and adhere to the instructions therein. Speakers are cautioned that under California

comments regarding any person simply because those comments are made at a
public meeting.

portion thereof to qualifying rosters, for the Fontana American Little
League to use the playing fields at Eric Birch High, Almeria Middle,
Locust Elementary, and Tokay Elementary to hold baseball practices for
their little league teams every Monday through Friday from March 18,
2013 through May 24, 2013 and to extend the same to all three leagues
named above should any of the others request playing fields.

The Fontana Unified School District Board of Education held a
regular meeting on February 20, 2013, in the John D. Piazza Education
Center, 9680 Citrus Avenue, Fontana, California. President Hawthorn
called the meeting to order at 5:00 p.m.; roll call is reflected below:

sentence fragment “as requested by” and corrected the vote on
Resolution 13-16 from 5-0 to 4-0-1; L. Corona abstained;
On Reference O, corrected the dollar amounts for the cost of
Lieutenant to $270,565.00, and total cost of District Police Chief Step 1 to

Oskar Zambrano commented on the interview process he had
been involved with several weeks earlier for a Police Chief, and his
disappointment that the selected candidate had not been presented to
the Board for approval. Staff explained the selection process and that a
committee’s selection may not necessarily be brought to the Board.
There was consensus among the Board Members to include a statement
on the confidentiality statement for members of interview panels to this
effect.

In the event the Board did not appoint a School Police Chief from
two pending interviews, the Board voted to use a search firm at a cost of
$17,500.00 plus approximately $6,800.00 in expenses and to continue
utilizing the services of the present Chief at Sargent pay for 30 days, and
directed the Superintendent to expedite the process.

request to implement a diversity committee, and asked her to bring a

The Superintendent shared an invitation to the San Bernardino
County Superintendent of Schools State of Education address where the
Fontana High School Marine Corps Junior Reserve Officer Training Corps
would be presenting the colors.
Correspondence
Oscar Dueñas, Associate Superintendent of Instructional Services,
shared information that District staff had attended and presented at the
recent California Association of Bilingual Educators conference in Long
Beach, and received recognition for their work on the District’s Seal of
Biliteracy.
Mark McLaughlin, Director of Certificated Human Resources,
thanked Mr. Zambrano for bringing his concerns forward; he wanted to
make sure district staff did not become entrenched in routine practices
and he wanted to make sure they were making the best
recommendations.

Board Member Green commented on visiting the family of the
student who had died, and asked what the protocol was when a visitor
at Board meetings was asked to leave. Attorney Medina explained that
because Board meetings were held in public the only reason a member
of the public could be asked to leave was if they were causing
disruptions or otherwise hindering the ability of the Board to conduct its
business.

President Hawthorn explained that he had noticed a gentleman
walk in wearing a heavy coat and carrying a bag, and due to recent
events in other school districts asked the Superintendent to have
Sergeant Avalos talk to the man as a precaution. Sergeant Avalos noted
that the person had left on his own and had been there for a different
item other than what was on the evening’s agenda and would come
back on a different date. Board Member Green continued that she had
a four-year-old daughter who watched the meetings and had asked
why Linda was so hateful. She provided information for the public that
she held several degrees and agreed with Bobbi Jo that the hatefulness
had gone on too long, and she was getting to the point where she
would start to respond from the dais. She thought people like Linda were
fueled by a former Board member; they were not talking from their heart
but because they were being sent by another person, they were the
same people who came and talked about Board Member Garcia and
were more hateful than anyone she had ever met.
Board Member Garcia noted that, regarding a statement made
during public comments, she was allowed to leave the dais and relieve
herself when she had to; she was there to do the work of the District and
people could see that such work was being accomplished despite all
the attempts to distract and be hateful. She had heard from employees
asking what the person was talking about and stated that she was OK
with people being critical of herself but she was not OK with anyone who
came to the podium to talk about members of her family; that was off
limits and if necessary she would “lawyer up”. She thanked staff who
were working hard to get things done despite being short-handed; the
CBO job was a huge thing to be handling and they had to make it a
priority to get someone in that position; she looked forward to a special
meeting to make an interim appointment.
Board Member Corona thanked principals for the opportunity to
walk schools, talk to teachers, parents and kids, it was a wonderful
community. She had talked to Academic Pathway Advisors,
Comprehensive Student Support Providers, and others who were going
above and beyond, using their personal time, and she was very grateful.
She thanked Cindy for attending and speaking about the fundraiser for
scholarships and looked forward to working with others to make the
program a success. She apologized to the audience for having to cope
with challenges and disrespect; it was not directed towards the
community, staff members or students, their positive input would help
them move forward, they believed they had a wonderful community.
She also thanked the Superintendent for being very kind, and thanked
staff members as she was learning step by step; they were there to
advocate for the community and had no hidden agendas. She was
looking for a place at the District Office where she could meet with
community members the first and second Thursdays of every month.

