There is an old saying that “it is an ill wind that blows nobody any good”. While it will be interesting to see the negotiations with the senate on what measures in the budget actually make it through, it is clear that with all the doom and gloom in the weeks leading up to budget night and the demonstrations following, that consumer confidence has fallen.
The up side to this is that it appears interest rates are likely to remain at all-time lows for longer than had been predicted and that investors are still out there looking for property with a good return.
As always the issue for us agents is stock, and if you have it, managing unrealistic buyer expectations, which in the case of investors, increasing prices are reducing returns particularly when combined with the rate of rental increases diminishing lately.
The use of EAC data in relation to suburb median prices etc. as well as sourcing as many comparable properties as possible is invaluable in giving you hard facts to combat these unrealistic vendor expectations.
On the 30th April, the EAC Board continued its policy of getting out to meet the members and travelled to Tamworth. The Board
meeting was followed by an industry update function with local offices and was well attended by principals, salespeople and property managers. Afterwards there was an opportunity for discussion of local issues directly with the Board over a quiet drink and finger food.
As we have found in the past, this one on one discussion is invaluable to EAC to learn more about issues at the coal face and areas where we may be able to improve our services. Combined with our feedback forms from those participating it helps us focus on those areas most important to our members.
The experience has been that while there are obviously many similar issues across the state there are also local issues particular to each area, which we try to accommodate as far as possible.
The EAC Board is always keen to receive feedback from our members on any topics that agents would like to see addressed which we will endeavour to include in future events. Feel free to contact a board member or EAC head office if you have feedback of your own, you don’t have to wait for our next visit to your area, the sooner we know of an issue you or your area has, the sooner we can work out a solution for you.

At the meeting we gave the Minister an overview of who we are and theservices we provide and the role we play in the industry.
On the 15th of April, Dale Whittaker, EAC Chairman and I met with the then new Minister for Fair Trading Stewart Ayres. At the meeting we gave the Minister an overview of who we are and the services we provide and the role we play in the industry. Some of the topics that we discussed included our relationship with the Real Estate Institute of Australia (REIA), The Fair Trading Dispute Resolution Service, Regulation of the Industry, training standards, the lack of consultation on the recent amendment to the Condition Reports, concern regarding Asbestos, Mutual Recognition and the demise of National Licensing late last year.
One of the other topics that we discussed with the Minister was the upcoming review of the Property, Stock and Business Agents Regulation and the draft regulation which was made available on the 19th May 2014. We are currently going through the proposed changes and will submit a paper by the required date of the 13th June 2014. I was going expand more on the outcomes of the meeting but as a result of the reshuffle that took place in early May we now have yet another new Minister for Fair Trading, Matthew Mason-Cox whom we plan to meet with soon.
The new eForms solution that you would have read about in recent communications will be released on the 10th June 2014. We will be holding webinar training on the new system prior to the release date so make sure you book a spot. I would like to thank the users and offices who took the time to assist with the beta testing of the new system, your feedback was invaluable.
For all the Auctioneers out there EAC in conjunction with the REIA will once again be hosting the NSW heats of the Real Estate Institutes’ Australasian Auctioneering National Championships. We now have nine entrants. Entry for contestants closed on the 30th May 2014 and more information can be found at eac.com.au
This year, for the first time in a few years, NSW offices of Affiliate Council Members of the REIA will again be able to enter the REIA National Awards for Excellence. The EAC / REIA NSW Awards for Excellence aims to encourage, recognise and
promote excellence and best practice in the profession. For more information on the awards please see the addition information in this edition or visit www.eac.com.au. We would love to see EAC Members recognised at both a state and national level.

