Thanks also to the winning bidders that quickly shared their treas-ured cake. This is a great example of teamwork in action! We are all winners. As an added bonus the Pate family shared their mom’s fam-ily cook book. Great times and great memories.

Case #10-4: Use of “Choose Your Ne d ighbor” Marketing Letters (AdopteNovember, 1987. Revised November, 2013)
REALTOR® A listed a property in a new subdivision. At the instruction of his client, Seller X, REALTOR A did ®
not file information on the listing with his Board’s MLS, did not place a “For Sale” sign on the property and did not advertise the property in the local newspaper. Seller X had told REALTOR® A that he wanted the sale handled quietly, with the new purchasers being people who would “fit into the neighborhood—people with the same socioeconomic background” as the other residents of the subdivision.
Based on his conversation with Seller X, REALTOR® A’s only marketing effort was mailing a letter to the other residents of the subdivision, inviting them “. . . to play a part in the decision of who your next neighbor will be. If you know of someone who you would like to live in the neighborhood, please let them know of the availability of this home, or call me and I will be happy to contact them and arrange a private showing.” REALTOR® A’s marketing strategy came to the attention of REALTOR® B, whose mother lived in the subdivision. REALTO ®R B filed a complaint charging REALTOR® A with a violation of Article 10 of the Code of Ethics.
At the hearing, REALTOR® B told the Hearing Panel of receiving a copy of the marketing letter from his mother, who had recently moved to the subdivision. REALTOR® B advised the panel that he had checked the Board’s MLS for information on the property had driven past the house to look for a “For Sale” sign and had scanned the Sunday real estate section of the local newspaper for information on the property. Finding no mention of the property in either the MLS or the newspaper and noting the absence of a sign on the property, REALTOR® B concluded that REALTOR® A’s marketing strategy was to limit access to the property to individuals preselected by the current residents. “In my mind,” said REALTOR® B, “this could only mean one thing. REALTOR® A was deliberately discriminating against home seekers from other areas, or those with different backgrounds, who would never have the opportunity to learn about the house’s availability.
Obviously, REALTOR® A was directing all of his marketing energies into

The Hearing Panel found REALTOR® A in violation of Article 10 of the Code of Ethics. In their decision, the
finding purchasers who would not disrupt the ethnic and economic character of the neighborhood.” REALTOR® A defended his actions by advising the panel that he was acting on Seller X’s instructions. Seller X appeared as a witness for REALTOR® A and confirmed this fact, adding that he and the other residents of his block had an informal agreement that they would try to find “suitable” purchasers for their homes if they ever decided to sell. Seller X felt that by broadening the marketing campaign to include all residents of the subdivision he had
panel advised REALTOR® A that no instruction from a client could absolve a REALTOR® from the obligation to market properties without regard to race, color, religion, sex, handicap, familial status, country of national origin, sexual orientation, or gender identity, as expressed in Article 10. There was no doubt, in the panel’s opinion, that the exclusive use of “Choose Your Neighbor” letters to market the property was designed to circumvent the requirements of Article 10.

MLS Statistics
Statistics developed by the REALTORS Association of Indian River County through its Multiple Listing Service and in conjunction with Flor a REALTO reflect the id RSfollowing for October 2016/2015. The Residential closed
sales of single family detached homes totaled 206 units for October 2016. This compares to a total of 223 units in
October 2015. The median price of single family detached homes sold by members of the REALTORS Association
of Indian River County MLS for October 2016 was $190,000. This compares to a median price of $198,950 for
October 2015. Current active inventory of residential single family detached homes total 1154 for October 2016. This compares to the active inventory of 1145 for October
2015.
The Residential closed sales of condominium homes totaled 53 units for October 2016. This compares to a total
of 59 units in October 2 .015 The median price of con dominium homes sold by members of the REALTORSAssociation of Indian River County MLS for October 2016
was $130,000. This compares to a median price of $107,000 for October 2015. Current active inventory of condominium homes total 324 for October 2016. This
compares to the active inventory of 300 for October 2015.

