(CVD) was retained by J. Lammer Developments Limited, to complete a Phase I Environmental Site Assessment (ESA) on the property located at 75 Dublin Street North in Guelph, Ontario (hereinafter referred to as the "Site"). The purpose of the Phase I ESA is to evaluate the environmental conditions of the Site and adjacent properties and to identify actual or potential sources of contamination associated with the subject property and surrounding properties. The Phase I ESA is part of the due diligence to support the development of the Site. It is understood that a Record of Site Condition (RSC) is not intended for the property at this time. The Site is a rectangular-shaped property that is located on the northeast corner of Dublin Street North and Cork Street West in an area of institutional, residential and office/commercial land uses. The property was formally a tennis court (former Church of Our Lady Tennis Club) that was part of the adjacent Basilica of Our Lady Immaculate. According to available research resources, the Church of Our Lady Tennis Club was founded over 100 years ago. The original courts were located south of the church however, due to expansion of the church parking lot they were relocated in the early 1930s to vacant church owned land at the northeast corner of Dublin Street North and Cork Street West. The Church of Our Lady Tennis Club operated on the Site until 2011. The findings of the Phase I ESA did not identify any actual or potential sources of contamination on the Site or surrounding properties. It is CVD's professional opinion that the potential for significant environmental liabilities associated with the Site under investigation is low, and that no further investigations are required at this time. This opinion is based on the following:
The Site does not appear to have ever been used for any land use that may produce, store, or dispose of environmentally hazardous materials.
The neighbouring properties adjacent to the Site are not expected to pose an environmental
concern for the Site. Based on inferred down-gradient and trans-gradient locations as well as separation distance, the identified surrounding land uses are not considered to be an environmental liability to the Site at this time.
A Phase I ESA and a Phase II ESA were completed for the Site by CVD in 2012. The findings and
conclusions of the Phase II ESA investigation documented minor exceedances of the applicable MOECC Table 2 standards of petroleum hydrocarbons (PHC F3 and F4) and lead in a localized area of fill material identified on the northeast corner of the former tennis courts.

2.1 Phase I Property Information Chung and Vander Doelen Engineering Ltd. (CVD) was retained by J. Lammer Developments Limited, to complete a Phase I Environmental Site Assessment (ESA) on the property located at 75 Dublin Street North in Guelph, Ontario (hereinafter referred to as the "Site"). The purpose of the Phase I ESA is to evaluate the environmental conditions of the Site and adjacent properties and to identify actual or potential sources of contamination associated with the subject property and surrounding properties. The Phase I ESA is part of the due diligence to support the development of the Site. It is understood that a Record of Site Condition (RSC) is not intended for the property at this time. The Site is a rectangular-shaped property that is located on the northeast corner of Dublin Street North and Cork Street West in an area of institutional, residential and office/commercial land uses. The property was formally a tennis court (former Church of Our Lady Tennis Club) that was part of the adjacent Basilica of Our Lady Immaculate. Appendix A shows the location of the Site. A Site Plan is provided in Appendix B. 3.0 SCOPE OF THE INVESTIGATION A Phase I Environmental Site Assessment is a thorough review of all activities that may have impacted the Site from an environmental standpoint. CVD conducted this Phase I Environmental Site Assessment in general accordance with the amended Ontario Regulation 153/04. This report also conforms to Canadian Standards Association (CSA) Z768-01 (R2012). The above-noted procedures set standards for review of information pertaining to the Site, development of detailed checklists or protocols, conducting the Site inspection, and preparation of the final report. This report will not satisfy all of the necessary requirements for filing a Record of Site Condition under the amended Ontario Regulation 153/04. The scope of work for the Phase I ESA consisted of the following tasks:
Review the historical occupancy of the Site, through the use of available archived municipal and business directories, fire insurance plans, and aerial photographs;
Review of previous environmental reports;
Review the current use of the Site and the practices that may have impacted the environmental condition of the Site;