Vice President Chavez shared that she truly loved the community
and the students of the community. She quoted Pope John Paul and
expressed the need to show love, to be quiet and listen and not quick to
answer. She commented on attending Coffee with the Principals and
that the topic of bullying kept coming up; she asked the administrators to
please do their jobs. She spoke of being involved in a survey through the
District English Learners Advisory Council and of a mental health
presentation than had to do with drugs and alcohol. She thanked Victor
Sanchez for his comments, and noted that as an advocate she had
concerns with the 504 plan.
President Hawthorn provided information on an upcoming cancer
survivor ice cream social, commented on the recent proliferation of solar
panels and asked to find out how those had worked out for other districts
and to take another look at implementing solar energy if the rest of the
Board so agreed. He then asked for Counsel to clarify and provide a
legal opinion on whether the process used to select a Supplemental
Early Retirement Program had been legal. Attorney Medina shared that
as the SERP contract was for professional services it did not need to go
through a Request For Proposals and that the selection process that staff
had undertaken was legal. Board Member Green noted that she had
two issues; one that a person got a denial letter before the closing
deadline, and the second that an employee had sent the denial letter
and she thought that it was a Board decision as to whether or not
something was approved. Attorney Medina explained that the process
had been handled properly; it was appropriate for staff to send
notification letters to the applicants advising of their recommendation,
but it would ultimately be the Board’s decision whether or not to
approve the recommendation. President Hawthorn then asked Attorney
Medina if it was legal and appropriate when responding to requests by
the Superintendent or staff on Board Members’ availability for special
meetings to copy the other Board members. Attorney Medina replied
that it was completely OK; the Brown Act applied only to actions, and it
was best not to reply all or comment on the substance of the meeting.

Superintendent Olsen-Binks noted that after reviewing the
availability of staff and Board Members as well as those who had an
interest it seemed that Wednesday would be best for a special meeting
on the rifles and counseling program. To provide the Board with the
opportunity to work through the budget process before Reduction In
Force notifications had to go out, she suggested a Tuesday meeting for
a budget study session. The Board provided consensus to schedule both
meetings.

Board Member Garcia asked Attorney Medina if it would be fair to
have a discussion of the CSSPs before the special meeting; she felt the
items she had requested had been pushed back. Attorney Medina
replied that there was no legal answer to that question; with the way the
Superintendent was suggesting the Board would have facts related to
the budget before; it was a matter of what made the most sense, if they
wanted to combine both into one meeting that was fine. Superintendent
Olsen-Binks shared that the two meetings would serve different purposes;
the workshop would be a study session with opportunities for questions
and to receive information before going into the Board meeting on
Wednesday. She then acknowledged Vice President Chavez for her
comments on bullying and shared that she and the Chief planned to
work on a defined process for administrators to follow; it was one of the
Chief’s priorities. She noted that the 504 training would be revisited, and
that staff was working on teacher and classified employee of the year
recognition as well as a parent recognition program.

Pat Mazzulli commented on the Governor’s education funding
proposal and how that might provide additional revenue to the District
in years to come; he encouraged the Board to take that into
consideration.
Tony Gutierrez commented that he would hate to see employees
laid off and that teamwork was needed to keep everybody working;
each classified position cut impacted two or three others.
Frank Scialdone commented on his past experience as a City
Council member and urged the Board to make sure revenue was there
and not make expenditures based on projections.

The Fontana Unified School District Board of Education held a
special meeting on February 27, 2013, in the John D. Piazza Education
Center, 9680 Citrus Avenue, Fontana, California. President Hawthorn
called the meeting to order at 6:32 p.m.; roll call is reflected below:

The Board adopted the meeting agenda with the following

Due to the many requests to address the Board, the time for
each individual speaker would be limited to three minutes so everybody
could be heard; speakers would be asked to gather in groups of three.

