BELIZE/GUATEMALANEGOTIATIONSPLANOFACTIONTOIMPLEMENTTHENOVEMBER8,2000AGREEMENTONCONFIDENCE‐BUILDINGMEASURESTheDelegationofBelize,headedbyH.E.AssadShoman,AmbassadorwithMinisterialRank,andtheDelegationofGuatemala,headedbyH.E.GabrielOrellanaRojas,MinisterofForeignAffairs,metinMiami,FloridaonJanuary16‐17,2001andagreedtothefollowingPlanofActiontoimplementtheAgreementonConfidenceBuildingMeasuressignedbythePartiesonNovember8,2000inWashington,D.C.ThisPlanofActionalsoservestofacilitatethenegotiationprocessconcerningtheirterritorialdifferendum,whichisbeingconductedundertheauspicesoftheSecretaryGeneraloftheOrganizationofAmericanStates.1.ThePartiesreiteratetheircommitmenttofullyimplementalloftheconfidencebuildingmeasuressetforthintheAgreementonConfidenceBuildingMeasuressignedonNovember8,2000.2.AdjacencyLineandAdjacencyZone:ThePartiesagreetotheidentificationoftheAdjacencyLineandAdjacencyZone,asdescribedinandsubjecttotheprovisionsofParagraphs3,4and5oftheAgreementonConfidenceBuildingMeasures,inthefollowingmanner:A.AttherequestoftheStatesParties,herebysignified,thePanAmericanInstituteofGeographyandHistory(PAIGH)will,urgently,andnolaterthan14daysfromthesigningofthisPlanofAction,determinethecoordinatesofthereferencemarkersatGraciasaDios,Garbutt’sFallsandAguasTurbias,andidentifytheAdjacencyLinefromGraciasaDiostoGarbutt’sFallsandfromGarbutt’sFallstoAguasTurbias.B.AttherequestoftheStateParties,herebysignified,thePAIGHwillprepareanddelivertothem,urgently,andnolaterthan21daysfromthesigningofthisPlanofAction,amapoftheAdjacencyZoneinwhichtheAdjacencyLineandthelinesconstitutingtheperimeteroftheAdjacencyZoneareidentified.3.Census:Within3daysoftheirreceiptofthemapoftheAdjacencyZone,whichthePartiesherebyagreetoaccept,theyshalljointlybegincreatingalistencompassingthenamesofallofthesettlersentitledtoremainundisturbedintheAdjacencyZonepursuanttothetermsofParagraphs6Aand6BoftheAgreementonConfidenceBuildingMeasures.Toaccomplishthisobjective,eachpartywillappoint3personstoa“censusteam.”TheteamwillpreparealistofallsettlementsandsettlersintheAdjacencyZonewithin14daysofitsinitiationofwork.Fromthatlist,theteamwillprepareasub‐listofallsettlerstotheeastoftheAdjacencyLinewhoareGuatemalannationalsandwhosatisfytherequirementsofParagraph6A,andanothersub‐listofallsettlerstothewestoftheAdjacencyLinewhoareBelizeannationalsandwhosatisfytherequirementsofparagraph6A.3.1AnychildrenbornafterOctober1,2000,tosettlersentitledtoremainintheZoneshallbeincludedinthesub‐listandentitledtoremainintheZoneunderthesameconditionsastheirparents.Thesub‐listshallalsoincludeallhouses,churches,schools,otherbuildings,farms,roads,andanyotherinfrastructureexistingasofOctober1,2000.ExpansionorimprovementwhichchangesthecharacterofsuchinfrastructurebelongingtoGuatemalannationalsonthesub‐listsofsuchpersonsontheeastsideoftheAdjacencyLinewithintheAdjacencyZonemaynotoccurwithoutpriorapprovalofBelize.ThesameshallapplymutatismutandiforBelizeannationals.AnydisagreementsthatariseinthecourseofthecensusshallbereferredtotheParties’MinistriesofForeignAffairsinthefirstinstance,forresolution.Intheeventadisagreementcannotberesolvedatthatlevel,itwillbereferredtotheFacilitatorsfortheirconsideration.4.DeterminationofLocationsofCertainSettlements:ImmediatelyfollowingtheidentificationoftheAdjacencyLine,thePAIGHshalldeterminetheprecisedistancefromthenearestpointontheAdjacencyLinetothesettlementknownasRioBlanco,andtheprecisedistancefromthenearestpointontheAdjacencyLinetothesettlementknownalternativelyasMachaquilaorTresPuentes.ThePAIGHwillalsodeterminetheprecisedistancesfromthe

