CN Rail has hired an environmen-tal consulting company to assess thedamage, following the Jan. 11 trainderailment in Burnaby that saw threeoverturned cars spill unknown quan-tities of coal into Silver Creek.
On Friday, Jan. 17, workers wereon the water at Burnaby Lake, in frontof the nesting area for the endangeredWestern painted turtle, at the mouthof Silver Creek. The crew also had thenesting area cordoned off with bluenetting.
The Burnaby NOW and members ofthepublic havephotographedandvid-eotaped impacts from the spill, includ-ing blackened banks on Silver Creek, alarge dark area in Burnaby Lake, andcoal-coated sand on the nesting areafor the endangered Western paintedturtle. The area of Silver Creek wherethe derailment occurred is markedby signs from Fisheries and OceansCanada that state the area is a sensi-tive fish and wildlife habitat.

While TransLinks mayorscouncil has openly disagreedwith the province over a pro-posed transit referendum, SimonFraser University groups arehoping to get more students outto vote for it.
At Wednesdays council meet-ing, Metro Vancouvers mayorsreiterated their disagreementover a transit referendum andbounced the responsibility backon the province to word thereferendum it pushed for overTransLinks funding problems.
On Thursday, TransportationMinister Todd Stone confirmed
the referendum will go throughin November 2014. He said theresponsibility lies with the may-ors to agree on a regional plan,determine the price tag anddecide how to fund it.

A local resident is raising concerns that aSouth Burnaby development is encroachingon habitat for wildlife and fish.
Cameron MacDonald, a biology instructorat Langara College, lives in the Big Bend areaand walks along Byrne Creek. The salmon-bearing streamruns southof theRiverwayGolfCourse, into the Fraser River, but MacDonaldhas concerns that a massive development nextto the creek is too close to the waterway.
My main concern is they have a little eco-logical setback and theyve just ploughedit under, he told the NOW, while walkingalongside the creek recently.
The setback MacDonald is referring to isa strip of land that functions as a buffer zonebetween the development and the creekside.At the development site, there was a wide set-back zone next to the creek, but that has sincebeen bulldozed and covered with sand, leav-ing only a couple of metres of buffer zone.
When the tides are really in and theres
rainfall, the creek is at road level, he said.Ive seen that within a metre.
According to MacDonald, who special-izes in ecology, a setback measuring 15 to30 metres would be ideal for a number ofreasons: erosion control, protecting the creekfrom runoff and providing a sliver of habitatfor wildlife.
Youve got 30 centimetres of setback whenyou really need 30 metres of setback, he said.As far as I can tell, theres no erosion controlhere.
According to MacDonald, the lower stretchof Byrne Creek is a tidal estuary that connectsto the Fraser and is subject to the pull of thetides. Estuaries, in general, are consideredextremely productive environments that arerich in biodiversity.
MacDonald goes birdwatching in the areaand has spotted the endangered barn owl,as well as barn swallows, which are listed asthreatened by the federal government, andshort-eared owls, which are considered a spe-cies of concern.
MacDonald also explained that the now-razed habitat corridor is important becauseit connects the Fraser River to the RiverwayGolf Course.
Any time you remove a connection likethat, youre going to impact species diversity,
he said.MacDonald said he contacted the City of
Burnaby with his concerns that the developerwas working in the setback area but was toldas long as they have proper erosion controlsin place, its all above board and that thedevelopment had passed an environmentalassessment.
Its a real lost opportunity for the city.Theres not a lot of green space in SouthBurnaby. A little sliver of space would have abig ecological benefit with very little economi-cal cost, MacDonald said.
Lise Townsend, the citys ecosystem plan-ner, told the NOW the owner/developersecured approval about 10 years ago fromthe city and Fisheries and Oceans Canadato work in the setback area, which includedclearing some vegetation and preparing thearea with preload to compact and stabilizethe soil. According to Townsend, the city hasa streamside bylaw that determines minimumsetback areas for developers working close towaterways, and the minimum for this site is15 metres from the top of the bank. Townsendalso said the plan is to replant the area in thefuture, possibly within the next year.

