ORDER No. 13/11-2020 PGT- (1) DATED, PANCHKULA, THE ti\ II \c1o~o Whereas, Smt. Dhanwanti has filed the present CWP No. 32530 of
2019 before the Hon 'ble High Court for issuance of a writ in the nature of
Certiorari for setting aside the order dated 18 .10.2019 (P-10) only to the
extent of dislocating the petiti ner and requested for adjustment of the
petitioner on temporary basis and further prayed for issuance of
writ/ direction in the nature of mandamus directing the respondents to
transfer back the petitioner at her earlier place of posting and also to transfer
the respondent no. 6 out of GSSS, Sikhopur, Gurugram. Further to issue
any other writ, order or direction which this Hon 'ble court may deem fit in
the facts and circumstances of the case.
That the writ petition came up for hearing before the Hon'ble Court on
08 .11.2019 and this Hon 'ble C urt was pleased to dispose of the same with
the directions to respondents a under:
"Grievance of petitioner, in the instant petition, is that owin.g to
interim orders passed in various writ petitions, pertaining the persons
mentioned in the list circulated vide order dated 18.10.2'019
(Annexure P-1 OJ, District E ucation Officers, have been directed to
adjust, displaced Post Graduate Teachers, like petitioner, by makinq
temporary posting.
Mr. Chandehas Yadav, learned counsel appearing on behalf of
the petitioner, expresses apprehension that temporary posting uiould.
again result into a dis-entitlement in respect of employees, who had
not approached this Court and it would also result into multiplicUy of
events and chain reaction would not end. At the best, respondents

ought to have placed the petitioner or the similarly situated persons,
~ at the previous place of posting.

I am of the view that grievance of petitioner, can onl!i be
addressed, in case, the petitioner makes a comprehensive
representation, in this regard. In case, such representation is made
within a period of one week rom the date of receipt of certified copy
of this order, Director Secondary Education, Haryana is directed. to
decide the same within another period of fifteen days, by passing a
speaking order and after affording opportunity of hearing to
petitioner, failing which, there shall be costs of '25,000/- to be paid to
the petitioner.
This condition of imposing costs is only to prevent petitioner to
run from pillar to post and avail remedy of contempt in cuse of
noncompliance of directions issued by this Court.
The writ petition stands disposed of with the above direction."
That the case of the petitioner was examined and as per MIS record of
the petitioner Smt. Dhanwanti, PGT Chemistry (095396), she had voluntary
participated in General Transfer Drive of PGTs in year 2019, she had
submitted her 'YES' for participation on 09.08.2019. Further, the post o:f PGT
Chemistry was also rationalized/removed from her previous place of posting
i.e. GSSS, Shikhopur, Gurugram as there were only four students of science
stream in 11th and 12th classes. Accordingly, she had exercised her option for
filling preferences and successfully got station out of her choice.
Further, it is pertinent to mention here that in compliance of the orders
of the Hon 'ble High Court, an opportunity of personal hearing was accorded
to the petitioner on 08.09.2020 through video conferencing due to covid-19
situation and the petitioner had stated her grievances regarding transfer. The
petitioner had submitted a written representation via e-mail with· duly
annexed documents/orders. In her representation she has stated that her
post was declared surplus due to which she was transferred to GSSS '
~ Pataudi, however, due to Honble High Court direction dated 27.09.2019

pas ed in CWP No. 27936/28041 of 2019, she got displaced and later on was
temporarily adjusted at GSSS, Sarai Alawardi (4401). The only request she
has made in her representatio is to give her permanent posting at G:SSS,
Sarai Alawardi (4401) till her zone service completion.
That after considering all the facts and representation of the petitioner,
the undersigned is of the view that the petitioner shall not be displaced from
the place where she has been adjusted i.e. GSSS, Sarai Alawardi (4401),
Gurugram. However, "she may be allowed to participate in the next
trans/ er drive".

ORDER No. 13/8-2020 PGT-llV (1) DATED, PANCHKULA, THE \8l1\l~o Whereas, Sh. Suresh Kumar and another has filed the CWP No. 30505
of 2019 before the Hon 'ble High Court for issuance of a writ in the nature of
Certiorari for quashing the transfer order dated 22.08.2019 (Annexure P-4
& P-5), vide which the petitioner no. 1 i.e. Sh. Suresh Kumar has been
transferred to Sirsa without considering the 65 options submitted by the
petitioner and without taking into consideration the couple case of the
petitioners as petitioner no. 2 i.e. Smt. Deepika has been transferred to
Barwala in Hisar. And also to issue a writ in the nature of mandamus
directing the respondents to consider the present case of transfer as couple
case and transfer the petitioner no. 2 (wife) to Sirsa as petitioner no.1 has
already been transferred to Sirsa and 5 seats are lying vacant in Sirsa.
Further to issue any other writ, order or direction which this Hon 'ble court
may deem fit in the facts and circumstances of the case.
That the writ petition came up for hearing before the Hon'ble Court on
22 .10.2019 and this Hon 'ble C urt was pleased to dispose of the same with
the directions to respondents a under:
"Prayer in the present writ petition is for quashlnq of
impugned transfer order dated 22.08.2019 (Annexure P-4 & P-5).
Petitioner No. 1 has been transferred from Government
Senior Secondary Sch ol, Majra, Block Narnaud, District Hisar
to Government Senior Secondary School, Sahuwala-11, Block
Nathusari Chopta, District Sirsa.
Petitioner No. 2 has been transferred from Government
Girls Senior Secondary School, Garhi Hansi (Net Ram Bhawati),
Block Hansi, District Hisar to Government Senior Secondary

