Published Primary Sources on Colonial South Asian Legal History

Overview: This list identifies a set of materials that, while often rare, are more accessible than unpublished,
archival sources. It is divided into three sections: (1) legislation, (2) case digests, (3) law reports and
journals. Each section begins with a short note discussing features and issues specific to the source type.
While the list includes most major titles, it is not exhaustive. In many instances, I have provided a date
range (see note on dates, below), court, and publication information . However, this information is not
available for all of the titles listed. The list is therefore somewhat uneven in its coverage. All titles are in
English, unless otherwise indicated. Square brackets indicate editorial additions by cataloguers or me. This
list complements my "Research Guide to Case Law."
Availability: Many of the titles listed are rare books, with only a handful of known copies in existence. In
addition to using current library catalogues to compile this list, I have drawn upon library lists (see “Colonia l
Law Library” tab) and bibliographies produced during the colonial period itself. As a result, no known copies
may exist of certain titles. If you are unable to locate certain titles on Worldcat or the British Library‟s
integrated catalogue, it is likely that there are no known copies of the book remaining—at least in the
western world. Copies may still exist in libraries, private collections, and used bookstores in South Asia, but
it will be harder to locate them.
Dates & editions: Many date ranges on this list come from Barada d‟As Bose‟s Digest of Indian Law
Cases (1912) ); W. Harold Maxwell and C. R. Brown‟s A Complete List of British and Colonial Law Reports
and Legal Periodicals (orig. pub. 1937); and K. P. Saksena‟s Muslim Law as administered in British India
(1938). Alternatively, date ranges may reflect the holdings of the Bombay law firm, Wadia Ghandy & Co.
circa 1911 (see “Colonial Law Library" tab); or owned by various libraries in the US, UK or India. For
serials, an open date run (e.g. All India Criminal Reports, 1924-) indicates that the publication continued at
least until 1947-8. 1947-8 is the end date for this list because it marks the end of British rule in South Asia.
Finally, there may be multiple editions of some of the titles listed. Check Worldcat or the British Library‟s
integrated catalogue for information on other editions.
1. Legislation
Overview: There are three types of publications in which colonial legislation appeared:

(i) Yearly state-printed volumes of legislation: In chronological order, these periodicals reproduced the
text of every piece of legislation passed by a particular legislature or organ of government, whether at the
imperial, all-India, presidency, or local level. For instance, see from the list below India (Governor-General),
A Collection of the Acts Passed by the Governor General of India in Council and the Government of India
Reforms Office, The Unrepealed Central Acts. At the British Library, see IOR series V/8. An impressive
array of these publications are available online through LLMC Digital (by subscription only). For a useful
explanation of English statute collections, see this guide.
(ii) Compilations of legislation published as individual books or sets of books: Major Acts were also
reproduced in books intended for reference use by lawyers, judges and colonial administrators. For
instance, see from the list below Agarwala‟s The Lawyers’ Vade Mecum and Cranenburgh‟s New Civil
Court Manual.
(iii) Treatises or textbooks on particular areas of law:These titles usually included the text of relevant
major legislation, whether throughout the text (accompanied by commentary and related case law) or as an
appendix. The legislation included was often part of the book‟s title, for example, J. P. Bhatnagar‟s Law and
Practice relating to the Opium Act 1878. The list below does not include this type of source. The best way
to identify relevant legal treatises or textbooks is to search a catalogue like the British Library‟s catalogue,
or Worldcat, for the name of the Act or area of law, both of which were often part of the book‟s title. For a

Format: In the English legal tradition, “Act” is capitalized both as part of the name of a statute (Madras
Panchayats Act), and when not being referred to as part of a proper name (e.g. the Act was controversial).
Acts are referred to by their name and date, and initially, with their number and year [e.g. Bengal Indigo
Contracts Act (X of 1836)]. Sections and sub-sections of legislation may be referred to thus: Parsi Marriage
and Divorce Act 1936, s.32(b)ii.
Online databases: Although legal websites like Indlaw or Manupatra (by subscription) offer the text of
many statutes that were passed during the colonial period, they offer versions of legislation as valid in
Indian law today. There have been amendments made to many colonial Acts, while others have been
repealed entirely, so beware when using online services as a shortcut: they will not necessarily provide you
with colonial legislation in accurate historical form.

2. Case Digests
Overview: Digests of case law contain potted summaries of leading cases over a particular time period in
one or several jurisdictions. Unlike law reports, which are organized by jurisdiction and year, these
summaries are organized by topic alphabetically (e.g. Co-widows, Probate). The asterix (*) indicates
digests that cover exclusively cases that were appealed to the Judicial Committee of the Privy Council
(JCPC) in London. Privy Council cases are included in many other law report series below (i.e. all of the
Indian Law Report series). However, only JCPC cases coming from a particular jurisdiction will be included
in a law report series covering that jurisdiction alone (i.e. only JCPC cases from Bombay presidency will be
reported in the ILR Bom law reports). If you want to find Privy Council cases from across South Asia, or
even the British Empire, use the sources marked with a *. On linking case digests to law reports, and law
reports to unpublished records like case papers and judgment notebooks, see my “Research Guide to

3. Law Reports and Law Journals
Overview: Law reports are volumes of published judgments, organized first by jurisdiction (typically, by
presidency or province), and then by year. Although some law journals contained only articles, most
included a mixture of reported case law and articles. I have grouped these two types of sources together
because of this common overlap. For the titles of articles in many law journals, see my "Colonial Law
Journals" tab. On using case digests as a way of finding relevant case law in the law reports, see my
“Research Guide to Case Law." For a list of standard abbreviations used when citing colonial case law, see
“Citation Abbreviations" tab.
General availability: In part, this section draws upon W. Harold Maxwell and C. R. Brown‟s British Colonial
Law Reports and Legal Periodicals (orig. pub. 1937). The Maxwell and Brown list of South Asian legal
periodicals includes many rare and obscure titles. In some cases, no known copies exist today. In others
(noted below), titles may have been listed in a prospectus, but may not ultimately have been produced.
After 1875, the most common and best established law report series were: (1) the Indian Law Reports (the
official law reports; see my “Research Guide to Case Law”); (2) the All India Reports; and (3) Indian Cases
(“the best unofficial series,” according to Maxwell and Brown). For the pre-1876 period, Moore’s Indian
Appeals and the Indian Decisions, along with various forms of the Sudder Diwani Adawlut Reports and
High Court Reports are generally the easiest to find.
Electronic availability: At present, very few of these sources are available electronically, but the situation
is changing. Heinonline and LLMC Digital are making some of these sources available online (by
subscription only). Other sources like Google Books and the Sri Lankan government‟s LawNet website
make selected colonial South Asian law reports available for free.
Spelling: South Asian words were transliterated into the Latin alphabet in a variety of ways, especially in
the early colonial period. In particular, the civil court known as the Sudder Dewanny Adawlut was
occasionally spelled Sadr Dewani Adalat or Sudder Dewanee Adalut. The criminal court known as the
Sudder Foujdaree Adawlut was also spelled Sudder Foujdaree Udalut or Sadr Faujdari Adalat. Try multiple
spellings when searching catalogues like Worldcat for serials with these names in their titles