Environment Canada,Fisheries and OceansCanada, and the B.C.Environment Ministry to find out who was look-ing after the fish in SilverCreek. After some initialconfusion on their partabout which agency wasleading the response, theNOW was referred back tothe Environment Ministry,which is working with CNto make sure the companyis following proper proto-col.
According to the revisedfederal Fisheries Act, itsillegal to deposit a del-eterious substance intowater frequented by fish,but Environment Canadatold the NOW that coal,when in solid form, isnot considered a deleteri-ous substance.
The NOW also hadseveral questions for CN,including the following: Isthe coal damaging for theendangered turtles? Howmuchwill the cleanup cost?Does CN have the moneyto cover it?
Silver Creek runsalongside a short stretchof the railway tracks onGovernment Street, where
the derailment occurred.CN attributed the derail-ment to a beaver dam thatbreached in heavy rains,and the subsequent wash-out eroded the railwayembankment, causing theaccident.
The NOW asked ifCN knew about the bea-ver dam ahead of timeand wanted to dismantleit, but CN spokesper-son Emily Hamer didntknow, and the Ministry ofForests, Lands and NaturalResource Operations hasno record of CN applyingfor permission to removeor maintain a beaver dam.
In an emailed statementto theNOW,Hamer said thecompany is working withthe Environment Ministryto assess the impact and iscommitted to all measurespossible to remediate theimpact of the coal spill intothe waterways.
According to Hamer,CN began the environ-mental survey of SilverCreek, Burnaby Lake andthe Brunette River onThursday, Jan. 16, five daysafter the spill. (The delaywas caused by bad weath-er, which left the groundtoo saturated to start the
survey.) The work includesmeasuring and docu-menting the location andquantity of coal deposition,collecting information onhabitat characteristics ofeach channel and collectingother relevant informationwhich may aid in assessingthe feasibility of practicalsolutions for the removalof coal accumulations,Hamer wrote.
CN still doesnt knowhowmuch coal was spilled,but Hamer said that wouldbe determined once theenvironmental survey wascomplete.
Thedata collected iden-tifying where the coal wasdeposited, how much wasdeposited and the impacton aquatic life will be usedto develop a response planfor recovery, she wrote.
As for the fish in SilverCreek,FisheriesandOceansCanada was not onsite fol-lowing the spill. Instead,Environment Canada ismonitoring the situationto determine if there areany violations of federalenvironmental legislation,including the pollutionprovisions of the FisheriesAct.
Christine Ensing, an
environmental servicesofficer with the City ofBurnaby, also checked thesite but said she didnthave much to say at thispoint.
We are definitelyinvolved, and they arekeeping us in the loop with
what they are doing, andthey are moving forward,she told the NOW.
Ensing pointed out thatCN is responsible for thecleanup and whatevercomes out of the companysassessment will includeissues to do with the fish
and the turtles.She also advised people
to stay out of the creek,to avoid disturbing salmoneggs, as the waterway ishabitat to spawning salm-on.

Transit sexual offences increased last yearThe year 2013 wasnt a particularly safe
one on public transit, as there were morethan 100 sexual offences reported on pub-lic traffic but Transit Police, as well asadvocates, hope to change that.
Sexual offences include voyeurism,indecent acts and inappropriate touch-ing, among others. In the first half of2013, there were 57 reported offences, and75 were reported in the last six months,according to Anne Drennan, Transit Policespokesperson.
We know its probably around one in10, or 10 per cent, of all sexual offenceson transit are reported, Drennan noted.The statistics, while concerning becausetheyre going up, are not really telling thetrue story or giving a clear picture sincewe know there are so many unreportedoffences.
Drennan said theres no geographicarea in particular that is prone to incidents,because predators are mobile when usingthe system.
It can happen anywhere, she told theNOW. They can find somebody they thinkis a vulnerable target anywhere along thesystem riding SkyTrain, the Canada Line,it can just happen anywhere.
Although Transit Police are alarmedover the rise in offences, its still a rel-atively small number compared to thehigh number of people who ride the railseach year, which is around one million,Drennan said.
Transit Police Sgt. Wendy Hawthornehas been watching out for peoples safetyon transit for the last 30 years, and shesays sexual offences have been a constantissue.
Its always a constant, Hawthornesaid, when asked if sexual incidents have
gotten better or worse during her career.I cant say whether its getting better orworse, the problem is people reporting.We believe only 10 per cent report,so that to me says that we needto do a better job of encouragingpeople to report.
The biggest change over the past30 years has been social media andthe ease with which people canreport, Hawthorne added.
I think the dynamics of ourcommunity and city has changed,with ESL students coming in now,she said, adding that language isoften a barrier. In my past experi-ences, they are often the vulnerabletarget. I dont like to say vulnerable,but those who may not be as comfortablein the environment and feel uncomfortablein reporting has increased exponentially.
Hawthorne was a speaker at the recentwomen transforming cities caf meeting atthe University of British Columbia, whichaddressed sexual assault, safety and pub-lic transit. She said the attendance washigh and diverse.
We have such a wonderful transitsystem, and I dont think sometimes weknow how fortunate we are, she said.At the end of the day, our main goal is tomake sure people have a safe ride, free ofharassment and feel comfortable. Theyreentitled to that.
Simon Fraser University student KatieNordgren, and co-creator of the popularblog, Harassment on TransLink, was alsoa speaker at the UBC event on Jan. 13. Shesaid many ideas about how to tackle tran-sit safety were brainstormed by the almost50 people who came.

jurisdictions? What does it look like whenits a fixed, functioning system whereeveryone is safe?
Nordgren said she wasntsurprised that the main top-ics of conversation were abouteducation and awareness.
Some interesting ideas wereraised, too, like specifically tar-geting men and boys insteadof speaking just to women andgirls, to teach them ways toprotect themselves, she said.But teaching men and boysto respect women was the sug-gested discourse.
Another factor that wasraised was modelling good
behaviour and how to encourage andteach that behaviour, Nordgren said.
Since her blog sharing harassment sto-
ries by almost anyone who submits onewas established in late October, it hasreceived 80,000 views and has more than160 story posts.
She said the Transit Police monitor herblog to stay on top of issues that havearisen, as well.
There was a submitter who alluded tohaving taken photographs of somebodywho harassed her or a friend, Nordgrensaid, saying a constable saw the story andasked to get in touch with the person.She decided to provide the photos tothe police, hopefully it will result in aconviction.

