5. ConstructionTiming:TheProjectisexpectedtobecompletedwithinapproximately66workingdays.TheProjectisproposedtobeginonJuly1,2016,andbecompletedonSeptember1,2016.

6. ProjectImpacts:TheproposedProjectwillresultinapproximately412.8linearfeet

(0.012acres)ofpermanentimpactstojurisdictionalwatersduetodisturbanceduringconstruction.TheproposedProjectwillresultinapproximately1,359.9linearfeet(0.04acres)oftemporaryimpactstojurisdictionalwatersduetothenewdrainagesystembeinginstalled.TheProjectwillalsoresultinapproximately0.001acresofpermanentimpactsand0.003acresoftemporaryimpactstowetlandsduetodisturbanceduringconstruction.

7. MitigationforProjectImpacts:Caltransshallmitigateforpermanentimpactsby

providing0.36acresofrestoredwetlandsand0.17acresofrestoredwatersofthestateatMacKerricherStatePark,immediatelynorthofFortBragg.MitigationshallbecompletedconsistentwiththeApril2013,InglenookFen‐TenMileDuneNaturalPreserveMitigationandMonitoringPlan,preparedbyCaltrans.

8. Post‐ConstructionStormWater:Post‐constructionstormwatertreatmentisnot

requiredbecauseProjectimplementationwillresultinlessthan5,000squarefeetofaddedorreworkedimperviousarea.

9. DisturbedSoilArea:Projectimplementationwillresultinlessthanoneacreofdisturbedsoilarea.Caltransshallutilizeappropriateerosioncontrol,sedimentcontrol,andsitemanagementBestManagementPracticestopreventdischargeofpollutantsduringconstruction.

10. UtilityRelocations:Utilityrelocationsaffectingjurisdictionalwatersarenotproposed

forthisProject.

11. OtherAgencyActions:CaltranshasrequestedU.S.ArmyCorpsofEngineersauthorizationtoperformtheprojectunderRegionalGeneralPermitno.2009‐00447N,pursuanttoCWA,section404.Caltranshasalsosubmittedasection1600NotificationofLakeorStreambedAlterationtotheCaliforniaDepartmentofFishandWildlife.CaltransreceivedaBiologicalOpinion(AFWO‐10B0003‐10F0090)fromtheNational

MarineFisheriesService(NMFS)onJanuary4,2005,thatdeterminedtheProjectisnotlikelytoadverselyaffectlistedsalmonidspecies.CaltransreinitiatedconsultationwithNMFSin2006afterachangeinthelistingstatusofCentralCaliforniaCoastcohosalmonaswellasdesignationofcriticalhabitatforNorthernCaliforniasteelheadandCentralCaliforniaCoaststeelhead.InaJanuary10,2007letter,NMFSmaintainedthattheoriginalBiologicalOpinionandincidentaltakestatementremainedvalid.

12. CEQACompliance:OnJune6,2005,CaltranssignedaNoticeofDeterminationapprovingaMitigatedNegativeDeclarationfortheProject(StateClearinghouseNo.2015021063)inordertocomplywiththeCaliforniaEnvironmentalQualityAct.

13. TotalMaximumDailyLoad:TheNavarroRiverisidentifiedasimpairedforsediment

andtemperatureundertheCleanWaterActSection303(d)list.Erosionisidentifiedasacontributingsourcetosedimentimpairment.Caltranswillutilizeappropriateerosioncontrol,sedimentcontrol,andsitemanagementBMPstocontrolpollutantsduringconstruction,anddrainageimprovementswillresultinanetreductioninsedimentcontributions.Accordingly,thiscertificationdoesnotcertifyanyactivitiesthatwouldcontributetoEelRiversedimentortemperatureimpairment.

