Background
On July 8 2015 Council resolved a 6-week extension to the debate and discussion on LRT to the end of August 2015 to allow for the retaining of a facilitator to assist Council
At the Special Council workshop of July 22 2015 Council discussed further the role of the facilitator and agreed to forward to the City Clerks Office no later than July 27 2015 individuals and firms to be considered in the role Council also discussed an extension from the original deadline of the end of August 2015 to September 16 2015 (next regular Council meeting) to allow a facilitation process to be completed

Stemming from the discussion at the Special Council workshop of July 22 2015 staff contacted each of the Council provided names as potential candidates for the role of facilitator The following table constitutes the list of firms or individuals provided by Council to the Clerks Office as of the July 27 deadline established by Council All suggested facilitators were contacted by telephone andor email In one case the individual could not be located As qualified at the workshop Staff did not add to the list of possible facilitators to be considered for the opportunity
Staff provided basic contextual information to the facilitator candidates including the decision by Council to engage a facilitator In the course of the conversations each were asked the following
bull Interest in taking on the role of facilitator and this assignment
bull Experience in facilitation andor arbitration-like settings
bull Availability during the months of August-October 2015
bull Are there any issues that they or their firm are aware of that that might prompt questions concerning objectivity in the role of facilitator

Should Council opt to have dialogue with any or all of the potential facilitators and assuming a formal process leading to procurement of a facilitator there are corporate and financial elements to consider
Financial and Corporate Implications
Budget and accounting
The Council approved 2015 Operating Budget did not contemplate a facilitator for this initiative hence provision was not made in the budget To capture all the costs related to the LRT facilitation two new accounts would need to be established in the Corporate Initiatives Cost Centre 0192 specifically
bull LRT Facilitation Expenses - to capture all related expenses including but not limited to facilitator costs additional resources meeting space costs meals and refreshments printing advertising etc
bull Contribution From General Rate Stabilization Reserve - to hold contributions from the
General Rate Stabilization Reserve to match all expenses incurred in the LRT Facilitation Expenses account
Since the total expenses incurred would be offset by a matching contribution from the General Rate Stabilization Reserve there would be no impact on the approved 2015 Operating Budget
Purchasing
The Citys Purchasing By-law 35-2012 requires that services such as those provided by a facilitator would normally be obtained through a competitive procurement process This would be the case in this situation should City Council short list a group of 3 or more firms from whom

Council wishes to obtain a quotation The Informal Quotation process under section 115 of the Purchasing By-law would be utilized as the estimated cost of the facilitator would be less than
the $50000 threshold that would require a more formal competitive process
Since a competitive procurement process would take time to complete and the time for completion of the facilitation process is uncertain Council could consider whether the
procurement of an LRT facilitator is an Emergency and therefore exempt from the competitive procurement requirements of Schedule B of the Purchasing By-law and deem the procurement of a LRT facilitator as an Emergency within the meaning of the By-law otherwise allowing Council to move quickly on securing a facilitator
To assist with the process to set-up of accounts and secure a facilitator the following resolutions are provided as starting points for Councils consideration

11 LRT Facilitation Expenses account to capture all related expenses including but not limited to facilitator costs meeting space costs meals and refreshments printing

2 That the Treasurer is authorized to transfer sufficient funds from the General Rate

Procuring a facilitator - Sample Resolutions
If Council wishes to proceed with an informal quotation process and subsequent Council decision the following resolution could be considered
1 That the procurement of a LRT Facilitator be through the Informal Quotation process
under section 115 of the Purchasing By-law 35-2012 by requesting quotations for services from at least 3 potential facilitators identified by City Council for City Councils
consideration
Alternatively if Council wishes to decide on a facilitator at the August 12 Council meeting the following resolution could be considered
2 That City Council deem the procurement of a LRT Facilitator to be an Emergency
procurement within the meaning of the Purchasing By-law 35-2012 and that First Name Last Name be appointed as the LRT Facilitator for City Council with an estimated upset

In either scenario and as part of the process for selection of a facilitator Council may wish to consider hearing from the candidate in person to discuss their methodology as part of the overall assessment and evaluation

candidates

I am writing with regard to the LRT issue in Brampton It is my understanding that Council will be engaging a facilitator to assist in clarifying the Brampton LRT routing issue and to assist in finding a stakeholder consensus if possible Iwould welcome an opportunity to be considered for this important assignment As you know Iam very familiar with the Brampton downtown issues and also familiar with the issues around the LRT alignment options Asa past member of the Go Transit and Metrolinx Boards Iam also familiar with the technical financial and transit policy perspectives I believe that the LRT link represents an important strategic opportunity for Brampton that can significantly improve Bramptons interregional accessibility and open new doors to future economic development for the city At the same time I appreciate many of the issues around alternative alignments and the concern about minimizing impacts and maximizing benefits Iam agnostic on which of the alternatives is best but I am confident that I can design and facilitate an open transparent and credible process for seeking consensus on what is in the best interests of Brampton

I am writing with regard to the LRT issue in Brampton It is my understanding that Council will be engaging a facilitator to assist in clarifying the Brampton LRT routing issue and to assist in finding a stakeholder consensus if possible Iwould welcome an opportunity to be considered for this important assignment As you know Iam very familiar with the Brampton downtown issues and also familiar with the issues around the LRT alignment options Asa past member of the Go Transit and Metrolinx Boards Iam also familiar with the technical financial and transit policy perspectives I believe that the LRT link represents an important strategic opportunity for Brampton that can significantly improve Bramptons interregional accessibility and open new doors to future economic development for the city At the same time I appreciate many of the issues around alternative alignments and the concern about minimizing impacts and maximizing benefits Iam agnostic on which of the alternatives is best but I am confident that I can design and facilitate an open transparent and credible process for seeking consensus on what is in the best interests of Brampton

