The first big decision was should the two CDDs at Seven Oaks merge. On January 9, 2008 at a special workshop attended by more residents than any CDD or SOPOA meeting, Pete Williams, Rizzetta’s Director of Management and Financial Services, explained why Seven Oaks has two CDDs, how the merger would change the way the Board members are elected, what the merger would cost, what impact it would have on the Series 2001A bond for CDD I and the Series 2003A and 2004A bonds for CDD II. There were many questions at the workshop. A couple of months later at the March 12, 2008 CDD meetings, the boards approved for the staffs to take the necessary actions to merge the two CDDs. At the meeting, it was estimated by Rizzetta that it would take 12 months. When the CDD boards changed to resident controlled in November 2008, the resident CDD boards monitored the progress at each meeting. The petition to merge the two CDDs is very bureaucratic in that the county and state staffs had to review it, and the Governor and his cabinet had to approve it. In March 2009, the merger package was being delayed by one of the state offices in Tallahassee. The Board sent Rep. Weatherford an email asking for his help. Shortly after this email, the package was completed by this office and continued to move through the process. These delays were also increasing our legal cost. Since this was the first time, the state staff had numerous questions that the CDD attorney was answering. By July 2008, the estimated legal fees had more than doubled the original estimate of $20,000. The CDD boards worked closely with the attorney to keep legal fees to a minimum. For example, the attorney would monitor meetings in Tallahassee from his office rather than being there in person to answer questions. Even though the legal cost will be about three times the original estimate when the merger is completed, the total cost of the merger should be recouped in about two years. Not only did the state have many questions but as they were reviewing our petition, they decided to change the state law on July 1, 2009 while we were in the final stages of merging CDDs. When the Board process was started at the March 12, 2008 CDD meeting, the law required that if CDDs merged it would be like creating a new CDD. Therefore, new Board members would have to be elected by landowner elections for the first six years.
Many Seven Oaks residents were not in favor of this aspect of the merger. The change allowed the two CDDs to designate a surviving CDD that could continue their conversion process to the general elections. Fortunately, the law was changed just in time to take advantage of the change. For Seven Oaks, the surviving CDD will be the CDD I which has a Board consisting of residents from both CDD I and CDD II. Was it worth the effort and expense? Yes, I think so. When the Districts are merged, all of Seven Oaks will be governed by one CDD Board. This will eliminate any potential disagreement that can occur between two boards that would cause each CDD to use their attorney to resolve the issue with the residents having to pay the legal cost for both CDDs. The CDD will also realize savings in administrative expenses that is estimated to be approximately $50,000 per year. These are hard economic times. I believe this change will help keep the CDD assessments as low as possible.

Vivicon has recommended that the dead foliage stay on the woody stemmed plants and trees until mid‐March when the last threat of frost or freeze has passed. They believe this will help protect the plants from the next cold spell. They have inspected the more sensitive plants such as the ones with color. If the stems on the plants are dead to the ground, they will cut them back. Since most of these plants came back last year, we are hoping that the same occurs this year. Rizzetta believes they can provide a fairly accurate cost estimate of the damage after the end of March when it can be determined what plants will and won’t push out new growth. The Board knows the importance of the landscaping as more funds are spent on it than any other area at Seven Oaks. From the fiscal year October 1, 2008 to September 30, 2009, the two Seven Oaks CDD Boards paid over $1,000,000 to maintain the landscaping at Seven Oaks. This included about $850,000 for maintenance, $37,000 to replace dead plants, and $115,000 for mulch and fertilizer. The landscaping is a large investment for Seven Oaks. It is one of the features that makes Seven Oaks a premiere community in the Tampa Bay area. The Board is prepared to protect and insure Seven Oaks’ reputation does not change.

Cold Damage ‐ Why Wait To Clean Up?

