UUCF Contractor VLicense Renewals

Just a reminder that the Contractor V license from theState Fire Marshal's office is up for renewal on June 30,2010. Current law requires Contractor Vlicenseholders to obtain 14 hours of continuingeducation with at least one hour in fire protectiondiscipline.

The UUCF office will also besending out a ConventionRegistration Form in the near futurewhich will cover the registration feefor all private UUCF functionsduring the cruise.

Please note: Due to the heightenedlevel of security in 2005, ALLpassengers are required to have apassport. UUCF will be holding a SilentAuction this year, but there is a twist.The Silent Auction will be called theWhite Elephant Auction. As in pastyears, individuals or companies willmake a donation to the Auction. Theindividuals, companies or UUCFoffice will wrap the item(s).Attendees at the convention will beprovided with a list of each of theitems donated; however, they will notknow what package the items arelocated in. Throughout theConvention, individuals will bid onthe items; however, they will notknow what is in the wrappedpackage that they are bidding on.Once UUCF closes the Auction,wrapped packages will be awardedto the highest bidder; however, thehighest bidder cannot open thepackage. Individuals who are the

highest bidder are allowed toexchange their wrapped package foranother wrapped package. Once theexchange is over, then each individualwith a wrapped package will beallowed to open their package. Someof the items donated to the WhiteElephant Auction will be silent itemsand others will be live items.

Instead of holding a Chinese Raffle,UUCF will be holding a Lucky 30Raffle. A Lucky 30 Raffle is whereUUCF will place the numbers of 1 –30 on slips of paper in a bowl.Attendees at the Convention will pulla number from the bowl. Whatevernumber they pulled, that is the cost oftheir raffle ticket (i.e., if the number30 is pulled, the individual would pay$30.00). Half of the proceeds fromthe Lucky 30 Raffle collected go tothe association, and the other half ofthe proceeds go to the winner. TheLucky 30 Raffle will be held on Fridaynight during the reception.

Johnson Memorial ScholarshipFoundation, Inc. is pleased toannounce that its scholarshipapplication is available. Thescholarship application is available toany employee and/or their immediatefamily member (i.e., child, grandchild,etc.) who is employed by a companythat is a member of UUCF.

This year, the foundation will beawarding two one–time only$6,000.00 scholarships. The first$6,000.00 scholarship is for anindividual who is currently a seniorgraduating from high school andenrolling in an accredited two– orfour–year college or university forthe year beginning in August orSeptember 2010. The second

$6,000 scholarship is for anindividual who is currently attendingan undergraduate two– or four– yearaccredited college or university forthe year beginning in August orSeptember 2010. The enrollmentmay be in a curriculum of anynumber of years but the scholarshipwill not exceed one year. (Applicantsmust be affiliated with a UUCFmember in good standing with duespaid at the time of application. Outof state branches of membercompanies are not eligible.)

The UUCF/Andrew Scott JohnsonMemorial Scholarship Foundation,Inc. was established in memory of"Andrew" Andy Scott Johnson who isthe son of a Past President of UUCF,Scott J. Johnson (Johnson–Davis, Inc.).

On December 28, 1999, Andrew“Andy” Scott Johnson was killed inan automobile accident. Andy was19 years of age. He was an honorstudent and a 1998 graduate ofPope John Paul II High School. Hewas a sophomore at VanderbiltUniversity. He loved the outdoors, allkinds of sports, especially Lacrosse,music and sport fishing. Andy wasespecially dedicated and loyal to hismany friends and family.

DEP Announces CompletedProjects with Stimulus Funds

to Benefit Water Quality–Federal funding to protect environment and public health,

stimulate economy–he Florida Department ofEnvironmental Protection

(DEP) announced recently that it hascommitted all $218.9 million inClean Water State Revolving Fund(CWSRF) and Drinking Water StateRevolving Fund (DWSRF) projectmoney made available through theAmerican Recovery andReinvestment Act of 2009 (ARRA).

Florida secured the ARRA money tohelp local governments across thestate finance improvements towastewater, stormwater and drinkingwater facilities essential to protecting

public health and the environment.Florida was one of the first states tomeet all the requirements necessaryto obtain the full amount of ARRAfunds.

“Investing in our wastewater,stormwater and drinking waterinfrastructure is critical to waterquality and public health protectionfor our citizens. The stimulus moneyoffered an important supplement toour existing programs to fundinfrastructure for local communities,”said DEP Secretary Michael W. Sole.“These projects have also boosted the

local economy through job creationand helped provide the communitieswith new sources of revenue.”

Twenty–eight projects have beenawarded stimulus funds totaling morethan $132 million through thedepartment’s CWSRF and another40 projects have been awardedmore than $86 million through theDWSRF. All local constructioncontracts have been awarded and allprojects have started construction.

million of ARRA drinking waterproject funds and more than $1.5billion in requests competing for$132.3 million in ARRA wastewaterand stormwater funding. Qualifyingprojects were selected for ARRAfunding, based on their construction–readiness and environmental orpublic health priority.

