Lot 76PLANTERS ASSOCIATION OF CEYLON, a collection of various items and ephemera related to noel Herbert Wykeham Dulling oBE

Mr n.H.W. Dulling travelled to Ceylon in 1921 to begin a venture in tea planting, following his success he became Secretary of thePlanters Assoction of Ceylon, a position he held for 20 year and in 1963 he was made a life member. He retired late 1964 and returnedto Britain. The collection comprises: A white metal mounted casket engraved to the cover ‘noel Herbert Wykeham Dulling admitted tolife membership of the Planter’s Association of Ceylon 29th March 1963’, within fitted case. A white metal scroll case, with chasedelephant and scroll decoration, engraved ‘noel Herbert Wykeham Dulling elected life member of the Kalutara district planters’ assoction25th September 1963’, enclosing presentation scroll A white metal medal; ‘The Planters Association of Ceylon, engraved ‘n.H. WykehamDulling oBE long and meritorious service 17.2.64’, within fitted case The most excellent order of the British Empire, silver gilt george Vbadge in fitted case with ribbon. A george V efficiency medal with ‘Ceylon’ clasp, awarded to ‘RFn n.H.W. Dulling C.P.R.C’. A Victoriadiamond jubilee 1837-1897 white metal medallion. A gentleman’s 18ct gold Universal geneve automatic wristwatch, the circular silvereddial with gold batons, sweeps second hand and attached black leather strap, engraved to the back ‘n.H.W.D from P.A of C 14.12.1963no.1537491-10220’, in original fitted case, with orginal receipt and booklet. The artist was born in Paris and was mainly known for hisportrayal of Parisian street scenes. In 1877 he was a student ofCharles Laloue, a long time member of the Artistes Francais.

During the early part of his career he used a number ofpseudonyms to overcome an exclusive contract with a majorgallery. These included the names, L.Dupuy, J.Lievin, andE.galiany, all of which are listed in the catalogue Raisonne.

He worked mainly in gouache with a light expressive style, andcaptured the atmosphere of the French street scene of the early1900’s with an accuracy that reflected that iconic era.

Indeed he was one of the first painters to historically representthese bustling streets, and as such has been a great influence toa host of later artists, such as Edouard Cortes and AntoineBlanchard. £5000 - £7000

He wasappointed as portrait and history painter to Queen Victoria in 1837,painting her coronation ceremony, as well as her state portrait, forwhich he was knighted in 1842. There was plenty to choose from in the final offering in 2014 for paintings, silver and jewellery and buyers were notbackwards in coming forwards with a whole raft of four and five figure prices recorded in this sale.

The day began with the silver section where an Edwardian silver butt marker with ivory pegs by George Betjemann andSons hallmarked London 1902, went ‘shooting’ over a £200/300 estimate to take £800. This was followed by a late 18th

century silver mounted coconut cup and cover by Ebenezer Coker and dated to 1760 which again confoundedexpectations of £300/500 when it sold for a healthy £1,000. A few lots later a Walker and Hall Victorian silver centrepiece,Sheffield 1892, formerly sold from the Leverhulme Collection in 2001, took £2,900 (Estimate £2,000/4,000) when it soldto an internet buyer.

2014 was a great year for amber at Halls and this sale was another opportunity to see itshine. Chinese buyers were once again in evidence and the first strong result wasregistered for a twenty eight bead example estimated at £2,000/4,000. Weighing 196grams and of deep butterscotch colour, the necklace eventually sold to a Chinese buyerfor £9.000. Five lots later, an amber bead necklace and pendant comprising fifty ninegraduated butterscotch oval amber beads again bettered hopes of £4,000/6,000 when itsold to the same Chinese buyer for £10,000, second highest price of the sale.

Novelty and rarity are nearly always qualities guaranteed to sell a lot at auction. Thefront cover lot here had both these attributes in abundance. This was a John Brogdenarchaeological revival gold pharaoh brooch in its original box which had beenconsigned during a routine valuation event. John Brogden was a Victorian designerwhose career spanned some forty years from the 1830s to the 1870s and whose workis highly sought after. Estimated at £3,000/5,000, this diminutive brooch sold for£4,200 to the London trade.