nearestpointontheAdjacencyLinetodwellingslocatedinthevicinityofValentinCamp.ThesedeterminationsshallbeprovidedtotheParties,totheFacilitatorsandtotheSecretaryGeneraloftheOrganizationofAmericanStates.TheFacilitatorswillthenissueaninterpretationastothestatusofthesesettlementsanddwellingsundertheAgreementonConfidenceBuildingMeasures,withwhichthePartieswillcomplyingoodfaith.5.ProcedureforRemovalofCertainSettlers:TheFacilitatorshavepreparedaProtocolforRemovalofallsettlerslocatedinsidetheAdjacencyZonebutnotentitledtoremaintherepursuanttothetermsofParagraph6AoftheAgreementonConfidenceBuildingMeasures.TheyhavealsopreparedaProtocolforRemovalofsettlerslocatedoutsidetheAdjacencyZone.TheProtocolswithwhichthePartieswillcomplyingoodfaith,areattachedasAnnexAandAnnexB.6.ReaffirmationofCertainCommitments:BelizeandGuatemalareaffirmtheircommitmenttorespectandleaveundisturbedallsettlersandsettlementsestablishedtotheeastandtothewestoftheAdjacencyLineandwithintheAdjacencyZoneonorbeforeOctober1,2000,assetforthinParagraph6AoftheAgreementonConfidenceBuildingMeasures.BelizeandGuatemalashallissuelicensestoallsuchsettlers,authorizingthemtoremainundisturbedintheAdjacencyZoneduringthependencyoftheAgreementofNovember8,2000.BothPartiesreaffirmtheircommitmenttocooperate,assetforthintherespectiveProtocols,intheremovalofsettlerslocatedtotheeastandtothewestoftheAdjacencyZone,orlocatedinsidetheAdjacencyZonebutnotentitledtoremainthereinunderParagraph6A.Guatemalaalsoreaffirmsitscommitmenttotakeeffectivemeasurestodissuadeitscitizensand/orresidentsfromestablishingnewsettlementsorjoiningexistingsettlements,totheeastoftheAdjacencyLine,includingaprogramtoidentifylandtothewestoftheAdjacencyLinethatcanbeallocatedtoGuatemalancitizensorresidentswhowouldotherwisebelikelytoattempttosettletotheeastoftheAdjacencyLineasprescribedinparagraph6DoftheAgreementofNovember8,2000.7.ReferenceMarkers:ThePartiesagreethattheexistingconcretestructuresatGraciasaDios,Garbutt’sFallsandAguasTurbiasconstitutereferencemarkerswithinthemeaningofParagraph3oftheAgreementonConfidenceBuildingMeasures,asfurtherdefinedintheFacilitators’lettertothePartiesofDecember15,2000.ThePartieswillcommencetheprocessofclearingtheareaaroundeachofthesemarkers,toaradiusof7.5meters,within14daysofthesigningofthisPlanofAction.Within7daysofthesigningofthisPlanofAction,BelizewillfurnishGuatemalaandtheFacilitatorswiththecoordinatesofothermarkers,andthebasisonwhichBelizeconsidersthemreferencemarkers.Within7daysofreceiptofsuchinformation,GuatemalaandBelizewillpresenttheirargumentstoeachotherandtotheFacilitatorsandwithinareasonabletime,havingdueregardtotheurgencyofthematter,theFacilitatorswillmakeaninterpretationastowhichmarkersare“referencemarkers”withinthetermsofParagraph3oftheAgreementofNovember8,2000andtheFacilitatorsletterofDecember15,2000.Upontheissuanceofthisinterpretation,eitherorbothPartiesmayproceedtocleararoundanyreferencemarkersinaccordancewithparagraph4oftheAgreementofNovember8,2000.8.PublicStatements:ToreinforcetheConfidenceBuildingMeasuresagreedtoonNovember8,2000andinthisPlanofAction,andtofacilitatethenegotiationprocessconcerningtheterritorialdifferendum,thePartiesreiteratetheirprioragreementtoexercisecautionandrestraintinthetreatmentofallissuesrelatedtothisnegotiationprocess.TothisendthePartiesshallframeallpublicstatementsrelatingtothenegotiationprocessinamannerthatisconsistentwiththeirobligationstotimelyandfullyinformtheirrespectivepublicopinionsconcerningtheprogressofthenegotiations,conducivetothesuccessfulconductofthenegotiations,thefacilitationofharmoniousrelationsbetweenBelizeandGuatemala,andthemaintenanceofpeace.ThePartieshavealsoaskedtheFacilitatorstoprovidethemwithguidelinesforpublicstatementsconcerningthenegotiatingprocess,anyagreementsreachedtherein,andanyallegedviolationsofsuchagreements.TheFacilitatorshaveagreedtoprovidesuchguidelinesbyFebruary5,2001.9.WhereverthisPlanofActioncallsforcooperationbetweenthePartiesorforjointactionandoneofthePartiesrefusesorfailstocooperateoractjointly,theotherPartyshallbefreeto
