ISSUE: Consider and/or act on the application of Shadab Parvez of Dulce Homes, for a variance to Murphy Code of Ordinances Section 26.06.002(1)(F), to permit a 5:12 roof pitch where 8:12 is required, at a property located at 120 Syed Drive, legally described as Lot 11, Block B, Oasis Spring Manors Phase One. STAFF RESOURCE/DEPARTMENT: Reagan Rothenberger, MPA, Planner SUMMARY: The subject property is located at 120 Syed Drive in Oasis Spring Manors and is zoned Single-Family Residential-9 (SF-9) with a Planned Development overlay (PD 16-10-1023). The applicant requests a variance to Murphy Code of Ordinances Section 26.06.002(1)(F), Roofs, in order to permit a lower pitch of 5:12 where 8:12 is required by code. This Planned Development makes no mention of roof pitch standards. Section 26.06.002(1)(F) states:

• Roofs: Roof materials shall be composition (30-year), standing seam metal, terra-cotta tiles, concrete tiles or slate in muted colors ..... Minimum roof pitch shall be at least 8:12, unless otherwise stated in the applicable zoning district or PD ordinance, and except for “Santa Fe” (with a flat roof and highly articulated parapet that conceals the roof and any roof-mounted equipment), “Texas ranch house” (with low pitched roofs, large eaves/overhangs, rambling design), or other uniquely styled home.

The applicant contends that Mediterranean style homes, from an architectural standpoint, generally call for a lower pitched roof especially if the roof material is tile or slate. The applicant has provided façade renderings for the proposed home. OTHER CONSIDERATIONS: Staff requests direction from the Planning & Zoning Commission and City Council regarding the last phrase in Section 26.06.002(1)(F), where it permits lower pitched roofs in "other uniquely styled homes". It is the belief of staff that multiple homes in this neighborhood will make the same request as this one. The following are options to consider:

• Each home can come before the approving bodies for a variance; • Staff can bring a PD amendment to the approving bodies addressing the issue; or • Staff can administratively approve homes with certain criteria, i.e., home must have

tile roof, home will be of the Mediterranean style, etc. by using the language provided in Section 26.06.002(1)(F).