Government Affairs Update
Proposed Changes to Appraiser Qualifications
In late October, NAR submitted a comment letter to the Appraiser Qualifications Board (AQB) in response to their second exposure draft concerning proposed changes to the AQB's Real Property Appraiser Qualification Criteria.
NAR agreed with the AQB’s proposed reductions in degree requirements for Licensed and Certified Residential appraisers and asked that prior work experience count toward the degree requirement for Certified General appraisers. While NAR agreed with the AQB’s proposed removal of time limits on obtaining experience hours, NAR is concerned that reducing the hours requirement for all appraiser classifications could weaken the quality of new appraisers entering the field. Mutual Mortgage Insurance Fund Steady
The Federal Housing Administration’s just-released actuarial report shows that the Mutual Mortgage Insurance Fund is on a steady financial trajectory, a finding the NAR says is as an opportunity to make FHA’s low-down-payment mortgage option available to an even broader array of borrowers.
“FHA’s actuarial report shows that the fund has indisputably found its footing,” said NAR President William E. Brown, a Realtor® from Alamo, California and founder of Investment Properties. “That’s good news for taxpayers, and a reflection of FHA’s sound stewardship. It’s clear from this report that FHA can continue taking responsible steps to manage their risk even as they take action to make homeownership more affordable for lower- and middle-income buyers.”
FHA’s MMIF is responsible for paying lenders if a mortgagor defaults. In a sign of continuing health, the report shows that the fund’s “seriously delinquent” rate is at a ten-year low, while the overall economic value of the fund has increased by $3.8 billion. Commercial Tax Issues to Be in Spotlight
Look for an effort in the new Congress to cut taxes, increase infrastructure spending, and take a look at the deductibility of business interest, building depreciation, and treatment of carried interest and 1031 like-kind exchanges, says Evan Liddiard, NAR’s senior tax policy representative..
REALTORS® Can Play Key Role in Flood Insurance
Floods are widespread throughout the nation, with Hurricane Matthew and this summer’s flooding in Louisiana serving as the latest examples.
Homebuyers need to be aware of the threat that flooding poses to their investment, as well as to their safety, and REALTORS® can play an important role in helping clients address that risk before disaster strikes.
Floods in lower risk zones are fairly common, according to Melanie M. Graham of H2O Partners. She said 20 percent of National Flood Insurance Program claims occur in low- to moderate-risk zones, receiving one third of overall flood disaster assistance. Graham also comments that a disaster declaration alone may not result in a payout for property owners, calling the idea a myth. Instead, she said having a flood insurance policy in hand is critical to protecting property owners when disaster strikes.
NAR supports a range of policy solutions to ensure access to affordable flood insurance. Among them, NAR supports an extension of the NFIP before it expires in September of 2017, as well as mitigation efforts that protect homeowners before a flood strikes. Earlier this year, NAR also supported House-passed legislation that would allow homeowners to move seamlessly between the NFIP and private insurance markets without the risk of an arbitrary rate increase.
“Floodwaters continue to threaten homes around the country, but the clock is ticking to reauthorize the NFIP,” said NAR President Tom Salomone. “As NAR works with leaders in Washington to reauthorize the program, REALTORS® in the field are doing their part to educate themselves and their clients on how they can best protect their homes, their investments, and their families.”
National Flood Insurance Program rates are set to rise an average of approximately 6 percent on April 1, 2017, less than the average for 2016.