Another name which is also sure to have hands waving bids in excitement is Faberge. Herea blue enamelled egg pendant with a pear shaped ruby and two brilliant cut diamondsand certificate of authenticity proved once again the durability of this brand when it soldto a Cambridgeshire buyer for £2,200 against an estimate of £600/800.

In brisk trade in the picture section, a pair of pen, ink and watercolour washes of‘Constantinople’ showing naval vessels excited a great deal of pre-sale interest. Attributedto Antoine Ignace Melling (1763-1831) these detailed views of the city and Bosporus weresensibly priced at £1,000/1,500 but ended up selling to the London trade for £6,500.

Top price of the day was the £12,500 given by a Cheshire buyer for a set of four unframedoil studies of children by Brian Shields (1951-1997) who went by the nomenclature ‘Braaq’.They had been estimated at £4.000/6.000 but were the sort of lively studies which themarket favours from Braaq.

Other top prices for paintings included£8,200 offered by a Shropshire buyerfor a Benjamin Williams Leader RA(1831-1923), £7,000 for an oil studyof ‘La Porte Saint-Martin’ by EugeneGalien-Laloue (1854-1941) and £3,000for an oil study by the popularcontemporary artist, Jonathan ArmigelWade (b.1960) titled ‘After theShooting Lunch’.

(c) All statements whether printed in the catalogue or made orally asto any of the matters set out in (b) above are statements of opiniononly and are not to be taken as being or implying any warranties orrepresentations of fact by Halls Holdings Limited unless they havebeen instructed in writing by the seller to so certify.

(d) Any claim under any Statute must be received in writing by theAuctioneers within ten days of the day of the sale.

3. The Auction. (a) The Auctioneer has absolute discretion to divide any lot, to combine

any two or more lots or withdraw any lot or lots from the sale, torefuse bids, regulate bidding or cancel the sale without in any casegiving any reason or without previous notice. He may bid on behalfof the seller for all goods which are being offered subject to reserveor at the auctioneer’s discretion.

(b) The highest bidder shall be the buyer except in the case of adispute. The Auctioneer may at his sole discretion determine theadvance of bidding or refuse a bid. If during the auction theAuctioneer considers that a dispute has arisen, he has absolutediscretion to settle it or to re-offer the lot.

(c) Each lot is put up for sale subject to any reserve price placed by theseller.

(d) All conditions, notices, descriptions, statements and other mattersin the catalogue and elsewhere concerning any lot are subject toany statements modifying or affecting the same made by theAuctioneer from the rostrum prior to any bid being accepted forthe lot.

4. Rescission. notwithstanding any other terms of these Conditions, ifwithin fourteen days after the sale Halls Holdings Limited havereceived from the buyer of any lot notice in writing that in his view thelot is a deliberate forgery and within twenty-one days after suchnotification the buyer returns the same to Halls Holdings Limited inthe same condition as at the time of sale and by producing evidence,the burden of proof to be upon the buyer, satisfies Halls HoldingsLimited that considered in the light of the entry in the catalogue thelot is a deliberate forgery then the sale of the lot will be rescinded andthe purchase price of the same refunded. The seller and the buyeragree to be bound by Halls Holdings Limited’s decision

5. Default. Halls Holdings Limited disclaim responsibility for default byeither the buyer or the seller because they act as agents for the selleronly and therefore do not pay out to the seller until payment is receivedfrom the buyer. Instructions given by telephone are accepted at thesender’s risk and must be confirmed in writing forthwith.

6. In the event of a sale by private treaty both the seller and the buyeragree to be bound by the general and any Special Conditions of Sale.

7. Third Party Liability. Every person on Halls Holdings Limited’s premisesat any time shall be deemed to be there at his own risk. He shall haveno claim against Halls Holdings Limited in respect of any accidentwhich may occur or injury, damage or loss howsoever caused, save inso far as the injury, damage or loss shall be caused by the directnegligence of Halls Holdings Limited’s employees.

