MANAGED FOREST PROGRAM
Details in Preparation for Farm Sale
21 acres of the ~75 acres for sale are enrolled in the Managed Forest Land Law (Order #65 007
1999). The contract is for 25 years, starting 1/1/1999 and expiring 12/31/2023.
The current owner has the option to remove the land from the program prior to sale, but that
would require payment of all the real estate taxes that have been deferred since 1999. There is
no current plan to do that.
The new owners can/will assume the existing Managed Forest contract. They will have multiple
options:
(1) Leave it in the Managed Forest program until the contract expires. That will end
their obligation under the existing contract with no deferred taxes to pay. Under
existing law, they could enroll the 21 acres again for a new contract
(2) Remove the 21 acres from the Managed Forest program at any time and pay the
taxes that have been deferred since 1999.
(3) On a one-time basis, “carve out” one to five acres and remove those acres from the
Managed Forest Program, subject to WI DNR guidelines and approval. Deferred real
estate taxes would have to be paid on the acre(s) that are removed. The balance of
the acreage would remain in the program until 12/31/2023. Current law requires a
MINIMUM of 20 acres to enroll in the Managed Forest program, so if more than 1
acre is “carved out”, the remaining land would NOT be eligible to enroll again under
existing guidelines. UNLESS, some of the prior pasture land would now qualify for
wooded acres because of new tree growth.
Any land removed from the Managed Forest Law program would still be subject to Lyons
Township and Walworth County guidelines for any planned development.
