The Department of Sanitation keeps New York City healthy, safe and clean by collecting,
recycling and disposing of waste, cleaning streets and vacant lots, and clearing snow and ice.
The Department employs a number of tools to keep our neighborhoods clean, including outreach
and education, mechanical cleaning, manual cleaning and enforcement. These efforts together
have led improvements in the City’s Scorecard street cleanliness rating. The two highest annual
scorecard ratings ever recorded by the Mayor’s Office of Operations occurred in the last three
years.
DSNY continues to make improvements in the allocation and deployment of cleaning resources
throughout the City in order to ensure the equitable and rational delivery of services. In addition,
the Department has added additional services over the last five years in response to physical
observations, scorecard ratings and feedback from community leaders and elected officials.
These include additional highway ramp cleaning, Sunday and holiday litter basket collection, and
the purchase of rodent resistant litter baskets in selected neighborhoods.
The Department also expresses its thanks for the City Council’s efforts to improve the
cleanliness of our City, including investments in additional cleaning resources and efforts to
increase violation amounts for illegal dumping and littering from a motor vehicle.
Local Law 138 of 2018 requires the Commissioner of the New York City Department of
Sanitation (DSNY) to submit to the Mayor and the Speaker of the Council by April 1, 2019, a
plan to increase enforcement of §16-118(4) of the New York City Administrative Code, as it
relates to littering from a motor vehicle.
To prepare this report, DSNY conducted a survey of all City Council members and Community
Boards and carefully reviewed all information as required by Local Law 138. This report reflects
DSNY’s findings and conclusions as it relates to the enforcement of the littering from a motor
vehicle law. The full text of Local Law 138 is attached as Appendix A.
1. List of Locations
On February 14, 2019, DSNY reached out via email to all City Council members and
Community Boards requesting the top three (3) to four (4) locations where littering from a motor
vehicle is prevalent in their respective districts and where possible increase enforcement
monitoring would be most beneficial. DSNY also reached out via phone to City Council
members and Community Boards starting on February 26, 2019. A follow-up email was sent on
March 5, 2019, with a final email sent on March 13, 2019.
The locations identified on this list represent locations of concern for littering from a motor
vehicle in all five boroughs. While these locations represent a broad range of New York City
streets and highways, a few specific common typologies present themselves. These are listed
below.
Highways and associated on- and off-ramps make up a significant number of locations
identified by survey respondents, especially in the Bronx, Queens and Staten Island.
These locations can be especially hard to patrol, given the volume of automobile traffic

and the difficulty of witnessing the action of littering from a stationary patrol. In such
locations, vehicle stops are required.
Examples: Throgs Neck Expressway, Sheridan Expressway, Van Wyck Expressway,
Grand Central Parkway, Long Island Expressway, Clearview Expressway, West Shore
Expressway.
Underpasses and railroad rights-of-way are common locations for several types of
cleaning violations, including littering from a motor vehicle. DSNY regularly patrols
such locations, especially those that are known locations for illegal dumping and
improper disposal.
Layover and standing areas for For-Hire-Vehicles make up a very small number of the
overall list of locations, but have been noted in some cases as an especially pervasive
issue for littering from a motor vehicle. DSNY will work with TLC discuss approaches to
identifying violators and curbing this practice.
Appendix B contains the full results of DSNY’s inquiry. This list also includes locations known
by DSNY to be a source of littering from motor vehicles.
2. Number of DSNY personnel necessary to enforce §16-118(4) at such locations.
DSNY’s enforcement activities are carried out by three types of staff:
Sanitation Enforcement Agents (SEAs) make up the majority of staff in the Department’s
Enforcement Division. SEAs conduct regular patrols of New York City neighborhoods to
identify violations of Title 16 of the Administrative Code, Title 16 of the Rules of the
City of New York, and additional City and State laws for which enforcement authority is
delegated to the Department. These staff conduct inspections by foot and by car.
Certain summonses for violations of the Sanitation code, including Dirty Sidewalk and
Failure to Clean 18 Inches into the Street, can only be issued during two one-hour periods
each day. These periods, called “routing hours,” are from 8:00 am to 8:59 am and from
6:00 pm to 6:59 pm for residential properties. For commercial properties, routing hours
vary by community district. Patrols are scheduled to maximize the effectiveness of SEAs
during these scheduled periods.
In addition, SEAs can issue summonses for other Sanitation offenses, including littering,
recycling violations, and. early or improper setout of material for Department collection.
The Department also has dedicated units of SEAs and supervisory staff for the issuance
of illegal posting summonses and canine waste summonses.
While agents can and do issue actions summonses, those that are issued after witnessing a
person partake in a certain unlawful action, such summonses are difficult for SEAs to
successfully witness and serve. Action summonses can only be issued to an individual
that carries out the action in question. SEAs have neither any meaningful way to compel
an individual to provide proper identification nor the ability detain such individual until a
peace officer arrives. Without some form of identification, an SEA cannot issue a
summons to the individual. In addition, as mentioned above the violation in question