School Police Chief Billy Green and Fontana Police Chief Rodney
Jones provided information regarding the purchase of 14 AK-15 assault
rifles for School Police Department officers.
Public comments on this item were received by: Oskar Zambrano,
Linda Scialdone, Frank Scialdone, Kyle Crowther, Anna Conklin, Theresa
Delgado, Bobbi Jo Chavarria, and Matt Owen.

President Hawthorn made a motion to protect students, parents
and employees by supporting the Superintendent and School Police
Officers, keeping the rifles in place, fostering important relationships by
keeping lines of communication open, and by educating students,
parents and employees to look for and identify individuals who could
become a threat; motion was seconded by L. Corona and carried on a
5-0 vote.

to take a look at an exemplary student support, counseling program,
subject to sufficient funding to support the program without
compromising the effectiveness of other programs, required bargaining
units with Fontana Teachers Association, a direct, distinct connection to
academic success of all students, a direct, distinct connection to school
safety, inclusion of reportable measures of number three and four, and
regular, recurring reports at least annually of those reportable measures;
motion was seconded by Board Member Green and carried on a 5-0
vote.

ITEM TITLE: Reimbursement BOARD OF EDUCATION MEETING: 03/13/13 Consent Calendar Session
BACKGROUND: Students within the Fontana Unified School District identified with exceptional needs may be placed at a site other than their home school due to the student’s needs. Parents of such students may be reimbursed for mileage expenses by the Fontana Special Education Local Plan Area (SELPA) should they agree to provide transportation as part of their student’s Individual Education Program (IEP). A Fontana Unified School District student identified with exceptional needs was placed at Applied Behavior Consultants, Inc., a nonpublic, nonsectarian school (NPS) due to the student’s need. Parent reimbursement is requested for February 1, 2013 through June 30, 2013. Parent will submit a monthly mileage report for reimbursement. FISCAL IMPLICATION: Estimated Amount: $5,330.60 (Special Education Restricted Funds-SPED)
RECOMMENDATION: The Superintendent recommends that the Board of Education approve reimbursement to Esmeralda Karime Navarro, parent of an exceptional needs student for transporting her child from their residence to Applied Behavior Consultants, Inc., in Ontario, at an estimated amount of $5,330.60 effective February 1, 2013 through June 30, 2013. BACKGROUND: As provided in Board Policy 6153, School-Sponsored Trips, “The Governing Board recognizes that field trips are important components in the instructional program of the school”. The policy also denotes that all trips involving out-of-state or overnight travel shall require prior approval of the Board. Fontana A.B. Miller has 2 students that have qualified for the Girls’ State Wrestling Championships in Lemoore, California on February 21-24, 2013, and have the opportunity to compete against various other schools. The students will miss 2 days of school. The trip requires an overnight stay, and will be chaperoned by the High School Wrestling Coach and Assistant Coaches. FISCAL IMPLICATION: Approximately $1300.00 – Funded by California Interscholastic Federation, Associated Student Body, and Athletics RECOMMENDATION: The Superintendent recommends that the Board of Education ratify an overnight trip for two qualifying students from the Fontana A.B. The policy also denotes that all trips involving out-of-state or overnight travel shall require prior approval of the Board. Approximately 16 students and 2 teacher chaperones from Fontana A.B. Miller High School have the opportunity to attend Friday Night Live Youth Leadership Training Institute at Buckhorn Camp in Idyllwild, CA on March 22–24, 2013. This conference gives students the chance to learn skills to implement a successful club that brings awareness of the effects of drugs/alcohol/tobacco. FISCAL IMPLICATION: Approximately - $1,620.00 to be paid out of the School, Safety, and Security (S3) Grant RECOMMENDATION: The Superintendent recommends that the Board of Education approve an overnight trip for approximately 16 students from Fontana A.B. Twenty-one students from Fontana High School’s Welding and Woodworking classes will attend the Skills USA State Leadership Conference and Skills USA Championships Competition in San Diego, California on April 4 - 7, 2013. Students will have the opportunity to demonstrate mastery of both curriculum and industry standards in competition. This trip requires students to miss two