14. AntidegradationPolicy:ThefederalantidegradationpolicyrequiresthatStatewater

qualitystandardsincludeanantidegradationpolicyconsistentwiththefederalpolicy.TheStateWaterBoardestablishedCalifornia’santidegradationpolicyinStateWaterBoardResolutionNo.68‐16.ResolutionNo.68‐16incorporatesthefederalantidegradationpolicywherethefederalpolicyappliesunderfederallaw.ResolutionNo.68‐16requiresthatexistingqualityofwatersbemaintainedunlessdegradationisjustifiedbasedonspecificfindings.TheRegionalWaterBoard’sBasinPlanimplements,andincorporatesbyreference,boththeStateandfederalantidegradationpolicies.ThiscertificationisconsistentwithapplicablefederalandStateantidegradationpolicies,asitdoesnotauthorizethedischargeofincreasedconcentrationsofpollutantsorincreasedvolumesoftreatedwastewater,anddoesnototherwiseauthorizedegradationofthewatersaffectedbythisProject.

15. ThisdischargeisalsoregulatedunderStateWaterResourcesControlBoardOrderNo.

2003‐0017‐DWQ,"GeneralWasteDischargeRequirementsforDredgeandFillDischargesThatHaveReceivedStateWaterQualityCertification,"whichrequirescompliancewithallconditionsofthiscertification.OrderNo.2003‐0017‐DWQcanbefoundhere:http://www.waterboards.ca.gov/board_decisions/adopted_orders/water_quality/2003/wqo/wqo2003‐0017.pdf.

CaltransshallimplementtheproposedStateRoute128/253CulvertRehabilitationProject(PhaseIII,Part2)RevegetationPlan,datedDecember2015(Plan).Caltransshallsubmityears1,2,3,4,and5monitoringreports,nolaterthanJanuary31followingtherespectivemonitoringyear.Themonitoringreportsshallincludephotos,plantcounts,andsuccesscriteriaforsurvivalcounts.

AllProjectactivitiesandBMPsshallbeimplementedaccordingtothesubmittedapplicationpackageandthefindingsandconditionsofthiscertification.SubsequentchangestotheProjectthatcouldsignificantlyimpactwaterqualityshallfirstbesubmittedtoRegionalWaterBoardstaffforpriorreview,consideration,andwrittenconcurrence.IftheRegionalWaterBoardisnotnotifiedofanalterationtotheProjectthatresultsinanimpacttowaterquality,itwillbeconsideredaviolationofthiscertification,andCaltransmaybesubjecttoRegionalWaterBoardenforcementactions.

6. AllconditionsrequiredbythiscertificationshallbeincludedintheContractDocumentspreparedbyCaltransforthecontractor.Inaddition,CaltransshallrequirecompliancewithallconditionsincludedinthiscertificationinthebidcontractforthisProject.

7. CaltransisprohibitedfromdischargingwastetowatersoftheState,unlessexplicitly

authorizedbythiscertification.Forexample,nodebris,soil,silt,sand,bark,slash,sawdust,rubbish,cementorconcreteorconcretewashings,weldingslag,oilorpetroleumproducts,orotherorganicorearthenmaterialfromanyconstructionorassociatedactivityofwhatevernature,shallbeallowedtoenterintoStatewaters.

8. Exceptfortemporarystockpilingofwastegeneratedduringdemolitionoperations

(“temporary”inthisinstancemeansgeneratedandremovedduringthesameworkingday),wastematerialsshallnotbeplacedinamannerwherethematerialsmaybetransportedintowatersoftheState.Wastematerialsshallnotbeplacedwithin100linearfeetofStatewaters.Exceptionstothe100‐footlimitmaybegrantedonacase‐by‐casebasisprovidedCaltransfirstsubmitsaproposalinwritingthatisfoundacceptablebyRegionalWaterBoardstaff.

