Minnesota Rules: Amendments and AdditionsNOTICE: How to Follow State Agency Rulemaking in the State RegisterThe State Register is the official source, and only complete listing, for all state agency rulemaking in its various stages. State agencies are

required to publish notice of their rulemaking action in the State Register. Published every Monday, the State Register makes it easy to follow and participate in the important rulemaking process. Approximately 80 state agencies have the authority to issue rules. Each agency is assigned specific Minnesota Rule chapter numbers. Every odd-numbered year the Minnesota Rules are published. Supplements are published to update this set of rules. Generally speaking, proposed and adopted exempt rules do not appear in this set because of their short-term nature, but are published in the State Register.

An agency must first solicit Comments on Planned Rules or Comments on Planned Rule Amendments from the public on the subject matter of a possible rulemaking proposal under active consideration within the agency (Minnesota Statutes §§ 14.101). It does this by publishing a notice in the State Register at least 60 days before publication of a notice to adopt or a notice of hearing, or within 60 days of the effective date of any new statutory grant of required rulemaking.

When rules are first drafted, state agencies publish them as Proposed Rules, along with a notice of hearing, or a notice of intent to adopt rules without a hearing in the case of noncontroversial rules. This notice asks for comment on the rules as proposed. Proposed emergency rules, and with-drawn proposed rules, are also published in the State Register. After proposed rules have gone through the comment period, and have been rewritten into their final form, they again appear in the State Register as Adopted Rules. These final adopted rules are not printed in their entirety, but only the changes made since their publication as Proposed Rules. To see the full rule, as adopted and in effect, a person simply needs two issues of the State Register, the issue the rule appeared in as proposed, and later as adopted.

The State Register features partial and cumulative listings of rules in this section on the following schedule: issues #1-13 inclusive; issues #14-25 inclusive (issue #26 cumulative for issues #1-26); issues #27-38 inclusive (issue #39, cumulative for issues #1-39); issues #40-52 inclusive, with final index (#1-52, or 53 in some years). An annual subject matter index for rules was separately printed usually in August, but starting with Volume 19 now appears in the final issue of each volume. Adopted RulesA rule becomes effective after the requirements of Minnesota Statutes §§ 14.05-14.28 have been met and five

working days after the rule is published in the State Register, unless a later date is required by statutes or specified in the rule. If an adopted rule is identical to its proposed form as previously published, a notice of adoption and a citation to its previous State Register publication will be printed. If an adopted rule differs from its proposed form, language which has been deleted will be printed with strikeouts and new language will be underlined. The rule's previous State Register publication will be cited.

KEY: Proposed Rules - Underlining indicates additions to existing rule language. Strikeouts indicate dele-tions from existing rule language. If a proposed rule is totally new, it is designated “all new material.” Adopted Rules - Underlining indicates additions to proposed rule language. Department of Health Notice of Reporting of New Diseases, Melioidosis and Glanders, under Minnesota Commu-nicable Disease Rules, Part 4605.7080

The Commissioner of Health gives notice that all mandated reporters are required to report melioidosis (Burkholde-ria pseudomallei) and glanders (Burkholderia mallei).

MDH will be conducting this surveillance under Minnesota Rules 4605.7000 to 4605.7900. Specifically, Minnesota Rules part 4605.7080 permits the Commissioner of Health to require reporting of newly recognized or emerging diseases and syndromes suspected to be of infectious origin if certain criteria are met.

Disease Definition. For mandated reporters, melioidosis includes suspected or confirmed cases of melioidosis or evidence of infection including isolation of Burkholderia pseudomallei from any body site, or detected by any other direct or indirect method. Glanders includes suspected or confirmed cases of glanders or evidence of infection, including isolation of Burkholderia mallei from any body site, or detected by any other direct or indirect method.

Request for Comments on Planned Amendment of Rules Governing Construction and Demolition Debris Landfills, Minnesota Rules, Chapters 7001, Permits, and 7035, Solid Waste; Revisor’s ID Number R-04556

NOTICE IS HEREBY GIVEN that the Minnesota Pollution Control Agency (MPCA or Agency) is requesting comments on its plans to amend existing Minnesota Rules, chapters 7001 and 7035 governing permits and solid waste landfills. It is seeking comments from interested parties on the scope and content of planned amendments. The Agency is calling this its Proposed Construction and Demolition Debris Landfill (CDL) rulemaking (Revisor ID #: R-04556). Please follow the instructions found under the public comment section below to submit comments.