Review the current use of the surrounding properties and practices that may have impacted the environmental condition of the Site;
Conduct a Site visit to identify the presence of environmental contaminants and concerns;
Contact government agencies to request information for the Site, regarding environmental regulatory registration or non-compliance. Review any such information where available;
Prepare a report of findings and conclusions.
CVD relies on information received from all parties as accurate, unless contradicted by field observations or written documentation.
4.0 RECORDS REVIEW
4.1 General Available information sources including regulatory data-bases were assessed in an effort to gain information related to past Site activities, and to address potential environmental issues that may be present at, or in the vicinity of the Site.
4.1.1 Phase I Study Area Determination A review of the documents listed in Section 4.0 indicates that there are no significant concerns with any properties outside a 250 m radius of the Site that would be considered of environmental liability. The study area for the Phase I ESA is therefore determined to be within a 250 m radius of the Site.
4.1.2 Site History According to available research resources, the Church of Our Lady Tennis Club was founded over 100 years ago. The original courts were located south of the church however, due to expansion of the church parking lot they were relocated in the early 1930s to vacant church owned land at the northeast corner of Dublin Street North and Cork Street West. The Church of Our Lady Tennis Club operated on the Site until 2011. Aerial photographs from 1933 to 2010 show tennis courts on the Site.
4.1.3 Fire Insurance Plans Fire Insurance Plans (FIP) from 1907 and 1960 were reviewed at the City of Guelph Public Library. The 1907 fire insurance plan (FIP) shows that a residential structure is either located on the Site or in close proximity to the Site. The 1960 fire insurance plan (FIP) shows a tennis court on the property.

In the 1960 FIP, a credit union and Our Lady Parish is shown adjacent to the east.
4.1.4 Previous Environmental Reports A Phase I ESA was completed for the Site by CVD in September, 2012. The findings and conclusions of the investigation are documented in the following report:

The findings of the Phase I ESA are summarized as follows:
The Church of Our Lady Tennis Club was founded over 100 years ago and has maintained tennis courts on this Site since the early 1930s. The Church of Our Lady Tennis Club operated on the Site until 2011.
The existing neighbouring properties adjacent to the Site are not expected to pose an environmental concern for the Site. Based on inferred down-gradient and trans-gradient locations as well as separation distance, the identified surrounding land uses are not expected to pose a significant environmental concern to the Site.
Based on observations, it is anticipated that fill of unknown origin was imported onto the Site during development of the tennis courts to level the grade along the north and east sides of the property. Fill of unknown origin is a potential environmental liability to the Site which warrants further evaluation (Phase II ESA).
A Phase II ESA was completed for the Site by CVD in November, 2012. The findings and conclusions of the investigation are documented in the following report:
Phase II Environmental Site Assessment, 75 Dublin Street North, Guelph, Ontario dated November 30, 2012.
The overall findings of the Phase II ESA concluded the following:
A total of seven (7) boreholes (BH1 to BH7) were advanced on the Site to characterize the underlying soil and groundwater conditions. A monitoring well was installed in four (4) of the seven (7) boreholes (BH1 to BH4).
A soil sample from fill material (0.00-2.60 m) identified in BH2 located at the northeast corner of the Site had petroleum hydrocarbon parameters PHCs F3 and F4 that were above the applicable MOECC Table 2 regulatory standards. PHCs in soil samples from all other borehole locations met the applicable MOECC Table 2 regulatory standards.

A soil sample from fill material (0.00-2.60 m) identified in BH6 located at the northeast corner of the Site had a metals (lead) concentration that was above the applicable MOECC Table 2 regulatory standard. Metals in soil samples from all other borehole locations met the applicable MOECC Table 2 regulatory standards.
The analytical results of the ground water samples selected for analysis from the monitoring
wells indicate that all analyzed VOC, PHC F1-F4, and metals parameters were either not detected or were below the applicable Table 2 regulatory standards.
4.2 Environmental Source Information
A summary of information obtained from available resource documents and from regulatory agency databases is provided as follows. A copy of all correspondence is included in Appendix E. Coal Gasification Plants According to the Intera Technologies Ltd. document entitled Inventory of Coal Gasification Plant Waste Sites in Ontario, dated April 1987, there are no coal tar sites located within 250 m of the Site. PCB Storage Sites A review of the Ministry of the Environment and Climate Change (MOECC) document entitled Ontario Inventory of Approved PCB Storage Sites, September 1988, indicates that no PCB containing properties are within 250 m of the Site. The Technical Standards and Safety Authority (TSSA), Fuels Safety Division (FSD) A Customer Service Advisor at TSSA was contacted to determine if any aboveground or underground storage tanks (ASTs or USTs) were listed in its database for the subject property. The TSSA indicated that there are no registered fuel tanks on the Site. A copy of the TSSA correspondence is included in Appendix E. Ministry of the Environment and Climate Change (MOECC) A FOI request was submitted to the MOECC for information regarding any environmental concerns, orders, spills, investigations/prosecutions, Waste Generator Numbers/Classes and Certificates of Approval related to the Site. However, it can take several weeks to receive a response from the MOECC. At the time of writing this report, we have not yet received a response to this request. Any relevant information received from the MOECC will be forwarded as an addendum to this report. The FOI request is included in Appendix E.