ConDITIonS oF SALE APPLICABLE To BUYERS

8. Inspection. opportunity is given for inspection and each buyer by makinga bid for a lot acknowledges that he has satisfied himself fully beforebidding by inspection or otherwise to all the Sale Conditions, the physicalcondition of and description of the lot including but not restricted towhether the lot is damaged or has been repaired or restored.

9. Property and Risk. The legal title in a lot shall not pass to the buyeruntil the lot(s) has been paid for in full and the Auctioneers shall beentitled to a lien on any lot sold until the purchase price (as defined in10 below) is paid in full but each lot is at the sole risk of the buyer fromthe fall of the hammer. Each buyer shall forthwith give his full namesand permanent address and if called upon to do so by the Auctioneershall forthwith pay Halls Holdings Limited such proportion of thepurchase price as the Auctioneer may require. If the buyer fails to doso, the lot may at the auctioneer’s sole direction be put up again andre-sold.

10. Every bidder shall be deemed to act as principal unless there is inforce a written acknowledgement by Halls Holdings Limited that heacts as agent on behalf of a named principal.

11. Removal of goods. (a) no purchase shall be claimed or removed until the sale has been

concluded. All lots shall be paid for and removed at the buyer’srisk and expense by the end of the second working day after thesale, failing which the Auctioneer shall not be responsible if thesame are lost, stolen, damaged or destroyed, and all lots not soremoved shall remain at the risk of the buyer and subject to awarehousing charge. If they are not paid for and removed withinseven days of the sale the Auctioneer may re-sell them by auctionor privately without notice to the buyer. Any liability which there maybe on the part of the Auctioneer in respect of any loss shall berestricted to a maximum of the price paid by the buyer of the lot.

(b) In the event of any failure of the buyer to comply with any of theabove conditions the damages recoverable by the seller or theAuctioneers from the defaulter shall include any loss arising onany re-sale of the lots, together with the charges and expenses inrespect of both sales, and together with interest at 2% aboveHandelsbanken Base Rate upon the price of any lot which has notbeen paid for within forty-eight hours of the sale, and any moneydeposited in part payment shall be held by the Auctioneers onaccount of any liability of the defaulter to them or to the seller. TheAuctioneers are unable to accept payment from successful biddersother than in cash or by the bidder’s own cheque. Cheques drawnby third parties, whether in the auctioneer’s favour or requiringendorsement, cannot be accepted.

12. Purchase Price. The buyer shall pay the hammer price together witha premium at the stated rates on the hammer price of 19.5%. Underthe Auctioneers’ Margin Scheme operated by HM Customs & Excise,the premium does attract VAT as an addition to the stated premiumrate. There is a 2.5% surcharge on all transactions made by credit cardalong with a one pound fee for payments on debit cards under twentyfive pounds.

13. Commission to Bid. Halls Holdings Limited will execute bids on behalfof intending buyers unable to attend the sale at no charge. HallsHoldings Limited undertake to purchase lots as cheaply as allowed byother bids and reserves. Bids must be submitted in writing and whilstevery care is taken in carrying out instructions Halls Holdings Limitedcannot be held responsible for errors or omissions made in carryingout such bids.

14. Lots on which Value Added Tax is payable on or included in thehammer price are indicated in the catalogue or description sheet witha sign. VAT is payable on or included in the hammer price of such lotsat the rates prevailing on the day of the auction.

15. The seller authorises Halls Holdings Limited to deduct commission atthe published rate and to retain the buyer’s premium of 19.5% plusVAT. The seller agrees to pay all special advertising charges andillustration charges (see 24) insomuch that they are reasonable.

16. Value Added Tax. A seller who sends for sale by auction any chattel(s)which is an asset of his business must disclose to the Auctioneerwhether or not he is a registered person for Value Added Tax purposesand, if so, his registered number and whether or not he intends tooperate the Dealer Margin Scheme covering works of art, etc. Thisinformation must be supplied to the Auctioneer on or prior to deliveryof the goods.