The East County Water ControlDistrict (ECWCD) is a primeexample of stimulus money at work.With $2,418,819 awarded by DEPon June 26, 2009, ECWCD hascompleted construction of the HarnsMarsh Phase I Improvements and theYellowtail Replacement Project—Florida’s first completed ARRAprojects. Working with DEP,ECWCD has been able to replacefour structures and build one newstructure in order to reduce floodingto downstream neighbors on theOrange River, improve water qualityand storage; and recharge thegroundwater aquifers.

The Harns Marsh Phase IImprovement Project and Yellowtail1A Replacement Project createdjobs that otherwise might not havebeen available in a down economy.More than 40 jobs in construction,engineering and projectmanagement put money in people’spockets and into the businesses oflocal communities.

“The support ECWCD has receivedfrom DEP enabled us to improve ourservices to local residents byreplacing and constructing muchneeded infrastructure,” said DaveLindsay, ECWCD District Manager.“The Harns Marsh Phase I andYellowtail Replacement Projectshave allowed us to recharge localbasins, alleviate flooding to ourOrange River residents and preparefor water storage for the 2010 rainyseason.”

ECWCD preserves and protectswater resources in Lehigh Acres(eastern Lee County) and westernHendry County through drainage,conservation, mitigation, navigationaland water management practices.

The District maintains 360 culvertcrossing, 22 bridges, 66 watercontrol structures and maintains1,298 preserve acres within 70,000acres of land – approximately68,000 of which lie in eastern LeeCounty.

DEP established its SRF programs,under agreements with the U.S.Environmental Protection Agency, toprovide low–interest financing toplan, design and build wastewater,stormwater and drinking watersystems. Funded by federalcapitalization grants, state matchingfunds, loan repayments, interestearnings, and periodic bond issues,SRF loans are offered at interestrates substantially below currentmarket rates and help make loansaffordable.

Since 1999, Florida has investedmore than $3.7 billion to upgradeand improve water and wastewaterfacilities and clean up stormwaterpollution, funding about 2,400projects statewide.

It is with greatsadness that weinform you of thepassing of NUCA’s1996 President,John R. Hall, onMonday, April 5,2010. He was one

of the most consistently friendlypeople around and a pioneer in thetrenchless industry. He and his wifeEveyln were familiar faces at NUCAconventions, traveling mostly in theirRV.

Johnny was the owner of SanAntonio Road Boring, and a strongsupporter of NUCA’s legislative andsafety programs. He will be greatlymissed by his many friends in theunderground utility constructionindustry. Click here to view his fullobituary.

White HousePLA Rule GoesFinal –Business Linesup inOppositionDuring the week of April 11, theObama Administration issued afederal rule that implements anExecutive Order (EO) that wassigned by President Obama inFebruary 2009. The ruleencourages federal agencies torequire “project labor agreements”(PLAs) for all construction projectslarger than $25 million, essentiallymeaning that only contractors who

agree to union representation areeligible for federal projects. Althoughthe rule does not throw a blanketrequirement subjecting all federalprojects to PLAs, it would requirefederal agencies to develop PLApolicies that that could be applied toindividual federal projects. Under thefinal rule, the threshold of the originalEO is maintained ($25 million forfederal construction projects) andPLA’s could not be retroactivelyapplied to federal projects alreadyunderway.

NUCA does not oppose policies thatallow for PLAs between the projectowner and the contractor(s) workingon the project. However, we dooppose federal requirements thatmandate the use of PLAs. Therefore,NUCA joined several businessorganizations signing a letter insupport of the Government Neutralityin Contracting Act (H.R. 983)introduced by Rep. John Sullivan (R–OK), stating that the bill would “curbwaste and favoritism in federalconstruction contracting and ensurethat taxpayer–funded constructioncontracts are awarded on soundprinciples that will deliver totaxpayers the best possible productat the best possible price.” Thelegislation would prohibit governmentmandated PLAs on federal projects,while permitting contractors andsubcontractors to voluntarily enterinto PLAs after the project has beenbid.

deadline to receive the specialdiscounted rate at the Hyatt Regencyon Capitol Hill for the NUCAWashington Summit, May 17 – 19,2010. This year, your participationhas never been more important: theissues we are working can put theunderground utility constructionindustry back to work, put twoburdensome tax issues to rest andensure a fair environment in laborrelations.

With construction unemploymentremaining at around 24 percent,advocating for legislation that willprovide public and private dollars inthe water and wastewaterinfrastructure market will be JOB#1. Legislation (HR 537) that wouldeliminate the state volume cap onprivate activity bonds (PABs) haspassed the House and is gainingmomentum in the Senate (seeprevious article). Passage of the billwould open the door to limitlessprivate capital in our market.

Two notorious tax issues arereaching critical deadlines. UnlessCongress agrees on a fix, the federalestate tax (death tax) will return toprevious (2000) levels. Also, thedreaded “government 3%withholding” tax will take effect in2012 unless we kill it this year ornext.