Subject of rules. The MPCA requests comments on its plans to amend its rules governing CDLs. The Agency’s CDL program has been implementing Agency priorities using outdated rules and guidance. The goal is to update these rules by incorporating lessons it has learned about the potential for groundwater impacts of unlined CDLs. Since its promulgation of the existing rules in 1988 and its development of 2005 CDL guidance, the Agency has found pollutants in groundwa-ter monitored around unlined CDLs. These pollutants have exceeded Minnesota Department of Health (MDH) Human Health-Based Water Guidance values. These values include Health Risk Limits (HRLs), Health-Based Values (HBVs), Risk Assessment Advice (RAA), U.S. Environmental Protection Agency’s Maximum Concentration Limits (MCLs), as well as the Agency’s own solid waste Intervention Limits (ILs).

At this time, the Agency does not foresee any likely disproportionate negative impacts to environmental justice (EJ) communities related to these possible rules (discussed further in the persons affected section).

The Agency intends to limit the scope of this rulemaking to issues described for CDLs with the understanding that related issues may eventually need to be addressed for other types of Minnesota landfills. At its discretion, the Agency may try to address an occasional related item, but only as the Agency believes resources would allow. The Agency con-siders all input, formal or informal, to be advisory in nature with the Agency deciding how it must focus its resources.

Plain language summary. Agency rules and guidance that have been governing landfills are incomplete and outdat-ed. The Agency is mindful of needing to provide regulatory certainty, a level playing field, a faster permitting process, and improved environmental protection for all types of landfills. With few exceptions, the Agency intends to limit the scope of this rulemaking to amendments aimed at regulating CDLs.

has not drafted any rule language. The Agency is seeking input on amending CDL regulations. For example, the Agency recognizes that compliance costs can be a concern. If you have cost information or other data that would help inform these rules, please share that information in writing. Sharing your thoughts at this early stage allows the Agency more time to address unanticipated issues and helps inform our decisions.

Persons affected. New rules will ensure a more consistent application of the conditions necessary to protect water quality around landfills. The anticipated requirements for CDLs will address growing concerns about groundwater con-tamination.

Because most unlined CDLs are located outside of the Minneapolis/St. Paul metropolitan area, the impacts or chang-es will be experienced primarily in Greater Minnesota. The Agency expects that the benefits of mitigated or reduced groundwater contamination and the cost of compliance will also be most experienced in Greater Minnesota.

Approximately 1/3 of the unlined C&D landfills are within 1 mile of an identified EJ community of concern accord-ing to preliminary data. The Agency believes that more protective rules would benefit these and other nearby commu-nities by reducing exposure to pollutants. The Agency welcomes any additional information or questions regarding potential issues of concern for EJ communities associated with this potential rulemaking.

Statutory authority. The Minnesota Legislature may provide agencies with either specific or general statutory rulemaking authorities. The Agency did not seek specific authority for this rulemaking as it intended to use the existing general solid waste rulemaking authority cited below.

Minnesota Statutes, § 116.07 Powers and Duties, subdivisions 2 and 4 authorize the Agency to adopt rules governing solid waste management. The Agency is using its existing authority under this statute to promulgate the amendments found here: www.revisor.mn.gov/statutes/?id=116.07.

Public comment. Interested persons or groups may submit comments or information on these possible rules in writ-ing until 4:30 p.m. on Monday, December 31, 2018. The Agency will not publish a notice of intent to adopt these rules until at least 60 days after the date of this request for comments.

The Agency may create an optional advisory panel, representing industry, local government and citizens, to weigh in on this rulemaking effort.

The Agency does not anticipate that the rule amendments will require local government to adopt or amend any ordi-nance or other regulation under Minnesota Statutes Section, 14.128. Local governments may submit written information to the contrary.

The Agency is seeking information pertaining to the cumulative effect of these amendments when applied in con-junction with other federal or state regulations related to the specific purpose of these rules. Cumulative effect means the impact that results from incremental impact of the proposed rules in addition to other rules, regardless of what state or federal agency has adopted the other rules.

Rules drafts. The Agency has not yet drafted the possible amendments and does not anticipate that a draft will be available before it proposes them for public comment. The Minnesota EBHV Grant program has an estimated total amount of 26 million for grantee funding under this RFP for the period of May 1, 2019 – December 31, 2022. The Lottery does not market to those under the age of 18, and family events with high levels of chil-dren present are generally not accepted. Attendance, on-site signage visibility and paid media exposure will be critical components that will be evaluated.

Through this RFP, organizations can apply to receive an AmeriCorps Operational Grant. AmeriCorps Operational GrantsAmeriCorps grants are awarded to eligible organizations engaged in evidence-based interventions that utilize Amer-

iCorps members to strengthen communities. An AmeriCorps member is an individual who is enrolled in an approved national service position and engages in community service. Members may receive a living allowance and other benefits while serving. Upon successful completion of their service members receive a Segal AmeriCorps Education Award from the National Service Trust.
