HOUSING / SERVICES AGREEMENT
THIS HOUSING / SERVICES AGREEMENT is made by and between
__________________________ (“Project Owner”) with an office located at
_____________________________________________, and (“Support Agency”) with an office
located at _______________________________.
Project Owner and Support Agency agree as follows:
1) Performance under this Agreement shall commence on _____________________(date)
and shall not be terminated unless terminated in accordance with the terms of this
Agreement.
2) Support Agency shall be the support/service provider for persons with/who
are_________________________________________________ (specific population of
residents with Special Needs [SN]) citizens of the Project.
3) ___( ) (number) housing units located at ______________________________
(“Project” street address), Village of _________________ , Town of _______________,
_______________ County, State of New York shall be made available to eligible
residents referred by Support Agency subject to the Project’s Marketing Plan as approved
by the New York State Homes and Community Renewal (“HCR”).
4) Support Agency shall provide support services to Special Needs Residents to enable
independent living to the greatest extent possible. Services provided to Residents in the
Project with Special Needs are listed in Attachment A to this Agreement.
5) Project Owner, its designees and Support Agency shall, as required by applicable law and
regulations, maintain the confidentiality of information relating to Residents with Special
Needs.
6) Project Owner shall provide Support Agency with income eligibility criteria for residency
in the Project.
7) Referrals from Support Agency shall have priority for units until at least ____( ) units
are occupied by Residents with Special Needs (named in #2 above). Out of these
referrals, priority shall be given to such persons with Special Needs who have served in
the armed services of the United States for a period of at least six months (or any shorter
period due to injury incurred in such service) and have been thereafter discharged or
released from the armed forces under conditions other than dishonorable.
8) Performance under this Agreement will comply with Title VIII of the Federal Civil
Rights Act of 1968, also referred to as the “Fair Housing Act”, Section 504 of the Federal
Rehabilitation Act of 1973, the Human Rights Laws of the State of New York, and all
other applicable laws and regulations.
9) Residents with Special Needs who reside in the Project shall:
a. Have the same services and accommodations as other residents.
b. Be governed by the same rules and regulations governing occupancy of the
Project as other residents.
c. Pay the same rent as other residents of comparable units.

d. Reside in units that are not segregated or identified as special needs units and are
comparable to units available to other residents.
10) For initial occupancy:
a. Project Owner or its designee shall notify Support Agency in writing of the
number of available special needs units, including the unit size, accessibility,
monthly rent and estimated utilities, income necessary for the rent/utilities
payment, the income eligibility guidelines, and the date of availability for
occupancy.
b. Support Agency shall identify, screen and refer potential Residents with Special
Needs to the Project Owner or its designee.
c. If a potential Resident with Special Needs referred by Support Agency is
rejected, Project Owner or its designee shall notify Support Agency in writing of
the reason(s) for the rejection.
d. If after two (2) months, an insufficient number of eligible Residents with Special
Needs has been referred to and selected by Project Owner or its designee, Project
Owner or its designee will attempt to identify and notify in writing any other
support/service providers in the community of the availability of units for
persons with special needs and HCR’s Office of Finance and Development.
e. Potential Residents with Special Needs shall be referred on a first-come, first-
served basis.
11) After initial rent-up of the Project, Support Agency shall have the option to provide the
payment of the rent to hold a unit, for a period not to exceed three (3) months, while an
eligible tenant is not in occupancy.
12) When a unit becomes vacant during the operation of the Project:
a. Project Owner or its designee will notify Support Agency in writing of each
available unit for residents with special needs, including the unit size,
accessibility, monthly rent and estimated utilities, the income necessary for the
rent/utilities payment, the income eligibility guidelines, and the date of
availability for occupancy.
b. Within ten (10) business days of such notification, Support Agency shall identify,
screen and refer potential Residents with Special Needs to Project Owner or its
designee.
c. If a potential Resident with Special Needs referred by Support Agency is
rejected, Project Owner or its designee shall notify Support Agency in writing of
the reason(s) for the rejection.
d. If after ten (10) business days, an insufficient number of eligible Residents with
Special Needs has been referred to and selected by Project Owner or its designee,
Project Owner or its designee will attempt to identify and notify in writing HCR
Office of Finance and Development and any other support/service providers in
the community of the availability of units for persons with special needs.
e. Potential Residents with Special Needs shall be referred on a first-come, first-
served basis.

13) Support Agency shall maintain a waiting list of potential Residents with Special Needs.
14) Support Agency shall provide information upon request by Project Owner or its designee
to fulfill reporting and monitoring requirements of the funding source(s) of the Project.
15) Support Agency shall provide Project Owner with the name and telephone number of a
Support Agency representative who will be available in the event of an emergency.
16) Support Agency shall notify Project Owner in writing, within five (5) business days of
occurrence, of any event which may significantly impact the capacity of a Resident with
Special Needs to reside in the Project and shall make recommendations for assisting the
Resident.
17) If a Resident with Special Needs materially violates the terms of the lease or the rules and
regulations of the Project:
a. Project Owner or its designee will notify the Support Agency of the violations in
writing.
b. Prior to commencement of eviction proceedings, Project Owner or its designee
will consult with Support Agency regarding the reason(s) for such possible
eviction.
c. Project Owner shall have the final decision regarding the continued occupancy of
Residents with Special Needs with respect to such violation in accordance with
the procedures for all residents.
18) Services provided under this Agreement may not be diminished nor may this Agreement
be changed, terminated or modified orally or in any manner unless both parties hereto
and the New York State Homes and Community Renewal consent in writing, which
consent will not be unreasonably withheld or delayed.

