Frequently Used Terms

• Plaintiff: A person who files a complaint• Defendant: A person who responds to the

complaint• Docket: Number assigned to the case

– FM: Case type in which the parties are seeking to divorce

– FD: Case type in which the parties are seeking to address child related issues

– FV: Case type in which the parties are seeking a domestic violence restraining order

Restraining Order

How to File for:

• Paternity/Maternity• Custody• Parenting Time• Support• Medical Coverage

• Complete forms and return to Family reception staff in Room L-50

• Photo Identification is required

• There is a $6 fee for child support services

• There is an annual $25 fee for spousal support services

Processing the Application

• Completed forms are processed by Family reception staff

• Please remain until your application is completely processed, and you have signed the form

Resolution of Cases

• The Family Court encourages parties to resolve their disputes through a variety of informal processes

• Agreements between the parties are usually more beneficial to the adults and the children involved

• Parties to disputes can make agreements they can live with

Cases Involving Paternity, Child Support and Medical Coverage Only

• This type of case is scheduled before a child support hearing officer

• A hearing officer calculates child support and makes a recommendation

• You have the option to agree with or appeal the recommendation

• Agreements become orders of the court

• Appeals are scheduled before a judge

Cases Involving Paternity, Custody, Parenting Time and Support

• This type of case is scheduled before a probation officer for a Consent Conference

• A consent conference is very similar to mediation

• Agreements become orders of the court

• Unresolved issues are scheduled before a judge

• A judge hears matters still in dispute

• These may be heard the same day as the hearing officer/ consent conference, or scheduled on another day

• Cases are resolved with a court order

Victims of Domestic Violence May Apply for a Temporary Restraining Order in

Family Reception, Room L-50

Applications for a restraining order under the Prevention of Domestic Violence Act may be requested when the parties have a past or present domestic relationship

How to File for a Domestic Violence Restraining Order

• During court hours, forms may be filed in Family Reception Room L-50

• After court hours and when court is not in session, parties should contact their local police departments

Temporary Domestic Violence Restraining Orders

• Requests for restraining orders can be heard by a domestic violence hearing officer, who grants or denies the application

• If the request is denied, an appeal may be heard before a judge the same day

Temporary Domestic Violence Restraining Orders

• If the DV hearing officer or judge grants the request, a temporary restraining order (TRO) is issued

• A hearing for a final restraining order is scheduled within 10 days before a Judge

• The sheriff serves a copy of the TRO to the defendant

• A copy of the TRO is faxed to the Police Department of the plaintiff’s town of residence

Final Domestic Violence Restraining Orders

• A judge determines whether or not to make a temporary restraining order permanent

• Final restraining orders do not expire, they can only be dismissed by a judge

• A final restraining order may include provisions for custody, parenting time, and support

Establishment of Support Obligations

• Once an order for support has been entered, Family Division staff located in Room L-50 meet with parties to:– Explain the transition of the case

from the Family Division to the Probation Division

– Provide payment instructions– Establish the child support

account

Child Support Debit Card

• Child support payments can be received through direct deposit into a personal bank account or through the N.J. Debit Card.

• The N.J. Debit Card can be used at banks, ATMs and to make purchases at most stores

• Support payments can be made in the Central Fee Office or at the Mechanic St. Office

Representing Yourself in Court

Pro se litigants represent themselves in court rather than obtain legal counsel to represent them.

Family Division Staff Can:

• We can explain and answer questions about how the court works.

