Office of the GovernorEmergency Executive Order 20-01: Declaring a Peacetime Emergency and Coordinating Minnesota’s Strategy to Protect Minnesotans from COVID-19

I, Tim Walz, Governor of the State of Minnesota,bytheauthorityvestedinmebytheConstitutionandapplicablestatutes,issuethefollowingExecutiveOrder:

TheinfectiousdiseaseknownasCOVID-19,anactofnature,hasnowbeendetectedin118countriesandterritories,includingtheUnitedStates.COVID-19hasbeenreportedin42states.Thereareover1,600confirmedcasesnationwide,includingfourteeninMinnesota.

TheU.S.DepartmentofHealthandHumanServicesSecretaryhasdeclaredapublichealthemergencyfortheUnitedStatestoaidthenation’shealthcarecommunityinrespondingtoCOVID-19.TheWorldHealthOrganizationhasrecentlyassessedthatthisoutbreakcanbecharacterizedasapandemic.

Incoordinationwithotherstateagencies,localgovernments,andpartnersintheprivatesector,theMinnesotaDepartmentofHealth(“MDH”)hasbeenpreparingforandrespondingtotheCOVID-19pandemicinMinnesota.

OnApril4,2019,IissuedExecutiveOrder19-22,whichassignedemergencyresponsibilitiestostateagenciestorespondtoandassistinrecoveryfromtheeffectsofnaturalortechnologicalemergencies,includingresponsibilitytoengageinemergencypreparednessefforts.OnApril4,2019,IalsoissuedExecutiveOrder19-23,whichdirectedstateagenciestoengageincontinuityofgovernmentandcontinuityofoperationsplanning.ThatExecutiveOrderestablishedtheContinuityPolicyCoordinationSub-Cabinettodevelopandmaintainaframeworkforacontinuityofgovernmentplan,andtooverseeagencycontinuityofoperationsplanning,ledbyMinnesotaManagementandBudget(“MMB”).

MinnesotahastakenproactivestepstoensurethatweareaheadofthecurveonCOVID-19preventionandresponse.OurStatehasbeenactivelyconductingcontinuityplanningforstateagencyoperations.MMBactivateditsStatewideContingencyResponseTeam(“SCRT”),whichmeetsregularlytocoordinateanddirectstateagenciestoensureprioritygovernmentservicescontinue.Stateagencyemergencymanagersandcontinuitycoordinatorsfromtheagencieshavebeenmeetingtogetherandsharinginformationrelatedtoemergencymanagementandcontinuityofoperationsplanningactivities.

TheStatealsohasactivatedourJointInformationCenter(“JIC”),ledbytheDepartmentofPublicSafety(“DPS”)andMDH.TheJICisresponsibleforsharingoperationalupdatesandkeepingthepublicinformedonCOVID-19.Thisgroupconvenesdailytoprovideconsistent,coordinated,andtimelyinformation.

Agencieshaveactivatedtheirinternalcommandorcontinuityteamsandhavebeenreviewingtheiremergencyresponseandcontinuityplans,whichareplansinplacethatoutlinehowagencieswillprovidepriorityservicesduringanemergency.Agencieshavebeenreviewingtheirpriorityservicesandpreparingtheiremployeeswiththegoalofprovidinguninterruptedpriorityservicesthroughoutanemergency.

OnJanuary29,2020,MDHinstituteditsIncidentCommandSystem(“ICS”).TheICSprovidesastandardizedapproachtothecommand,control,andcoordinationofemergencyresponse.MDHconvenedastateagencyCOVID-19

Executive OrderscoordinatinggrouponMarch3,2020.DPS’sDivisionofHomelandSecurityandEmergencyManagement(“HSEM”)activatedtheStateEmergencyOperationsCenteronMarch6,2020.

MDHremainsinclosecontactwithfederal,state,andlocalpartners,andtheCommissionerofHealthrecentlyconvenedagroupofexperts,includinghealthcareprofessionals(doctors,nurses,administrators,insurers),governmentpartners(cities,counties,tribalnations),businessandlaborleaders,educators(childcare,K-12,highered),publichealthexperts,andauthoritiesonlongtermcareandMinnesota’sagingpopulation.Thiscross-sectorgroupprovidesguidancetotheCommissioneronMDH’sstrategiesforrespondingtoCOVID-19.

Aspartoftheresponse,MDHexpertshavebeenprovidingtimelyinformationandeducationtothepublicandstakeholdersthroughup-to-datewebsiteinformation,regularpressbriefings,andcallsforstakeholderssuchasschools,long-termcarefacilities,healthcareproviders,andthebusinesscommunity.MDH’sCOVID-19website,withmaterialsavailablein16languages,hasbeenaccessedbythousandsofMinnesotans.

LocalresourcesareinadequatetofullyaddresstheCOVID-19pandemic.Wemustcontinuetotakethispandemicseriously,andtherearesensiblestepsthatMinnesotansandourstategovernmentcantaketoprotectallMinnesotansbyslowingthespreadofCOVID-19,prioritizingourhealthcareresources,andsafeguardingat-riskcommunities.