days of school instruction, and an overnight stay of three nights. The trip will be chaperoned by two certificated employees of the Fontana Unified School District and one Board approved volunteer. This event gives students the chance to prepare for upcoming events, foster team building, and to encourage students to trust each other. Parents will drop students off at the school and students will remain on campus for the duration of the camp. The portion of the contract for Axiom to provide District Report Card Services at $1,250.00 per year was inadvertently left off of the previous Board approval. ITEM TITLE: Claim BOARD OF EDUCATION MEETING: 03/13/13 Consent Calendar Session BACKGROUND: The Fontana Unified School District Board Policy 4156.3 (a) (b) (c) (d), 4256.3, and 4356.3 allows reimbursement to district employees up to $200.00 for damaged or stolen property (excluding money); and a maximum of $250.00 for vehicle damage resulting from malicious acts while the vehicle is parked or driven on or contiguous to school or other district premises. Rachel Coccia is a teacher at Fontana A. B. Miller High School. On May 14, 2012, the girl’s Physical Education Department was broken into and her Oakley Sunglasses and Lexar jump drive were stolen. The value totaled $136.00 No prior approval (by completing form No. B-57) was received by the employee to cover the above referenced items. Secondly, the Employee Reimbursement form is due within ten days and the Employee’s request for reimbursement was submitted late. ITEM TITLE: Claim BOARD OF EDUCATION MEETING: 03/13/13 Consent Calendar Session BACKGROUND: Fontana Unified School District contracts with Southern California Relief as a third party administrator to handle and adjust Property/Liability claims submitted against the District. However, in some instances there are claims that can also be handled directly by Fontana Unified School District. Ann Evans parked her car in the West Randall Elementary School parking lot. When Ms. Evans returned to her car, she noticed that her vehicle had been struck by another vehicle. The District’s video surveillance cameras do not cover that area. Since it was a vehicle vs. a vehicle incident, it would not be a covered claim. The responsible party would be the owner of the vehicle who struck Ms. Evan’s vehicle. FISCAL IMPLICATION: Amount: Undetermined at this time RECOMMENDATION: The Superintendent recommends that the Board of Education reject the claim for an undetermined amount submitted by Ann Evans as recommended by the Fontana Unified School District Risk Management Department. There is playground equipment located in the play area outside of this building. The equipment is not suitable for use at any other location in the District. Fontana United Methodist Church has offered to remove the equipment for use at the church. They will sign a liability waiver releasing the District from any and all liability during and after the removal of the equipment. By donating the equipment, the District would save the cost of having to have it removed and disposed of. RESOLUTION NO. 13-19 OF FONTANA UNIFIED SCHOOL DISTRICT APPROVING PURCHASES OF WIRELESS COMMUNICATION SERVICES
AND EQUIPMENT FROM VERIZON WIRELESS OFF THE WESTERN STATES CONTRACTING ALLIANCE (WSCA)
WHEREAS, pursuant to Public Contract Code Section 12100 Department of General Services is authorized to make purchases of wireless communication service and equipment on behalf of school districts and other local governmental agencies; and WHEREAS, the purchase or leases of such goods and services by the Department of General Services are to be made upon the same terms conditions and specifications at a price lower than the District can obtain through its normal acquisition procedures; and WHEREAS, the Western States Contracting Alliance (WSCA) has contracts for wireless communication service and equipment which the District needs to purchase in order to complete the project identified below; and WHEREAS, based upon the facts identified below and information presented to the Governing Board, it is in the best interest of the District to purchase wireless communication services and equipment from Verizon Wireless, who currently has contracts in good standing with WSCA. This authorization is requested for the 2013/2014 school year (through June 30, 2014). NOW, THEREFORE, BE IT RESOLVED: SECTION 1. FACTS SUPPORTING PURCHASE OFF WSCA Verizon Wireless has provided wireless communication services and equipment for surrounding businesses for many years. They are in good standing with Universal Service Administrative Company (USAC) and are aware of our District’s standards and needs. Based upon the goods and