must be witnessed by the agent in order for a summons to be issued. Moreover, SEAs
cannot make vehicle stops, so they are only able to issue summonses for littering from a
motor vehicle if that motor vehicle is stationary.
The Department has 187 SEAs, 52 Associate Sanitation Enforcement Agents and 1
Administrative Sanitation Enforcement Agent.
Sanitation Police Officers (SPOs) comprise the remainder of the Department’s
Enforcement division. SPOs are New York State peace officers, are generally armed and
are able to make vehicle stops and detain individuals when appropriate. Like SEAs,
Police Officers can enforce Title 16 of the Administrative Code, Title 16 of the Rules of
the City of New York, and additional City and State laws for which enforcement
authority is delegated to the Department. However, SPOs typically conduct enforcement
activities for which there is an element of criminality or a likely element of criminality.
These activities predominantly are illegal dumping and associated activities, as well as
the theft of recyclable items (including Department-marked appliances).
The Department also has two specialized units comprised of highly trained Sanitation
Police Officers. The Permit and Inspection Unit (PIU) oversees the privately-operated
transfer stations in New York City. PIU inspects these facilities on a regular basis and
plays a critical role in identifying and closing illegal transfer stations and dump sites.
The Environmental Police Unit (EPU) conducts inspections and enforcement related to
the storage, transportation and disposal of asbestos and regulated medical waste. EPU
officers also respond to incidents involving the improper disposal of chemicals,
household hazardous waste, low level radioactive waste, and medical waste posing a risk
to DSNY personnel and the general public. These officers may also issue summonses for
violations witnessed while in the course of their specialized duties.
Sanitation Police Officers patrol by marked or unmarked police vehicles, as resources
permit, and are the most appropriate enforcement branch to issue summonses for littering
from a motor vehicle.
Together, the Sanitation Police, Environmental Police, and Permit and Inspection units
have a total of 111 peace officers, all of which can issue summonses for littering from a
motor vehicle.
Sanitation Supervisors are the Department’s first-line supervisors, responsible for
overseeing the collection and cleaning operations of Sanitation Workers in the field.
Supervisors also conduct enforcement activities as resources and conditions necessitate.
Like SEAs, Supervisors have neither any meaningful way to compel an individual to
provide proper identification nor the ability detain such individual until a peace officer
arrives. Bureau of Cleaning and Collection Supervisors may issue only when a vehicle
stop is not necessary (i.e., when vehicle is parked).Meanwhile, Supervisors have several
additional daily functions that limit the amount of time that can be spent on enforcement
patrol.

As described above, littering from a motor vehicle is an action offense, meaning that the
violation must be witnessed and the summons must be personally served upon the violator.
DSNY Sanitation Police regularly patrol known areas of concern for these violations, and they
may issue summonses for littering from a motor vehicle in the course of patrols for other types of
violations.
However, it is not possible for DSNY Sanitation Police to be at all of the location outlined in
Appendix B on a daily basis, nor would it be an effective use of the Department’s resources.
DSNY Sanitation Police, Permit and Inspection Unit and Environmental Police, which total 111
peace officers, are prepared to issue violations for littering from a motor vehicle, which may
include a vehicle stop. DSNY believes that this is an adequate number of enforcement personnel.

Please note that DSNY is unable to provide accurate statistics relating to littering from a motor
vehicle prior to November 26, 2018 since DSNY issued violations for all littering offenses (both
by a person and from a vehicle) using the same violation code (S03). The S3C code, which has
been in effect since the effective date of Local Law 138, only captures littering from a motor
vehicle and is an accurate indicator of DSNY’s enforcement efforts to date.
Both the S3C (from November 26, 2018 to the present) and the S03 for calendar years 2017 and
2018 are included in Appendix C.
4. Description of steps that DSNY will take to increase enforcement of §16-118(4).
DSNY believes that obtaining an amendment to the New York State Vehicle and Traffic Law
would allow it to issue violations for littering from a motor vehicle more effectively. Such
legislation would create a presumption of liability against a vehicle owner, based on the license
plate, and would allow for service of such violation on the owner of the motor vehicle via first
class mail. DSNY will work with our state elected officials to draft, introduce and enact such
legislation.
In the interim, DSNY will continue to monitor the locations outlined in Appendix B, and any
new locations brought to the agency’s attention by the public, against those who litter from a
motor vehicle. DSNY encourages New Yorkers to report problem locations for littering or other
quality of life concerns by calling 311.

5. Date for implementation of such plan.
DSNY will pursue such legislation at the State level. In the interim, DSNY will continue to use
the enforcement tools it has on hand to enforce against those that litter from a motor vehicle.

Be it enacted by the Council as follows:
Section 1. The commissioner of sanitation shall develop and submit to the mayor and the
speaker of the council by April 1, 2019, a plan to increase enforcement of subdivision 4 of section
16-118 of the administrative code of the city of New York. This plan shall include but not be
limited to:
a. a list of locations in the city where litter is commonly thrown from cars, which shall be
developed by such commissioner in consultation with council members and community boards;
b. the number of sanitation officers necessary to enforce such subdivision in such locations;
c. the number of violations issued annually for littering out of a vehicle, disaggregated by
sanitation district;
d. a description of steps the department of sanitation will take to increase enforcement of such
subdivision; and
e. a timeline for implementation of such plan.
§ 2. This local law takes effect immediately.