Forthesereasons,IdeclareapeacetimeemergencyinMinnesotaandorderasfollows:

1. Inconsultationwithfederal,state,andlocalpartners,tribalnations,relevantexperts,andstakeholders,MDH willcontinuetoleadthecoordinationoftheState’sresponsetoCOVID-19.

2. HSEMwillcontinuetoassistMDHandcoordinatesupportthroughtheStateEmergencyOperationsCenterand inaccordancewiththeMinnesotaEmergencyOperationsPlan.

3. Allstateagencies,incooperationwithappropriatefederalagencies,willworktosupporthealthcareproviders, tribalandlocalgovernments,andpublichealthorganizationsastheyrespondtoCOVID-19.

4. TheMinnesotaNationalGuardwillensurethatitisreadytoassistasneededduringthispeacetimeemergency.5. InconsultationwiththeCentersforDiseaseControlandPrevention,aswellaspublichealth,medical,andother

experts,MDHwillcontinuetoprovideguidancethatisaccessibleandtransparenttoallMinnesotans,including guidanceonhowtobestpreventandreducecommunityspreadofCOVID-19withinMinnesotaandmanage criticalhealthcareresources.

6. IencourageindividualMinnesotanstohelpprotectallMinnesotansbycontinuingtheirindividualprevention effortssuchasstayinghomewhenfeelingsick,frequentlywashingtheirhands,andmonitoringinformation aboutCOVID-19.

7. IurgeandadviseMinnesotanstofollowMDHguidanceregardinghygiene,publicgatherings,socialdistancing, andhealthcareuse.MinnesotansshouldregularlycheckMDH’sCOVID-19webpage: https://www.health.state.mn.us/diseases/coronavirus/

SinceIissuedExecutiveOrder20-01,theMinnesotaDepartmentofHealth(“MDH”)hasconfirmedadditionalCOVID-19casesinMinnesota.WecontinuetotakethispandemicseriouslyandaretakingsensiblestepstoprotectallMinnesotans.OurschoolsareplaceswherelargenumbersofMinnesotanscongregate.Theythereforeneedtimetoplanstrategiesforachievingeducationalgoalswhilealsocomplyingwithpublichealthguidance

UnderMinnesotaStatutes2019,section12.21,subdivision3,IampermittedtoauthorizetheCommissionerofEducation“toalterschoolschedules,curtailschoolactivities,ororderschoolsclosed.”InconsultationwithmyCabinet,Ihaveconcludedthatsuchactioniswarrantedtoallowforplanningtocontinuetoprovideaworld-classeducation,whilepreservingthehealth,safety,andlivesofMinnesotans.

AllowingschoolsandschooldistrictstimetoplanwithoutstudentsintheclassroomwillbenefitallofMinnesota.TheMinnesotaDepartmentofEducation(“MDE”)willprovideguidanceontheseimportantplanningefforts.Irealizethatschoolsarecommunityhubsforchildrenandfamilies.Schoolclosuresputburdensonchildrenandfamiliesandcreatedisproportionateimpactsondifferentcommunities.Forthatreason,wemustensurethatschoolsandschooldistrictscontinuetoprovidesupporttoMinnesotafamilies,evenwhilestudentsarenotintheclassroom.Wemustalsoacttominimizedisruptionscausedbyschoolclosuresonthestate’shealthcaresystemandemergencyworkers.

Inadditiontoschools,familieswithyoungchildrendependonchildcareproviders.Center-basedandfamilychildcareprovidersprovideanessentialservicetoourchildren,andtheyensurethatoureconomyandworkforcecanthrive.Unlikeschools,thesesettingsaresmalleranddonotneedtoplanfordistancelearning.Wemustcontinuetosupportchildcareproviders’effortstoremainopenandcomplywithpublic-healthguidanceastheyprovideessentialservicestoMinnesota.

Forthesereasons,Iorderasfollows:

1. PursuanttoMinnesotaStatutes2019,section12.21,subdivision3(11),IauthorizeanddirecttheCommissionerofEducationtocloseallschoolstostudents,exceptassetforthbelow,beginningonWednesday,March18,2020throughFriday,March27,2020(“ClosurePeriod”).

2. ThisorderappliestoallschoolsassetforthinMinnesotaStatutes2019,section12.21,subdivision3(11).IencouragetribalandprivateschoolstofulfillthespiritanddirectivesofthisExecutiveOrder.

3. TheClosurePeriodismeanttoprovidetimeforourschoolstoadequatelyplanforcontinuityofeducationduringtheCOVID-19pandemicforthepurposeofpreservingthehealth,safety,andlivesofMinnesota’sstudents,educators,andthebroaderpublic.

