FACTS:
1.OnSeptember 1, 1971,GregorioKalaw,claimingto bethesole
heirofhisdeceasedsister,NatividadKalaw,filedapetitionfortheprobate ofherholographicWillexecutedon December24,1968.
2.TheholographicWill,asfirstwritten,named RosaKalaw,asisterof thetestatrixashersoleheir.Sheopposedprobate
allegingthat theholographicWillcontainedalterations,corrections,andinsertionswithouttheproperauthenticationbythe fullsignatureofthetestatrixasrequiredbyArticle814oftheCivilCode reading:Art.814.Incaseofanyinsertion,
cancellation,erasureoralterationinaholographicwillthetestatormustauthenticatethesamebyhisfullsignature.
3.ROSA'spositionwas thattheholographicWill,asfirstwritten,shouldbe giveneffect andprobatedsothatshecouldbethe soleheirthereunder.
4.TrialCourtdenied petitiontoprobatetheholographicwill.Reconsiderationdenied.
ISSUE:W/Ntheoriginalunalteredtextaftersubsequent
alterationsandinsertionswerevoidedbythe TrialCourtforlackofauthenticationbythefullsignatureof the testatrix,shouldbeprobatedornot,withRosaassoleheir.RATIO:-Ordinarily,whenanumberoferasures,corrections,andinterlineationsmade
bythetestatorinaholographicwillhavenotbeennotedunderhissignature,the
willisnottherebyinvalidatedasawhole,butatmostonlyasrespectsthe
particularwordserased,correctedorinterlined.
-However,whenasinthiscase,theholographicwillindisputehadonlyone
substantialprovision,whichwasalteredbysubstitutingtheoriginalheir
withanother,butwhichalterationdidnotcarrytherequisiteoffull
authenticationbythefullsignatureofthetestator,theeffectmustbethat
theentirewillisvoidedorrevokedforthesimplereasonthatnothing
remainsinthewillafterthatwhichcouldremainvalid.
-Thatchangeofmindcanneitherbegiveneffectbecauseshefailedto
authenticateitinthemannerrequiredbylawbyaffixingherfullsignature.
