Summary of Conditions in force as of Nov 2008: Technical data and site access to be provided in a
“timely manner” for preliminary analysis Response to a Proposal To Share to be provided
within 30 days by the Licensee Offer To Share by the Licensee to be made in every
case where sharing is “technically feasible” Existing licensees must negotiate with a Requesting
Operator in “good faith” If agreement is not reached within 90 days of the
Licensee receiving the Proposal To Share, it will go to arbitration
Descriptions of incumbents by new carriers: “very limited co-operation from the incumbent carriers” “foot-dragging” and “very slow in terms of answers”
February 17, 2009, Industry Canada released a consultation letter looking for comments on:
Response to a request for prelim information to be provided within 1 week
Site access to be provided within 1 week of the request Only “imminent future use” to be provided in the
technical data Non-disclosure agreements to be generic

Site access to be arranged “within one week” Clarification of info to be provided, if available Equipment installations identified in plans to be
installed within 18 months will not be disrupted Space reserved on a tower for identified imminent
future use by a 3rd party should be identified, and not disrupted
NDAs are not a valid reason to delay providing preliminary information
4 months to obtain a co-location agreement is purely theoretical
Almost every co-location request will go to arbitration as the incumbents will continue to throw up barriers
Any space offered in an offer to share will be on poor locations on the tower
To mitigate risk, any co-location application should have alternate site acquisition plans running in parallel