9. Caltransisliableandresponsiblefortheproperdisposal,reuse,and/orrecyclingofallProject‐generatedwasteincompliancewithapplicableStateandFederallawsandregulations,andasdescribedinCaltrans2010StandardSpecifications13‐4.03D,WasteManagement.Additionally,whenhandling,transporting,disposing,reusing,and/orrecyclingProject‐generatedwaste,Caltransandtheircontractorsshall:

i) ProvidetheRegionalWaterBoardwithacopyoftheSolidWasteDisposalandRecyclingReportpreparedforCaltransbythecontractorperCaltrans2010StandardSpecification14‐10.02A(1),Submittals.ThesereportsshallbeprovidednotlaterthanJanuary31foreachyearworkisperformedduringthepreviouscalendaryear.AcopyofthefinalSolidWasteDisposalandRecyclingReportshallbesubmittedtotheRegionalWaterBoardwithin30daysafterbeingreceivedbyCaltransfromthecontractor.

ii) Forwasteotherthansolidwaste,obtainevidencethatwastehasbeenappropriatelydisposed,reused,and/orrecycled.Evidenceshallinclude

typeandquantityofwasteandmayinclude,butnotbelimitedto,propertyowneragreements,permits,licenses,andenvironmentalclearances.EvidenceshallbeprovidedtotheRegionalWaterBoarduponrequest;and

iii) Forwasteotherthansolidwaste,ensuretheResidentEngineerhasgivenwrittenpermissionfordisposal,reuse,and/orrecycling,priortotheactualdisposal,reuse,and/orrecycling.

10. Asphalt‐concretegrindingsshallnotbeplacedinanylocationwheretheymay,atany

time,bedirectlyexposedtosurfacewatersorseasonallyhighgroundwater,exceptasphalt‐concretegrindingsmaybere‐usedandincorporatedintohotmixasphaltproductsorencapsulatedwithintheroadwaystructuralsection.

11. CaltransandtheircontractorsshallcomplywiththeactivityrestrictionsdetailedinCaltrans2010StandardSpecifications13‐4.03C(1).Inaddition,fueling,maintenance,storageandstagingofvehiclesandequipmentshallbeprohibitedwithinwatersoftheState(e.g.,gravelbars,seeps,ephemeralstreams)andriparianareas.

12. Fueling,maintenance,and/orstagingofindividualequipmenttypeswithinwatersof

theStateorriparianareasmaybeauthorizedifCaltransfirstpreparesaplanforreviewandapprovalbyRegionalWaterBoardstaffthat:

i) Identifiesthespecificpieceofmachinerythatmayrequirefueling,maintenance,and/orstagingwithinwatersoftheStateorriparianareas;

ii) Providesjustificationfortheneedtorefuel,maintain,orstagewithinStatewatersorriparianareas.Thejustificationshalldescribewhyconductingtheactivityoutsideofjurisdictionalwatersisinfeasible;and

iii) IncludesanarrativeofspecificBMPsthatshallbeemployedtopreventdischargestoStatewatersandriparianareas;

13. CaltransshallnotuseleakingvehiclesorequipmentwithinStatewatersorriparian

areas.14. Only100‐percentbiodegradableerosionandsedimentcontrolproductsthatwillnot

entraporharmwildlifeshallbeused.Photodegradablesyntheticproductsarenotconsideredbiodegradable.IfCaltransfindsthaterosioncontrolnettingorproductshaveentrappedorharmedwildlife,personnelshallremovethenettingorproductandreplaceitwithwildlife‐friendlybiodegradableproducts.Thisconditiondoesnotprohibittheuseofplasticsheetingusedinwaterdiversionordewateringactivities.CaltransshallrequestapprovalfromtheRegionalWaterBoardifanexceptiontothisrequirementisneededforaspecificlocation.

15. Workinflowingorstandingsurfacewaters,unlessotherwiseproposedintheproject

descriptionandapprovedbytheRegionalWaterBoard,isprohibited.