School, Dhani Khan B hadur, Block Barwala, Hisar, District
Hisar.
The impugned orders are dated 22.08.2019, thus, it WCJ•uld
not be appropriate for this Court to break cycle of transfers. In
case, petitioners are aggrieved, shall be at liberty to make
representation or upload objections, if any, on MIS portal. In case
such objections are taken or already submitted, respondents are
directed to dispose of the same after affording opportunity of
hearing to petitioner within a period of one month from the date
of receipt of certified copy of this Court by passing a reasonable
speaking order in accordance with transfer policy.
With aforesaid direction, the writ petition stands
disposed of."
Whereas, the Government of Haryana has framed Teachers
Transfer Policy, 2016 dated 29.06.2016 and the same was amended
on 01.06.2017. Thereupon, transfers were made under this amended
policy of 201 7 to ensure equitable, demand based distribution of
Teachers/Heads to protect academic interests of students and
optimize job satisfactio amongst its employees in a fair · and
transparent manner. Under this policy, all government schools have
been categorized into seven zones for the purpose of transfer of
teachers and the teacher is eligible to opt any number of schools across
the zones available to him, across the districts in the State. He/She is
free to give preferences in order of his suitability. That for the purpose
of Transfer Drive, the teachers who have already completed a period of
1 year service in a particular zone may seek his/her transfer to some
other station and on the ther hand the following categories of teachers
have been asked to participate in the transfer drive compulsorily:-

a. A post of any cadre held by a teacher previously or presently
in the school education department in a regular capacity for a
period of 5 years or more on the qualifying date in the present
zone of posting, hall be taken as a deemed vacancy and such
teacher shall participate compulsorily in the transfer driv:e.
b. Teachers declared surplus from a station as a part of
rationalization/Normalization shall also participate
compulsorily in the transfer drive.
c. Teachers who have been given temporary manual posting
previously due t non-availability of online transfer drive or
technical problem or compulsion of administrative or
litigational nature.
In compliance of the orders passed by the Hon 'ble High Court an
opportunity of personal hearing was accorded to the petitioner on 21.09.2020
through video conferencing du to Covid-19 situation and the petitioner had
stated his grievances regarding transfer. Whereas, the case of the petitioner
has been examined as per the record and it was found that as per the MIS
record of petitioner Sh. Suresh Kumar (5017216), PGT Chemistry, he was
participated compulsory in General Transfer Drive of PGTs in the year of
2019, as he was temporarily posted on fresh appointment with a condition
that permanent posting will be given in the next transfer drive. Therefore, he
had participated in General Transfer Drive of PGT in year 2019. There is no
violation of Teacher's Transfer Policy, 2016 in his case of transfer/ posting, he
had obtained a score of 34.1616 and had allocated GSSS, Sahuwala-II (2846),
Nathusari Chopta, District Sir a under Anywhere in Haryana Category. The
last preferred station i.e. 65th station GSSS, Palwas, Bhiwani was allotted to
other teacher namely Raj Kala who had obtained score of 63.7233 which was
higher than the petitioner and thus, the petitioner was allocated station t under 'Anywhere in the State Category'

i In view of the position explained above, it is clear that the petitioner
I has be n transferred as per th provisions of the Teachers Transfer Policy,
2016 (as amended on 01.06.2017) and there is no substance in the claim of
the petitioner and the same is liable to be dismissed, being devoid of any
merits.

The petition was isposed of by the Hon'ble High Coui t on
17.10.2019, the operative part of the order dated 17.10.2019 is
reproduced here as under:-
"Prayer in the present writ petition is for quashing of

That in complianc of the orders passed by the Hon'ble High
Court an opportunity of personal hearing was accorded to the petitioner
on 15.10.2020 through ideo conferencing due to Covid-19 situation
and the petitioner had stated his grievances regarding transfer.
Whereas, the case of the etitioner has been examined as per the record
and it was found that a per the MIS Portal of petitioner Sh. Dinesh
Kumar (5015521), PGT Chemistry, he was compulsory participant for
General Transfer Drive of PG Ts in the year of 2019, as earlier he was
adjusted on temporary basis on his fresh appointment with a condition
that he has to take part i next transfer drive for his permanent posting.
Therefore, he had participated in General Transfer Drive of PGT in year
2019 and had filled 58 preferences, but all of his preferences were
allocated to other teachers obtaining higher points than him. He was
transferred to GSSS, Chakkan, Block Rania in District Sirsa (2821)
under 'Anywhere Category' with 32.4 767 points. The 58th station was
allocated to some other teacher namely Sh. Jitender Kumar having
56.624 7 merit points. He also took part in Grievance Redressal Drive
and got choice posting in 'Preferred School' i.e. GSSS, Suchan in
District Sirsa. Hence, th re is no violation of Teacher's Transfer Policy,
2016 in case of his transfer/ posting. The petitioner further made a
request for allowing him to participate in .the incoming transfer drive, a
general decision in this regard will be taken in accordance with the
policy.
In view of the p sition explained above, it is clear that the
petitioner has been transferred as per the provisions of the Teachers
Transfer Policy, 2016 (as amended on 01.06.2017) and there is no

substance in the claim of the petitioner and the same is liable to be
dismissed, being devoid of any merits.