• We can tell you what the requirements are to have your case considered by the court

• We can provide you with samples of court forms that are available

• We can answer questions about court deadlines

Family Division Staff Cannot:

• We cannot give you legal advice

• We cannot tell you whether or not you should bring your case to court

• We cannot talk to the judge for you about what will happen in your case

• We cannot let you talk to the judge outside of court proceeding

Como Solicitar:

• Llene los formularios necesarios y entréguelos a personal de la División de Familia en el salón L-50

• Deberá presentar una identificación con foto

• La solicitud de Servicios de manutención de menores requiere un pago único de $6

• La solicitud para servicios de pensión alimenticia requiere una tarifa anual de $25

Proceso de Solicitudes

•El personal de Recepción del Tribunal de Familia procesara los formularios

• Por favor no se retire hasta que se procese su solicitud y usted firme los documentos

Determinación de Casos

• El Tribunal de Familia trata de alentar a las partes a resolver sus desacuerdos por medios informales

• Generalmente es mucho mas beneficioso para los adultos y los niños involucrados llegar a un acuerdo por consentimiento

• Es mucho mas fácil para las partes aceptar un acuerdo al que llegaron mutuamente

Casos de paternidad, manutención y seguro médico

• Estos casos son presentados ante un Oficial de Audiencias de casos de manutención

• El Oficial de Audiencias calculará la cantidad de manutención y hará una recomendación

• Usted puede aceptar o apelar la cantidad recomendada

• Los acuerdos se convierten en órdenes judiciales

• Las apelaciones se presentan ante un Juez

Casos de Paternidad, Custodia, Visitas y Manutención

• Estos casos son referidos a un Oficial de Probatoria

• Se fija una conferencia • La conferencia es similar

a mediación • Los acuerdos llegan a ser

órdenes jurídicas• Las áreas que continúen

en desacuerdo se presentan frente a un juez

Tribunal

• El juez escucha los casos que continúan en desacuerdo.

• Los casos pueden ser escuchados el mismo día cual fue fijado frente a un Oficial de Audiencias o de una conferencia

• Los casos se resuelven a través de una orden juridica

• Devolución de impuestos• Prueba de gastos de

guardería infantil• Información de desempleo• Prueba de beneficios del

Seguro Social• Copias de otras órdenes

de manutención

está a incapacitado • Licencia de conducir• Tarjeta de seguro médico

Las víctimas de violencia doméstica pueden solicitar una orden de

restricción temporal en la Recepcion de Familia en la sala L-50

Puede solicitar una orden de restricción bajo la ley de Prevención de Violencia Doméstica si las partes han tenido o tienen un parentesco familiar

Como Solicitar una orden de Restricción contra la Violencia

Doméstica

• Los formularios se deben llenar durante el horario de atención del Tribunal en la Recepción de Familia,salón L-50.

• Cuando las oficinas de los Tribunales están cerradas, debe pedir ayuda al departamento de policía de su localidad

Órdenes de Restricción Temporal contra la Violencia Doméstica

• Un oficial de audiencias de casos de violencia domestica escuchará su solicitud para una orden de restricción la cual puede ser otorgada o denegada

• Si su solicitud es denegada, un juez escuchará la apelación el mismo día

Órdenes temporales de Restricción

• Si el Oficial de Audiencias de violencia domestica o el Juez aprueba su solicitud, se le otorgará una orden de restricción temporal

• Se fijará una audiencia para una orden permanente en diez días

• Un Alguacil le entregará una copia de la orden de restricción temporal al demandado

• Se enviará por fax una copia de la orden al departamento de policía de la municipalidad de la victima

Órdenes Permanentes de Restricción contra la Violencia Doméstica

• El Juez determinará si la orden temporal se convertirá en una orden permanente

• Las ordenes permanentes no expiran, solamente pueden ser retiradas por un Juez

• Las ordenes permanentes pueden incluir custodia, visitas y manutención

Establecimiento de una cuenta de manutención

• Una vez que el juez firme la orden de manutención, las partes serán entrevistadas por el personal de la División de Familia, en el salón L-50 para;– Explicar la transición del caso

de la División de Familia a la División de Probatoria.

– Proveer información de pagos.– Establecer cuentas de

manutención de menores.

Tarjeta de Debito Master Card de New Jersey

• Los pagos de manutención pueden ser depositados en su cuenta bancaria o por medio de una tarjeta de debito de New Jersey

• Puede usar la tarjeta de debito en bancos, ATM y realizar compras en la mayoría de tiendas.

Tribunales• Hablar con el juez acerca de lo que va a pasar con su

causa• Hablar con el juez afuera del proceso judicial