Agent webpage is a web presence by adding listings, text images/videos to their own personally branded webpage. GoMLS APP 1:30-3:30pm. Using public and REALTORS® MLS Wireless App search for current listings and photos, maps using GPS, Realist tax on IOS, iPad and Android mobile devices. Now available basic editing of existing listings, not entry of new listings. These forms are not intended to provide a comprehensive listing form with all fields, only for basic “quick updates” such as price, status, expiration date and remarks. Today adding photos in GoMLS is not yet available, but it is a planned feature called Roadmap. .
“Withdrawn and Temp off Market” Withdrawn status is when seller has been released from the listing agreement. Unconditional release. Temp off Market is when listing is either off the market for time period or conditionally released until the end of the listing period but the client is still bound by a listing agreement. These listings would then expire at the end of the listing period.
“Sellers Waiver of Entry in MLS”
The “Sellers Waiver of Entry” form is an agreement signed by the sellers and listing agent broker to waive RAIRC MLS entry of a listing. When you notice that a property located in IRC appears in other websites or see a sign on a property, but do not see it listed in the RAIRC MLS, contact the Association. Staff will check to see if a “Sellers Waiver of Entry” form along with the listing agreement was submitted indicating that the listing is being waived from input by the sellers temporarily until a certain date or even for the entire listing period. This is a broker’s business decision. Sellers Waiver of Entry form can be found in Form Simplicity under Board Realtors Association Form.
“Matrix New and Enhanced Features” Some of the new features released Matrix 6.14.12 are: 1. Auto-emails that display multiple listings can now include direct links to the individual listing detail report on the customer portal. The links can be incorporated into simple text hyperlinks to the ML#, photo or more details. 2. A Data Checker widget is now added to the home page that will indicate if a current user has any current outstanding violations. 3, You can now edit contact information directly from send email screen without having to exit the send email process. 4. The auto-email disclaimer and unsubscribe text and link font size has been reduced to 8 pixels in auto e-mails. 5. New “Back to Results” link on full view on Portal. A new feature when viewing a full property display in the client portal the x button in the top right corner could easily be overlooked, so it has been replaced by a much more prominent “Back to Results” link in the left side of that same top bar. 6. Improved “Share Listing for internet sites can now configure certain listing fields on the shared listing to be populated into social media as the title and description. The image that is used in social media displays is automatically set as the primary image for that listing. Next Basic and Advanced Matrix training is January 9th.
“Reporting NON-MLS Property
as Sold for Comps” A $30 fee for listing entry by Association staff applies to and includes Non-MLS property when entered and reported as sold in the MLS for comparable purposes. A sold property will be allowed to be entered when sold by an MLS Participant firm when the following criteria is met and documentation is provided by mailing to RAIRC MLS Staff for entry into the MLS. The following are required: 1. Completed MLS data input sheet with all required fields describing the property for input and fill out the sold data on the change form 2. Exterior photo of the property emailed to MLS in jpg format and 3. One of the following to support that MLS Participant participated in the sell of the property; a. Signed Buyers Brokers Agreement with Buyer of Property. b. Copy of HUD showing participating brokerage firms to the transaction. or c. Copy of the commission check form Seller/closing Agent (FSBO) or Brokerage (Non-MLS Participant) showing the requesting office participated in the transaction. 4. Payment of $30 by Visa or Master Card .

REALTORS® Property Resource (RPR) for all RAIRC REALTORS® members Only. The RPR Mobile App has improved search auto-suggest., virtual tour links on property details, sorting by days in RPR, improved parcel boundaries visibility on maps and auto-saved settings and more Sentrilock and RPR integration is available and you can enable this feature and select option “view property details”. How to View the Access Log
Any time someone uses their SentriCard®, contractor code or 1 day code to access the key compartment of a lockbox, the lockbox and SentriCard® records certain access information. You can view this information on the Lockbox Access Report or Lockbox Access Log.
1. Insert your SentriCard® into the Reader and Login.
2. From the Main Menu, click Lockboxes or My Lock-boxes.
3. On the Lockboxes window, click the lockbox's View Access Log hyperlink. You can also click the View Access Log hyperlink on the Edit Lockbox window.
4. The SentriLock Server will display the Access Log.

REGISTRATION: We appreciate your cooperation in your timely arrival as the course will begin promptly as scheduled. Due to DBPR requirements, Registration Sign-In will begin 30 minutes PRIOR to the start of ALL scheduled courses.
REGISTRY DEADLINE: *2 Calendar Days PRIOR to the scheduled course or event,
by (Midnight) 11:59PM.
Anyone registered after the deadline will be considered a LATE registry and will be REQUIRED to pay FULL PRICE prior to attending the course or event.
REGISTRATION CONFIRMATION: Anyone who registers for a course using the website, www.RAIRC.com, will receive a registration confirmation number. All students registered for an RAIRC CEU course or event will receive an email confirmation 2 days prior to the scheduled course. If you have not received a confirmation email by this time, contact the Association to confirm you’re registered. If you register after this time, you will not receive an email confirmation. If you are not on the registration roster the day of class, you will be required to pay a Late Registry fee (see below for fee information).