The past year was one ofchange and future planning forbusinesses in Burnaby, as thecitys town centres geared upfor major shifts in the comingdecade.
While the focus in Brentwood,Lougheed, Edmonds andMetrotown was on future devel-opments, one neighbourhoodhas seen a great deal of changealready Burnaby Heights.
The city changed a zoningbylaw in the Heights about fiveyears ago to allow for somemixed residential and commer-cial developments, and that shifthas started to change the face ofthe neighbourhood.
Even so, its going to takeanother five to 10 years to reallysee it blossom into where theresno gaps, said Isabel Kolic, exec-utive director for the HeightsMerchants Association.
A mixed-use development atMadison Avenue and HastingsStreet is now under construction,and there are plans for a mixed-use development across fromHappy Honda in the eastern endof the Heights.
But already, the changes canbe seen with buildings such asthe Tramonto at 4365 HastingsSt. and the Altezza building at
4710 Hastings St.There is a healthy mix of
nationally recognized brands,specialty shops andother small busi-nesses in the areanow, according toKolic.
I think all thebusiness types haveto play together ina sort of economicdevelopment sym-phony, she said.
However, thechanges to then e i g h b o u r h o o dhave also meantsome losses, such asplans for a mixed-use developmentwhere the DolphinTheatre now stands,she pointed out.
Although werehappy to see revi-talization on theHeights, we alsolament the lossof a local culturalanchor, Kolic saidin a follow-up email.Something like atheatre is a significant part of astrong economic and social mix.It complements and strengthensthe other businesses and createsa more walkable local neigh-bourhood.
This past year brought anoth-er type of shift to the neigh-bourhood hope for economic
recovery after the2008/2009 recession.
Businesses havebeen telling me asof mid-year that ithas stopped get-ting worse, Kolicsaid. And I heardthat quite a bit.Restaurants in par-ticular have stabi-lized they werereally suffering in2012, and 2013 was alittle bit easier.
In the comingyear, the associationwill be looking at theofficial communityplan for the neigh-bourhood, whichwas developed in theearly 90s.
That was a quar-t e r - o f - a - c e n t u r yago, and Burnabysbecome a lot moreurban since then,she said, and peo-ple are moving to the
Heights from many other urbanareas of the Lower Mainland.They come to the Heightsbecause they love that urban vil-lage environment.
The association also plans to
return to the issue of the HOVlane along Hastings Street, shesaid.
Well continue to advocatefor the removal of the HOV laneand restore a quieter and morefriendly walking environment ofthe Heights, she said.
As the Heights goes throughthis transition phase, it may bea sign of whats to come in thecitys four town centres.
Edmonds has its new commu-nity centre, and plans are mov-ing forward for a major mixed-use development at the site ofthe current Value Village.
Construction is underway atBrentwood Town Centre and atStation Square in Metrotown,with plans to make the centresmixed-use developments aswell,creating more walkable commu-nity space instead of the walled-in malls of the 80s and 90s.
And Shape Properties, whichowns Lougheed Town Centreas well as Brentwood, is in thepreliminary planning stages forLougheed, with an ambitiousplan to create the public heartof the community with a mixed-use development on the site.
While the four centres are inthe beginning stages of theseplans, the recent changes in theHeights offer a smaller-scaleglimpse of how they may playout.

Last week, we cel-ebrated Inspiration Dayat Century House in NewWestminster. I inviteyou to celebrate yourown Inspiration Week byreflecting on seven well-springs of inspiration.

2. Models of HumanAchievement: Great fig-ures in history have setthe bar high and showus what a human beingcan achieve. We remainin awe when listening toBeethoven, Mozart andBach, read Shakespearesplays and sonnets, and
look upon great works ofart.
3. Everyday Heroes:While the giants of thepast may make us feellike puny underachievers,we have heroes amongus each day. These areordinary people like youand me who choose todo extraordinary things.They express courage andperseverance in the face ofoverwhelming adversity orperform acts of generosityand compassion.
4. The Inspiring Peoplein Your Personal Life:Think about the specialpeople from your past
who have made a positivedifference in your life. Thismay include your parents,teachers, mentors andfriends. My best friendstell me the truth when Ineed to hear it and remindme of my greatest aspira-tions.