If the fixed term of the lease is more than 3 years then you can nominate the size of the penalty which is then written into the agreement.
The Residential Tenancies Act 2010 (the Act) provides options for property managers as to how they intend to handle the circumstances of a tenant who wishes to break their lease. The only difficulty is that you cannot wait for the tenant to break the lease before you choose the method; you need to make the decision and have agreement with the tenant before the lease is entered into.
The standard form of Residential Tenancy Agreement provides for an additional term, Clause 41. This clause is a “default” option, that is it is written into the standard agreement and if you don’t delete it then the clause applies and the penalties payable by the tenant for breaking are fixed and enforceable.
Clause 41 provides for the payment of the following penalties depending on the circumstances.
If the fixed term of the lease is for 3 years or less then the penalty is 6 weeks rent if less than half of the term has expired or 4 weeks rent in any other case.
If the fixed term of the lease is more than 3 years then you can nominate the size of the penalty which is then written into the agreement.
If you decide to delete the break fee then you will have recourse to the traditional method whereby the tenant who is breaking the lease is required to pay the rent until a new tenant is found and meet a proportion of the advertising costs and the agent’s reletting fee. These costs can be apportioned in keeping with the unexpired portion of the lease. For example if the tenant is breaking in the first quarter of the agreement then they may be
required to meet 75% of the costs of reletting.
In these circumstances Clause 36 of the Agreement applies the rules of law relating to the landlord’s responsibility to mitigate the loss to the tenant, that is “reasonable” action must be taken to contain the loss.
In the event, however, where you have not deleted Clause 41, that is you have adopted that method, then the mitigation of loss rules do not apply. The penalty is fixed, either 4 or 6 weeks, and irrespective of when a new tenant is found that is what the outgoing tenant has to pay. On some occasions you may find a replacement tenant within a few days and the penalty payable will represent a “profit” situation for the landlord. The costs of the reletting are then met by the landlord and are not passed on to the tenant.
Property managers should not make the decision on which method to adopt without consultation with their client, the landlord. You need to explain the two methods that are available and think through which method would better suit the circumstances and the type of property, having particular regard as to the likely time for reletting.
If the break fee method is chosen then keep in mind that you should collect the break fee, either 4 or 6 weeks, separately from the bond, that is ask the tenant to pay the fee at the time of giving notice. The bond is only 4 weeks and if there are arrears and damages at the time the tenant vacates then the chance of you collecting the break fee will be remote, particularly if the tenant is going overseas so make early arrangements to secure payment.
The following article recently published by OFT is a timely reminder for property managers and building owners to be aware of the risk and be alert to possible problems. The attitude of “well, it’s been there for a long time and hasn’t fallen down yet so it must be OK” is simply not good enough. We as property managers are not qualified as structural engineers or builders and must not make assumptions about structural integrity. Careful inspection is the key and if you have any concerns whatsoever then request the owner to obtain a professional report. Simply stating in the condition report that there is a “damaged rail” and then not having it attended to would be clearly negligent. This sort of detail should be noted in the Property Inspection Report, (the initial report required under Schedule 2, Rule 10 that you complete at the time of entering into the managing agency agreement), and the owner made aware immediately. Any necessary repairs must be carried out as a matter of urgency, before occupation by the tenants.

Decks and balconies, like all parts of our homes and other buildings, require routine and regular maintenance to keep them in good repair and to identify any emerging issues.
Under NSW tenancy laws, landlords must provide and maintain rented premises in a reasonable state of repair. At the beginning of a tenancy, any faults or damage should be noted on the condition report that must be completed and signed by both parties.

Real Estate Video Marketing is a standard in online marketing for Real Estate Agents and YouTube has been the platform of choice from which to launch these videos. Visual marketing plays a huge role in advertising properties.
Using a customised thumbnail image you can have greater control of how your video is presented in YouTube. Optimisation can be achieved by using the “Hero” image of a property and including the listing title. The image can include your logo and corporate colours.
To add the custom thumbnail you need to log into your YouTube account and click on your video manager. From there you click on edit for the video you want to add the image to. Then browse to the destination folder on your computer and upload the image. Don’t forget to click save.

Awards for Excellence 2014 Estate Agents Co-operative Ltd (EAC) and the Real Estate Institute of Australia (REIA) will be hosting the New South Wales Awards for Excellence recognising the real estate industry’s top performers from the NSW Affiliate Council Members of the REIA.
The EAC/REIA Awards for Excellence aims to encourage, recognise and promote excellence and best practice in the profession.
These awards provide an opportunity to be recognised at both a state and national level and winners from the New South Awards for Excellence will progress to REIA National Awards for Excellence in Perth on 12 March 2015.
EligibilityEntry to the Awards for Excellence is open to and needs to be made through the NSW Affiliate Council Members of the REIA including Estate Agents Co-operative, LJ Hooker, Professionals and First National.
Award CategoriesThere are a total of fifteen separate categories in the 2014 EAC/REIA NSW Awards for Excellence.
The award categories for agencies are:• Large Residential Agency of the Year• Medium Residential Agency of the Year• Small Residential Agency of the Year• Commercial Agency of the Year• Innovation Award• Communications Award• Community Service Award

Residential Condition ReportsThe Residential Condition Report amendment was announced late on Friday 28 February to commence from the next day, Saturday 1 March, with the advice that practitioners “must use the new version of the condition report.”
Unfortunately this amendment was introduced without consultation with industry bodies and as a consequence did not consider the practical application of the changes.
EAC has now received a response from NSW Fair Trading regarding any further changes and will soon have an updated version of our printed form available for purchase. The eForms version has been amended accordingly. If you are not using EAC Forms, check out our price comparisons and see what you can SAVE!

Legal costs are in addition to the policy limit, that is the limit is available for payments of any awards against the agent, rather than being used up by applicable legal defence costs;
Sub-Contractors and Consultants – the vicarious liability to the insured agency is covered for the actions of any sub-contractors and consultants;
Dishonesty of Employees – cover is provided to the agency for the actions of dishonest or fraudulent employees, provided such acts were not condoned by the Insured;Minimum premiums for a Professional Indemnity cover of $1,000,000 any one claim, with $3,000,000 in the Aggregate begin at $1,250 including all taxes, fees and charges.The policy includes the ability to purchase higher levels of cover as required.
OAMPS and EAC have also negotiated for reduced rates for office insurance and public liability, as well as a policy for management liability cover for members in order to provide a holistic solution to their business needs.
