The Germantown Village Boardapproved a motion Aug. 31 to re-bid thecost of grading and erosion control for thevillage's sixth Tax Incremental Finance(TIF) district after changes to the projectadded $650,000 to the original bid.
The village's sixth TIF is located in an
area between Appleton Avenue, LannonRoad and Division Road. In a TIF, taxesnormally directed toward local govern-ment units (municipal, school district, tech-nical school district, county) are insteadused to pay for infrastructure improve-ments, with the local government units laterbenefitting from the increased propertyvalue generated by the improvements.
While the village originally had a ten-ant lined up for the TIF at this time lastyear, the company later dropped its plansfor expanding into the area. The gradingand erosion control contract with SuperWestern originally came in at $1.497 mil-lion last year. However, with changes to
the plan, an additional $650,000 wasadded to the cost of the revised project.
Josh Regent-Smith, project managerand estimator for Super Western, saidthe industry for excavators "has complete-ly changed" over the past year.
"Last year, we were at a time when allour scrapers and the rest of the industryscrapers were all parked, everybody was
looking for scraper work. This year, it'scompletely opposite," Regent-Smith said, referring to equipment used to grade theland.
Regent-Smith cited the recent approvalof a subdivision by the village as part of the growth. As a result, people in the indus-try have had to start renting scapers to dothe additional work. Regent-Smith addedthat materials prices have "skyrocketed"due in part to the Zoo Interchange project.
Village Engineer Brionne Bischke saidthe village should re-bid the project. Hesaid the risk in doing that would be losinga potential tenant for the business park.
"There's really nothing we can do
about this. These costs exceed 15 percentof the cost of the contract," Bischke said.
Regent-Smith said he later agreed withBischke's recommendation to re-bid theproject.
"Right now, you're not going to findany excavating company that's going togive you numbers that you guys are look-ing for, whatever your budget is," Regent-
Smith said. "It's the industry right now, everybody has enough work to finish upthe rest of this year.
Regent-Smith added that there wererisks in doing the project before the end of this year "are huge" and are part of thereason for the increased costs. He notedthat a rainfall on Friday and Saturdaydelayed work for other projects for severaldays because the ground was wet.
Village Administrator David Schornackadded that costs have skyrocketed in spe-cific areas of the contract.
"I don't think there is a lot of questionhere, this will have to be (re) bid out,"Schornack said.
He added that with the currebers "this thing is too risky" and sailage should examine if there's reduce the excavation costs. Attorney Brian Sajdak said that ject's cost increase by more than cent, the village is required to reproject.
Village President Dean Wolter
would be a good time for the v"regroup" to get village staff ansentatives from MLG (which is devthe TIF) to examine options recosts for the project going forward
"As stewards of that TIF, we really seriously look at that and mwe're making the right decision awe are being financially astute in start that process," Wolter said.
Wolter said he favored re-bidproject but also meeting with alinvolved in the TIF to prevent thefrom being in a similar situationfuture.
A Washington County Circuit Court Judge ruled in favor of the village of Richfield in a challenge to the village'sordinances to regulate certain aspects of aproposed clean fill site,
Scenic Pit LLC sought a temporaryrestraining order against the village June 5but it was denied by Washington CountyCircuit Judge Andrew Gonring. Scenic Pit
LLC received state approvals for clean fillto be placed at the location and hasargued that it does not need villageapprovals on any items related to the proj-ect.
During a hearing on a temporaryinjunction on Sept. 1, Judge AndrewGonring dismissed the request by ScenicPit for a temporary injunction, ruling that
the firm had to comply with local ordi-nances related to the request.
Bruce McIlnay, an attorney for ScenicPit, indicated that barring any unexpecteddevelopments, Scenic Pit will appeal theruling as soon as the written order isentered by the court.
Richfield Village Administrator JimHealy was pleased by the court ruling.