Lammer Developments Limited October 4, 2016 Phase I Environmental Site Assessment File No.: E16311 75 Dublin Street North, Guelph, Ontario Page 6 Waste Disposal Inventory A review of the MOECC document entitled Waste Disposal Site Inventory, June 1991, indicates that there are no closed or active landfill sites located within 250 m of the Site. Ecolog Eris A request was made to Ecolog Eris for a standard select report for the Site. The standard select report provides historical environmental information for the subject property and lands surrounding the Site within a 250 m radius. Selected federal, provincial and private sector databases are researched to identify potential environmental concerns. The standard select report is used to aid in the identification of possible environmental risk factors for commercial, industrial and residential sites. The standard select report dated October 3rd 2016 did not provide any listings for the Site that would have the potential to be an environmental liability to the Site. The Site was not listed in any of the databases selected. The report did identify the following for properties within a 250 m radius of the Site:
According to the Commercial Fuel Oil Tanks database, a 500 gallon, steel fuel storage tank is
located at 21 Paisley Street (approximately 160 m north of the Site). A 5072 litre fuel storage tank is listed at 20 Cork Street (approximately 250 m east of the Site). Based on separation distance, CVD does not anticipate that abovementioned fuel storage tanks are an environmental concern to the Site.
A total of forty (40) Ontario Regulation 347 waste generators were identified on properties
within a 250 m radius of the Site. A review of the wastes generated and properties listed did not reveal any that would pose a significant environmental liability to the Site at this time.
According to Ontario Spills, a release of natural gas was reported at the intersection of Cork Street and Dublin Street in July, 2005. Based on the nature of the spill (atmospheric release), CVD does not anticipate any environmental impact to the Site.
A total of ten (10) spills have been reported to Ontario Spills within a 250 m radius of the Site. A review of the spills did not reveal any that would have the potential to impact on the environmental integrity of the property. A copy of the Ecolog Eris Standard Report is included in Appendix F.
City Directories Vernons City of Guelph directories for the years 1917 to 2012 were reviewed at the City of Guelph Public Library. Later directories (1990-2012) do not list the Site. Early directories list the property as Church of Our Lady Tennis Court. No address is associated with the property in the early city directories. The Site was not listed in the 1917 directory.

4.3.1 Aerial Photographs Aerial photographs for the years 1955, 1978, 2000 and 2010 located at the University of Waterloo Geospatial Centre, in Waterloo, Ontario were reviewed. Observations of the Site and surrounding properties are outlined in the following table. Aerial photographs are enclosed in Appendix C.

1955 A tennis court appears on the Site. Central Public School is shown adjacent to the north of the Site. Church of Our Lady is shown to the south. Residential development is shown to the west. Commercial and residential is shown to the east.
1978 No significant changes on the Site or surrounding properties.
2000 No significant changes on the Site or surrounding properties.
2010 No significant changes on the Site. A school formerly located at the southwest corner of Norfolk Street and Cork Street East no longer appears.
4.3.2 Topography, Hydrology, Geology According to the Map 2556 entitled Quaternary Geology of Ontario published by the Ministry of Northern Development and Mines, the subject property is located in a physiographic area that consists primarily of Port Stanley till. According to Map 2544, Bedrock Geology of Southern Ontario, Southern Sheet, the bedrock in the area generally consists of dolomite of the Guelph Formation. The nearest significant surficial body of water is the Speed River, located approximately 870 m east of the Site. The property is situated at a topographic high point. Topography slopes down from the Site in all directions. However, it is anticipated that the shallow direction of ground water flow is towards the Speed River to the east.
4.3.3 Fill Materials Fill material composition and source location are considerations in determining whether environmental concerns are present. Importation of fill of unknown quality is identified as a potential contaminating activity within Ontario Regulation 153/04.