17. Instructions. All goods delivered to the Auctioneers’ premises will bedeemed to be delivered for Sale by Auction and will be catalogued andsold accordingly unless special instructions are recorded on thereceipt.

18. Reserves. Halls Holdings Limited will be pleased to advise on suitableprotective reserves but if no reserves have been received prior to theday of the Sale, the lot will be sold without reserve or at the discretionof the Auctioneer. Reserves must be confirmed in writing or notifiedon the receipt at the time of delivery.

19. Indemnity. Vendors shall indemnify Halls Holding Ltd against any claimsin connection with goods sold by Halls on the vendor’s behalf.

20. Collections. The Auctioneers do not themselves undertake thecollection of goods but acting expressly as Agents, they will if required,instruct or recommend a carrier on the vendor’s behalf for which therewill be a charge.

21. Withdrawals. Where a seller cancels instructions for sale, or where alot is withdrawn for any reason other than misattribution orauthenticity, Halls Holdings Limited reserves the right to charge a feeequal to 10% plus VAT of the reserve price of the lot, or where noreserve has been fixed, Halls’ lower estimate of the item(s) withdrawn,together with any expenses incurred in relation to the item(s)withdrawn.

22. Insurance. Halls Fine Art are not regulated by the FSA for the provisionof insurance to its clients. However, Halls Holdings Limited, for itsown protection insures property consigned to it at bottom pre saleestimate, unless the item has been sold, in which instance property isinsured at the hammer price for loss, occasioned as a result of theft,fire or negligence whilst in their custody or control.

23. Warranty of Title. The seller warrants to Halls Holdings Limited andto the buyer that he is the true owner of the property or is properlyauthorised to sell the property by the true owner and is able to transfergood and marketable title to the property free from any third partyclaims.

24. Photography. Vendors give Halls Holdings Limited the right tophotograph and illustrate and promote any lot placed with them forsale and to use such photographs and illustrations at any time at theirdiscretion, whether or not in connection with the auction.

25. Electrical and Mechanical goods. The seller and consignor ofelectrical or mechanical goods warrants and undertakes to HallsHoldings Limited that on the date received by Halls that the same aresafe if reasonably used for the purpose for which they were designedand free from any defect not obvious on external inspection whichcould prove dangerous to human life or health, and will indemnifyHalls its servants and agents against any loss or damage suffered byany breach of the above warranty.

26. Agency. The Auctioneers act throughout as Agents only and are notresponsible for any default by the buyer. Halls Holdings Limiteddisclaim liability for paying the vendor until they have receivedsettlement from the purchaser.

27. Warehousing. The Auctioneers exempt themselves from any liabilityto goods delivered to their salerooms without sufficient saleinstructions, and reserve the right to make a warehousing charge inthis respect. A similar warehousing charge will be applicable forgoods left on their premises after they have requested the vendor toremove them.

28. Unsold goods. Unsold goods must be collected if they are not to bere-offered within 14 days following receipt of any after sale advice slip.Halls Holdings Limited reserve the right to sell by auction on behalfof the vendor without reserve any items after this period.

29. Important notice. Any monies held on your behalf will be held in aClients Bank Account at the Handelsbanken, Shrewsbury and will beprotected by the FSA. Furthermore for your protection, Halls adhereto the Clients Monies rules of the RICS. Any incidental interest earnedon such monies will be retained by Halls as part of their terms ofengagements, and by instructing Halls to act on your behalf, you areagreeing to and endorsing that course of action.

RICS operates a Clients’ Money Protection Scheme (CMPS). Thisscheme, of last resort, covers direct loss of clients’ money as a resultof misappropriation (or equivalent) by a RICS Regulated Firm, up to a£50,000 limit. ThecmPS nor Halls will provide protection for the failureof a bank. But protection for bank failure is provided by The FinancialServices Compensation Scheme up to a £50,000 limit.