services to be provided by Verizon Wireless, it has been determined that the price to be obtained through WSCA is lower than if the District were to competitively bid the goods and services. BACKGROUND: March 31st marks the 83rd anniversary of the birth of one of the nation’s foremost civil rights and labor leaders, Cesar Estrada Chavez. In 1952 Chavez co-founded the National Farm Workers Association and led human rights campaigns throughout California. Cesar Chavez became an organizer for Community Service Organization (CSO), coordinating voter registration drives, battling racial and economic discrimination against Chicano residents, and organizing new chapters of the CSO across California and Arizona; he went on to serve as national director of the CSO in the late 1950's and early 1960's; after failing to convince the CSO to commit to helping migrant farm workers in organizing, he quit his job and founded the National Farm Workers Association (NFWA). He was nominated three times for the Nobel Peace Prize. During his lifetime, Cesar Estrada Chavez led a national movement to improve the lives of migrant farm workers. Whereas César Estrada Chávez was a leader for civil rights, Latinos, farm workers, and labor; a community servant and social entrepreneur; a crusader for nonviolent social change; an environmentalist and consumer advocate; and, in the words of Robert F. Kennedy, “one of the heroic figures of our time,” and Whereas César Chávez’s dream was to create an organization to protect and serve farm workers, whose poverty and disenfranchisement he had shared. Chávez led the first successful farm workers union in American history, achieving dignity, respect, fair wages, medical coverage, pension benefits, and humane living conditions, as well as countless other rights and protections for hundreds of thousands of farm workers; and Whereas César Chávez’s organization became, in 1966, the United Farm Workers of America, AFL-CIO, which shares, in common with all organized labor, the goals of dignity, respect, fair wages, medical coverage and pension protections for old age; and Whereas the life of César Chávez transcends any one cause or struggle. He was a unique and humble labor leader, and a great humanitarian and communicator who influences and inspired millions of Americans from many diverse walks of life to seek social justice and civil rights for the poor and disenfranchised in our society; and Whereas the Fontana Unified School District Board of Education recognizes the contributions and accomplishments of César Chávez and encourages all schools to conduct appropriate school activities in observance of his birthday on March 31st. ITEM TITLE: Second Reading Revised Board Policy
BOARD OF EDUCATION MEETING: 03/13/13 Discussion/Action Session
BACKGROUND: The Fontana Unified School District Board Policy (BP) 6200 reviews and updates the requirements for High School Graduation credits for the Fontana Adult School and is in need of revision. The revised Board Policy 6200 with the new High School Graduation requirements is to be effective the 2012/13 school year.
Existing state law requires all graduating high school diploma students to complete one course in visual and performing arts or foreign language. Beginning with the 2012/13 school year; New Legislation AB 1330 authorizes local educational agencies to accept a Career Technical Education (CTE) course as an optional high school graduation requirement in lieu of one course in visual and performing arts or foreign language. AB 1330 will be in effect until the end of the 2016/17 school year.
Transfer of Credits by Non-Graduates: Beginning with the 2012/13 school year and every year thereafter, students may transfer a maximum of 40 credits earned from Fontana Adult School back to a FUSD High School in order to receive a diploma from that high school, if the student does not graduate with his/her class. Students must meet the most current Graduation Requirements as established by the Board of Education. Proof of graduation will be given upon request at the time of verification of completion of all work required for graduation.
The first reading of this policy was approved at the February 20, 2013 regular Board meeting and is now being brought back for second reading adoption. New language is shown as underlined text in the attached Board Policy 6200 document. Adult Education
The Governing Board recognizes that education is a lifelong process and that it is important for individuals to continuously develop new skills.
The Superintendent or designee shall develop and oversee the district's adult education program. The Board shall approve all courses to be offered in this program.