As you are probably aware the severe cold has caused
some damage to your landscaping. Some plants show the damage immediately; others may look undamaged for now but will not grow in the spring because the bark/cambium layer has been damaged. We have seen this problem in the past specifically with, but not limited to Viburnum, Ligustrum, and Azaleas. The recommended clean up procedure is to let the dead foliage stay on the plants and trees until the last threat of frost or freeze has passed (i.e. early to mid‐March). This dead foliage may help to protect (blanket) any viable plant tissue from the next cold spell. There is a very good chance we will get more cold weather before spring so as you look out your window and are disappointed by the condition of your property, be thankful for the protection it will bring should we experience another frost/freeze. Some of the more sensitive plants (generally the ones with color) such as Hibiscus, Duranta, Arboricola, Downy Jasmine, Firebush, and Plumbago, etc. may be killed to the ground. You will not know what plants survived until spring, so avoid being too quick to dig up plants that look dead. Some of my Hibiscus I cut to the ground in 2009 did not sprout new growth until May. Last year, most of these plants did come back. However, this recent cold spell was much different then last year. In the twenty five years I‘ve lived in Tampa I cannot recall this many consecutive below freezing days. Plants that were already stressed from insect or disease will have a difficult time rebounding. Recently installed plants may also struggle, but your more mature plants will have a better chance of surviving the cold damage due to the ample supply of stored energy in their established root systems. Be very careful not to over irrigate your landscaping during the recovery time. Use your finger to check the soil. If it is moist, do not run your irrigation. The over watering will only promote root rot and further weaken your plants. I have had my irrigation off since early November. Recent rain storms have been providing enough water for the landscape. Be cautious of relying on the rain sensor connected to your irrigation system to determine the watering needs of your landscape. Once a predetermined amount of rain is collected, the sensor will temporarily shut down the timer however, this sensor does not know the moisture level in the soil. The problem with rain sensors this time of year is they will dry out much faster than the soil thus permitting your automatic irrigation system to water even when it is not needed. Save water and your plants by shutting off your timer for the next few months and use your finger to monitor soil moisture. As the days get longer, the temperatures increase, and the landscape requires more water, you should then return to using your automatic irrigation system. Your turf (St. Augustine , Bahia, Bermuda , Paspalum) that was exposed (not under trees) to the frost/freeze will turn brown. The St. Augustine turf will be the first to green up. On a more positive note, the severe cold may help reduce/control some insect pests this year…lets hope so!

This is my first article for the CDD Newsletter. If most of you do not cancel your subscriptions after reading this article, I’ll probably try to do one for every issue. I think that I should talk today about gate codes. It doesn’t have the same pizzazz as deed restrictions, late fees or other things that the SOPOA Board is doing to restrict our “freedom”. (Being on the SOPOA board, I get to hear that a lot.) However, gate codes are important to those of us in gated communities and also to those in un‐gated communities. Before you think I’ve “gone round the bend”, let me explain. Gate Codes are part of the overall security of our total Seven Oaks development. They, along with neighborhood watches and the Seven Oaks Crime Watch Patrol, all play a role in keeping our neighborhood safer. If you live in a gated community, NEVER give out your individual gate codes to friends, vendors, visitors, etc. Also, if you have teenagers, please instruct them NOT to give out the code to their friends because that’s like broadcasting your security code to at least half of the known world. We’ve just eliminated many of the “Common” codes that were in use. We’re being very careful to give codes only to those with a legitimate need for them. (That does not include the ice cream man or the “Laker” delivery person, etc.) We are not trying to restrain trade or prevent people from making a living, we are trying to keep our neighborhood safe. We are doing a better job of monitoring what codes are used and the frequency. We will be able to spot codes that have become “widespread” and as such, will be able to change them when needed. And we will! It’s all part of an attitude that says, I’m going to watch out for my home, my family and my neighbors. I think we all need to take our security more seriously and not giving out gate codes is just one way of doing that.

Notice of Access Card Change Owners vs. Renters
As of December 9th, 2009, the CDD Board approved that homeowners and commercial building owners can relinquish their clubhouse facility rights to their tenants. Before your tenant can obtain an access card, the homeowner or the commercial building owner must fill out and sign a Seven Oaks Access Card Relinquish Form. This form can be found on the official Seven Oaks website @ www.MySevenOaks.com. Click on the clubhouse tab and then click on the access card tab where you will find the Seven Oaks Access Card Relinquish Form. You may either fax this form to the clubhouse managers @ 813‐907‐0660 or email the clubhouse managers with the attachment @ [email protected] .

We follow the Pasco County School calendar, so after spring break ends on April 11th, the slide will be open on Saturdays and Sundays only until schools ends for summer break on June 9th, 2010.