The property is topographically higher than properties located to the north and east of the Site. A retaining wall extends along the east property boundary and a steep embankment slopes towards Central Public School to the north. It is anticipated that fill of unknown origin was imported during development of the tennis courts to level the grade along the north and east sides of the property.
4.3.4 Water Bodies and Areas of Natural Significance There are no significant water bodies or areas of natural significance in close proximity (250 m) of the Site. The Speed River is located approximately 875 m east of the Site. It is anticipated that shallow ground water flow is towards the Speed River.
4.4 Site Operating Records There were no Site operation records for review during the Phase I ESA.
5.0 INTERVIEWS CVD did not conduct any interviews during the Phase I ESA. Information provided by the previous Phase I ESA is consistent with the information provided by and gathered from the authorities and databases outlined in Section 4.2 of this report.
SITE RECONNAISSANCE
6.1 General Requirements An assessment of the Site was completed by a representative of CVD, on September 30, 2016. A complete walkover of the Site and surrounding properties was conducted at this time. Based on current and historical land uses on the Site, in accordance with the amended Ontario Regulation 153/04, the Site is not considered to be an enhanced investigation property.
6.2 Specific Observations at Phase I Property The Site was historically a tennis court with a storage shed that was located at the southwest corner of the property. Several temporary wooden structures have been constructed on the tennis court for a Halloween theme based charity event. A chain link fence extends along the perimeter of the property. Light standards providing illumination extend along the perimeter of the property.

Lammer Developments Limited October 4, 2016 Phase I Environmental Site Assessment File No.: E16311 75 Dublin Street North, Guelph, Ontario Page 9 Underground and Aboveground Storage Tanks Inspections and interviews were conducted to assess the presence/absence and condition (if present) of underground storage tanks (USTs) & aboveground storage tanks (ASTs) at the Site. CVD did not find any correspondence to support the current or past use of USTs/ASTs at the Site and did not observe any evidence of USTs or ASTs during the Site reconnaissance. CVD contacted the TSSA, Fuels Safety Division (FSD), to determine if any registered fuel outlets were listed in its database for the Site. A representative of the TSSA indicated that no storage tanks were registered with the TSSA and that there were no issues identified with the property. Chemical Inventory, Storage and Handling CVD did not observe any signs of chemical storage or handling practices on the Site that has the potential to impair the Site and none are expected. According to available information, chemicals have not been historically, used, generated or stored on-Site. Solid and Liquid Waste Generation and Disposal There are no solid or liquid wastes generated or stored on the Site. According to available resources, solid and liquid wastes have not been historically generated or stored on Site. Designated Substances In Ontario, the Occupational Health and Safety Act has a list of nearly a dozen substances have been classified as "designated substances" largely in response to their harmful characteristics. Asbestos Containing Materials Asbestos is a group of naturally occurring minerals, formerly used for thermal and acoustic insulation, as well as fireproofing. The use of asbestos was common due to its strength and resistance to heat, and is often found in old ceiling tiles, pipe and vessel insulation, blown into structural beams and ceilings, in floor tile, linoleum, and mastic. The use of asbestos building materials was banned in Canada in the late 1970's. Asbestos is not always an immediate hazard, though when asbestos containing materials are disturbed, microscopic fibres become airborne and may be inhaled by humans, where it may cause cancer and lung disease. There were no asbestos containing materials observed on the property and none are expected.

Lammer Developments Limited October 4, 2016 Phase I Environmental Site Assessment File No.: E16311 75 Dublin Street North, Guelph, Ontario Page 10 Lead Based Paint Lead is a highly toxic metal which, when present in the human body (in sufficient quantities), attacks the central nervous system and can result in numerous health problems. Lead-based paints have not been used since the late 1970's, when the U.S. Department of Housing and Urban Development (HUD) banned it for use in all homes and most other buildings There was no lead based paint observed on the property and none is expected. Other Designated Substances CVD did not observe any other designated or hazardous substances at the Site and none are expected.
6.3 Surrounding Properties Phase I Study Area The Site is located in an area of institutional, residential and office/commercial land uses. Land uses currently and historically surrounding the Site are described as follows: North of the Site (inferred trans-gradient): Adjacent to the north of the Site is Central Public School. Central Public School is a junior-kindergarten to grade six, public elementary school. A chimney stack was observed extending from the roof at the middle of the building indicating the location of the boiler room. It is anticipated that furnace oil was stored in an UST or AST located in close proximity to the boiler room in the school. Based on inferred trans-gradient location, CVD does not anticipate that furnace oil storage on the adjacent property is a significant environmental liability to the Site. According to available resources, the original Central Public School was constructed in the early 1900s. A new addition was constructed onto the school in 1969. East of the Site (inferred down-gradient): Adjacent to the east of the Site is a dentists office (Dr. Steven Cremasco), beyond which are office/commercial and residential land uses. According to available resources, land uses adjacent to the east have historically been commercial, prior to which residential dwellings were present. A former gasoline service station and automotive garage was located approximately 170 m to the east at 6-10 Macdonell Street. Fire insurance plans from 1929 and 1960 also show four (4) underground storage tanks along Macdonell Street in front of 20-26 Macdonell Street and one (1) UST is shown on Cork Street East in front of an automotive repair garage (Canadian Tire Corp.) at 19 Cork Street East.