4. Recognizingthateveryschoolandschooldistricthasdifferentcircumstancesandneeds,MDEandMDHwillprovideguidancetoschoolsonapproachestodistancelearningandsocialdistancingwithinschools.IencourageschoolsandschooldistrictstoprovidefeedbacktoMDEaboutfurtherstepsthattheStatemaytaketoensurecontinuityofeducation.

5. Subjecttoparagraph12,schoolemployeesaredirectedtoreporttoworkinaccordancewithapplicablelaboragreementsandasrequiredbytheiremployerstoassistwiththeemergencymanagementplanningactivitiesprovidedinthisExecutiveOrder.

Executive Orders6. UponapprovalbytheExecutiveCouncil,duringtheClosurePeriodtheCommissionerofEducationwill

calculatemembershipforgeneraleducationandotherrevenueprogramsbasedontotaldistrictenrollment,regardlessofwhetherinstructionisprovided.Nothinginthisprovisionshouldbeconstruedtorequiredistrictstomake-upinstructionaltimelostduringtheClosurePeriod.

7. UponapprovalbytheExecutiveCouncil,forSchoolYear2019-2020only,theminimumdaysandhoursofinstructionrequiredfordistrictsandcharterschoolsunderMinnesotaStatutes2019,section120A.41,willbereducedbythenumberofdaysandhoursofinstructionduringtheClosurePeriod.

8. Subjecttoparagraph12,schoolsandschooldistricts,incooperationwithstateagencies,aredirectedtosupportcommunitiesdisproportionatelyimpactedbyinequities,including,butnotlimitedto,low-incomefamiliesandfamiliesexperiencinghomelessness.DuringtheClosurePeriod,schoolsareexpectedtoprovidemealstotheirstudents.MDEwillprovideadditionalguidancetoschoolsandschooldistricts.

9. Idirectstateagenciestoworktogethertoensurecontinuityofmentalhealthservicestochildrenandtheirfamilies.Stateagenciesaredirectedtotakeactionaddressingthisissue.

10. DuringtheClosurePeriod,schooldistrictsaredirectedtoexploreoptionstocarefor,andprotectthehealthandsafetyof,childreninlow-incomefamiliesifaprolongedschoolclosureisnecessary,utilizingguidancefromMDEandMDH.

11. Emergencyworkers(includingprovidersofhealthcare,emergencymedicalservices,long-termandpost-acutecare;lawenforcementpersonnel;personnelprovidingcorrectionalservices;publichealthemployees;firefightersandotherfirstresponders;andcourtpersonnel)arecriticaltotheState’sresponsetoCOVID-19.DuringtheClosurePeriod,andsubjecttoparagraph12,schoolsaredirectedtoprovidecareto,ataminimum,district-enrolledstudentsaged12andunderwhoarechildrenofemergencyworkers.Inprovidingthiscare,schoolsmustpracticehygieneandsocialdistancingbestpractices.Schoolsarenotrequiredtoprovidethiscareduringpreviouslyscheduledbreaksreflectedonaschool-boardapprovedcalendar.Iencourageschoolsandschooldistrictstoalsoprovideextendedcare—beforeandafterschoolhours—tostudentswhoarechildrenofemergencyworkers.MDEwillprovidefurtherguidancetoschoolsandschooldistrictsaboutthisprovision.

12. NothinginthisordershouldbeconstruedtoencourageorrequireMinnesotansinat-riskcategoriestotakeactioninconsistentwithpublichealthrecommendationsortheadviceoftheirdoctors.AllMinnesotansshouldcontinuetoregularlycheckandfollowtheadviceonMDH’sCOVID-19webpage: https://www.health.state.mn.us/diseases/coronavirus/

13. Tosupportcenter-basedandfamilychildcareprovidersinstayingopen,supportingtheiremployees,andremaininginbusinessduringthispeacetimeemergencyandafterward,Idirectstateagenciestocollaborateandalignresourcestosupportchildcareproviders.

14. ByMarch20,2020,IdirecttheDepartmentofHumanServicestosubmittomyofficeaproposaladdressingstrategiestocontinuesupportsforcenter-basedandfamilychildcarecenters,accommodatethecontinuationofchildcareproviders,andenableproviderstoservenewfamiliesneedingcarebecausetheyareassistinginemergencyrelief.

15. Toensurethehealth,safety,andwellbeingofchildrenandmaintainanadequatesupplyofchildcare,Idirectstateagenciestocreateahotlinespecificallytoaddresschildcareproviderconcernsandprioritizeestablishingmechanisms,totheextentpossibleandpermittedbylaw,forfinancial,operational,andothertechnicalassistanceresourcesthatwillenableproviderstoadapttotheCOVID-19pandemic.

ThisExecutiveOrderiseffectiveimmediatelyunderMinnesotaStatutes2019,section4.035,subdivision2.ItwillremainineffectuntilthepeacetimeemergencydeclaredinExecutiveOrder20-01isterminatedoruntilitisrescindedbyproperauthority.