16. Non‐stormwaterdischargesareprohibitedunlessthedischargeisfirstapprovedbytheRegionalWaterBoardandincompliancewiththeBasinPlan.Ifdewateringofgroundwaterisnecessary,thenCaltransshalluseamethodofwaterdisposalotherthandisposaltogroundorsurfacewaters,suchaslanddisposal.GroundwaterdisposedoftolandshallnotenterStatewaters.Alternatively,CaltransmayapplyforcoverageundertheLowThreatDischargePermitoranindividualNationalPollutantDischargeEliminationSystem(NPDES)Permit.IfCaltransappliesforcoverageundereitherofthesepermits,thendischargeisprohibiteduntilCaltranshasreceivednotificationofcoverageundertherespectivepermit.

17. GravelbagsusedwithinStatewatersshall:

i) ComplywithCaltrans2010StandardSpecificationssections13‐5.02Gand88‐1.02F;

ii) Beimmediatelyremovedandreplacedifthebagshavedevelopedoraredevelopingholesortears;and

iii) Befilledonlywithcleanwashedgravel.

ExceptionstothesecriteriaaresubjecttothereviewandacceptanceofRegionalWaterBoardstaff.

18. Thiscertificationdoesnotauthorizedraftingofsurfacewaters.

19. CaltransshallprovideaccesstotheProjectconstructionsiteuponrequestbyRegional

WaterBoardstaff.

20. InitialwaterpollutioncontroltrainingdescribedinCaltrans2010StandardSpecifications13‐1.01D(2),Training,shallapplytoallCaltransemployees,contractors,andsub‐contractors.InitialwaterpollutioncontroltrainingtopicsshallincludeRegionalWaterBoard401certificationandconstructiongeneralpermitrequirements,identificationofstatewatersandriparianareas,andviolationavoidanceanddischargereportingprocedures.

21. CaltransshallmaintainlogsofallCaltransstaff,contractors,andsub‐contractorstrainedpursuanttotheCaltrans2010StandardSpecifications13‐1.01D(2).Thelogsshallincludethenamesoftrainees,trainingdates,andsummaryofthescopeoftraining.CaltransshallprovideevidenceofthisdocumentationupontherequestoftheRegionalWaterBoard.

22. Ifanunauthorizeddischargetosurfacewaters(includingwetlands,riversorstreams)occurs,oranyotherthreattowaterqualityarisesasaresultofProjectimplementation,theassociatedProjectactivitiesshallceaseimmediatelyuntilthethreattowaterqualityisotherwiseabated.IfthereisadischargetoStatewaters,theRegionalWaterBoardshallbenotifiednomorethan24hoursafterthedischargeoccurs.

23. UncuredconcreteshallnotbeexposedtoStatewatersorsurfacewatersthatmaydischargetoStatewaters.Concretesealantsmaybeappliedtotheconcretesurfacewheredifficultyinexcludingflowforalongperiodmayoccur.Ifconcretesealantisused,watershallbeexcludedfromthesiteuntilthesealantiscured.Ifgroundwatercomesintocontactwithfreshconcrete,itshallbepreventedfromflowingtowardssurfacewater.

24. Groundandsurfacewaterthathascomeintocontactwithfreshconcrete,andallother

wastewater,shallnotbedischargedtoStatewatersortoalocationwhereitmaydischargetoStatewaters;thewastewatershallbecollectedandre‐usedordisposedofinamannerapprovedbytheRegionalWaterBoard.

25. Allimportedfillmaterialshallbecleanandfreeofpollutants.Allfillmaterialshallbe

importedfromasourcethathastheappropriateenvironmentalclearancesandpermits.Thereuseoflow‐levelcontaminatedsolidsasfillon‐siteshallbeperformedinaccordancewithallStateandFederalpoliciesandestablishedguidelinesandmustbesubmittedtotheRegionalWaterBoardforreviewandconsiderationofacceptance.

26. CaltransshallprovideacopyofthiscertificationandStateWaterResourcesControlBoard(SWRCB)OrderNo.2003‐0017‐DWQ(weblinkreferencedbelow)tothecontractorandallsubcontractorsconductingthework,andrequirethatcopiesremainintheirpossessionattheworksite.Caltransshallberesponsibleforworkconductedbyitscontractorandsubcontractors.