Financial and Corporate Implications
Budget and accounting
The Council approved 2015 Operating Budget did not contemplate a facilitator for this initiative hence provision was not made in the budget To capture all the costs related to the LRT facilitation two new accounts would need to be established in the Corporate Initiatives Cost Centre 0192 specifically
bull LRT Facilitation Expenses - to capture all related expenses including but not limited to facilitator costs additional resources meeting space costs meals and refreshments printing advertising etc
bull Contribution From General Rate Stabilization Reserve - to hold contributions from the
General Rate Stabilization Reserve to match all expenses incurred in the LRT Facilitation Expenses account
Since the total expenses incurred would be offset by a matching contribution from the General Rate Stabilization Reserve there would be no impact on the approved 2015 Operating Budget
Purchasing
The Citys Purchasing By-law 35-2012 requires that services such as those provided by a facilitator would normally be obtained through a competitive procurement process This would be the case in this situation should City Council short list a group of 3 or more firms from whom

Council wishes to obtain a quotation The Informal Quotation process under section 115 of the Purchasing By-law would be utilized as the estimated cost of the facilitator would be less than
the $50000 threshold that would require a more formal competitive process
Since a competitive procurement process would take time to complete and the time for completion of the facilitation process is uncertain Council could consider whether the
procurement of an LRT facilitator is an Emergency and therefore exempt from the competitive procurement requirements of Schedule B of the Purchasing By-law and deem the procurement of a LRT facilitator as an Emergency within the meaning of the By-law otherwise allowing Council to move quickly on securing a facilitator
To assist with the process to set-up of accounts and secure a facilitator the following resolutions are provided as starting points for Councils consideration

1 That the Treasurer is authorized to create the following two new accounts in the Corporate

Conclusion

Several individuals are available and prepared to discuss further the opportunity A Council decision on how to proceed with selecting a facilitator eg RFP or Emergency procurement is required as is the establishment of timeframes for the facilitation exercise budget and approval to set-up accounts As facilitation is otherwise an intimate engagement with Council the facilitators style and methodology is important to a productive exercise Council may wish to consider including the details highlighted on Appendix A in an RFP as well as other qualifications that may prove helpful to the process such as a pre-facilitation discussion with the

I am writing with regard to the LRT issue in Brampton It is my understanding that Council will be engaging a facilitator to assist in clarifying the Brampton LRT routing issue and to assist in finding a stakeholder consensus if possible Iwould welcome an opportunity to be considered for this important assignment As you know Iam very familiar with the Brampton downtown issues and also familiar with the issues around the LRT alignment options Asa past member of the Go Transit and Metrolinx Boards Iam also familiar with the technical financial and transit policy perspectives I believe that the LRT link represents an important strategic opportunity for Brampton that can significantly improve Bramptons interregional accessibility and open new doors to future economic development for the city At the same time I appreciate many of the issues around alternative alignments and the concern about minimizing impacts and maximizing benefits Iam agnostic on which of the alternatives is best but I am confident that I can design and facilitate an open transparent and credible process for seeking consensus on what is in the best interests of Brampton

In either scenario and as part of the process for selection of a facilitator Council may wish to consider hearing from the candidate in person to discuss their methodology as part of the overall assessment and evaluation
Conclusion
The information provided in this report is intended to assist Council in its next steps concerning a facilitated process for the LRT On July 8 2015 Council resolved to retain a facilitator to
assist with their deliberations concerning the LRT project and on July 22 2015 Council discussed further the role of the facilitator as well as extending the timeframe for a complete facilitated process to September 16 2015 Council forwarded to the City Clerks Office individuals and firms to be considered in the role of facilitator whom Staff contacted to discuss
interest and availability
Several individuals are available and prepared to discuss further the opportunity A Council decision on how to proceed with selecting a facilitator eg RFP or Emergency procurement is required as is the establishment of timeframes for the facilitation exercise budget and approval to set-up accounts As facilitation is otherwise an intimate engagement with Council the facilitators style and methodology is important to a productive exercise Council may wish to consider including the details highlighted on Appendix A in an RFP as well as other qualifications that may prove helpful to the process such as a pre-facilitation discussion with the
candidates

I am writing with regard to the LRT issue in Brampton It is my understanding that Council will be engaging a facilitator to assist in clarifying the Brampton LRT routing issue and to assist in finding a stakeholder consensus if possible Iwould welcome an opportunity to be considered for this important assignment As you know Iam very familiar with the Brampton downtown issues and also familiar with the issues around the LRT alignment options Asa past member of the Go Transit and Metrolinx Boards Iam also familiar with the technical financial and transit policy perspectives I believe that the LRT link represents an important strategic opportunity for Brampton that can significantly improve Bramptons interregional accessibility and open new doors to future economic development for the city At the same time I appreciate many of the issues around alternative alignments and the concern about minimizing impacts and maximizing benefits Iam agnostic on which of the alternatives is best but I am confident that I can design and facilitate an open transparent and credible process for seeking consensus on what is in the best interests of Brampton
