About the Administrative Record This administrative record contains the documents that the U.S. Environmental Protection Agency (EPA) has considered or relied on to select remedial actions for the Mine Area Operable Unit (OU-01) at the Lava Cap Mine Superfund Site in Nevada City, California. It is presented in compact disc (CD) format. The administrative record includes the cumulative administrative record files for the Mine Area Operable Unit that were released for public review and comment in February 2004 and subsequently updated in January 2005 (as Update #1) and November 2014 (as Update #2). An administrative record is a collection of documents which forms the basis for an agency's decision, in this case the selection of a response action at a Superfund site. This does not mean that only documents which support a response decision are placed in the administrative record. Relevant documents that were relied upon in selecting the response action, as well as relevantdocuments that were considered but ultimately rejected, are included. The administrative record also acts as a vehicle for public participation in selecting a response action. Under section 113(K) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), as amended by the Superfund Amendments and Reauthorization Act (SARA), the U.S. Environmental Protection Agency (EPA) is required to establish an administrative record for every Superfund response action and to make a copy of the administrative record available at or near the site. The administrative record must be reasonably available for public review during normal business hours and should be treated as a non-circulating reference document.