Lammer Developments Limited October 4, 2016 Phase I Environmental Site Assessment File No.: E16311 75 Dublin Street North, Guelph, Ontario Page 11 South of the Site (inferred trans-gradient): Directly adjacent to the south of the Site is Cork Street West beyond which is Basilica of Our Lady Immaculate. According to available resources, the Basilica of Our Lady Immaculate was initially formed in 1827 and the initial church was constructed in 1835, prior to which land uses to the south were undeveloped natural forest land. West of the Site (inferred up-gradient): Adjacent to the west of the Site are residential land uses located along Dublin Street North and Cork Street West. According to available resources, land uses to the west of the Site have historically been residential dating back to the late 1800s.
7.0 REVIEW AND EVALUATION OF INFORMATION
7.1 Current and Past Uses on the Phase I Property According to available resources, the current tennis courts on the Site were constructed in the early 1930s. According to available resources including city directories from 1917 as well as a 1907 FIP, prior to the early 1930s the Site was either vacant and undeveloped land or a residential land use. Aerial photographs from 1933 to 2010 show the current tennis courts on the Site.
7.2 Potential Contaminating Activities (PCAs) Potentially contaminating activities (PCAs) are a use or activity set out in Column A of Table 2 of Schedule D within Ontario Regulation 153/04 that is occurring or has occurred in a Phase I study area. Fill material of unknown quality may have been imported to the Site as part of initial development of the tennis court lands. The potential for importation of fill material of unknown quality is listed as PCA No. 30 under Ontario Regulation 153/04. No other PCAs that have the potential to be an environmental liability to the Site were identified within the Phase I study area.

Areas of potential environmental concern (APECs) are defined within the amended Ontario Regulation 153/04 (amended regulation) as those on, in or under a phase one property where one or more contaminants are potentially present. APECs are related to potentially contaminating activities set out and numbered in Column A of Table 2 of Schedule D in the amended regulation. The following APEC corresponding to those listed and numbered in the amended regulation was identified on the Site and Phase I study area.

Lammer Developments Limited October 4, 2016 Phase I Environmental Site Assessment File No.: E16311 75 Dublin Street North, Guelph, Ontario Page 13 8.0 CONCLUSIONS CVD was retained to conduct a Phase I ESA on the property located at 75 Dublin Street North in Guelph, Ontario. The purpose of the Phase I ESA is to evaluate the environmental conditions of the Site and adjacent properties and to identify actual or potential sources of contamination associated with the Site and surrounding properties. The findings of the Phase I ESA did not identify any actual or potential sources of contamination on the Site or surrounding properties. It is CVD's professional opinion that the potential for significant environmental liabilities associated with the Site under investigation is low, and that no further investigations are required at this time. This opinion is based on the following:
The Site does not appear to have ever been used for any land use that may produce, store, or dispose of environmentally hazardous materials.
The neighbouring properties adjacent to the Site are not expected to pose an environmental
concern for the Site. Based on inferred down-gradient and trans-gradient locations as well as separation distance, the identified surrounding land uses are not considered to be an environmental liability to the Site at this time.
A Phase I ESA and a Phase II ESA were completed for the Site by CVD in 2012. The findings and
conclusions of the Phase II ESA investigation documented minor exceedances of the applicable MOECC Table 2 standards of petroleum hydrocarbons (PHC F3 and F4) and lead in a localized area of fill material identified on the northeast corner of the former tennis courts.

Lammer Developments Limited in evaluating the environmental conditions of the Site at the time of CVDs Site visit. CVD will not be responsible for the use of this report by any third party, or reliance on or any decision to be made based on it without the prior written consent of CVD. CVD accepts no responsibility for damages, if any, by any third party as a result of decisions or actions based on this report. This report presents an overview of issues of environmental concern, reflecting CVDs best judgment using information reasonably available at the Site at the time of CVDs Site visit. CVD has prepared this report using information understood to be factual and correct and shall not be responsible for conditions arising from information or facts that were concealed or not fully disclosed to CVD at the time of the Site visit. The American Society of Testing and Materials Standard of Practice notes that no environmental Site assessment can wholly eliminate uncertainty regarding the potential for recognized environmental conditions in connection with a property. Performance of a standardized environmental Site assessment protocol is intended to reduce, but not eliminate, uncertainty regarding the potential for recognized environmental conditions in connection with the property, given reasonable limits of time and cost. This assessment was carried out using historical data and a Site walkover. Intrusive testing is not part of the scope of this assessment.
