INFORMATION ABOUTTHIS LICENCE
Definitions of Terms
. A section on the definition of terms used in this Licence can be found at the end of this
Licence
. Terms used in the Licence which are defined in the Water Act(the Act) have the meaning
given in that Act unless specifically indicated otherwise
Responsibilities of Licensee
. It is an offence under the Act, ifthe holder of a Licence contravenes orfails to comply withthe conditions of the Licence
. In addition to the conditions set out in this Licence, general responsibilities of Licensees are
set out in the Act, the Waste Management and Pollution ControlAct, and associated
Regulations
. Licensees must comply at alitimes with the requirements of these Acts and all other
applicable laws
. Except as expressly provided for in this Licence, the Licensee must not
o cause environmental harm either directly or indirectly;
o allow waste to come into contact with water; or
o allow water to be polluted
. Withoutlimiting the conditions of this Licence, in conducting the Activity, the Licensee must
do alithings reasonable and practicable to
o prevent or minimise the likelihood of pollution occurring as a result of, or in
connection with, the Activity;
o prevent or minimise the likelihood of environmental harm occurring as a result of, or
in connection with, the Activity;
o effective Iy respond to pollution and the risk of pollution occurring as a result of, or in
connection with, the Activity;
o effectiveIy respond to environmental harm and the risk of environmental harm
occurring as a result of or in connection with the Activity; and
o asfaras practicable
avoid and reduce waste produced as a result of, or in connection with the
Activity;
increase the re-use and recycling of waste;
effective Iy manage waste disposal; and
apply the principles of ecologicalIy sustainable development

Duration of Licence
. This Licence will remain in force untilits expiry date, or until it is surrendered b the
Licensee, or untilit is suspended or revoked by the Controller
Amendment, Modification or Revocation of Licence (section 93 of the Water Act). The Controller of Water Resources may, by notice
o amend or modify the terms and conditions of a licence;o revoke a licence; or
o suspend a licence

Environment Protection Objectives and Beneficial Use Declaration
. An Environment Protection Objective (EPO)is a statutory instrument to establish princileson which (Part 4 of the Waste Management and Pollution ControlAct, WMPCA)
a) environmental quality is to be maintained, enhanced, managed or protected;by pollution, or environmental harm resulting from pollution, is to be assessed,
prevented, reduced, controlled, rectified or cleaned up; andc) effective waste management is to be implemented or evaluated
. In accordance with section 18 of the WMPCA, a beneficial use, qualit standard, criteriaobjective declared under section 73 of the Act and in force is an environment rotectionobjective forthe purposes of the WMPCA
. Beneficial Use Declaration (BUD)is a legislated process that reduces the effects of water
pollution and assists in the protection and management of water. The coinmunit decides
how a particular water body should be used by choosing on one or more Beneficial Usecategories
. The following EPOs and BUDS are relevant to this Licence
o Declaration of Beneficial Uses and Objectives, Darwin Harbour Region, NorthernTerritory Government Gazette No. G27, 7 July 2010, being forthe protection of

Environmental Interests
. This section highlights sensitivity of the surrounding land use and environment associated
with the location of the approved activity that represents an interest to the Northern
Territory Government and the community:
o Sites of Conservation Significance, Darwin Harbour, SOCS Number 6.

Environment, to provide water to maintain the health of aquatic ecosystems;
Cultural, to provide water to meet aesthetic, recreational and cultural needs; and

9.4 the nature of events giving rise to the complaint;
9.5 prevailing weather conditions at the time of the complaint;
9.6 the action taken in relation to the complaint, including any follow-up contact with

10. The Licensee must implement the Compliance Plan provided as Attachment I to the
Application for Waste Discharge Licence, dated 10 March 2010, reviewed 5 June 2014

41.1 fitfor purpose;
11.2 maintained in accordance with the manufacturer's specifications; and

23. The Licensee must keep records of all non-compliances with this Licence.
24. The Licensee must notify the NT EPA as soon as practicable, and in an case within24 hours, of becoming aware of any non-compliances with this Licence.
25. Non-compliance notifications required under condition 24 mustidentif :
25.1 circumstances leading up to the non-compliance;
25.2 the risk to the environment from the non-compliance;25.3 what actions the Licensee will undertake to mitigate any environmental harm
resulting from the non-compliance; and
25.4 what corrective actions the Licensee will undertake to ensure the nori-
compliance does not occur again.
26. The Licensee must as soon as practicable report to the NT EPA, all exceedances of thelimits specified in Table 2.

27. Exceedance reports required under condition 26 must identify:27.1 potential contributing factors (e. g. operational, environmental);27.2 the likely risk of environmental harm arising from the exceedance; and27.3 anymanagementactionstaken.
28. The Licensee must immediately and in any case within 24 hours notif the NT EPA of an
potential or actual environmental harm or pollution by contacting the Pollution Hotline ontelephone number 1800 064 567 and emailing o11ution nt. ovau.
29. The Licensee must comply with the requirements of section 14 of the WMPCA.
30. The Licensee must provide a Monitoring Report to the NT EPA within two calendar month
after completion of the Activity, rioting that the NT EPA may require the Licensee to revise,amend and/orresubmitthe report.
31. The Monitoring Report must include:
results of all monitoring and records required under this Licence; and
assessment of likely impact to the Darwin Harbour Water Quality Objectives forthe water quality parameters measured.
32. The Licensee must complete the attached Audit and Compliance Report (Appendix C), andprovide it to the NT EPA within two calendar months after completion of the Activit , notinthat the NT EPA may require the Licensee to revise, amend and/orresubmitthe Audit andCompliance Report.

The Licensee must provide a Monitoring Report to the NT EPA within twocalendar months after completion of the Activity, noting that the NT ERAmay require the Licensee to revise, amend and/or resubmitthe report
31 The Monitoring Report must include31.1 results of all monitoring and records required under this Licence;and
31.2 assessment of likely impact to the Darwin Harbour Water QualityObjectives forthe water quality parameters measured.
32 The Licensee must complete the attached Audit and Compliance Report(Appendix C), and provide it to the NT EPA within two calendar monthsafter completion of the Activity, noting that the NT EPA may require theLicensee to revise, amend and/orresubmitthe Audit and ComplianceReport.