Although “card check” legislation hasstalled for the moment, organizedlabor is no shrinking violet – they willpull out all the stops over the nextseveral months to move theEmployee Free Choice Act this year.So unless you’re okay with afacilitated process regarding unionaffiliation and binding governmentarbitration when a contract isn’tagreed to in 90 days, we respectfullysuggest you have a vested interest inthis year’s Washington Summit.

� All 120 state House seats are upfor grabs and more than half ofthe Senate.

Legislative actions have a majorimpact on our industry. It isimportant to elect members to theFlorida Legislature who are willing tolisten objectively to our concerns,

understand them and act accordingly.Our opponents are powerful withseemingly unlimited resources. Theyspend big money to elect candidateswho do not share our values andconcerns.

UUCF has just come off anothersuccessful Legislative Session. Thesuccess was hard fought. Thesevictories came because UUCF hasworked hard to send elected officialsto Tallahassee who will listen to ourconcerns.

UUCF has enjoyed much successover the years through its day–to–daylobbying efforts. The reasons forthis success are clear — we are visible,vocal and effective. The UUCF PACis one vehicle we use to reach our

Certified ContractorLicense Renewal

ReminderJust a reminder that the Certified Contractor licensesfrom the Department of Business and ProfessionalRegulation (DBPR) are up for renewal on August 31,2010. Current law requires licenseholders to obtain14 hours of continuing education with at least onehour in workplace safety, one hour in workers’compensation, one hour in business practices, onehour in the advance building code module, one hourin laws and rules (Chapter 489) and one hour in windmitigation (this requirement only affects general,residential, building, roofing and glass and glazingcontractors).

Don't forget to notify the DBPR office of any addresschange. Section 489.124(2) gives sole responsibilityto the licensee for notifying DBPR in writing of thelicensee's current mailing address and phone number.Failure to notify the department of a change ofaddress shall constitute a violation of this section. Inaddition, if your address changes and you do notnotify the department, you may not receive importantmailings from the department such as your renewalnotice.

Greetings to all, andwelcome to our newmembers. Lastmonth, we held theUUCF Board ofDirector’s Meeting at

the Governors Club in Tallahassee andmet with our state representatives andsenators. Our meeting went well,and the two main items approved werethe Budget and our contract with the R.Bruce Kershner Company. I would like tothank Kirk Richmond, Bruce Wendorfand everyone who helped with theirinput on these items. Like a lot of ourcompanies, we have made as manyrealistic cuts as we can, and BruceKershner will continue taking advantageof any savings that might come upduring the year. If you have anyquestions on these two items, you arewelcome to call your chapterrepresentative, myself or the UUCFoffice, and we will be glad to answeryour questions.

On TuesdayMarch 23,we visitedourrepresenta-tives andsenators atthe Capitol.

I have not spoken to the otherchapters but our Northwest FloridaUCA chapter had very good visits withour representatives and senators. Forthe most part, they felt the same waywe did about our issues. One majorissue before the state is taking $426million dollars out of the StateTransportation Fund and putting thatmoney into the general fund. The ideabehind moving the money is that somethink it will create jobs. Our thoughtsare that it will take away more jobsthan it will create and will take workfrom our industry. We also heard thatmost of the money will go toeducation, and the legislators areworried how to argue against

education to save the highway money.

In closing, congratulations to theUUCF/Andrew Scott JohnsonMemorial Scholarship FoundationFishing Tournament which, as usual,was a great success. Also, we have our2010 UUCF Convention 30thAnniversary “Journey to the Future . . .‘Don’t Stop Believin’” cruise on July22–26 which should be a blast. TheConvention Cabin Registration Form isout, and we encourage everyone toregister as soon as you can. The Underground Utility Contractorsof Florida (UUCF) Board of Director’sMeeting and Annual LegislativeBriefing were held in Tallahassee onMonday, March 22. The chapter wasrepresented by Joe Cook, Bill Davis,Bill Lee, Paula Lieser, Bill McGoughand Michele Kelson.

On Tuesday, attendees met withmembers of our legislative delegationto voice concerns on specific bills andissues which will impact our industry.

SolisAnnouncesNew OSHAEnforcementInitiativesSecretary of Labor Hilda Solisannounced a number of major newOSHA enforcement initiatives duringher April 14 keynote address atthe National Action Summit for LatinoWorker Health and Safety. OSHAcurrently requires that trainingprovisions under OSHA standards beprovided in a language or a form thatworkers can understand. OSHAfurther requires that its ComplianceOfficers check and verify that workershave received the training requiredby OSHA standards. The Agency willexpand upon this and effective onApril 28 –– Workers Memorial Day–– Secretary Solis explained, "OSHAwill also assure that its ComplianceOfficers check and verify not only thatthe training has been provided, butthat it was provided in a format thatthe workers being trained canunderstand." The Secretary alsoannounced a new pilot program whereOSHA will work with local buildinginspectors to assure worker safetyand health protection. In construction,the four leading causes of workerdeaths are falls, electrocution, beingcrushed or caught between andbeing struck. Inspectors participatingin this pilot program will notifyOSHA when they observe unsafework conditions leading to these fourmajor causes of workplace fatalities.