27. Thevalidityofthiscertificationisconditionedupontotalpaymentofanyfeerequired

undertitle23,CaliforniaCodeofRegulations,section3833.Thetotalapplicationfeeis$10,794.TheRegionalWaterBoardreceived$10,794fromCaltransonDecember2,2015.

28. Thiscertificationwillbesubjecttoannualbillingduringtheconstructionphase(“AnnualActiveDischargeFee”)andduringthemonitoringphaseoftheProject(“AnnualPostDischargeMonitoringFee”),perthecurrentfeeschedule,whichcanbefoundonourwebsite:http://www.swrcb.ca.gov/northcoast/water_issues/programs/water_quality_certification.shtml.ThesefeeswillbeautomaticallyinvoicedtoCaltrans.

30. ThiscertificationactionisnotintendedandshallnotbeconstruedtoapplytoanydischargefromanyactivityinvolvingahydroelectricfacilityrequiringaFederalEnergyRegulatoryCommission(FERC)licenseoranamendmenttoaFERClicenseunlessthepertinentcertificationapplicationwasfiledpursuanttotitle23,CaliforniaCodeofRegulations,section3855,subdivision(b)andtheapplicationspecificallyidentifiedthataFERClicenseoramendmenttoaFERClicenseforahydroelectricfacilitywasbeingsought.

31. Intheeventofanyviolationorthreatenedviolationoftheconditionsofthiscertification,theviolationorthreatenedviolationshallbesubjecttoanyremedies,penalties,processorsanctionsasprovidedforunderapplicablestateorfederallaw.Forthepurposesofsection401(d)oftheCleanWaterAct,theapplicabilityofanystatelawauthorizingremedies,penalties,processorsanctionsfortheviolationorthreatenedviolationconstitutesalimitationnecessarytoassurecompliancewiththewaterqualitystandardsandotherpertinentrequirementsincorporatedintothiscertification.Inresponsetoasuspectedviolationofanyconditionofthiscertification,theStateWaterBoardmayrequiretheholderofanyfederalpermitorlicensesubjecttothiscertificationtofurnish,underpenaltyofperjury,anytechnicalormonitoringreportstheStateWaterBoarddeemsappropriate,providedthattheburden,includingcosts,ofthereportsshallbearareasonablerelationshiptotheneedforthereportsandthebenefitstobeobtainedfromthereports.Inresponsetoanyviolationoftheconditionsofthiscertification,theRegionalWaterBoardmayaddtoormodifytheconditionsofthiscertificationasappropriatetoensurecompliance.

32. Thiscertificationactionissubjecttomodificationorrevocationuponadministrativeorjudicialreview;includingreviewandamendmentpursuanttoWaterCodesection13330andtitle23,CaliforniaCodeofRegulations,section3867.

33. i) ThedischargebeinglimitedtoandallproposedmitigationbeingcompletedinstrictcompliancewithCaltrans’sProjectdescriptionandCEQAdocumentation,asapprovedherein;and

vi) CompliancewithallapplicablewaterqualityrequirementsandwaterqualitycontrolplansincludingtherequirementsoftheWaterQualityControlPlanfortheNorthCoastRegion(BasinPlan),andamendmentsthereto.

35. AnychangeinthedesignorimplementationoftheProjectthatwouldhaveasignificantormaterialeffectonthefindings,conclusions,orconditionsofthiscertificationmustbesubmittedtotheExecutiveOfficeroftheRegionalWaterBoardforpriorreview,consideration,andwrittenconcurrence.IftheRegionalWaterBoardisnotnotifiedofasignificantalterationtotheproject,itwillbeconsideredaviolationofthiscertification,andCaltransmaybesubjecttoRegionalWaterBoardenforcementactions.

36. TheauthorizationofthiscertificationforanydredgeandfillactivitiesexpiresonMarch

25,2021.Conditionsandmonitoringrequirementsoutlinedinthiscertificationarenotsubjecttotheexpirationdateoutlinedabove,andremaininfulleffectandareenforceable.