"The Village is thankful that the Hon. Judge Andrew Gonring found merit in thearchitecture of the Village’s legal analy-sis," Healy said. "The findings by the judgepunctuate the importance of local control,
especially when dealing with itemnificance, such as a local goveright to enforce its own municipal
He added that the village "is pared to respond to a petition to thof Appeals and we are also similpared to process any application the Village Board regarding thapprovals necessary for Danah aZoulek (Scenic Pit LLC) to apply regard to their stated desire to opclean fill landfill at 609 Scenic Ro

Drs. Richard and Bruce Winter
Dear Dr. Winter, I have a bad mouth! I haveloose teeth, root tips, bleeding gums and badmouth odor. I really want to have a smile I can be
proud of for once in my life.I am on a fixed income so I do not have all the
money for a glamorous makeover but I amhopeful you can help me. I saw your website andrealize you have helped thousands of patientswith problems similar to mine. Please let meknow how you can help me. Ann
Dear Ann, when people are in pain or ashamedof their mouth the first step is always the hardest!Since we see people with severe dental issues youcan be assured that you will never be judged. Theconcepts that Dr. Winter lectures on include"Upgradeable Dentistry" which allows people topick a plan that will sequentially help peopleimprove their smiles at a pace they can afford.
If you must have dentures we may offer deluxedentures with soft liners to give you the ultimatein comfort. Or we may offer small diameterimplants to help hold your dentures firmly inplace without the need for messy adhesives.
From there we discuss whether we can performgrafting to improve the amount of bone you have
so that implants can be done within 8-12 monthswhile avoiding more expensive graftingprocedures. Perhaps we can discuss a path where2-4 implants are placed each year and you wouldgo from a removable implant retained denture toa "fixed bridge". That option would allow you tohave your teeth in your mouth 24/7 without theembarrassment of removing them at night.
So having the flexibility to discuss dynamictreatments is what we offer at Hampton DentalAssociates. You can go towww.hamptondentalassociates.com and see ourpatient testimonials, read our blog and visit oursocial media! We would love it if you would visit:https://www.facebook.com/HamptonDentalAssociates
And like us on facebook! We share articles, a rich photo gallery and
videos to help people make informed decisions
about their complex dental needs.Dr. Winter has a Mastership in the Academy
of General Dentistry, a Diplomate in theInternational Congress of Oral Implantologists,he has a Diplomate in the American Board of Oral Implantology/Implant Dentists and will bereceiving his Fellowship in the AmericanAcademy of Implant Dentistry in October 2015.
By investing in education, taking rigorousexaminations and becoming certified in all themajor dental implant organizations he is poisedto educate and offer the finest treatment that isavailable with dental implants. We invite any of our readers or their friends to come in for anexamination visit and to take the first steptoward regaining your smile and dignity.
We look forward to meeting you!Dr. Richard Winter MAGD, DICOI, DABOI/ID

Field possession and mistakes com-bined to turn a close game betweenGermantown and Waukesha CatholicMemorial into a lopsided contest, as theCrusaders won 28-0.
"It was field position tonight and whenit swung the other way, that's what reallyhurt us," Germantown Coach Jake Davissaid.
The teams opened the first quartertrading possessions on the CatholicMemorial side of the field. The Cruadersgot on the board with an 80-yard, fourplay drive that ended with a 4-yard runby Josh Karfonta with 26 seconds left inthe first quarter. The extra point kick hitthe goal post and was no good.
Germantown's defense kept Memorialout of the end zone for the second quar-ter, as Germantown's defense containedMemorial.
"That was the game we wanted to bein to test us and learn from, and we've gotto let that drive us the rest of the way,"Davis said.
The Crusader's next score came at the2:22 mark of the third quarter as Karfonta
finished a drive which was started by aGermantown fumble with a 1-yard run.The Chargers then completed the two-point conversion.
At the 10:30 mark of the fourth quar-ter, Neko Medina in tercep ted aGermantown pass and returned it 15-
yards for a score."The field position got
away from us -- theturnovers, the mistakes. Weknew that is what it wasgoing to come down to,"Davis said.
Memorial's next drivewas finished by a 33-yardrun by Karfonta with 6:33left in the game.
Karfonta was the lead-ing runner for the game, rushing for 179 yards on16 carries. AustinMozdzen led Germantownwith 79 yards on 25 car-ries.
The constant rain likelyhampered the passingattack for both teams, asMemorial's Alex Bray com-pleted only 2 of 10 passes for 38 yardswhile Germantown only completed one of 11 passes, with the lone completion com-ing on a halfback pass by Daniel Ubert toConnor Stoming for 24 yards.
Germantown opened the North ShoreConference portion of the season atNicolet Sept. 4.
"This one will sting, it's going to hap-pen. But we've got to refocus and go atthat North Shore Conference," Davis said.
Superior 37, Menomonee Falls
