s e l l e r ; and

(c) origin of s p e c i e s bought or so ld .

( 3 ) Each person shall promptly furnish such information which may be required under this regulation.

PART X L - OFFENCES, F I R E S AND F E X A I T L E S

42. (1) Any person rrho contravenes any provision of these Regu la t ions coinrnits an o f f e n c e and shall be liable on conviction to a fine -

(a) of not more than US $ 5 , 0 0 0 i n respect of a foreign or c h a r t e r e d fishing v e s s e l or foreign national;

( b ) of not more than US $ 1000 i n the equivalent amount i n Leones on the date of c o n v i c t i o n , in respect of a local fishing vessel or Sierra Leone citizen.

(2) Where the o f f e n c e in sub-regulation (1) is a continuing one, a further fine shall be imposed for every day that the offence continues -

( a ) US $ 1,000 in respect of a foreign or chartered fishing vessel or foreign national;

(b) US $ 200, in the equivalent amount in Eeones on the date of conviction, in respect of a local fishing v e s s e l or a Sierra Leone citizen.

( 3 1 In addition to or instead of the fines described in sub-regulations (1) and ( 2 ) , any person who contraveses a n y p rov i s ion of these Regulations shall be liable to a term of imprisonment not exceeding two years.