Graduation Requirements
High school graduation shall require a total of 180 units of credit of courses as prescribed by the Fontana Unified School District and the State Department of Education.
Year 2003 and before: required courses - 130; elective courses - 50
Year 2004 and after: required courses - 110; elective courses - 70
1. Credit will be given from the 9th grade and beyond in the area or required subjects such as English, Math, Science, and Social Studies, as well as any elective subjects.
2. Physical Education is not a requirement of Adult School.
3. Five units of credit will be given for courses consisting of a minimum of 50 hours of instruction at Fontana Adult School.
4. Transfer of Credits by Non-Graduates: Beginning with the 2012-13 school year and every year thereafter, students may transfer a maximum of 40 credits earned from Fontana Adult School back to a FUSD High School in order to receive a diploma from that high school, if the student does not graduate with his/her class. G.E.D Tests
Students must be 18 years of age before G.E.D. credit and/or testing will be allowed. (Exceptions: certain eligible minors.)
1. On each test the student must earn a score of at least 410 to pass each individual test, however, a total score of 2250 points must be obtained to pass the entire battery of tests.

4. Any person who has passed the test may repeat a different form of the test for the purpose of increasing the number of semester hours of credit earned if he/she presents evidence of having taken courses which might tend to improve his/her scores on certain areas of the test.

California Little League District 71, representing Fontana American Little League, Southridge Little League and Southwest Little League, has filed a request to waive fees for use of District playing fields for baseball practices for the leagues named. Fontana American Little League is the only one of these to have filed a Request and Agreement for Use of School Facilities for the use of the playing fields to date. They are requesting playing fields at Eric Birch High, Almeria Middle, Locust Elementary, and Tokay Elementary to hold baseball practices for their little league teams every Monday through Friday from March 18, 2013 through May 24, 2013. This waiver request would extend to all three leagues named above should any of the others request playing fields. BACKGROUND: On March 21, 2012, the Board of Education approved a contract addendum for Wide Area Network (WAN) services with Sunesys, LLC. This contract runs through June 30, 2013. Renewing this contract would increase the District’s Wide Area Network capabilities while reducing the individual site cost. The amount may vary depending on the number of students receiving free or reduced meals at the school sites. To receive E-Rate funding, we must post a Request For Proposals (RFP) on our District website, as well as advertise in a local newspaper. Three (3) vendors responded to the RFP. After review of proposals, it is being recommended that the proposal be awarded to the lowest responsible, responding bidder. After review of proposals, it is being recommended that the proposal be awarded to the lowest responsible, responding bidder. BACKGROUND: Pivot Learning Partners will work with the district, parents, Superintendent, Executive Cabinet and Board of Education to facilitate the building of long range planning that is student –focused and based on a future vision for student success with Common Core State Standards and 21st Century teaching and learning. Pivot Learning Partners will support the district leadership in all departments through a process to align the budget to the goals and ensure the success of the plans by coaching and supporting as they create action plans to support the goals of the plan, implement those action plans, and then monitor and adjust as needed. Pivot Learning Partners currently provides Leadership training for Superintendents in the county of San Bernardino through the County Superintendent of Schools. FISCAL IMPLICATION: Not to exceed $74,025. ITEM TITLE: CSBA Delegate Assembly BOARD OF EDUCATION MEETING: 03/13/13 Election Discussion/Action Session
BACKGROUND: As a member of the California School Boards Association (CSBA), the Fontana Unified School District Board of Education participates in the CSBA Delegate Assembly Elections for Subregion 16-B, San Bernardino County. Voting is now occurring for representatives to the CSBA Delegate Assembly. Subregion 16-B has seven vacancies. The Board as a whole may vote for up to the number of vacancies in the Subregion as indicated on the attached ballot. Not more than one vote may be cast by the Board for any one candidate. The ballot must be returned to CSBA, postmarked by the U.S. Post Office on or before Friday, March 15, 2013. ITEM TITLE: Board Member Conference BOARD OF EDUCATION MEETING: 03/13/13 Attendance Request Discussion/Action Session
BACKGROUND: The District’s Fontana Leadership Intervention Program (FLIP), has been selected as the National School Boards Association Magna Awards 2013 Grand Prize Winner. The program will receive special recognition during the NSBA Annual Conference in San Diego; Board Members and the Superintendent have been requested to attend the awards luncheon on Saturday, April 13; travel to the conference is at the District’s expense.
Board Bylaw 9250, Remuneration, Reimbursement And Other Benefits, provides that Board members shall be reimbursed for actual and necessary expenses incurred in attending any meetings or in making any trips on official business of the school district when so authorized in advance by the Board.
Board Member Green has requested to attend the National School Boards Association 73rd Annual Conference in San Diego Saturday through Monday, April 13-15, 2013. Anticipated costs are as follows:
Registration (non-member): $920.00
Lodging (Three nights @ $239 + tax/night): $807.12
Estimated meals ($60.00 per day; includes travel days) $300.00