may include, but will not be limited to the following:

Davis-Bacon and Related Acts & Federal Labor Standards Applicants should be aware that Davis-Bacon and Related Acts apply to the construction of projects which will have:
• HOME funding of twelve (12) or more units; or • Nine (9) or more Project Based Vouchers.
All projects that are subject to Davis-Bacon must schedule a preconstruction conference with HCR. It is important that this preconstruction conference occur prior to the Agreement between the Owner and Contractor (Owner/GC agreement). Below are links to HUD’s Office of Labor Relations and DOL. Applicants proposing projects that are subject to Davis-Bacon are strongly encouraged to read and understand the information presented on these webpages. Project Based Voucher Program Initiative (PBV) As authorized by program regulations at 24 CFR 983, HCR plan to offer up to 100 units of Project Based Voucher (PBV) assistance for proposed projects financed through the HTF, LIHC, SLIHC and/or HOME programs as well as for proposed projects financed in conjunction with the USDA Rural Development Section 515 Program. A complete description of all applicable program regulations can be found within the Electronic Code of Federal regulations at: http://ecfr.gpoaccess.gov Developers interested in being considered for PBV assistance should fully review program regulations prior to making application in order to ensure that their proposed project is consistent with all terms and provisions of those regulations. Applicants are advised to carefully examine the subsidy layering review guidelines relative to PBV assistance issued by HUD in its notice of July 9, 2010. These guidelines establish certain development and operations standards that must be adhered to by projects receiving PBVs, including limits on builder’s fees, developer’s fee, and project cash flow. Applicants are invited to submit proposals for the use of PBVs in connection with the rehabilitation or construction of rental units in only those local program areas serviced by HCR’s Section 8 Voucher Program and its network of Local Administrators. All areas in New York State are serviced by HCR’s Section 8 Voucher Program except in the following counties: Albany, Broome, Cortland, Erie, Fulton, Monroe, Montgomery, Onondaga, Rensselaer, Schenectady, Schoharie and Warren. Applications requesting project based assistance only will not be accepted. Requests for PBV assistance must be accompanied by a request for assistance from one of the programs included in this funding round.
a. Basic Requirements:
Only applications submitted in response to this RFP will be considered for this funding. Applications requiring permanent relocation of current tenants will not be eligible.
HCR requires all applicants seeking PBVs to provide information on the degree to which PBVs enable a project to serve a lower income population than the project would otherwise be capable of serving absent the PBVs. A detailed description of the impact PBVs will have on the population served must be provided in an application seeking PBV assistance. The description must be provided in Attachment F9- Proposal Summary as part of the response to the question of what public purpose is served by the project and who the project beneficiaries will be.
Regulations generally limit PBV assistance to no more than 25% of the units in each building (when the project contains multiple buildings). Projects serving persons who are elderly (62 years or older), persons with disabilities or families receiving supportive services generally equivalent to HUD “Family Self-Sufficiency” programming may be allowed to exceed the 25% per building cap. Davis-Bacon wage rates apply to any project with nine or more units of project based assistance. Housing Choice Voucher Program (HCV)
HCR's Section 8 Housing Choice Voucher (HCV) Program provides rental assistance and home ownership option to extremely low, very low and low income households in New York State. The program also provides assistance to senior citizens and disabled persons on fixed incomes, displaced families, and homeless individuals with disabilities.
One goal of the HCV Program is to enable eligible households to rent or purchase decent, safe and sanitary housing in the private housing market. After a voucher is issued it remains with the family or individual as long as they remain eligible, even if they change residence. The dollar amount of HCV Program Housing Assistance Payments will vary depending on the income of the family or individual and the approved rent/mortgage for the unit.
Another facet of the HCV Program is the home ownership option available to current participating families. The voucher assistance is available and being used by current participants, who meet the home ownership eligibility requirements, toward mortgage payments to purchase a home. The HCR local administrators have programs to empower interested families with readiness for and assistance with home ownership.
Families interested in applying for the HCV Program must obtain an application from the local Public Housing Authority (PHA). In New York City, HCR operates the HCV Program through its Subsidy Services Bureau.
The New York City Housing Authority (NYCHA) and the New York City Department of Housing Preservation and Development (HPD) also operate HCV Programs in New York City. HCR's Statewide HCV Program administers the HCV Program in other areas of NYS via a network of Local Administrators.
In Westchester County, HCR also operates a model housing counseling and mobility program through the Enhanced Section 8 Outreach Program (ESOP). The goal of this special-purpose program is to assist HCV applicants and participants secure housing in racially and economically diverse neighborhoods. HCR plans to expand the counseling and mobility services to other local HCV Program jurisdictions.
Once a completed application is submitted and the applicant is determined to be eligible, the applicant is placed on a waiting list. When a subsidy becomes available, the household is issued a Housing Choice Voucher. The voucher certifies that the applicant is eligible for the HCV Program and also specifies, based on the number or people in the family, the size of the unit the family is authorized for. Among other requirements, the family must participate in the program for a minimum of 12 months before it is deemed eligible for the home ownership option.
The regulations for the HCV Program are set by the U.S. Department of Housing and Urban Development (HUD). Households must meet eligibility requirements and the apartment to be subsidized must meet federal Housing Quality Standards (HQS). The unit must pass the HQS inspection before the PHA can approve monthly Housing Assistance Payments. HCV Housing Assistance Payments are sent directly to participating owners or authorized managing agents.
